NEWS HEADLINES DETAILS ECP submits report on ISLAMABAD - The returning officer NA-125 in his reply to Election Commission of Pakistan alleged NA-125 rigging (ECP) revealed that 40 staff members in the constituency were changed three days prior to the The Nation 31st May, 2014 general election due to Pakistan Tehreek-e-Insaf candidate’s concerns. Bhatti stated that about three days before the election, Hamid Khan, a PTI candidate, visited him and expressed reservations over the appointments of presiding officers belonging to LDA and PHA. To alleviate his (Hamid Khan) concerns and ensure impartiality and transparency, despite acute shortage of staff and the electoral exercise having reached its fag end, more than 40 presiding officers belonging to LDA and PHA and its sister organisations i.e. WASA and TEPA were replaced by the officials provided by the election cell of the district returning officer. The Supreme Court on May 8, 2014 had directed the ECP to submit comprehensive report on PTI applications, which alleged massive fraud in the general election and called for the verification of voters’ thumb impressions with the help of the National Database Registration Authority (NADRA). The PTI is seeking a direction for recounting of votes and verification of thumb impressions in NA-110, Sialkot, from where Khawaja Mohammad Asif, minister for defence and water and power, got elected, NA-122, Lahore, from where National Assembly Speaker Sardar Ayaz Sadiq won, NA-125, Lahore, from where Railways Minister Khawaja Saad Rafiq was elected and NA-154, Lodhran, from where Siddiq Khan Baloch won the election. The PTI believes that the verification of thumb impressions and a fresh vote count in the four constituencies might prove a serious blow to the PML-N. Afghan election body sacks KABUL: Afghanistan’s election commission said on Wednesday it had fired more than 3,000 thousands over fraud staff accused of fraud in the first round of the country’s presidential election, as it sought to quell The News 22nd May, 2014 fears that it might fail to deliver a legitimate outcome. The run-off will be held on June 14 and the results will be announced on July 22.Both frontrunners, former opposition leader Abdullah Abdullah and ex-World Bank economist Ashraf Ghani, complain that widespread fraud undermined the first round, reinforcing concern that the loser on June 14 may reject the run-off result. Rigging did not occur in NA- ISLAMABAD: The Election Commission of Pakistan (ECP) on Wednesday said no rigging 68: ECP occurred in the NA-68 Sargodha, as the vote count rose due to a typing mistake.Talking to The News 22nd May, 2014 media persons here, Additional Secretary Election Commission of Pakistan Dr Sher Afgan said a typing mistake in a polling station result did not have any impact on the election result of the NA-68 Sargodha. He said 15 candidates contested in the National Assembly constituency NA- 68 in the last general election and the winning candidate Mohammad Nawaz Sharif secured 140,000 votes. The seat was later vacated and a by-election was held, the voter turnout was comparatively low and this time the winning candidate got 68,000 votes, he added. He said the Election Commission feels that the result issued by the Returning Officer for polling station number 246 carried a numerical typing mistake, which was later corrected. He said the Election Commission only issued ballot papers according to number of voters at the polling station. “Some 7,000 ballot papers were not even issued for the polling station concerned.” He said the mistake did not have any impact on the election result. Dr Sher Afgan said when the result on ‘Form 16’ is issued to the candidates, they make their own calculations. If there is any discrepancy, the candidates file complaint and the result is corrected, he added. He said after the last general election, complaints were filed before the election tribunals and many of the cases were sub judice. ECP to act against bogus ISLAMABAD: In a major move, the Election Commission of Pakistan (ECP) on Monday voters decided to take action against those who were found involved in casting bogus votes or more The News 20th May, 2014 than one vote during the last year’s general elections. In another development, the Ministry of Finance on Monday asked the EC to return Rs3 billion issued for holding the local government elections, as the electoral exercise had been delayed for several months now. However, the commission contended that it had to pay pending amount of general elections to the army and Nadra for services rendered. The ECP stated that Rs450 million would be paid to Nadra while Rs310 million would be given to Pakistan Army. The community meeting was organized at a local restaurant by a body of Pakistani lawyers which is headed by Ramzan Rana. Responding to newsmen’s question about his involvement in electoral rigging as claimed by Pakistan Tehreek-i-Insaf chief Imran Khan, Chaudhry said, “These allegations are absolutely baseless.” Elaborating, he said, the election process was the sole duty of the Election Commission of Pakistan (ECP), which was responsible for the appointment of returning officers. Asked why he did not act on Imran Khan’s complaint about electoral rigging in some constituencies, Chaudhry said Article 225 gave that responsibility to election tribunals. But he said that election tribunal should have taken quicker decision.The former chief justice also denied that he brought any pressure on Fakhruddin G Ibrahim, as stated by the former chief election commissioner, saying he had nothing to do with the elections. Chaudhry strongly condemned the murder of Rashid Rahman, the