Chairman of the Editorial Board Predseda Redakčnej rady Štát a právo 1-2 / 2018 2 Účasť na štátnej moci a politika štátu v oblasti kultúry a školstva národnostných menšín a etnických skupín Jaroslav Chovanec Abstrakt: Autor v štúdii rozoberá a hodnotí: „Účasť na štátnej moci a politika štátu v oblasti kultúry a školstva národnostných menšín a etnických skupín.“ Pritom zdôrazňuje, že štátotvorný národ (Slováci) tvorí s príslušníkmi národnostných menšín štát, garantujúci im menšinové práva. Ide o politický národ – občanov Slovenskej re- publiky, národ ako politický subjekt, teda občania ako zdroj moci podľa Ústavy SR čl. 1 ods. 2 ako subjekt štátu. Právny poriadok Slovenskej republiky zakotvuje, že každá národnostná menšina alebo etnická skupina má právo v súlade so zákonom o združovaní občanov, združovať sa do spolkov a rôznych politických hnutí a združení. Prostredníctvom politických strán a hnutí sa môže uchádzať o účasť na štátnej moci, a to spôsobom, ktorý ustanovujú volebné zákony do zákonodarného zboru (NR SR) a do samosprávnych celkov krajov. Na základe posledných výsled- kov všeobecných volieb do NR SR, ktoré boli v r. 2016, t.j. funkčné obdobie 2016-2020 má maďarská národnostná menšina pro- stredníctvom strany MOST – HÍD zastúpenie v Národnej rade SR 8 poslancov maďarskej národnosti a 7 poslancov v slovenskej národnosti – spolu 15 a vo vláde SR má 3 ministrov a z toho ministerku spravodlivosti a zároveň podpredsedníčku vlády SR. Národná rada SR ako jediný ústavodarný a zákonodarný orgán si okrem iných výborov zriaďuje i Výbor Národnej rady SR pre verejnú správu, územnú samosprávu a národnosti. Vláda SR ako vrcholný orgán výkonnej moci si zriadila Radu vlády pre ľudské práva, národnostné menšiny a rodovú rovnosť. Ide o porad- ný, iniciatívny a koordinačný orgán vlády SR pre otázky národnostnej politiky. Okrem uvedeného vláda SR zriadila i vládnych splnomocnencov vlády pre rómsku komunitu a vládneho splnomocnenca pre ľudské práva, národnostné menšiny a rodovú rovnosť. Slovenská republika uskutočňuje národnostnú politiku štátu aj v kultúrnej oblasti, dotýkajúcu sa bezprostredne života národnostných menšín a etnických skupín, ktorá smeruje k zachovaniu ich kultúrnej, jazykovej a národ- nej identity, a to predovšetkým finančnou podporou (dotáciami) ich aktivít, najmä v spoločensko-kultúrnom živote. V rámci nej zabezpečuje vydávanie periodickej tlače pre všetky národnostné menšiny žijúce v Slovenskej republike, ktoré sa uskutočňuje prostredníctvom finančnej podpory Ministerstva kultúry Slovenskej republiky. Podporuje vydávanie aj neperiodickej tlače, t. j. vydávanie kníh pre národnostné menšiny a etnické skupiny na základe schválených projektov a gran- tov. V tejto súvislosti sa žiada poukázať na skutočnosť, že vláda SR schválila v marci 2017 návrh zákona o Fonde na podporu kultúry národnostných menšín. Ide Dr. h. c. prof. JUDr. Jaroslav Chovanec, CSc. Okrem toho z určeného príspevku na čin- nosť príspevkových organizácií alikvótnym podielom (podľa počtu obyvateľov) financuje kultúrne aktivity národnostných menšín a etnických skupín. V tejto ob- lasti môžeme ako príklad uviesť, že v Slovenskej republike pôsobia dve profesio- nálne maďarské divadlá, a to v Komárne od roku 1952 Jókai Sziház a v Košiciach Thália od roku 1969 podnes. Okrem týchto dvoch divadiel maďarskej menšiny pôsobia v Slovenskej republike ďalšie dve profesionálne divadlá. Jedno rusín- sko-ukrajinské, ktoré pôsobí v Prešove, a jedno rómske v Košiciach. V oblasti maďarskej národnostnej kultúry v rámci Slovenskej republiky existuje i maďarské národnostné múzeum, a to Podunajské múzeum v Komárne a dve galérie v Dunaj- skej Strede. Okrem toho existuje a pôsobí i profesionálny maďarský národnostný súbor Mladé srdcia (Iljú