EUROPEAN PARLIAMENT 2004 2009 15.1.2007 0003/2007 WRITTEN DECLARATION pursuant to Rule 116 of the Rules of Procedure by Bogusław Rogalski on the banning of neo-Nazi parties Lapse date: 15.4.2007 DC\646935EN.doc PE 384.005 EN EN 0003/2007 Written declaration on the banning of neo-Nazi parties The European Parliament, – having regard to the European Charter of Fundamental Rights, in particular Article 21 thereof on equality and non-discrimination, – having regard to Article 6 of the Treaty on European Union, – having regard to Article 7 of the Treaty on European Union, – having regard to Rule 116 of its Rules of Procedure, A. whereas the National Democratic Party of Germany (NPD) and the German People's Union (DVU) should be banned on European Union territory on the grounds that their activities infringe the human rights guaranteed within the EU, B. whereas the 15 EU Member States unanimously adopted a Directive in 2000 banning discrimination, which was to be implemented by 2003, 1. Calls on the German Government to take decisive steps to ban neo-Nazi parties and to prevent their being formed in future; 2. Strongly condemns the following individuals: Christian Worch, a co-organiser of neo- Nazi marches celebrating the Nazi criminal Rudolf Hess; Klaus-Jürgen Menzel, who stated on the German television channel MDR that 'he had always supported Hitler'; Udo Pastörs, according to whom 'Adolf Hitler was a phenomenon; his achievements were outstanding in practically all fields' and 'the present-day borders are in violation of international law. A state of war persists'; and Udo Voigt, leader of the NPD party, who called, on behalf of his party, for Germany to be restored to its historical borders; 3. Believes that statements of this nature are unacceptable and should be vigorously condemned; 4. Is concerned at the inadequate response by German officials, politicians and courts to the rise of racial intolerance; 5. Calls on the authorities of the Federal Republic of Germany to bring its national law into line with European Union provisions on discrimination, in particular Directive 2003/43/EC; 6. Instructs its President to forward this declaration, together with the names of the signatories, to all Member States and to the Commission and Council. PE 384.005 2/2 DC\646935EN.doc EN.