slain human rights lawyer, and appealed the government to conduct a thorough investigation into the case. He lauded the services of Raman as a defender of people’s rights. About entering politics, he said at this particular time he was working on establishing a think-tank. PTI ex-vice president urges ISLAMABAD: One of the closest erstwhile aides of Imran Khan Tuesday urged the Election ECP to order probe into Commission of Pakistan to take notice of PTI’s Special Audit Report and order a NAB or FIA party accounts team to probe alleged corruption and gross law abuses in handling the party accounts. Babar, th who is PTI founding member and ex-central vice president, approached this correspondent to The Nation 18 May, 2014 share his views with regard to the so-called audit and Imran’s desire for fairness and transparency in each and every matter while conveniently closing his eyes on what was happening under his nose. He backed Imran’s demands for transparency and accountability in public matters but charged that PTI chief’s demands sounded hollow in view of his continued refusal to hold the allegedly corrupt PTI office-bearers accountable. Babar parted ways with the party after the PTI chairman declined to listen to him for accountability and transparency in party matters. The ex-confidant of Imran noted that when the PTI leader demanded during the Sunday rally the accountability (jaza or saza) of those behind the electoral fraud, those in the PTI directly responsible for intra-party electoral fraud sat next to him. “When the PTI chairman states that a corrupt leadership elected through fraud cannot deliver, by the same token he is surrounded by a corrupt coterie against whom serious corruption allegations have evoked no independent inquiry or action from Imran,” he noted. Babar reminded the PTI chairman that in August 2011, he had pointed out in writing with words that “the PTI Central Office is infested with corruption” and later demanded an independent accountability commission should be formed to investigate serious allegations of corruption within the PTI. He said in March 2013, to avoid public disclosures that might have had hurt the PTI election campaign, the PTI chairman agreed to initiate a special audit. Babar said that despite truncating the scope of the special audit to donations only without any audit of expenses, the special audit report was an indictment and an FIR against the tall claims of internal transparency by the PTI leadership. Babar pointed out that the special audit was stalled for several months while false statements were made about the status of the audit. For example in August 2013, Imran stated in a news story by The News Group Editor Shaheen Sehbai dated August 8, 2013 that “we already have the preliminary report and I can assure you that there is no sign of any wrongdoing”. Another PTI spokesman, he continued, stated that “the party had a special audit conducted just to lay these accusations to rest. Upon completion of the audit no irregularities have been found in the PTI accounts and we will be publishing this audit report soon”. Both the statements were false and hollow as no interim or preliminary report was ever issued by the auditor, he claimed and added that in fact a senior PTI official even tried to offer the auditor future business, which could be ascribed as offering a bribe to the auditor while conducting an audit. Babar said the special audit report of donations made it crystal clear that the PTI accounts were not maintained transparently and according to law. He demanded that the PTI is public entity run on public donations and hence should be fully transparent and accountable. Thereunder are some excerpts from the special audit report: “We were not allowed to take photocopies of bank statements along with other data including financial statements with us. These were shown to us but no record was allowed to be retained by us. “We observed that there were no segregation of duties regarding cash receipts within the accounts department. We observed that Accounts Manager was handling cash and was responsible for recording it also. In addition to this, we noted that the person who was introduced at the start of our assignment as Internal Auditor later during our assignment was appointed as Chief Financial Officer (CFO). “Also, no authorisation, no vouchers relating to donation, was available in evidence to review the work done by Accounts Manager. Both of the above were noticed in the case of transactions in general and especially in case of donations received through employees. As regards conflict of interest, it is felt that CFB should have disassociated the finance team from the assignment in the course of the audit. On account of inherent risk of cash, leads us to the conclusion that the internal control system was not well designed.” The report says: “Although the instructions were to receive the money by wire, and no such amount was received through wire, we were informed that majority of money was received through cash, but no evidence of person handing over the money, in shape of CNIC or signature was retained as directed by CFB. “During the course of our engagement, we also observed that reconciliation provided to us was not either

