Mayor Jones called the regulm· meeting of the Morehead City Town Council to order at 5:30 p.m. with a quorum present. Councilmember Ballou gave the invocation and Mayor Jones led all in the Pledge of Allegiance.

RECOGNITIONS/PRESENTATIONS

Presentation of Resolution 2019-R-48 in Honor of Billy Beck Upon His Retirement

Mayor Jones presented Resolution 2019-R-48 to Billy Beck in recognition of his retirement from the Town of Morehead City on August 1, 2019. Mr. Beck began his career with the Town on November 10, 2003 as a Firefighter/Engineer with the Morehead City Fire/EMS Depmtment and was promoted to the position of lieutenant on September 28, 2006, a position he held until his retirement. Mayor Jones explained that it is not only the employee who serves,

1 Morehead City Town Council Meeting August 13, 2019 but also the family as they support the employee in fulfilling their duties. Therefore, he encouraged everyone to extend thanks to Billy and his family for their many years of service.

Fire Chief Fulk presented Lt. Beck with his helmet and badge, stating that Billy is the salt of the earth in that he has repaired and towed many vehicles for the department free of charge, and works continuously behind the scenes to benefit the Depaiiment and the City. He shared that Billy has more than 40 years of service between Morehead City Fire/EMS and the Beaufo1i Fire Depmiment.

Lt. Beck stated that he has really enjoyed his time with Morehead City Fire/EMS and has met many wonderful people during his time of service.

Presentation of Mayor's Proclamation in Recognition oflnternational Literacy Day

Mayor Jones presented a proclamation recognizing Saturday, September 8, 2019 as International Literacy Day in the Town of Morehead City to Clyda Lutz, Vice President of Carteret County Literacy Council. Mayor Jones stated that it is an honor to recognize those that give so much back to their community such as those who volunteer for the Cmieret County Literacy Council.

Literacy education serves as a unique and powerful tool to eradicate poverty and is a strong means for creating sustainable societies. Mayor Jones commends the efforts of the hundreds of volunteers, tutors and adult learners who have worked through the Cmieret Literacy Council's Adult Literacy & ESL Program, and urges all citizens to suppmi the goals of the Cmieret Literacy Council's program to make Cmieret County a more literate community. This year's theme is Literacy and Multilingualism.

Ms. Lutz reminded those present that the Cmieret Literacy Council is always looking for tutors for all age groups.

Seafood Festival Presentation

Mayor Jones then recognized Mitch Gay, Chairman of the No1ih Carolina Seafood F es tival, who came forwai·d to propose Resolution 2019-R-47 endorsing the 3 3rd Annual Seafood Festival. Mr. Gay stated that the committee is once again ready and excited to offer a full festival following the recovery of Hurricane Florence. This year's festival will feature the area's culinary talents in the Chefs Tent and local musicians both located in Katherine Davis Park; a local oyster industry showcase at Big Rock Landing; headline ente1iainment at Jaycee Park, and carnival rides in the Sanitary parking lot. The Festival will offer a 3-Bridge Road Race (Beaufort, Radio Island and Atlantic Beach) to include 5k, 1Ok and half marathon races.

The Festival board then distributed the official 2019 Festival poster to the Council and staff members.

CONSENT AGENDA

2 Morehead City Town Council Meeting August 13, 2019 Mayor Jones reviewed the Consent Agenda. Councilmember Walker made a motion to approve the Consent Agenda as presented. Councilmember Taylor seconded and the motion carried unanimously. (5-0)

Councilmember Wanender questioned the amount of requested ad valorem tax refunds as noted in Item C. Finance Director Jewel Lasater stated often property owners and their banks, through the escrow program, will pay on the same invoices.

NEW BUSINESS

Governing Body Appointments: Planning Board, Board of Adjustment, and Highway 70 Corridor Commission

Planning Director Sandi Watkins presented the Planning Committee's recommendation for filling the expiring In-City seat te1ms on the Planning Board and Board of Adjustment.

Board of Adjustment:

The Board of Adjustment In-City Member te1ms for Charles Sewell and Katrina Smith, as well as the Alternate Member terms for Judson Walton and John Steele expire on August 27, 2019.

The Planning Committee recommends the reappointment of Charles Sewell and appointment of Judson Walton to the Board of Adjustment In-City Member seats, and the appointment of Sarah West and Bobby Schultz to the Board of Adjustment In-City Alternate seats for a three (3) year terms to begin August 27, 2019 and expire August 27, 2022.

Planning Board:

The Planning Board In-City Member term for Andrea Smith expires on August 15, 2019. Ms. Smith is eligible and has expressed an interest in continuing to serve.

