1. The Speaker opened the sitting at 8.40 am.
2. The Hon. Robert SARKI said the prayer.
3. The Hon. Speaker read the agenda.
4. The Hon. Vincent BOULEKONE asked the house if it was possible to adjourn the sitting for one day in order that MPs could study the bills.
5. The Hon. Speaker explained that there was ambiguity in Standing Orders 26(2) and 14(3) and considered that the Standing Orders Committee should examine it. He also pointed out that members should decide in Parliament whether or not to continue the sitting.

Flme le D6put6 Hilda LINI fait eavoir qu'alle n'avait regu les projets de loi que ce matin, at approuve la suggestion du Ddputd Uincent BOULEKONE de suspendre la stance, mais seulement pour la dami-journde. 7. The Hon. Prime Minister, Fr. Walter LINI indicated that the Standing Orders were not clear on the period of notice to be given to members for ordinary and extraordinary sessions. He said chat most of the bills concerned amendments of figures and were not long and that members would ask, the same questions in Parliament if they examined these bills today or Che next day. He considered that Parliament should continue with the sitting according to the agenda.
8. The Hon. Tele TAUN pointed out that the bills were very short and expressed support for the suspension of the Standing Orders for half a day.
9. The Hon. Wilson TARISEVUTI considered that it was not necessary to take a long time to study the bills and that the sitting could continue.
10. The Hon. Vincent BUULEKONE proposed and seconded by the Hon. Joseph JACOBE that the sitting be adjourned until 8.30 the next morning.
11. The Hon. Speaker accepted the proposed motion.
12. The sitting was suspended at 0930.

14. The Hon. Vincent BOULEKONE informed the House that with the consent of the seconder of the motion, he had decided to withdraw the motion.

19. The Hon. Minister Sela MOL1SA introduced the bill explained its purpose anS
provisions and moved that the bill for the Economic and Social Development Loans (Issue of Bonds) (Amendment) Act No. of 1989, be read a first time.
20. The Hon. Joseph JACOBE asked whether government loans were used for
economic and social developments.
21. The Hon. Andrew WELWEL supported the bill especially if the government hoped to increase Che amount of loans to help development projects.
22. The Hon. Minister Sela M0L1SA explained that money raised through this law was to help finance development projects which would contribute to improving the economy of the country.
23. The Motion that the bill for the Economic and Social Development Loans (Issue of bonds) (Amendment) Act No. of 1989, be read a first time was carried unanimously.

PREMIERE LECTURE 28 M. le Premier Ministre Father Walter H. LINI presents le projet de loi et propose qu’il soit examine en premiere lacture et adoptd. 29. The Hon. Vincent BODLEKONE felt that this repeal would help the govern ment financially. He asked how many years the bonds would be issued for. •
30. The Hon. Minister Sela MOLISA explained that interest rates on loans were high at the moment. He added that there was no problem in raising funds and guaranteeing payments through the Reserve Bank. He explained that bonds were for 15 years.

BILL FOR THE CRIMINAL PROCEDURE CODE (AMENDMENT) ACT NO. OF 1989

36. The Hon. Prime Minister, Fr. Walter LINI introduced the bill, explained its purpose and moved that the bill be read a first time.
37. The Hon. Vincent BOULEKONE expressed reservations about the removal of assessors in the Supreme Court as they had an important democratic role to play. He nevertheless indicated that the assesors were very often influenced by personal sentiments. He added that he would abstain in the voting.
38. The Hon. Minister Donald KALPOKAS supported the bill. He indicated that in Vanuatu assessors very often influenced judges and that the government considered that a judge was sufficient for a case. He said that in other countries, assessors formed the jury, which had certain rules to follow in cases. 29. 1*1. le Chef de 1‘Opposition, 1*1. 40. The Hon. Hilda L1NI supported the bill and explained that experience showed that assessors did not know their role.
41. The Hon. Wilson TAKI SEVUTI supported the bill and said there was no need for assessors.
42. The Hon. Minister Sethy REGENVANU expressed support for the bill as it would help rid Vanuatu out of its Colonial legacy. He said there was no need for assessors as the laws of the current court system were clear.
43. The motion that the bill be read a first time was carried with 30 votes in favour and 5 abstentions.