signed by the preparer, reviewer nor the secretary finance or any member of the then CFB. It is to be noted that neither the then CFB nor finance team asked respective employees to submit a reconciliation of amounts received and deposited as per CFB approval. Also, no minutes of the CFB meetings were provided in which these transactions were discussed.” The report points out the board resolution were dated July 01, 2011, however, some of the identified transactions relate to the period earlier than this date. The resolution did not explain to the Board any reason for such transactions. All of these reveal the lack of review procedures to ensure accountability among employees who have been given the responsibility of handling donations. Needless to add that the lack of system could be associated to employees but for the then CFB members, it seems it would be more appropriate to say that they had no accounting background. “We are of the view that employees were not able to justify the amounts deposited in their personal bank accounts beyond their known and documented source of income other than monies received on the Party’s behalf.” The audit reports says: “It is to be noted that first of all, proper receipt acknowledgment was to be provided by the accounts department. Secondly, this was only restricted to monies wired into employee accounts. Both the above conditions were not fulfilled. In addition to the above, a summary of donations was to be provided to all members of the CFB and its secretary, which as we have been informed has not been done. “Further, the above referred CFB resolution was dated July 01, 2011, however, the identified transactions relate to the period earlier than this date. The above referred resolution did not explain to the CFB any reason for such transactions. It is to be noted that neither the then CFB nor finance team asked respective employees to submit a reconciliation of amounts receipts and deposited as per Board approval. The performance was not monitored in the light of the strategy given by the CFB. “We had pointed out to CFO, finance team and later to the CFB in our meeting dated August 27, 2013 that a complete reconciliation should have been made at the time of transfers. No such reconciliation was provided to us at the time, we raised our observation. “Review of bank statements of accounts of PTI employees managing PTI accounts was made and the concerned employees were provided opportunity to explain the amounts deposited in their personal bank accounts beyond their known and documented sources of income. In this regard, we initially identified an amount of unusual credits of Rs19 million, other than monies received on the Party’s behalf as donations, in the personal bank accounts of employees which could not be reconciled. “It is worth noting here that we circularised KASB Bank Limited only as we were not allowed to write letters to other banks in which employees had accounts. All the bank statements of employee accounts were provided by the employees on their own in the shape of photocopies.” Concluding excerpt reads: “Because the above procedures do not constitute either an audit or a review made in accordance with International Standards on Auditing or International Standards on Review Engagements, we do not express any assurance on donation receipt for the period covered in our assignment. Why is the election Election Commission of India allowed the government to go ahead with the appointment of the commission effective in country’s new army chief hours after the polling ended in the last phase on May 12. The India? commission had actually allowed the Ministry of Defence to forward the file to the appointment th committee headed by the prime minister two weeks ago but the government sought its explicit Dawn 14 May, 2014 permission again to be doubly sure. Has the commission a role in appointment of the army chief in India? Certainly no, but there is no uncertainty in any mind here that the constitutional body becomes the supreme de facto government of the country as soon as elections are announced. The commission in India does not only have all the powers that it needs to organise this biggest electoral exercise in the world, it is willing and ready to use it as well. The size of electorate in India is a colossal 810 million, ten times the one in Pakistan and multiplying it with the geographical, linguistic and other diversity factors, the sheer mechanics of the exercise become mind boggling. Yet, the commission comes out victorious from this labyrinth as the participants generally do not contest its impartiality or capacity. The commission has faced some criticism in the present hotly contested elections but that has largely focused on it being not quick in responding to calls for action. From Pakistan’s point of view where the commission is mistrusted and always deeply embroiled in controversies, the more surprising is the fact that the commissions in both countries enjoy roughly the same constitutional powers. There are however some differences as well. “The courts can’t intervene in our working in any manner. The constitution guarantees this non-interference that many subsequent court rulings have further reinforced. That gives us the required agility,” said S.Y. Quraishi, the former Chief Election Commissioner of India in an interview with Dawn in New Delhi. “Then we assume total control over bureaucracy, cutting its links with the political governments completely. We purge the entire state machinery of political bias by ordering transfers and postings following our own assessments of each individual functionary or in response to complaints,” says Mr Quraishi. He adds: “The commission invites every party individually in every area and each of them gives us their lists of suspected, biased functionaries. We act after summary inquires.” “We also insulate the officials appointed to perform election duties from their political masters. No minister or chief

