Hahn, B.A., M.A. Marquette University, 2012 This dissertation attempts to articulate the concept of personhood in Husserl. In his research manuscripts, Husserl recognized the need for a concrete description of subjectivity that still remained within the transcendental register. The concept of personhood, although never fully worked out, is intended to provide this description by demonstrating how the embodied, enworlded, intersubjective, and axiological dimensions of experience are integrated. After briefly outlining the characteristics of a transcendental phenomenological account of personhood, this dissertation outlines the essential structures of personhood. The person, for Husserl, includes the passive dimension with the instinctive and affective dimensions of subjectivity, which become sedimented into habits, and the worldliness of subjectivity that provides a background horizon for the subject’s actions. However, the full concept of personhood does not yet emerge in the passive sphere. The active dimension of position-taking acts, especially with respect to the loved values that make up one’s vocation, is what constitutes the person as a unity of intentional activity, history, and striving, and makes it possible to speak about the transcendental person, as opposed to merely the transcendental subject or ego. Because the person lives in a community with others, the choice of a vocation can be subjected to critical scrutiny on the part of the community, and the community itself ought to critically reflect upon its own telos. After outlining the structures of personhood, this dissertation argues that there is a teleology running from the lowest dimensions of passive experience all the way up to the highest ideal of a person and his or her community. This teleology is ultimately a teleology of reason, and it reveals the philosophical task of living a life that can be absolutely justified. This dissertation concludes by describing the person as an entelechy of reason, which captures the teleological striving of reason inherent in Husserl’s concept of personhood. i ACKNOWLEDGMENTS Colin J. Wolfe Springer, forthcoming 2013 To undertake a history of vitalism at this stage in the development of the ‘biosciences’, theoretical and other, is a stimulating prospect. We have entered the age of ‘synthetic’ life, and our newfound capacities prompt us to consider new levels of analysis and understanding. At the same time, it is possible to detect a growing level of interest in vitalistic and organismic themes, understood in a broadly naturalistic context and approached, not so much from broader cultural concerns as in the early twentieth century, as from scientific interests – or interests lying at the boundaries or liminal spaces of what counts as ‘science’.1 The challenge of understanding or theorizing vitalism in the era of the synthetic is not unlike that posed by early nineteenth-century successes in chemistry allowing for the synthesis of organic compounds (Wöhler), except that now, whether the motivation is molecular-chemical, embryological or physiological,2 we find ourselves asking fundamental questions anew. What is life? How does it differ from non-living matter? What are the fundamental processes that characterize the living? What philosophical and epistemological considerations are raised by our new understandings?3 We are driven to consider, for example, what metaphors we use to describe living processes as our knowledge of them changes, not least since some of the opprobrium surrounding the term ‘vitalism’ is also a matter of language: of which terms one 1 Gilbert and Sarkar 2000, Laublichler 2000.

When speaking about legitimizing law we can mainly mean analysis which concerns metaphysical justification for what is called the phenomenon of law. From the metaphysical point of view, the justification of law means indicating the foundation of its existence. It is about seeking (indicating) an esse (essence) basis of law, in line with the task set by the metaphysical analysis, namely seeking an answer to the question: Why does object X exist? And in the answer, there will appear a formula indicating the final reasons for its existenceratio ( essendi). The same ideas that we can find in Adolf Reinach’s principal work,The Apriori Foundations of the Civil Law, provide a possibility of better understanding this important issue of legal philosophy, namely the question of legitimizing law (justifying law). INTRODUCTION The same ideas that we can find in Adolf Reinach’s principal work, The Apriori Foundations of the Civil Law, provide a possibility of better understanding an important issue of legal philosophy, namely the question of legitimizing law (justifying law). If we enrich and complete these ideas with similar remarks from Roman Ingarden’s ontology, we can, in my opinion, give quite a coherent and convincing argument on this issue. In the introduction to his main work, Reinach stated “[…] we may hope that the apriori theory of right (die apriorische Rechtslehre) can here and there make a clarifying contribution even to the history of law.

