("RIAA"), on its own behalf. and on behalf of SoundExchange, presently an unincorporated division of the RIAA, submits the following comments in response to the Copyright Office Notice published at 67 Fed. Reg. 70093 (November 20, 2002). The members of RIAA and SoundExchange, which are not entirely co-extensive, own the copyrights in more than 85 lo of all the sound recordings legitimately sold in the United States. The Librarian of Congress has designated SoundExchange as the agent to receive royalty fees and statements of account submitted by eligible nonsubscription transmission services under provisions:of the Section 112 and 114 licenses that are directly at issue in the above-referenced proceeding. 37 C.F.R. $ 261.4(b). Accordingly, RIAA and SoundExchange each have a significant interest in the royalty rates that are the subject of the proceeding referenced above. See 17 U.S.C. $ 803(a)(1). Attached as Exhibits A and B are lists of RIAA and SoundExchange members. These lists, particularly the SoundExchange list, may be amended as additional record companies join one or both organizations. On behalf of its members, RIAA is engaged in ongoing negotiations with the affected services and remains hopeful that voluntary agreements will be reached and that CARP proceedings will be avoided. If CARP proceedings are required to set terms and rates for the Section 114 statutory license for some or all ofthe services involved in this proceeding for the relevant period, RIAA or SoundExchange, or both, intend to fully participate in any such proceedings. Likewise, RIAA or SoundExchange, or both, intend to fully participate in any CARP proceedings to set rates and terms for the Section 112 statutory license for the relevant period.     Taking Intellectual Property into Their Own Hands Amy Adler* & Jeanne C. Fromer** When we think about people seeking relief for infringement of their intellectual property rights under copyright and trademark laws, we typically assume they will operate within an overtly legal scheme. By contrast, creators of works that lie outside the subject matter, or at least outside the heartland, of intellectual property law often remedy copying of their works by asserting extralegal norms within their own tight-knit communities. In recent years, however, there has been a growing third category of relief-seekers: those taking intellectual property into their own hands, seeking relief outside the legal system for copying of works that fall well within the heartland of copyright or trademark laws, such as visual art, music, and fashion. They exercise intellectual property self-help in a constellation of ways. Most frequently, they use shaming, principally through social media or a similar platform, to call out perceived misappropriations. Other times, they reappropriate perceived misappropriations, therein generating new creative works. This Article identifies, illustrates, and analyzes this phenomenon using a diverse array of recent examples. Aggrieved creators can use self-help of the sorts we describe to accomplish much of what they hope to derive from successful infringement litigation: collect monetary damages, stop the appropriation, insist on attribution of their work, and correct potential misattributions of a misappropriation. We evaluate the benefits and demerits of intellectual property self-help as compared with more traditional intellectual property enforcement. (“Warner”) contending that he is owed royalties for songs that he wrote. Warner moves to dismiss Crichlow’s action on several grounds [#4]. Upon consideration of the motion, the opposition thereto, and the record of this case, the court concludes that Warner’s motion must be granted because this court is unable to exercise personal jurisdiction over Warner. I. BACKGROUND Crichlow, a songwriter and resident of Sweden, signed two music publishing agreements with subsidiaries of Warner. Crichlow and a company named Megasong Publishing A/S (“Megasong”) entered into a music publishing agreement (the “Megasong Agreement”). Megasong was subsequently acquired by Warner/Chappell Music Denmark A/S, which is in turn owned by Warner/Chappell Music Scandinavia AB. Warner/Chappell Music Scandinavia AB is in turn owned by Warner Bros. Music International, Inc., which is owned by Warner/Chappell Music, Inc. Warner/Chappell Music, Inc. is owned by Warner via two non-operating holding companies. Thus, Warner is separated from Megasong by approximately seven corporate levels.