minister is allowed to call them for a meeting. We suspend them even if we come to know that the chief minister has talked to them on phone,” says the former commissioner who belonged to Indian Civil Service. Quraishi whose book on Indian elections ‘An undocumented wonder’ has been published last month believes that once under the commission, the government functionaries have no option but to behave. “They are our main force but we cannot trust their impartiality and have put in place many safeguards,” says Quraishi elaborating that as a last measure, “we order repolling following the report of our own observers or complaints from candidates of say booth capturing.” The four-day gap between the last polling and result announcement is to facilitate repolling before the final tabulation. The commission in India does not require army to perform any election duty and in fact keeps it “miles away from the process”. It instead lists police, paramilitary and other armed forces for assistance and once they are assigned they come under the commission’s ‘command’. Quraishi is all for the Electronic Voting Machines (EVMs) and rubbishes the criticism on this “illiterate-friendly” machine that has replaced paper ballots in India. The machine was first introduced in one state on experimental basis as early as 1984 but it was provided the requisite legal cover only in 1998. It was then put to use in all the state assembly elections before being used for the entire Lok Sabha elections in 2004 for the first time. He believes that EVMs not only save the commission from the hassle of printing paper ballots, it also makes the contentious counting process as easy as one, two, three. “Another matchless advantage is obliteration of votes rejected for being marked erroneously,” says Quraishi. (According to a FAFEN report the number of rejected votes in 2013 elections in Pakistan exceeded the margin of victory on 35 of the 266 contested seats.) The commission in India is also experimenting with introduction of biometric system for voter identification. ‘The money power’ however is the biggest and burgeoning challenge that the commission is faced with. It not only places a legal bar on the candidates to not spend beyond the prescribed limit, it makes them open separate bank accounts dedicated to their campaign expenses. “Then our flying squads videograph the campaign activities and maintain a shadow account of each candidate,” says Quraishi. “The candidates have to submit their expense accounts three times during the 14-day campaign and they are not allowed to report the cost of a cup of tea that they offered to their supporters at rupees two if its market rate is rupees seven.” The commission carries a list of the market prices of all the items that a candidate can possibly use in his/her campaign and has powers of disqualifying them on wrong reporting. The commission places a ban on the movement of cash, intended to be distributed among voters as bribery. It has raided suspected places, including ambulance vans and coffins in funeral processions, to check violations and confiscated currency worth hundreds of crores of rupees during current elections. The banks are directed to report any ‘extraordinary withdrawal of cash’. The commission also bans movement of liquor that is another favourite item of bribery for voters. Quraishi believes that the use of money in elections is the fountain head of corruption in governance system and has led efforts to check it and the best they could do is to make “the life miserable for them”. The commission has stretched itself to the limits. It has very encouraging stories to tell but aren’t all its victories pyrrhic? “The challenge is formidable,” admits Quraishi, adding; “the crime is always ahead and they keep finding ways to get around but rest assured the commission is at it. The best thing about the Indian election body is that it learns quickly, devises new creative solutions and implements them. Every election is better than the previous and the best ever in Indian history.” Fakhru Bhai’s ECP reforms ISLAMABAD: The critically important legislative bill, seeking empowerment of the Election ignored by old and new Commission of Pakistan on the lines of the Indian model, was referred to parliament in Feb parliament 2013 for enactment but despite the lapse of over one year no one has bothered to take it up for th consideration either in the National Assembly or in the Senate. Proposed by the Election The News 13 May, 2014 Commission of Pakistan for enactment in Feb 2013, several weeks before the May 11 elections; the bill was ignored by the last parliament as well as the present legislature. The bill, which was approved by the ECP under the then Chief Election Commissioner Fakhruddin G Ebrahim had mainly sought the empowerment of the ECP to transfer or suspend any officer including the Chief Secretary or the Inspector General of Police in case such an officer was found involved in meddling in the election affairs or creating hurdles in the holding of elections in a free, fair and independent manner. The ECP had sent the bill to parliament for enactment several weeks before the elections but despite repeated reminders it was not taken up by the then parliament for enactment.The legislative bill had also proposed 30-day scrutiny period but even this was not allowed by the last parliament. The Election Commission of Pakistan (ECP) had approved a 30-day scrutiny period for nomination papers of candidates to ensure that frauds, fake degree holders, tax and utility bill defaulters and other cheats are barred from contesting the next polls by cross checking their credentials from the concerned authorities. To ensure true representation of the people, the legislative bill also recommended that the winners in elections must bag 50 percent of the total votes cast. The fines for violation of the code of conduct were also proposed to be increased manifold. For instance, Rs100,000 fine was recommended to be imposed on a voter casting a bogus vote. Those committing election forgery were also recommended to pay a fine of Rs100,000 and up to five years imprisonment. The ECP under Fakhruddin G Ebrahim had miserably failed to deliver as per the expectations of the masses because it was not empowered by the parliament to function independently and ensure impartiality. The ECP even during the election days was dependent on the Executive to transfer any officer. Many of ECP’s requests regarding posting and transfer of officers were even

