Doctor of Philosophy (Political Science), August 2008, 191 pp., bibliography of 227 titles. This dissertation addresses an ignored [partly for its controversial nature] aspect of Nietzschean philosophy: that of the role of modern woman in the creation of a future horizon. Details of the effects of the Enlightenment, Christianity and democracy upon society are discussed, as well as effects on the individual, particularly woman. After this forward look at the changes anticipated by Nietzsche, the traditional roles of woman as the eternal feminine, wife and mother are debated. An argument for the necessity of a continuation of the battle of the sexes, and the struggle among men and women in a context of sexual love and friendship is given. This mutual affirmation must occur through the motivation of pride and not vanity. In conclusion, I argue that one possible avenue for change is a Nietzschean call for a modern revaluation of values by noble woman in conjugation with her warrior scholar to bring about the elevation of mankind. -

Title: Racism and Bad Faith. Redacted for privacy Abstract approved: Leilani A. Roberts Human beings are condemned to freedom, according to Jean-Paul Sartre's Being and Nothingness. Every individual creates his or her own identity according to choice. Because we choose ourselves, each individual is also completely responsible for his or her actions. This responsibility causes anguish that leads human beings to avoid their freedom in bad faith. Bad faith is an attempt to deceive ourselves that we are less free than we really are. The primary condition of the racist is bad faith. In both awarelblatant and aware/covert racism, the racist in bad faith convinces himself that white people are, according to nature, superior to black people. The racist believes that stereotypes ofblack inferiority are facts. This is the justification for the oppression ofblack people. In a racist society, the bad faith belief ofwhite superiority is institutionalized as a societal norm. Sartre is wrong to believe that all human beings possess absolute freedom to choose. The racist who denies that black people face limited freedom is blaming the victim, and victim blaming is the worst form ofracist bad faith. Taking responsibility for our actions and leading an authentic life is an alternative to the bad faith ofracism. I am grateful for the opportunity to submit the following statement for the record. Since I teach at National Intelligence University (NIU) which is part of the Department of Defense (DoD), I need to begin by making clear that all statements of fact and opinion below are wholly my own and do not represent the views of NIU, DoD, any of its components, or of the U.S. government. You have asked me to discuss whether China seeks an alternative global order, what that order would look like and aim to achieve, how Beijing sees its future role as differing from the role the United States enjoys today, and also to address the parts played respectively by the Party’s ideology and by its invocation of “Chinese culture” when talking about its ambitions to lead the reform of global governance.1 I want to approach these questions by dissecting the meaning of the “new era for socialism with Chinese characteristics” Xi Jinping proclaimed at the Communist Party of China’s 19th National Congress (afterwards “19th Party Congress”) in October 2017. -

MOTIVATED AVERSION: NON-THETIC AWARENESS IN BAD FAITH Jonathan Webber Sartre Studies International vol. 8, no. 1 (2002) – please cite only publication – Abstract: Sartre's concept of ‘non-thetic awareness’ must be understood as equivalent to the concept of ‘nonconceptual content’ currently discussed in anglophone epistemology and philosophy of mind, since it could not otherwise play the role in the structure of ‘bad faith’, or self-deception, that Sartre ascribes to it. This understanding of the term makes sense of some otherwise puzzling features of Sartre's early philosophy, and has implications for understanding certain areas of his thought. Exactly what does Jean-Paul Sartre mean by describing some conscious awareness as ‘non- thetic’? He does not explicitly say. Yet this phrase, sprinkled liberally throughout his early philosophical works, is germane to some of the distinctive and fundamental theories of Sartrean existentialism. My aim in this paper is to examine the concept in terms of the role that Sartre claims it plays in bad faith (mauvaise foi), the deliberate and motivated project of refusing to face or consider the consequences of some fact or facts. I will argue that non-thetic awareness could play the role Sartre ascribes to it in bad faith only if it is understood as being equivalent to the nonconceptual representational content currently discussed in anglophone philosophy of mind. I will proceed by first providing an initial rough characterisation of ‘non- thetic’ awareness through a discussion of the philosophical background to Sartre’s term, then showing how this rough characterisation needs to be refined in order that bad faith may evade the two paradoxes of self-deception, next drawing the distinction between conceptual and nonconceptual content, and then arguing that non-thetic awareness must be construed as nonconceptual content. -

\\server05\productn\N\NVJ\10-3\NVJ303.txt unknown Seq: 1 26-OCT-10 9:00 HERMENEUTICS—THE PATH OF THE HERMENEUTIC-ONTOLOGICAL SHIFT AND THE DECOLONIAL SHIFT Celso Luiz Ludwig* The purpose of the reflections that follow is to highlight the meaning and importance of the hermeneutic shift produced by the work of Gadamer, to con- sider some of his themes and categories, and to extend the meaning of this hermeneutic rationality to the legal field in terms of a new conception of inter- pretation. A second objective is to catch sight of new theoretical perspectives, having as a starting point the unfolding of practical philosophy into hermeneu- tic philosophy carried out by Gadamer. This article aims at recuperating, among other things, the fundamental hermeneutic problem, so as to obtain a glimpse into the possibility of new theoretical prospects (just as Aristotle’s pro- posed division of philosophy into practical and theoretical generated new theo- retical perspectives for Gadamer). However, this objective will not be developed in-depth in its concepts and categories, but only suggested in the final paragraph. I. PHILOSOPHICAL CONTEXT The philosophical context of the hermeneutic philosophy of Hans-Georg Gadamer can be situated within what is called “linguistic turn.” The “turn” in question can be understood as a paradigm change, as that term is articulated by Thomas Kuhn. This paradigm change, which was welcomed by philosophy to classify its own history, led to the paradigm of language in the second half of the twentieth century, after going through the paradigm of the being (the onto- logical paradigm) and the paradigm of the subject (the paradigm of conscious- ness). -

Contemporary developments unfortunately prove her right. In the United States, outraged protests against President Donald Trump’s sexist remarks erupted in early 2017. In Poland, a bill banning abortion, permitted in certain circumstances since 1993, was submitted to parliament in 2016. In Iraq, a bill endangering women’s rights that included lowering the legal age for marriage was presented to the parliament in Baghdad the same year. Covering women’s issues does not come without danger. A female editor was murdered for denouncing a sexist policy. A reporter was imprisoned for interviewing 3 a rape victim. A woman reporter was physically attacked for defending access to tampons, while a female blogger was threatened online for criticizing a video game. -

INTRODUCTION Implied as a matter of law within every contract is a cove- nant of good faith and fair dealing requiring that neither party do anything which will injure the right of the other to receive the benefits of the agreement.' Through application of this covenant, a breach of contract may be found when a promisor, by his bad faith conduct, has jeopardized or de- stroyed a promisee's opportunity to reap the expected benefit of the bargain, even though that conduct failed to violate ex- pressed provisions of the agreement.2 In recent years, courts in several jurisdictions have given this implied covenant extra- contractual relevancy by holding the breach thereof to be tor- tious,3 thereby permitting the injured promisee remedial relief * Professor of Law, Whittier College School of Law.