The Planning Committee recommends the reappointment of Andrea Smith to the Planning Board In-City seat for a three (3) year term to begin August 15, 2019 and expire August 15, 2022.

Highway 70 Corridor Commission

4 Morehead City Town Council Meeting August 13, 2019 On August 14, 2018, Council appointed Ryan Eggleston to the Highway 70 Conidor Commission to fulfill David Whitlow's unexpired term to expire on December 31, 2018. The Council then reappointed Mr. Eggleston on December 11, 2019 to a one-year te1m beginning January 1, 2019 and expiring December 31, 2019. Carteret County advised that the term changed to begin August 20, 2019 and expire August 20, 2020. Therefore, staff requests that Council reappoint Ryan Eggleston to the Highway 70 C01Tidor Commission for a one-year tenn to begin August 20, 2019 and expire August 20, 2020.

Councilmember Wanender made a motion to Reappoint Charles Sewell and appoint Judson Walton to the Board of Adjustment In-City Member seats, and appoint Sarah West and Bobby Schultz to the Board of Adjustment In-City Alternate seats for a three (3) year terms to begin August 27, 2019 and expire August 27, 2022; reappoint Andrea Smith to the Planning Board In-City seat for a three (3) year term to begin August 15, 2019 and expire August 15, 2022; and to reappoint City Manager Ryan Eggleston to the Highway 70 Corridor Commission for a one-year term to begin August 20, 2019 and expire August 20, 2020. Councilmember Ballou seconded. Motion canied by majority vote (5-0).

Consider Adoption of Updated Personnel Policy Manual

City Manager Ryan Eggleston presented a revised edition of the Morehead City Personnel Policies. Revisions were highlighted by red text. This revised edition is the end product of a review process that continued over a period of approximately six (6) to eight (8) months. The review committee represented a staff member from every department with the last meeting being a presentation to the depmtment directors for their review, comments, and feedback. All committee members were engaged and provided much feedback, suggestions, and comments to produce the proposed document.

The Finance and Administration Committee reviewed the policy on Tuesday, August 6, 2019, at which time the City Manager and HR Director presented the policy to Councilmembers Ballou and McCann page by page providing explanations. After review and fu1ther changes, the Committee recommended the policy for approval, directing that it be presented to Council for consideration at this meeting under New Business.

Revisions focus on policies and benefits that will enhance recruitment and retention of highly qualified individuals. The benefit revisions did not include salaries, but rather leave protocols and other similar benefits. It was pointed out that Mr. Eggleston met with councilmembers individually to review all the proposed amendments and to answer their questions. Councilmembers commended Mr. Eggleston, Human Resources Director Susan Nixon, and staff on their effo1ts in developing the comprehensive policy.

Councilmember Taylor made a motion to approve the updated Personnel Policy Manual as presented and recommended by the Finance and Administration Committee. Councilmember McCann seconded. Motion canied by majority vote (5-0).

CITY MANAGER'S REPORT:

5 Morehead City Town Council Meeting August 13, 2019 City Manager Ryan Eggleston reported that he and Communications Director Alize Proisy continue to move forward with the new branding initiatives. Samples of various logo items were shared.

CITIZEN REQUESTS/COMMENTS (2 Minute Time Limit)

Fred Tootle, 1003 Avery Street: Mr. Tootle came forward to address the alley adjacent to his home, asking why the City no longer mows this area. Mayor Jones and City Manager Ryan Eggleston assured him that staff will look into the matter. He also rep01ied that cars are parking in the alleyway.

George Hesta, 1008 Avery Street: Mr. Hesta stated that the streets lights along Avery Street between 10th and 12th sh·eets appear to be darker than they used to be. This is a concern for area residents as street lights are a deterrent for unwelcome activity. Mr. Eggleston assured him that staff will look into the matter as well.

COUNCIL REQUESTS/COMMENTS

Councilmember Wanender thanked everyone for coming and sharing their comments. She then reminded those present of the statewide Litter Sweep North Carolina Clean Up initiative scheduled for September 14-28, 2019 and welcomed everyone to participate.

Councilmember Taylor thanked everyone for coming and stated that it was great to have citizens involved in the governing process. He then commended Human Resources Director Susan Nixon on the comprehensive personnel policy.

Councilmember Walker thanked attendees for coming and for making Council aware of their concerns.

Councilmember Ballou expressed agreement with the prior comments and stated that it is an honor to serve the citizens of Morehead City.