    CHAPTER ONE HUSSERL’S TRANSCENDENTAL PHENOMENOLOGY CONSIDERED IN THE LIGHT OF (RECENT) EPISTEMOLOGY Christian Beyer Edmund Husserl’s transcendental phenomenology represents an epis- temological project which he sometimes refers to as “First Philosophy”. He also speaks of “Cartesian Meditations” and stresses that “the first philosophical act” is “the universal overthrow of all prior beliefs, however acquired” (Hua VIII, 23).1 This project aims at nothing less than a philo- sophical understanding of our whole view of the world and ourselves. I propose to investigate into this undertaking regarding both its method and content and to relate it, where useful, to more recent (analytic) epistemology. For Husserl, the task of First Philosophy is to philosophically explicate our access to, or being in, the world, i.e., the intentionality of our con- sciousness. By an intentional state of consciousness, an intentional (lived) experience, he understands a state of consciousness that has a subject matter which it is directed toward, so to speak (cp. the literal meaning of the Latin verb intendere); a state that is “as of ” something, represents something. It was Husserl’s teacher Franz Brentano who brought this notion to the attention of philosophers and psychologists. In his Psychol- ogy from an Empirical Standpoint he says: Every mental phenomenon is characterized by what the Scholastics of the Middle Ages called the intentional (or mental) inexistence of an object, and what we might call, though not wholly unambiguously, reference to a content, direction toward an object (which is not to be understood here as meaning a real thing [eine Realität]), or immanent objectivity.

The interminable agony of metaphysics Throughout the twentieth century, numerous philosophers sounded the death knell of metaphysics. Ludwig Wittgenstein, Rudolf Carnap, Martin Heidegger, Gilbert Ryle, J. L. Austin, Jacques Derrida, Jürgen Habermas, Richard Rorty, and, henceforth, Hilary Putnam: a great many tutelary figures have extolled the rejection, the exceeding, the elimination, or the deconstruction of first philosophy. All these necrological chronicles do not have the same radiance, the same seriousness, nor the same motivations, but they all agree to dismiss the discipline, which in the past was considered “the queen of the sciences”, with a violence at times comparable to the prestige it commanded at the time of its impunity. Even today, certain philosophers hastily spread the tragic news with contempt for philosophical inquiry, as if its grave solemnity bestowed upon it some obviousness. Thus, Franco Volpi writes: ‘Grand metaphysics is dead!’ is the slogan which applies to the majority of contemporary philosophers, whether continentals or of analytic profession. They all treat metaphysics as a dead dog.1 In this way, the “path of modern thought” would declare itself vociferously “anti- metaphysical and finally post-metaphysical”.

Wood 2012 Abstract Bertolt Brecht began an intense engagement with Marxism in 1928 that would permanently shape his own thought and creative production. Brecht himself maintained that important aspects resonating with Marxist theory had been central, if unwittingly so, to his earlier, pre-1928 works. A careful analysis of his early plays, poetry, prose, essays, and journal entries indeed reveals a unique form of materialism that entails essential components of the dialectical materialism he would later develop through his understanding of Marx; it also invites a similar retroactive application of other ideas that Brecht would only encounter in later readings, namely those of the philosophy of Georg Wilhelm Friedrich Hegel. Initially a direct result of and component of his discovery of Marx, Brecht’s study of Hegel would last throughout the rest of his career, and the influence of Hegel has been explicitly traced in a number Brecht’s post-1928 works. While scholars have discovered proto-Marxist traces in his early work, the possibilities of the young Brecht’s affinities with the idealist philosopher have not been explored. Although ultimately an opposition between the idealist Hegel and the young Bürgerschreck Brecht is to be expected, one finds a surprising number of instances where the two men share an unlikely commonality of imagery.