Szívek). Ďalej treba poukázať i na skutočnosť, že Ministerstvo kultúry Slovenskej republiky financuje i vysielací čas vo verejno- právnych inštitúciách (Slovenský rozhlas, Slovenská televízia) pre národnostné menšiny a etnické skupiny. Ako príklad môžeme uviesť, že Slovenský rozhlas vysiela v maďarskom jazyku viac ako 40 hodín týždenne a Slovenská televízia vysiela každý deň spravodajstvo a rôzne relácie v stanovenom čase, najmä v jazy- ku maďarskom a rómskom, ale tiež i v jazyku iných národnostných menšín žijúcich v Slovenskej republike. V súvislosti s uskutočňovaním práv národnostných menšín a etnických skupín v oblasti kultúry považujeme za potrebné poukázať i na reali- záciu práv o združovaní sa občanov do politických strán, hnutí a občianskych združení resp. spolkov i občanov patriacich k národnostným menšinám a etnickým skupinám v Slovenskej republike. Toto ústavné právo príslušníkov národnostných menšín a etnických skupín žijúcich v Slovenskej republike sa v plnej miere uplat- ňuje i v spoločensko-politickej praxi. Na dôkaz toho môžeme uviesť, že v Sloven- skej republike je na ministerstve vnútra registrovaných 32 politických strán národ- nostných menšín, z toho 10 politických strán, ktoré reprezentujú maďarskú národnostnú menšinu a 21 politických strán, ktoré reprezentujú rómsku národ- nostnú menšinu a 1 politická strana rusínsko-ukrajinská. Okrem toho sú na Minis- terstve vnútra Slovenskej republiky registrované rôzne spolky a kultúrne zväzy národnostných menšín. Okrem uvedeného treba ešte poukázať, že po Nežnej revo- lúcii v roku 1989 Rómovia založili profesionálne divadlo Romathan, ktoré je do- tované zo štátneho rozpočtu. V tomto období vznikla i stredná umelecká škola pre talentovanú rómsku mládež. Rómovia ako autori vypracovali rómsky šlabikár a čítanky v rómskom jazyku, ako aj jazykový rómsky slovník a učebnice rómčiny. Tieto aktivity Rómov podporoval i financoval štát – SR. Štát začal podporovať i vydávanie periodickej aj neperiodickej rómskej tlače, rozhlasového a televízneho vysielania v rómčine. Záverom tejto podkapitoly môžeme jednoznačne konštatovať, že štát – SR svojou kultúrnou národnostnou politikou zabezpečuje kultúrny rozvoj národnostných menšín, ako aj ich kultúrnej národnostnej identity. Slovenská republika v oblasti národnostného školstva uskutočňuje svoju politiku prostredníctvom Ministerstva školstva, vedy, výskumu a športu SR: „v predškol- ských zariadeniach, základných školách, stredných školách, špeciálnych školách a školských zariadeniach s vyučovacím jazykom alebo vyučovacím jazykom ná- rodnostných menšín“. V tejto súvislosti treba poukázať na skutočnosť, že v súčas- nosti sa uskutočňuje v Slovenskej republike vzdelávanie na všetkých stupňoch škôl v materinskom jazyku národnostných menšín a to maďarskej,

The considerations presented in this article are an addendum to the issues related to the policy of the authorities of the Second Republic of Poland on national minorities and its influence on the internal security of the state. This subject was undertaken by the Author earlier when he analysed the activity of the represen- tatives the German and Ukrainian minority. The article presents potential factors which can destabilise internal security, especially at the social level, as a result of forces in the envi- ronments of the indicated national and ethnic minorities in the II RP. The presented argu- ments allow to conclude that during the whole interwar period the II RP authorities had to struggle with multiculturalism related to the presence of Belarusian, Lithuanian, Jewish and Silesian minorities because in their environment centrifugal forces were occurred many ti- mes and posed a threat to the internal security of the newly re-established Polish state.