ignored by the then caretaker federal and provincial governments. Now with the PTI coming on the roads demanding electoral reforms, this is high time for the government as well as the parliament to set-up a committee of all stakeholders to chalk-out a comprehensive reforms package to ensure fair, free and independent elections. Such a package should include the mechanism for the implementation of the Article 62 and 63 to ensure that only the men of character could get into the parliament. Tehreek-e-Insaf (PTI), made in his Sunday address to party protesters, the motive of his rally is Dawn 12th May,2014 crystal clear. He wants verification of votes of four National Assembly seats all from Punjab come what may. This was the bottom line of his speech as senior leaders of his party have been claiming in their recent statements about his ultimate motive of untimely protest call. If there were hidden motives other than the polls rigging that would be alarming especially when Imran continues with his protest campaign. In that situation he might end up with additional demand of mid-term elections. But how the leadership of the ruling PML-N and other major political parties look and react to such possible demand still remains a far-fetched notion. Apart from his assertions on rigging issue, Imran Khan sought an autonomous Election Commission with introduction of key electoral reforms to ensure more transparency in the elections held in future. So, basically Imran Khan is seeking verification of thumb impressions of the votes polled in May 11 general elections in four National Assembly seats, and that too from Lahore and other parts of Punjab, the political bastion of the ruling PML-N. This has been despite the fact that he initially accepted the elections results, interestingly took oath as MNA as his other elected party MPs did, and kept mum on the rigging issue ostensibly it being a subjudice matter for one year. During this period, the PTI and ruling PML-N have been clandestinely discussing the issue. Prime Minister Sharif and his party did not oblige Imran Khan simply on the pretext that there is no legal basis for the Prime Minister to intervene and resolve the standoff between the two parties because there is no executive power with Prime Minister, and the matter can be resolved only through the Election Commission and the Election Tribunals. Imran Khan instead of waiting for the legal process to complete has resorted to street protest, an unpleasant surprise for the government and main opposition party and other political players including ANP, JUI (F) and QWP. What has pushed him to take the judicial issue to the streets is the key question being discussed both by government and main opposition parties including the PPP. They all individually seemed to smelling a rat in Imran Khan’s protest campaign after one year on election issues that have been largely resolved lawfully and only a portion of the elections related petitions including that of PTI’s are to be decided. Insiders in these political parties believed Imran Khan, PAT of Dr. Allama Tahirul Qadri, Awami Muslim League of lone Sheikh Rashid Ahmed and Pakistan Muslim League (Quaid-e-Azam) of Senator Chaudhry Shujjat Hussain have jumpstarted protest campaign on the desire of ‘military establishment’ because of a friction with civil government on the question of highhandedness of former military chief General (retd) Pervez Musharraf in his trial under Article 6, an allegation none of them was able to substantiate. Still, some do maintain that protesting parties are just exploiting the reported strain in the civil-military ties to get political mileage for them and their protest would not bear steam, a notion only the time would determine the cause of their protest. On the other hand the record of the Election Commission of Pakistan suggests that only 100 of the total 435 election related petitions are near completion of the judicial process at the Election Tribunals and decision is expected by the end of this month. Interestingly, PTI’s has only 20 petitions including 15 petitions relating to National Assembly seats including the four for which Imran Khan wants verification and five of the Provincial Assembly seats. These all 20 petitions filed by PTI and decision is awaited are mostly from the Punjab province. Rest of 100 election petitions has been filed by others. How these 20 seats even if all decided in favour of Imran Khan’s PTI would benefit the party considering as its main objective of the protest campaign? Critics both in the ruling PML-N and PPP and other parties opposed to his untimely protest campaign viewed the development as his tactical gain. Some believed despite his mere gain in terms of an increase in his parliamentary strength in the National Assembly, he would not be able to bring down the government of Prime Minister Nawaz Sharif. Only few are of the opinion that ‘the gain’ in question might help him in his elevation as Leader of Opposition in the National Assembly, a possibility the PPP insiders strongly ruled out. Others critics looked at his protest as a mischievous move, blaming Imran Khan for working on someone else agenda. They are of the view that he might be trying to create a space for the ‘hidden hands’, if any, to prop up handful