Adolf Reinach met and befriended Hermann Kantorowicz in one of Lujo Brentano’s political economy seminars during the 1901/1902 academic year at the University of Munich. After Munich, Kantorowicz would go on to be a major contributor to the Free Law Movement (Freirechtsbewegung) in Germany and play an important role in the development of the sociology of law in the 20th century. Reinach encountered the work of Edmund Husserl while studying with Lipps and later became central to the phenomenological movement in Göttingen. But all the while he remained interested in and focused on issues related to justice. His last scholarly publication before leaving for battle in WWI, Die apriorischen Grundlagen des bürgerlichen Rechtes (The a priori Foundations of Civil Law, 1913) published in the very first edition of the Jahrbuch für Philosophie und phänomenologische Forschung (Yearbook for Philosophy and Phenomenological Research) is a testament to this. Here we see Reinach taking his phenomenological education and applying it to entities of justice. I believe Kantorowicz inspired this lasting interest in matters of justice. This essay will focus on the influence of Kantorowicz on Reinach, and while doing so attempt to flesh out and contrast the ways in which these two men sought to overcome the problems of justice (Recht) of their time. Phenomenology is a movement that explores the lived experience of a given phenomenon. Edmund Husserl and Martin Heidegger were two of the most prominent philosophers who spearheaded this movement and subsequently, they developed their own distinct philosophical approaches and methods of inquiry as means to exploring and understanding the human experience. Various and more distinctive psychological research approaches emerged in other disciplines from the philosophies of Husserl and Heidegger, and the researchers who developed these methods contribute to expanding repertoires aimed at understanding of the human experience. QUALITY IN HIGHER EDUCATION: SYSTEMS AND LIFEWORLDS IN COLLISION Jeff Aper Blackburn College ABSTRACT Questions abound about the quality and purpose of American higher educa- tion in the early 21st century. Solutions have tended to be framed in terms of economic production and manufacturing quality control models, and these terms increasingly characterize state and federal systems of authority over colleges and universities. As Habermas theorized, system logic, left to its own devices, will ultimately overpower, or “colonize,” the day to day meaning making culture or “lifeworld” of the campus. This colonization runs at counter purposes to the es- sential foundation of meaning for authentic education. A solution is proposed, suggesting that a deeper base to higher learning lies in embracing the traditional values of the academy and cultivating the faculty as a uniquely rich resource in support of student learning and the dual work of preservation and innovation in addressing the most pressing needs of humanity.

Introduction: Simone de Beauvoir (1908-1986) Beauvoir was born in Paris and studied philosophy at the Sorbonne. She passed exams for Certificates in History of Philosophy, General Philosophy, Greek, and Logic in 1927, and in 1928, in Ethics, Sociology, and Psychology. She wrote a graduate diplôme (equivalent to an MA thesis) on Leibniz. Her peers included Maurice Merleau-Ponty, Claude Lévi-Strauss, and Jean-Paul Sartre. In 1929, she took second place in the highly competitive philosophy agrégation exam, barely losing to Jean-Paul Sartre who took first (it was his second attempt at the exam). At 21 years of age, Beauvoir was the youngest student ever to pass the exam. She taught in high school from 1929-1943, and then supported herself on her writings, and co-editorship of Le Temps Modernes. She is known for her literary writing, and her philosophical work in existentialism, ethics, and feminism. She published The Second Sex in 1949. 2. Gender ‘One is not born, but rather becomes, a woman. No biological, psychological or economic fate determines the future that the human female presents in society.’ (II.iv.1) A. What is a woman? “Tota mulier in utero: she is a womb,” some say. Yet speaking of certain women, the experts proclaim, “They are not women,” even though they have a uterus like the others. Everyone agrees there are females in the human species; today, as in the past, they make up about half of humanity; and yet we are told that “femininity is in jeopardy”; we are urged, “Be women, stay women, become women.” So not every female human being is necessarily a woman… (23) So there seems to be a sort of contradiction in our ordinary understanding of women: not every female is a woman, otherwise they would not be exhorted to be women.

    Chapter 11 The Theory of Communicative Action 11 The Theory of Communicative Action and Theory of System and Lifeworld in Relational Practice In this chapter I would like to inform our understanding of relational practice and sustainability by taking another set of ideas about communication and behaviour, which is slightly different to the Batesonian pragmatics of human communication used in the last chapter. Here I focus upon the critique of modern welfare-state capitalism to be found in the social theory of Jurgen Habermas and his associated working of behavioural communication. I first describe some key aspects Habermas’ social theory (located within a line of critical theorists from the Frankfurt school following Marx) by introducing two main elements of his theory of communicative action - the theory of system and lifeworld and the theory of knowledge constitutive interests. Having introduced these ideas - in what is again quite a theoretically dense section - I then work with Habermas’ theoretical constructs to engage in further reflection upon business- NGO relations and my own research/practice in the context of the modern welfare-state. More specifically, looking through the conceptual lenses of system and lifeworld, I suggest that perceptions of NGOs as being separate from the steering media of money and power have allowed the sector to engage in change efforts with powerful actors such as business. However, this distance is more perceived than real. As a result private sector engagement, whilst affording solutions to pressing problems, may seriously affect NGO legitimacy. I frame my own research/practice in terms of the system and lifeworld theory.
