chapter 4 Ideological Contributions of Celtic Freedom and Individualism to Human Rights This chapter emphasizes the importance of the often-overlooked contribu- tions of indigenous European cultures to the development of human rights. Attention is given to the ancient Celtic culture, the ideas of Celtic freedom and individualism, the distinctive role of the Scottish theologian, John Dunn Scotus and the Scottish Arbroath Declaration of Freedom (1320).1 It is from the Scottish Enlightenment and its subsequent influence on the late 18th century revolutions that we see an affirmative declaration of the Rights of Man, which is a precursor to the development of modern human rights. The importance of the Celtic-Irish-Scottish contribution to human rights is that it was the foun- dation for individual liberty and dignity in Western civilization. Indigenous Celtic culture staked an original and critical claim to the ideal of universal hu- man dignity. This is an important insight because it broadens the ideals that promote human rights, including within them those ideals of the indigenous cultures of the world, whose voices are oftentimes forgotten. It strengthens the universality of human rights. i The Intellectual and Philosophical Origins of International Law and Human Rights The intellectual and philosophical origins of human rights rhetoric and law, democracy, freedom and ideas supporting “consent of the governed” are in- tertwined in this composite explanation that attempts to explain all of these themes with the historical themes of Roman natural law, Athenian democracy and later the modern political philosophy of John Locke and his followers. The absence of a medieval connection between the alleged ancient Roman and Greek sources and the modern developments of human rights indicates that this perspective is faulty. -
Libertarianism, Culture, and Personal Predispositions
Undergraduate Journal of Psychology 22 Libertarianism, Culture, and Personal Predispositions Ida Hepsø, Scarlet Hernandez, Shir Offsey, & Katherine White Kennesaw State University Abstract The United States has exhibited two potentially connected trends – increasing individualism and increasing interest in libertarian ideology. Previous research on libertarian ideology found higher levels of individualism among libertarians, and cross-cultural research has tied greater individualism to making dispositional attributions and lower altruistic tendencies. Given this, we expected to observe positive correlations between the following variables in the present research: individualism and endorsement of libertarianism, individualism and dispositional attributions, and endorsement of libertarianism and dispositional attributions. We also expected to observe negative correlations between libertarianism and altruism, dispositional attributions and altruism, and individualism and altruism. Survey results from 252 participants confirmed a positive correlation between individualism and libertarianism, a marginally significant positive correlation between libertarianism and dispositional attributions, and a negative correlation between individualism and altruism. These results confirm the connection between libertarianism and individualism observed in previous research and present several intriguing questions for future research on libertarian ideology. For much of the preceding half-century, under the influence of logical positivism’s heavy emphasis on empirical verifiability, much of moral philosophy was taken up with meta-ethics (e.g., the semantics of moral discourse)—with little attention given to normative moral theories. Moreover, to the extent that normative theories were considered, utilitarianism was the center of attention. This all changed with the publication of Rawls’s articulation and defense of liberal egalitarianism and Nozick’s libertarian challenge to the legitimacy of anything more than the night-watchman state. At the core of Nozick’s book are two arguments. One is that a night-watchman state (which protects only against violence, theft, fraud, and breach of contract) could be legitimate, even without the consent of all those to be governed. The other is that nothing more extensive than the night-watchman state is legitimate, except with the consent of all. The argument is complex, and Nozick often inserts long—and very interesting—digressions. Below I shall focus only on his core argument. Can citizenship be extended even further to domesticated animals? We begin this article by sketching an argument for why justice requires the extension of citizenship to domesticated animals, above and beyond compassionate care, stewardship or universal basic rights. We then consider two objections to this argument. Some animal rights theorists worry that extending citizenship to domesticated animals, while it may sound progressive, would in fact http://ojls.oxfordjournals.org/ be bad for animals, providing yet another basis for policing their behaviour to fit human needs and interests. Critics of animal rights, on the other hand, worry that the inclusion of ‘unruly’ beasts would be bad for democracy, eroding its core values and principles. We attempt to show that both objections are misplaced, and that animal citizenship would both promote justice for animals and deepen fundamental democratic dispositions and values. While it appears that capitalism provides some necessary element for a democracy, a problem of political inequality and a possible violation of liberty can be observed in many democratic countries. I argue that this political inequality and threat to liberty are fueled by capitalism. I will analyze the ways in which capitalism works against democratic aims. This is done through first illustrating what my accepted conception of democracy is. I then continue to depict how the various problems with capitalism that I describe violate this conception of democracy. This leads me to my conclusion that while capitalism is necessary for a democracy to reach a certain needed level of independence from the state, capitalism simultaneously limits a democracy from reaching its full potential. -

Comparing the notion on individual freedom espoused in On Liberty to the notion of the social welfare in Utilitarianism, this analysis posits that it is impossible for a political philosophy to have two ultimate ends. Thus, Mill's liberalism is inherently flawed. As this philosophy was the foundation of Mill's progressive vision for humanity that he discusses in his Three Essays on Religion, this vision becomes paradoxical as well. Contending that the neo-liberalist global economic order is the contemporary parallel for Mill's religion of humanity, this work further demonstrates how these philosophical flaws have spread to infect the core of globalization in the 21 st century as well as their implications for future international relations. -