Councilmember McCann also thanked attendees for coming, and commended Communications Director Aliza Proisy for her efforts on the branding campaign. She also offered congratulations to the Morehead Marlins on their 2nd Coastal Plain League Petitt Cup Championship.

Mayor Jones stated that a community is really about the individuals within the community, and a town will always be a work in progress. Noting that the Council's primary responsibility is to keep its citizens safe, he too thanked Mr. Tootle and Mr. Hesta for sharing their concerns.

City Clerk Cathy Campbell presented the minutes of the July 9, 2019 Closed Session for review and approval. After a review of the minutes, Councilmember Ballou moved to Approve

Mayor Jones called the special meeting of the Morehead City Town Council to order at 2:03 p.m. with a quorum present, and advised that the purpose of this meeting was to receive the final design of the City Hall project in preparation for bid adve1tisement. Public Services Director Daniel Williams introduced Town Consultant Wylie Cooke, Bill Schwegler of Waller Todd and Sadler Architects and John Wade of Arendell Engineers.

Mr. Wade presented the landscape plan reflecting the arched walkway to include both new and original building bricks, and the thi1teen (13) live oak trees reflective of those present when the Charles Wallace School building was built. The trees represented the Nation's original thi1teen (13) states. The plan also identified a future growth area that could accommodate up to a 5,000 square foot, two-story building if needed. Mr. Wade pointed out handicap, customer, and employee parking areas.

st nd Mr. Cooke and Mr. Schwegler reviewed the first (1 ) and second (2 ) story floor plans which provides a total of 21,300 square feet of space. The first floor will consist of Billing/Collections, Planning, Finance, and Public Services depaitments, while the second floor will consist of Administration, Human Resources, and Information Technology (IT) departments as well as the council chambers and an exhibit lobby. One wall within the exhibit lobby and the first floor entry halls will be covered with wood planks saved from the original building. Placing them on the walls will prolong the life of the wood and reduce maintenance. The building will feature a center rotunda that will be open to the top floor and a skylight in the ceiling. Tenazzo tile flooring will be used in the high traffic areas.

1 Morehead City Town Council Meeting September 3, 2019 The front fa;ade ( south side) includes a medallion and clock similar to that of the original school building. The back facade (north side) is very similar to the front differing only in the omission of the clock face, a reduced number of windows and the addition of a covering over the doorway.

TOWN OF MOREHEAD CITY RESOLUTION 2019-R-50

ENDORSING NC EAST SPORTS LOOKOUT SHOOTOUT FUN RUN AND AUTHORIZING ACTION NECESSARY FOR THE EVENT TO BE HELD SEPTEMBER 21st, 2019 IN MOREHEAD CITY

WHEREAS, NC East Sports [hereinafter called NCES], a private non-profit organization that desires to promote Morehead City and the surrounding area for tourism in the shoulder season, shall be responsible for conducting a boat poker FUN Run in Morehead City, North Carolina, on September 21st, 2019, with the Town of Morehead City providing solely ancillary services as requested by the NCES; and

WHEREAS, NCES requests to levy such fees as may be necessary to cover those costs associated with the planning, organizing, and conducting the Lookout Shootout Fun Run and these fees [e .g., registration] shall be in addition to any other City fees or license normally required to cover business activities;

NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Morehead City, North Carolina, in regular session that it wholeheartedly endorses the NCES Lookout Shootout Fun Run; and

BE IT FURTHER RESOLVED, that the Town Council of the Town of Morehead City, North Carolina authorizes the following:

1. The permission to use the City Dock's located at Jaycee Park at the end of 9th Street for the purpose of boat docking from Thursday September 19, 2019 through Sunday September 22, 2019.

2. The NCES is declared an independent contractor and is not an employee or agent of the Town of Morehead City and is solely responsible for the planning, organizing, implementing and monitoring of the activities.

3. The NCES is solely responsible in its capacity as an independent contractor to see such activities are canied out in compliance with all federal, state and local laws and regulations, and is carried out in a manner protecting the property rights of citizens and insuring the safety and well-being of citizens attending the activities.

