BILL NO. 7135 ORDINANCE NO. 10- 2021

AN ORDINANCE AMENDING CHAPTER 300.010 OF TITLE III CODE) OF THE CODE OF ORDINANCES, CITY OF , RELATING TO DEFINITIONS.

WHEREAS, Section 304.033 of the Revised Statutes of Missouri authorizes the governing body of any municipality to pass a resolution or ordinance allowing persons to operate Recreational Off Highway- Vehicles ( ROHVs) upon any street or highway under the governing body' s jurisdiction; and

WHEREAS, Section 304. 034 of the Revised Statutes of Missouri authorizes the governing body of any municipality to pass a resolution or ordinance allowing persons to operate Golf Carts upon any street or highway under the governing body' s jurisdiction; and

WHEREAS, Section 304. 120 of the Revised Statutes of Missouri further authorizes municipalities to, by ordinance, make additional rules of or traffic regulations to meet their needs and traffic conditions; and

WHEREAS, the City Council of the City of Louisiana, Missouri finds it in the best interest of the City to amend Chapter 300.010 relating to Definitions applicable to Title 111 ( Traffic Code) of the Code of Ordinances, City of Louisiana, Missouri.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISIANA, PIKE , MISSOURI, AS FOLLOWS:

Section 1. Section 300.010 of the Code of Ordinances of the City of Louisiana is hereby amended by removing the definition of "Neighborhood Vehicles."

Section 2. Section 300.010 of the Code of Ordinances of the City of Louisiana is hereby amended to add the following two definitions to read as follows:

GOLF CART

A motor vehicle that is designed and manufactured for operation on a golf course for sporting or recreational purposes and that is not capable of exceeding speeds of twenty miles per hour

RECREATIONAL OFF-HIGHWAY VEHICLE (" ROHV")

Any motorized vehicle manufactured and used exclusively for off-highway use which is more than fifty inches but no more than eighty inches in width, measured from outside of tire rim to outside of tire rim, with an unladen dry weight of three thousand five hundred pounds or less, traveling on four or more nonhighway tires, as defined in 301. 010 RSMo.

Section 3: This Ordinance shall be in full force and effect on and after its passage and approval by the Mayor.