of stressed PML-N MPs facing PTI’s rigging allegations. They argue that despite stricter floor crossing law they may fall an easy prey in resisting any attempt to form forward blocks both in the National Assembly and Punjab Assembly, if that at all is the objective. He castigated the rulers and said what was the use of paying Rs500 billion under the tag of circular debt, as the power tariff had been doubled and there was no let- up in power outages while circular debt had again gone up to debt had again gone up to Rs300 billion. He said the PPP government had doubled the electricity tariff in five years, while PML-N government had doubled it in just one year. He asked the audience was there any decline in unemployment and he replied that how new jobs could be created when there was no investment coming to Pakistan. He quoted Finance Minister Dar saying $200 billion was stashed in Swiss banks and said if it was brought back, Pakistanis would enjoy tax holidays for ten years. “But if the rulers have their own assets abroad, how can they bring back money lying in Swiss banks. How patriotic these rulers are that they keep their money and assets abroad and do politics in Pakistan,” he quipped. He claimed biggest ever loan was obtained in the last one year and said a leader had to lead by example. Addressing Prime Minister Nawaz Sharif, he said they wanted to play a match but with natural umpires unlike Nawaz, who had a bad habit of playing at Gymkhana Club with his own umpires. He added fair and transparent match was possible only with neutral umpires and recalled how he as national team skipper had introduced neutral umpires in world cricket. He dispelled the impression created by the ruling parties that PTI had fixed the event on the nod from someone and questioned who had made IJI on whose signal and who was its captain? Imran justified holding the rally and said they had exhausted all possible options and now were presenting their demands after getting no justice from any forum despite having provided evidence of rigging in a 2100-page white paper. The PTI chief referred to a Sargodha constituency of Nawaz Sharif, from where at a polling station, total number of registered voters was 1500, whereas 8100 votes were polled. About his demands, Imran said they wanted an ECP that should be independent and returning officers should be under it, who had massively rigged the 2013 elections. Imran demanded that thumb verification of four constituencies should be carried out immediately and reiterated his readiness for verification anywhere, from where his party had won. “If PML-N has genuinely won then why it is afraid of electoral investigations? I have not said anything strange and there is no threat to democracy from voters’ thumb verification,” he maintained. On this occasion, he requested the Supreme Court to play its role in unmasking and punishing those involved in rigging and stealing people’s mandate. He proposed that probe into four constituencies was possible within five days. He mentioned Hamid Zaman’s petition, which had fought in the elections from NA-118 by spending Rs5.7 million. He recalled out of 325 bags, 250 opened bags were found and it was revealed after eight months following the elections that of 1, 70000 votes, 90,000 were empty chits. “Who is responsible for this? RO you must be ashamed of your deeds and you are going to be a judge. Up to 60 bags found were not of the Election Commission,” he asserted. The PTI chief said he would go to the last until he was provided justice with regards to rigging in elections. He said it should also be probed whether it was done by ROs or it was a team effort. Imran said a joint line of action would be thrashed out with all those political parties that believed rigging was done the elections. He asked the youth to be ready for tsunami that would now turn to Faisalabad. On each Friday, protest will be held before the Election Commission against rigging. He said tsunami would not stop now until justice was provided to him and true democracy was established through a transparent electoral process and those who stole the masses mandate were not punished. The PTI chief asked the rulers to give justice to his party, as it was a better option for them. PTI leaders Javed Hashmi, Jehangir Tareen, Shah Mehmood Qureshi, AML President Sh Rashid Ahmad and Mian Muhammad Aslam of Jamaat-e-Islami also spoke on the occasion. Earlier, Imran left for the venue on a black luxury vehicle from his Bani Gala residence, accompanied by Sh Rashid Ahmad, Jahangir Tareen and Shah Mehmood Qureshi. Media reports kept pouring about the administration impeding arrivals of PTI leaders and workers from various districts. It was widely alleged that public transporters was denied plying buses and vans on roads. It was learnt hundreds of vehicles were impounded under one