4. The NCES shall indemnify, reimburse, keep and hold harmless the Town from any liability on account of any kind of haim or injury [including death], damage, or liability whatsoever to persons, firms, corporations, and prope1iy arising out of the occupation or use of the Town streets, sidewalks, parks, parking areas, buildings, toilet facilities, docks and any other prope1iy, buildings and facilities owned, leased or w1der the control of the Town within the areas occupied, used or controlled by the NCES or any exhibitor or vendor or invitee or from the sale of all foods, goods, products and beverages during the NCES's event and also, for any harm, claim or damage which may result directly or indirectly from the NCES 's failure to ca1Ty out this agreement, except the Town shall remain liable for any actions due to the negligence of the Town or its employees or due to the intentional wrongdoing of the Town or its employees. In the event that any suit or proceeding is brought against the Town at law or in equity, either independently or jointly with the_NCES or either of them, on account of any use or occupation of the Town streets, sidewalks, parks, parking areas, buildings, toilet facilities, docks and any other prope11y, buildings and facilities owned, leased, or otherwise controlled by the Town, the NCES or any vendor, and all foods, goods, products and beverages by any of them, the NCES will defend the Town with total cost accruing to the NCES including all reasonable attorney fees for the NCES and Town. The Town of Morehead City may select Counsel of its own choosing to consult with the NCES's attorney and/or participate in the defense of such suit or proceeding. In the event of final judgment or decree being obtained against the Town, either independently or jointly with the NCES or either of them, the NCES, to the extent provided herein, shall pay such judgment and all costs or comply with such decree and pay all costs and expense of whatsoever nature, including interest and fines, and hold the Town completely harmless therefrom. The indemnification and hold harmless obligations of the NCES will not be limited in any way by the limits of insurance provided for in the agreement.

5. The NCES shall secure liability insurance effective during the course of the activities. Limits of the policy shall be dete1mined by the City Manager. The kind of insurance required shall include, but not limited to comprehensive general liability, including personal injury, blanket contracting and non-owned auto.

6. The NCES shall be held responsible for any damage/loss to City property within the designated event boundaries and shall leave the ai·ea used as originally found.

7. The City Manager shall be the liaison person to the NCES and shall dete1mine the scope of ancillary City services to be provided to the NCES.

WHEREAS, a petition requesting annexation of an area described in said petition has been received by the Town Council of the Town of Morehead City; and

WHEREAS, G.S. 160A-31(c) provides that the sufficiency of the petition shall be investigated by the City Clerk before frnther annexation proceedings may take place; and

WHEREAS, the Town Council of the Town of Morehead City, deems it advisable to proceed in response to this request for annexation;

WHEREAS, Candace Walston has submitted a request to amend the Unified Development Ordinance to amend Article 11 by allowing an Arcade Club to operate as a special use in the Downtown Business (DB) District; and

WHEREAS, the Planning Board meeting date and Town Council Notice of Public Hearing date was published in accordance with G.S. 160A-3 64 in The Caiieret County News-Times, a local newspaper, once each week for two (2) successive weeks, said notice having been published the first time not less than 10 days prior to the date of such hearing; and

WHEREAS, in accordance with the provisions ofN01ih Cai·olina General Statute 160A- 383, the City Council does hereby find and determine that the adoption of the ordinance rezoning the following described property is consistent with the adopted land use plan and that the adoption of the ordinance rezoning following described property is reasonable and in the public interest due to its consistency with the land use plan and, as a result, its frniherance of the goals and objectives of the land use plan; and

WHEREAS, the said public meeting was actually conducted at 5:30 p.m., Tu~sday, September 101\ 2019, wherein a reasonable opportunity was given to all those in attendance to speak either in favor or against the said change or to make relevant comments;

WHEREAS, Candace Walston has submitted a request to amend the Unified Development Ordinance to amend Article 11 by allowing an Arcade Club to operate as a special use in the DB (Downtown Business) District; and

WHEREAS, effective October 1, 2017, North Carolina General Statute 160A-383 requires that "Prior to adopting or rejecting any zoning amendment, the governing board shall adopt one of the following statements which shall not be subject to judicial review: (1) A statement approving the zoning amendment and describing its consistency with an adopted comprehensive plan and explaining why the action taken is reasonable and in the public interest. (2) A statement rejecting the zoning amendment and describing its inconsistency with an adopted comprehensive plan and explaining why the action taken is reasonable and in the public interest. (3) A statement approving the zoning amendment and containing at least all of the following: (a) A declaration that the approval is also deemed an amendment to the comprehensive plan. The governing board shall not require any additional request or application for amendment to the comprehensive plan. (b) An explanation of the change in conditions the governing board took into account in amending the zoning ordinance to meet the development needs of the community. (c) Why the action was reasonable and in the public interest"; and

WHEREAS, this text amendment request was duly adve1tised and was the subject of a public 1 hearing before the Morehead City Council on September 10 \ 2019, during which the applicant, interested parties, and staff were given the opportunity to comment on the application; and

WHEREAS, the Morehead City Council has made the following findings and conclusions:

1. The Planning Board unanimously recommended approval of the request on August 2011\2019.

2. The proposed text amendment is consistent with the CA.MA Land Use Plan Vision Statement and does appear to be consistent with the following land use and development policies: • Section 4.2.2 Land Use Compatibility, Policies #1 and #2; and • Section 4.2.3 Irrfrastrncture Canying Capacity, Policy #6; and • Section 4.2.7 Areas of Local Concern, Policies #3, #8 and #9; and • Section 4.2.8 Neighborhood-Specific Policies, Neighborhood 1.