    Wall and Window The rubble of the Warsaw Ghetto as the narrative space of the POLIN Museum of the History of Polish Jews* Konrad Matyjaszek Abstract: Opened in 2013, the Warsaw-based POLIN Museum of the History of Polish Jews is situated in the center of the former Nazi Warsaw ghetto, which was destroyed during its liquidation in 1943. The museum is also located opposite to the Monument to the Ghetto Heroes and Martyrs, built in 1948, as well as in between of the area of the former 19th-century Jewish district, and of the post-war modernist residential district of Mu- ranów, designed as a district-memorial for the destroyed ghetto. Constructed on such site, the Museum was however narrated as a “museum of life”, telling the “thousand-year-old history” of Polish Jews, and not focused directly on the history of the Holocaust or the history of Polish antisemitism. The paper offers a critical analysis of the curatorial and architectural strategies assumed by the Museum’s de- signers in the process of employing the urban location of the Museum in the narratives communicated by the building and its core exhibition. In this analysis, two key architectural interiors are examined in detail in terms of their correspondence with the context of the site: the Museum’s entrance lobby and the space of the “Jewish street,” incorporated into the core exhibition’s sub-galleries presenting the interwar period of Polish-Jewish history and the history of the Holocaust. The analysis of the design structure of these two interiors allows to raise the research question about the physical and symbolic role of the material substance of the destroyed ghetto in construction of a historical narrative that is separated from the history of the destruction, as well as one about the designers’ responsibilities arising from the decision to present a given history on the physical site where it took place.

Dziekonski The copyright over the translation has been granted to the translator by the copyright holder of the original Polish text, and I authorize the University of Washington Libraries to make the full text of the English translation available to readers worldwide. TRANSLATOR’S NOTE The original Polish version of this book was written in the 1980s under communist rule, and remained dormant in a censor’s office for over a year. The author was ordered to alter various references concerning the Teschen dispute in 1938 and the Soviet invasion of Poland in alliance with the Nazis in September, 1939. Although the author expressed satisfaction at the eventual compromise between mandated omissions and academic integrity just prior to publication, the translator has made an attempt to add a few footnotes to provide some balance to the narrative. Regarding the customary problems with geographical locations in multiple languages, most locations described in First World War battles on the eastern front in which the Legions were involved and the post-war military operations in the Ukraine, Byelorussia, and Lithuania are in Polish. Otherwise, respective languages for whichever countries in which the geographic locations happened to be situated at the time are used. English names were used for those which possess them, such as “Warsaw,” “Cracow,” “Kaunas,” etc. Numbered footnotes are mostly identical to those in the original text and are listed at the end of each respective section. Footnotes with an asterisk at the bottom of the page are citations which the translator has added.

Creating the National Identity on the Polish-Lithuanian Borderland abstract The authors are discussing the shaping of the national identity of Polish-Lithua- nian frontier denizens, regarding the historical events of the 20th century. In the first part of the article, they present a brief historical sketch of Polish-Lithua- nian relations, putting significant emphasis on the moment of the Sejny uprising beginning, that is August 22nd, 1919. Reclamation of independence after World War I put both countries in a challenging position of building own national- ity image. Defining own territorial affiliation of the Sejny region spawned an exceptionally harsh conflict between Poles and Lithuanians, leading to the upris- ing. The results of these events echo in Polish-Lithuanian relations in the Sejny region to this day. The second part of the article is devoted to the presentation of the multidimensional and constantly created identity concept by Jerzy Nikitoro- wicz, as an introduction to considering the shaping process of identity among youth of the cultural borderland. The authors point to the fact how important it is to find a platform of dialogue for both parties. They explain selected activities regarding intercultural education, accomplished in local environments by the “Borderland of arts, cultures and nations” center animators in Sejny.     A Triumphant Gate of the Polish Narrative The Symbolic Reconstruction of the Bridge over Chłodna Street in Warsaw vis-à-vis the Crisis of the Dominant Polish Narrative of the Holocaust Elżbieta Janicka Abstract: The article is a study of the symbolic topography of Warsaw’s Chłodna Street. In 1940–1942, Chłodna Street was an “Aryan” border strip, dividing the small and large ghettos. For the past quarter-century, the symbo- lic dominance of this space has been made manifest by the subsequent commemorations of the ghetto’s wooden footbridge that existed here between January and August 1942. These commemorative artefacts evolved from a counter-commemoration (1996), into a commemoration through the use of painting (2007) and photography (2008), into a symbolic reconstruction of the bridge (2011). The analysis of this dynamic, from representation of an object to its materialization, is complemented by a reconstruction of the patterns and stakes of narratives that make up the subsequent layers of the Chłodna Street narrative palimpsest. An important context for the analysis, apart from the history of the site, is the fact that today, the means of control over the space of the for- mer Ghetto are in the exclusive possession of the non-Jewish majority. A turning point in the commemoration process was Roman Polański’s film The Pianist (2002). The bridge over Chłodna was reconstructed “one to one” – in Warsaw but outside the space of the former Warsaw ghetto. The film was shot in the midst of a nationwide debate taking place in Poland about Jan Tomasz Gross’ book Neighbors (2000).