Red Zone of the federal capital was sealed off by containers as part of security arrangements owing to PTI protest rally at D- Chowk. According to reports, more than one hundred containers have been placed to block the roads leading towards Red Zone. Organisers of the PTI rally said that the workers, including women, started gathering at the venue Saturday night.They said caravans came from Lahore, Multan, and Faisalabad, Dera Ismail Khan, Peshawar and other cities in vehicles, claiming that most of them had been stopped by the police. PTI leader Shah Mehmood Qureshi said in an interview his party had adopted legal procedures to get justice over rigging but they have not been given way by the government. A year after elections, ECP ISLAMABAD - One year down the road since the country witnessed general elections amid striving to deal with massive rigging complaints, the Election Commission of Pakistan (ECP) is still swamped by caseload pending cases as Sunday marks a year since polls were held. Soon after the polls were th concluded, the ECP had received 435 complaints, out of which 30 were decided by the The Nation 11 May, 2014 commission itself while the rest were transferred to 14 Election Tribunals established for thoroughly inquiring the grievances expressed by candidates. While the tribunals disposed of more than 300 cases, more than 100 petitions are still hanging in the balance to what sources said was the failure of government to constitute more tribunals for speedy hearing of the polls related complaints. “The tribunals have concluded discussions on 50 election related complaints while the remaining 50 cases would be disposed of in coming weeks,” ECP Deputy Director Khurshid Alam told The Nation on Saturday. Official sources told this reporter that the ECP had requested finance ministry for approving 28 election tribunals in country so that the piling complaints against rigging could be resolved in minimum time but they said the ministry declined to meet the request. With Pakistan Tehrik-i-Insaf (PTI) all set to converge on D Chowk in the federal capital on Sunday against rigging in election last year, some of the most controversial cases pending with ECP include the four constituencies where the PTI has been demanding vote verification. Information gleaned by The Nation reveals that the future of a dozen of lawmakers in National Assembly is in doldrums keeping in view the severe nature of complaints lying vacant with the election tribunals. Recently, the ECP declared PPP candidate from NA-202 Shikarpur Aftab Shaban Merani as successful although according to initial polling result the constituency was won by PML-N candidate Dr Muhammad Ibrahim Jatoi. Similarly, the ECP had recently declared Ahmed Ludhianvi as successful against PML-N MNA Sheikh Muhammad Akram in Jhang until the Supreme Court again asked ECP to suspend the notification of Mr Ludhianvi. “The nature of election related complaints is so complex that we are hesitant to issue a clear verdict. It is a labyrinth for election tribunals to get through,” a retired judge heading a tribunal told this reporter seeking anonymity. “It takes time to hear all the cases at the same time. We have disposed of hundreds of complaints and the rest will be heard within weeks,” an ECP official remarked. Although the ECP claims that the 14 election tribunals are under nobody’s influence in decision making, the lingering polls-related complaints still pending also put a question mark on the independence of the tribunals keeping in view the prolonged delay in resolving over 100 complaints. For some candidates, the decisions of election tribunals too are not acceptable and they have moved the apex court for more transparency while the cases resolved by the ECP have been challenged in high courts. Wasiq Qayyum, who contested for PP-6 constituency in Rawalpindi and was defeated by PML-N candidate, is still hopeful of winning the seat after the tribal hears his case. SC seeks ECP reply on PTI ISLAMABAD: The Supreme Court (SC) on Thursday directed the Election Commission of petition Pakistan (ECP) to submit para-wise comments and detailed report on three miscellaneous The News 9th May, 2014 applications regarding recounting of votes in the four constituencies of the Punjab. A three- member bench of the apex court headed by Chief Justice Tassaduq Hussain Jillani and comprising Justice Ejaz Afzal Khan and Justice Sheikh Azmat Saeed resumed hearing on the petition filed by Pakistan Tehreek-i-Insaf (PTI) Additional Secretary Saif Ullah Nizai regarding the recounting of votes in four constituencies of the Punjab after verification of thumb impression. Appearing on notice, Bilal Hassan Minto submitted before the court that the apex court’s order regarding elections reforms was not implemented in letter and spirit. Hamid Khan; counsel for PTI said that the party had filed a different petition against rigging in general elections. Justice Sheikh Azmat Saeed remarked that the petitioner’s queries would be sorted out after the ECP filed its reply. Meanwhile, the court directed ECP to submit para-wise comments and detailed report within 15 days and adjourned further hearing in the instant case.Later, talking to reporters outside Supreme Court, PTI chief Imran Khan said that people responsible for rigging in the general elections must be punished, adding that fair and transparent elections strengthen democracy. Unless investigation into rigging of the elections was held and the people responsible were not taken to task, elections should not be held on those constituencies. He said that the general elections were held under an independent judiciary hence, he said that they had knocked the door of the highest court of the country for justice. Replying to a question he said that the speech of Makhdoom Javed Hashmi on the floor of the National Assembly was very much clear. The PTI chief alleged that the government was creating hurdles in the way of their protest being launched on May 11. He however, warned if they were prevented from peaceful protest, the government would be responsible.

