ALPINE SHIRE COUNCIL Notice of Intention to Make a Local Law Governance Local Law (2020) At its ordinary council meeting on 7 July 2020, Council endorsed the proposed Governance Local Law (2020) for the purpose of seeking public submissions. In accordance with section 119(2) of the Local Government Act 1989, the objectives of the proposed local law are to: – regulate the use of the Alpine Shire Council Common Seal; – provide for offences in relation to unauthorised use of the Common Seal or any device resembling the Common Seal; and – provide for offences in relation to Council meetings and Delegated Committee meetings. Plant Biosecurity Act 2010 ORDER DECLARING A RESTRICTED AREA IN NORTHERN VICTORIA FOR THE CONTROL OF QUEENSLAND FRUIT FLY I, Jaclyn Symes, Minister for Agriculture, being of the reasonable belief that Queensland fruit fly (Bactrocera tryoni (Froggatt)) is present in Victoria, make the following Order under section 32(1) of the Plant Biosecurity Act 2010 declaring the area described in clause 6 and the Schedule to this Order to be a restricted area. 1. Objectives The objectives of this Order are – (a) to declare a restricted area for the control of Queensland fruit fly in Victoria; and (b) to specify the prohibitions, restrictions and requirements which are to operate in relation to the restricted area. 2. Authorising provision This Order is made under section 32(1) of the Plant Biosecurity Act 2010 (‘the Act’). 3. Commencement This Order comes into operation on the day that it is published in the Government Gazette. 4. Revocation The Order entitled Order declaring a restricted area in northern Victoria for the control of Queensland fruit fly, made under section 32(1) of the Plant Biosecurity Act 2010 and published in Victoria Government Gazette G27 on 4 July 2019 at pages 1304–1307, is revoked. 5. (c) The owners and occupiers of land in the restricted area described in clause 6 and the Schedule must give an inspector access to such land for the purposes of inspection, deployment of any lures or traps, application of any treatment or performance of any other actions which are necessary for the eradication or prevention of spread of Queensland fruit fly. 9. Inspector may issue directions An inspector is authorised to issue a direction to any owner or occupier of any land found within the area of land in the restricted area described in clause 6 and the Schedule requiring the owner or occupier to – (a) strip Queensland fruit fly host material from plants, and collect and dispose of that material; or (b) treat or destroy that material. 10. LATE NOTICES BOROONDARA CITY COUNCIL Public Notice Inviting Submissions Boroondara City Council is considering making a local law to be known as the ‘Common Seal and Conduct at Meetings Local Law’. The following information about the proposed local law is provided in accordance with section 119 of the Local Government Act 1989 (the Act): Purpose of the Proposed Local Law The purpose of this Local Law is to: revoke Council’s Meeting Procedure Local Law 2017; regulate the use of the common seal; prohibit unauthorised use of the common seal or any device resembling the common seal; and create offences relating to the conduct at Council and delegated Committee meetings. General purport of the Proposed Local Law The proposed local law, if made, will: regulate the storage and use of the common seal; establish a law which will maintain order at meetings; and create enforcement mechanisms for contravention of the proposed local law, which may incur a penalty specified in the proposed local law. A copy of the proposed local law and community impact statement may be obtained from Council’s website, www.boroondara.vic.gov.au Any person affected by the proposed local law may make a submission relating to it to the Council. All submissions received by the Council within 28 days of the publication of this notice will be considered in accordance with section 223 of the Local Government Act 1989. Any person making a submission is entitled to request (in the submission itself) to be heard in support of the submission by appearing before a meeting of Council (either personally or by a person acting on his or her behalf). CITY OF BALLARAT Notice of Proposed Common Seal and Meeting Conduct Local Law Notice is hereby given that Council, at its meeting of 8 July 2020, resolved to give public notice of its intent to make a new Common Seal and Meeting Conduct Local Law. Such notice is given in accordance with section 119 of the Local Government Act 1989 (the Act). The Council has commenced the process of developing the new Common Seal and Meeting Conduct Local Law to replace Meeting Procedure Local Law 2018. The review has been undertaken by Council officers from all relevant departments and consultation with Council. With the development of new Governance Rules as part of the implementation of the Local Government Act 2020, many elements of the Governance Rules are derived from the Meeting Procedures Local Law 2018. It is proposed that the new Governance Rules will embed the meeting procedures of Council; and thus, replicate the Meeting Procedure Local Law 2018. Therefore, in order to prevent duplication between the instruments, it is proposed that the remaining elements that are still required in the Meeting Procedure Local Law be developed into the new Common Seal and Meeting Conduct Local Law. The draft Common Seal and Meeting Conduct Local Law has been prepared with reference to the state government’s guidelines for local laws. The matters addressed by the proposed Common Seal and Meeting Conduct Local Law include the following: Regulation and use of Council’s Common Seal; Meeting conduct requirements; and Offences. A copy of the draft Common Seal and Meeting Conduct Local Law together with a Community Impact Statement has been prepared and are available for viewing on the City of Ballarat’s website and for inspection at the Ballarat Library, 178 Doveton Street North, Ballarat. Any person may make a written submission to Council under section 223 of the Local Government Act 1989. Written submissions must be received by the City of Ballarat by 5.00 pm, 5 August 2020. Written submissions should be addressed to the Executive Manager Safety, Risk and Compliance Services, City of Ballarat, and sent by mail to: PO Box 655, Ballarat 3353. Any person who has made a submission under section 223 of the Act and has requested to be heard in support of their written submission, is entitled to appear in person or to be represented by a person specified in the submission before the Council. Submissions to be heard will be presented at the 12 August Ordinary Council meeting. The proposed Local Law will be then considered at the additional Council meeting to be held on 26 August 2020. The time and place of the Council meeting will be advised in writing.