3. The proposed text amendment is in the public interest because: • The DB district is located within areas identified as Downtown Mixed Use on the Futme Land Use Classification Map. According to section 4.5A of the Morehead City Land Use Plan, "The Downtown Mixed Use classification is intended to delineate properties that can accommodate a variety of retail, office, business services and personal services." • Properties located within the DB district have adequate access to water and sewer services as well as adequate stJ.·eets to accommodate higher tJ.·affic volumes.

4. The proposed text amendment does not appear to conflict with other City plans.

NOW, THEREFORE, BE IT RESOLVED, on the basis of the foregoing findings and conclusions, that the Morehead City Planning Board does hereby find the request for text amendment to be consistent with the CAMA Land Use Plan and is in the public interest and recommends to the Morehead City Council that the request for text amendment be approved.

An Arcade Club is a family oriented establishment that features a combination of classic arcade games, gaming tables (such as air hockey or foosball) and/or pinball machines as we ll as draft beer from local and regional American breweries.

We propose to amend article 2.2 by adding Arcade Clubs as a classification.

We propose to amend article 11 by allowing an arcade club to operate in the CD and DB district as a special use business.

We propose to amend article 14 by allowing an arcade club to operat e in the CD and DB district as a special use business as an arcade while also serving alcohol, where food may or may not be served, under the following requirements:

• Hours of operation being Monday-Saturday 12pm-11pm. Closed Sundays. • Alcohol service areas will not be visible from the outside of t he business. • No arcade club shall play, operate, or caused to be played or operated, any amplified or non­ amplified musical instrument or sound reproductive device in a manner that causes a nuisance on any neighboring premises or public area.

Earlier in the year we working on amending the articles mentioned above for the CD district only, we retracted right before BOA due t o finding a better location. The new building is located in the DB district.

Public Services Director Daniel Williams will appear before the Town Council to present and request approval of the Waste Industries LLC contract extension until June 30, 2022. The amended contract includes a 1.9% cost of living increase for all services and a recycle processing fee of $.88 for each recycle cart service, both of which will be covered by the City's solid waste rate adjustment effective January 2020. Staff is reviewing a 3-year contract and replacement of all trash cans with new GFL cans.

At their August 20, 2019 meeting, the Public Utilities Committee recommended approval and presentation to the Town Council.

Amendment of Contract Agreement Between the Town of Morehead City and Waste Industries, LLC

Amendment of Contract between the Town of Morehead City and Waste Industries, LLC, dated July 1, 2007 and subsequently amended on July 1, 2014. Remainder of Terms and Conditions remain the same.

Reference: Mutually agreed upon contract updates.

Section 3 Collection Services-General

3. 10 Contractor will provide and deliver all new roll carts to approved service locations within the Town to receive residential service under this contract. Contractor will remove existing carts. Carts will remain property of Contractor. Contractor will replace all carts due to normal wear and tear (as needed) at no additional cost to Town.

All other terms and conditions in this section remain the same.

Section 7 Contract Term and Performance

7.1 Upon finding the Contractor's performance is satisfactory and that it is in the best interest of the Town to continue this Contract beyond the current term, therefore by mutual agreement, the parties agree to extend the current Contract until June 30, 2022. All other terms and conditions in this section remain the same.

Section 8 Rates

U There will be a 1. 9% Cost of living increase for all services for contract year July 1, 2019 through June 30, 2020. In addition, a recycle processing fee of $.88 each for each recycle cart service will be added. All other terms and conditions of this section remain the same.

In addition, the below items were discussed and mutually agreed upon as conditions to extend this agreement: 1 )Contractor will add a direct line and/ or extension in our Newport Branch for your offices' use to enable your team to forward or direct calls to our facility for resolution. 2) Town will continue to deliver or replace carts at this time. Contractor provides carts.

3) We will include updated literature pertaining to recycling and other cart guidelines when we deliver all new trash carts to Town approved residential customers.

4) We will switch out eight (8) cubic yard dumpster in town owned parking lot on waterfront. 5)We will work with Town IT department to add a link to Contractor website for better communications and customer service.

6) We will schedule the waterfront service for first thing on Monday mornings.