4. The Hon. Prime Minister, Fr. Walter H. LINI introduced the bill, explained its purpose and provisions and moved that the bill for the Penal Code (Amendment) Act No. . of 1989 be read a first time.
5. The Hon. Hilda LINI asked for a brief explanation of separate offences concerned in Che bill.
6. The Hon. Andrew WELWEL supported the bill. He said he thought the whole principal act should be amended.
7. The Hon. Jack Kalo NIAL supported the bill and commented that it was appropriate and important for the government to tighten some laws in the country and increase penalties in order to maintain law and order for the

Vincent BOULEKONE, Leader of the Opposition considered that the details of offences and their new penalties should be published. He added that imprisonment was not sufficient and that with the help of churches and political chiefs, and educational system and various organised activities could be instituted in prisons in order to enable convicts to reintegrate into society when they left prison. He explained that it was necessary to have three separate prisons : one for adolescents,one for women and one for men.

41. The Hon. Minister Jimmy 0. METO made a statement in Bislama concerning the - current dengue fever epidemic in Vanuatu, (stament appended) and asked
Parliament to discuss it.
42. The Hon. Vincent BOULEKONE thanked the Hon. Minister of Health and stated that the population had not followed Che advice given by the Health Department in order to eradicate this epidemic. He added that the government had not taken sufficient measures Co get rid of dengue mosquitoes. He declared that the Municipality and Che government had to do all they could to clean up the two towns and was convinced chat Vanuatu would receive foreign aid for this if it was requested.
43. The Hon. Hilda LINI wondered whether people were aware of dengue symptoms and asked whether traditional medicine could be used since no cure was known for this illness.
44. The Hon. Tele TAUN stressed the seriousness of this disease and asked the Minister of Health if measures were to be taken to help islands who have no hospitals.
45. The Hon. George BAET commented that this illness was serious, that there was no treatment to cure it, only paracetamol for lessening the pains.
46. The Hon. Jimmy C. METO in response said that dengue fever was a sickness w which needed to be studied by doctors. He added that it was important and urgent to Lake measures to eradicate th is epidemic. <
47. The Hon. Prime Minister, Er. Walter LINI explained that Radio Vanuatu had put out many programmes concerning dengue fever since January 1989. He added that the dengue mosquito was everywhere and bit at any time of the day or night, and Lhat it was up to individuals to try and eradicate this illness by getting rid of musquitos by cleaning up gardens and the environ ment. He stressed that advice had already been given on the treatment of this illness and repeated that people should take only paracetamol but not any medicine with aspirin content. 39. The Hon. Minister Sela MOLISA explained that the VCMB was a legally established body which was responsible for copra, the nation's most important industry. He added that the main functions of the Board were laid down in Section 6(1) and (2) of Act No. 10 of 1981. He pointed out that the country’s main commodities were copra and cocoa but coffee and kava were under coneide- ration. He informed the House that Vanuatu signed the LOME III agreement in Togo in December 1984. He said that STABEX helped to stabilise copra prices, diversify Lhe economy and encourage livestock. He continued that Vanuatu may claim compensation from STABEX and recently Vanuatu received Vatu 2.000 million. He stated that the stabilisation fund for cocoa would be dispensed through the STABEX fund of 1988 and commented further that EEC had to approve all proposed projects on which Vanuatu intended to spend STABEX funds. He agreed chat the principal Act required an annual report to be submitted by the Board.
69. The Hou. Minister Sethy REGENVANU supported Che principles of the bill. He explained chat the VCMB was a statutory body and asked its members to per suade people to produce more copra.

70. The Hon. Hilda L1NI supported the principles of the bill but asked whether the contract required the General Manager to work under a probation period before being given a permanent post. She questioned whether there was a section in the contract which authorised the Minister or Board to terminate the service of the General Manager before 5 years.
71. The Hon. Minister Sela MOLISA supported the Hon. Minister Sethy REGENVNAU’s point of view. Concerning the terms and conditions, he explained that the Board could tercninate the contract if the General Manager was incapacitated or guilty of professional misconduct. He continued that normally there was no ’ probation period.
72. The Hon. Vincent BOULEKONE , Leader of Che Opposition stated that the Opposition would not accept some of the arguments raised by the government. He asked Che Minister to clarify the activities, management, budget and revenues of the VCMB. 68. Il explique que ces fonda aont d6poa6a dans un Fond de Reserve at sont utilises & diversifier P6conomie, stabiliser le prix du coprah et d^uelopper l'dlevage. 34. The Hon. Prime Minister, Fr. Walter LINI pointed out that the freedom of expression referred to in the Constitution remained unchanged. He said that the purpose of Che bill was to allow the applicant more time to appeal and also for the Minister to consider the application. The bill also permitted the applicant to sue the government if he wished to, he added. He explained that if Vanuatu were to maintain its status as a democratic state, they would have to legislate for public order.