People of Pakistan seek the justice,” he said. The PTI chief, however, refrained this time from accusing the judiciary of involvement in election irregularities, saying that “our party respects judiciary.” Khan called for action against election riggers. “Those stole the public mandate should be punished under Article 6 of the Constitution.”Lashing out at government, Khan said Nawaz government had paid Rs500 billion circular debt despite spending such big amount from public money. He alleged that Shakeel Awan did not submit the affidavits and the list of witnesses before the tribunal with his application which was against the rules and regulations and Election Tribunal passed interim order on the applications. He prayed before the bench to set aside the interim order of Election Tribunal as Election Tribunal did not follow the due process laid down in the laws.Subsequently, the bench observed that as before this application many other identical petitions were pending before the Supreme Court so decided to club it with these applications for hearing. Later, the bench fixed the matter for hearing after one week.It is to mention that a three-member bench of LHC had been decided that interim order of Election Tribunal could not be challenged. Against this verdict of LHC, so many petitions were filed before the apex court from many quarters. Imran boycotts Jang Group, ISLAMABAD: The Pakistan Tehreek-e-Insaf (PTI) Chairman, Imran Khan, on Friday accused accuses it of influencing Geo TV of being a part in rigging during the 2013 general elections and announced to boycott polls the Jang Group and the channel. Talking to media persons here, Imran said that no PTI rd representative would appear on Geo or subscribe to the Jang Group newspapers till the time The News 3 May. 2014 the private television apologised for its role in the rigging. Imran noted that PTI candidate for NA-118 had to pay a total of Rs5.2 million for thumbprint verification of voters, the election tribunal and lawyer fee, and it was found that out of 325 bags, 170 were opened while only 69 had all the requisite documents. He continued that out of 170,000 votes cast in the constituency, only 81,000 had either partial or complete record and more importantly, 70 bags did not belong to the Election Commission of Pakistan but were altered. The PTI chairman pointedtribunals to going to the Supreme Court (SC) and raising the issue in the National Assembly.“This was simply because the PTI did not want to destabilise the government. Never at any time did the PTI accept the rigging that had clearly taken place in general elections 2013,” he noted. Imran asserted that almost a year had passed and neither the tribunals nor the SC had given any decisions on their petitions. PTI’s demand for thumbprint verification in only four constituencies had still not been acceded by the ECP and the petition for the same remained undecided by the SC. The PTI chairman said that his party had been left with no option but to come out on to the streets to protest the rigging so that future elections were made transparent and fair, or people would lose faith in the entire electoral process. “Others will assume that the only way to win is through rigging. And the unprecedented turnout of youth and the urban professionals who came out to vote will again retreat and they won’t bother to cast their votes. This bodes ill for the future of democracy in Pakistan and the PTI will not allow this to happen,” he noted. Imran pointed to the ‘questionable role’ of the ex-chief justice of Pakistan, the ROs and the Election Commissioners from the Punjab and Sindh in aiding and abetting rigging, along with the now infamous 35 punctures of the then Punjab acting Chief Minister Najam Sethi, who had been duly rewarded. He drew attention to the comprehensive PTI White Paper on rigging as well as the Fafen report.The PTI chief recalled when thumbprint verifications were ordered and then Nadra chief complied in NA 118, Babar Sattar stated that the Nadra chief was threatened by Rana Sanaullah and then removed. The IHC decision on Nadra chief’s removal corroborated this statement. It is interesting to note that for other reasons, the Pakistan People’s Party (PPP), which was in power, had also boycotted Geo for some months but had to return to it on its own. PTI’s boycott of Jang Group was discussed during the recently held Core Committee meeting and more deliberations were held in a select group of party leaders.
