TREMPEALEAU COUNTY DRIVEWAY CONSTRUCTION REQUIREMENTS

The following is a list of requirements and considerations when constructing new driveways in Trempealeau County.

DRIVEWAY REQUIREMENTS:

1. Failure to obtain a driveway permit is considered a criminal offense in Wisconsin per Wis. Stat. §86.07(2) and is punishable by a fine of not less than $50 nor more than $500 or imprisonment not to exceed six (6) months or both.

4. In addition to the requirements outlined herein, all driveways exiting and entering subdivision lots must satisfy the applicable requirements outlined in section 6.05 of the Trempealeau County Comprehensive Zoning Ordinance.

5. Except in cases where the indicated driveway may be constructed by forces acting on behalf of the County in relation to a highway construction or reconstruction project, the permittee shall furnish all materials, do all work, and pay all costs in connection with the construction of the driveway and its appurtenances on the right-of-way. Materials used and the type and character of the work shall be suitable and appropriate for its intended purpose, and the type of construction shall be as designated and subject to approval of the County. The permittee shall make the installation without jeopardy to or interference with using the highway. Highway surfaces, shoulders, ditches, and vegetation disturbed, including drainage appurtenances, guardrail, signs, electric conduits/cables, etc. (collective facilities), shall be restored to at least pre-existing conditions. In every instance, the subsequent maintenance of the driveway and it appurtenances within the limits of the highway right-of-way shall be the responsibility of the permittee, who shall be obligated to pay all costs and accomplish all works necessary in relation to said maintenance. Any highway facilities disturbed by operations relating to maintenance of the driveway shall be promptly restored by the permittee to the satisfaction of County. No survey markers shall be disturbed without the prior approval of the County.

6. The permittee must receive written approval from the County prior to changing the type of driveway use granted herein. The County will evaluate all potential highway impacts that could arise from the proposed change and therefore, cannot guarantee that the change will be approved. No revision or additions shall be made to the driveway or its appurtenances on the right-of-way without written permission of the County.

7. The County reserves the right to make such changes, additions, repairs, relocations and removals within statutory limits to the driveway or its appurtenances on the right-of-way that may at any time be considered necessary to facilitate the relocation, reconstruction, widening, and maintaining of the highway, or to provide proper protection to life and property on or adjacent to the highway.

8. Vertical rock, bituminous, , timber or other embankment retention methods or other driveway making treatments are prohibited. The summer and winter maintenance of the driveways to the edge of the for unpaved driveways and to the edge of the pavement for paved driveways shall be responsibility of the permittee.

9. Driveways to be constructed within 500 feet of state highway must receive Wisconsin Department of Transportation approval.

10. The number of driveways permitted serving a single property frontage along a county trunk highway shall be the minimum deemed necessary by the County for reasonable service to the property without undue impairment of safety, convenience, and utility of the highway. The island area on the right of way between successive driveways or adjoining a driveway and between the highway shoulder and right-a-way line shall remain unimproved for vehicular travel or parking.

11. For all single family residential and duplex residential uses, driveways shall be at least 12 feet wide and not more than 24 feet wide extending 50 feet back from the highway centerline.

12. Driveways for all other uses, except agricultural uses, shall be at least 20 feet wide and not more than 35 feet wide extending a minimum of 50 feet back from the highway centerline. Such drives may be reduced to 12 feet wide if they are enter-only or exit- only drives.

13. Intersection with highway. All driveways shall intersect a public highway at a 90 degree angle. All driveways shall be sloped down from the highway edge for at least 20 feet from the highway edge so the elevation of the driveway is at least 6 inches below the level of the highway at a point 20 feet from the edge of the highway.

14. Driveways shall be covered with either , asphalt pavement, or gravel at the time of occupancy.

15. Driveways shall have a minimum 24 foot culvert with a 15 inch minimum diameter. (The culvert requirement shall remain in effect unless the highway agency with jurisdiction grants an exception). Apron end walls may be required.

16. Driveways shall be constructed so that runoff water does not flow onto the highway pavement

17. Setback. All Driveways shall be placed such that the driveway edge nearest to an adjoining property owner's lot line is at least 5 feet from the lot line, unless driveways are shared by adjoining property owners.

18. Grade. All Driveways shall accommodate emergency vehicles. The maximum grade for driveways serving dwelling units constructed after the effective date of this ordinance shall be 20%. Any applicant seeking to construct a driveway, any portion of which shall contain a grade in excess of 20%, may seek a Conditional Use Permit from the Zoning Committee, and present any plans and information which demonstrate that the steeper grade satisfies driveway requirement.

19. Site Distance. Driveways shall be so located to have a minimum 400-foot sight distance in either direction. A greater sight distance may be required at the discretion of the highway agency with jurisdiction. A driveway shall be so located and constructed that vehicles approaching or using it will have adequate sight distance in both directions along the highway.

DRIVEWAY CONSIDERATIONS

1. Carefully design your driveway in such a fashion that emergency vehicles will be able to service your structure(s) in the event of an emergency.

2. It is recommended that your driveway be a minimum of 12 feet wide and have 2-foot shoulders and have an 18-foot minimum elevation clearance.

3. Attempt to locate your driveway entrance/exit where you can have the maximum amount of sight distance for highway safety.