Hilda LINI was unsure whether the section which referred to assembly also applied to other islands apart from the two towns. She wanted to know the number of persons forming a group which was required to apply to the Minister.
37. The Hon. Minister Iolu ABBIL answered that the bill covered the whole country and applications were required for all sorts of assembly which the public has easy access to. He said that an assembly of more than one person required an application. He stated that police officers or Local Government Secretaries in the rural areas may be empowered to consider applications.
38. The Hon. Hilda LINI felt that the bill would prevent people from holding meetings if it were to cover the whole country and also it would cause more problems because it would not be easy to apply for permission. She was pleased to learn that the bill may be amended in futurre if necessary.
39. The Hon. Prime Minister Fr. Walter LINI declared that in most cases the Minister would allow the event to take place but in cases where the possibi- 4 lity of damage or injury existed, the Minister would have to take more time to consider. He said that the bill required the individual only to inform the Minister and iLs purpose was to introduce some tough penalties. He emphasised that a country needed to be controlled by laws without which there would be chaos and instability.
40. The Hon. Minister lolu ABBIL said that the Minister would always have to have good reasons for refusing applications and any rejected application wouLd be on the grounds chat it may result in danger to public order. He pointed out that any person who refused to follow the Minister’s decisions would have to take the responsibility tor any problems caused.
41. The Hon. Minister Sethy REGENVANU felt that any law-abiding citizen should not be afraid of the laws. He said that the Constitution provides freedoms and also obligations. He stated that the purpose of the bill was to allow more time for preparation of the event and that better organisation would reduce the risk of problems.

34. The Hon. Minister Sela MOLISA tabled the bill, explained its purpose and moved that the bill be read a first time and pass.
35. The Hon. Hilda LINI asked for the equivalent of 35 million french francs in vatu.
36. The Hon. Minister Sela MOLISA in reply explained that 35 million french francs was approximately 550 million vatu, depending on the exchange rate.
37. The Hon. Kalkot MATASKELEKELE supported the bill in principle and aaid that the development of a telecommunications infrastructure would encourage other developments such as finance centre^.
38. The Hon. Jack Kalo N1AL supported the bill and asked whether the government could not borrow the money from any other organisation apart from Caiase Centrale for this telecom project.
39. The Hon. Minister Sela MOLISA thanked the various members for their comments and support of the bill. In response to the Hon. Jack K. NIAL’s question he explained that the government had nego .tiated the loan for the telecoms project with Caiase Centrale because it offered better conditions than other banks. BILL FOR THE NATIONAL HOUSING CORPORATION (AMENDMENT) ACT NO. OF 1989
FIRST READING
52. The Hon. Minister Sela MOLISA moved that the bill be read a first time.
53. The Hon. Hilda LINI supported the principles of the bill and asked the Minister to inform the House of the number of employees currently employed by the NHC.
54. The Hon. Robert SAKKI supported the principles of the bill and felt chat a contract of 5 years would be sufficient for the re-structuring of the Corporation. He wished to see the corporation assist housing schemes in the rural sectors. *
55. The Hon. Vincent BOULEKONE supported the Hon. Robert SAKKI'a point of view^ and hoped to see sufficient decentralisaiton of government revenues because the NHC was a body set up to benefit the whole population and not only people in the urban areas.
56. The Hon. Jack Kalo N1AL expressed his support for the bill and said housing was a major need in most parts of the nation. He asked whether Che NHC would cater for housing needs in the two towns.
57. The Hon. Prime Minister, Fr. Walter LINI hoped to see the NHC expand its activities to the rural areas. He wanted to see the NHC agree on some other forms of loan repayments such as repayments in kind.
58. The Hon. Minister Sethy REGENVANU said that the NHC should share the benefits amongst the Local government regions, but he said Chat, until there was land settlement in the rural areas, it would be difficult for Che NHC to extend its activities to other Local Government Councils.
59. The Hon. Minister Sela MOLISA responded that the NHC was currently employing 5 employees and said the number of staff would be kept at a minimum to reduce costs. He pointed out that the NHC would not expand its activities to areas where there were land disputes or where land was not leased.
