300. Replacing of Seat : Pinner Road, : That, in response to a letter, dated 15th February, 1945, the Clerk of the Council inform Mr. W. E. Stone that it is not possible at the present committee. time to replace the seat recently removed from the pavement outside the Embassy Cinema, North Harrow, but that the matter will be reconsidered when circumstances permit. 301. Headstone Drive : That, arising out of resolution 284 (22nd January, 1945), the Committee receive the letter, dated 7th February, 1945, from the Workers' Production Committee of Kodak, Ltd., and agree to receive, pursuant to Standing Order 46, at the next meeting, a deputation from that Committee ; and that the Production Committee be required to furnish particulars of their proposals to the Surveyor within 14 days of a further request to that effect. 302. PART I.—RECOMMENDATIONS. RECOMMENDATION I.—Central Joint Planning Committee. The Council at their meeting on 13th January, 1945, passed a resolution, in the exercise of powers conferred by section 3 of the Town and Country Planning Act, 1932, concurring in the appointment of an executive joint planning committee for the areas of the Municipal Boroughs of and and the Urban Districts of Harrow, -Northwood and , or so many of them as might pass a similar resolution. The resolution also contemplated the appointment of representatives upon the new joint body by Middlesex County Council. It is now known that, whereas Wembley and Willesden have passed the necessary resolution, Ruislip-Northwood and Uxbridge have failed to do so, preferring to become members of the reformed West Middlesex Joint Planning Committee. In the result, a new Joint Committee comprising representatives of Wembley, Willesden and Harrow is now in being and held their first meeting at Wembley Town Hall on 7th February, 1945. Although the Urban Districts of Ruislip-Northwood and Uxbridge have not agreed to join the new Committee, it should be noted that representatives of the Borough of , at their own suggestion, ttended the meeting referred to above and indicated that, if they ould be satisfied that the new Joint Committee would adopt conditions 459

acceptable to them, they would be prepared to recommend 24th March, of delegation 1945' Hendon Town Council to pass the requisite resolution to join the Central Middlesex Joint Planning Committee. It will be remembered that, in the report of the Town Planning and Valuation Committee of Committee. 18th December, 1944, it was stated that, at that time, it was under­ stood that Hendon preferred to adhere to the proposed North Middlesex and South East Hertfordshire Joint Planning Committee. The circumstances mentioned in the last paragraph have put a much more satisfactory complexion upon the acceptability of the new Central Middlesex Joint Planning Committee to the Ministry of Town and Country Planning. Although it must be understood that the formation of a joint committee under section 3 of the Town and Country Planning Act, 1932, does not require the approval of the Minister, and is a fait accompli as soon as the necessary formative resolutions are passed by the constituent authorities, the Minister has wide powers of control under section 5 of the Act and may, in his discretion, direct a local authority to join any existing joint committee in circumstances where he thinks such a course to be expedient. In this connection the Ministry had already indicated that they would not regard the formation of a joint area comprising only the boroughs of Wembley and Willesden and the Urban District of Harrow as being a desirable proceeding, and that these authorities should become members of the West Middlesex Executive Joint Planning Committee. A representative of the Ministry of Town and Country Planning was present at the meeting already referred to and agreed that the addition of Hendon to the three other authorities raised a new issue upon which he would report back to the Ministry. The further views of the Ministry are, therefore, awaited by the Central Middlesex Joint Planning Committee. With regard to the conditions of delegation, the Central Middlesex Committee at their meeting on 7th February, 1945, unanimously agreed to recommend the constituent authorities of Wembley, Willesden and Harrow to adopt the conditions set out in the recommendation below. Conditions in this form are completely acceptable to the Hendon repre­ sentatives who have, therefore, stated that they will recommend Hendon Town Council to agree to join the new joint committee. The conditions of delegation now recommended to the Council for adoption are, in the opinion of the Central Middlesex Committee, eminently suitable to the circumstances. It will be remembered that a special Sub-Committee of the existing North Middlesex Joint Town Planning Committee recently conferred with a special Sub-Committee of the existing West Middlesex Joint Planning Committee in an endeavour to formulate uniform conditions of delegation for adoption by such executive joint planning committees as might be set up in Middlesex. Agreed conditions were in fact approved by both these bodies, subject to an important difference in regard to the definition of the scope of the duties of a joint committee in regard to the preparation of a compre­ hensive planning scheme for the joint planning area. Paragraph 1 of the conditions set out below is in the form suggested by the West Mid­ dlesex Joint Planning Committee, but all the remaining paragraphs are in the form which has been jointly agreed by the existing North and West Joint Committees. It will be seen that paragraph 1 preserves a very large measure of autonomy in planning matters to the constituent Councils. The joint committee is to be responsible for the preparation of a " regional scheme " for the whole joint planning area, and, subject to the regional framework taking precedence, to incorporate within the 460

24th March, regional scheme, without amendment, the planning proposals of the constituent authorities on all matters other than regional matters : regi°nal matters being denned as including main road communications committee. and broad zoning of industrial, residential and agricultural areas and open spaces. Your Committee, therefore, recommend that the Council should adopt the conditions of delegation referred to above which are necessary to supplement the resolution passed by the Council on 13th January, 1945, which, it will be remembered, was passed subject to the approval at a later date of conditions of delegation. Resolved to RECOMMEND : • That a resolution in the following terms be passed by the Council : — (1) That the Council hereby approve and adopt the following conditions of delegation in respect of the Central Middlesex Joint Planning Committee : — 1 . The duties of the Joint Committee shall be as follows : — To prepare and adopt a regional scheme for the whole of the planning district, and also any subsequent varying schemes (" regional " includes main road communications and broad zoning of industrial, residential and agricultural areas and open spaces). Subject to the regional framework taking prece­ dence, to incorporate within such regional scheme ' without amendment- the planning proposals of the ; local planning' authorities on all matters other than regional matters. To take all subsequent necessary steps with a view to the comprehensive scheme and any varying schemes being approved by the Minister. 2. For the purpose of assisting the Joint Planning Committee there shall be set up an Advisory Legal and Technical Sub-Committee, consisting of the Surveyors or Planning Officers of the constituent authorities, together with the Clerks of such authorities. 3. The Joint Committee shall have power to appoint a secretary, planning officer or consultant and such staff as may be necessary, and to provide office accommodation therefor. 4. The scheme shall specify each constituent authority as the responsible authority so far as the various matters dealt with by the scheme are in accordance with the statutory responsibilities of such authority in respect of its own area. 5. Subject to the Town & Country Planning Acts, 1932-1944, and to the powers vested in the Minister thereunder, and notwithstanding anything contained in the terms of delegation to the joint committee— 461

(a) each local planning authority shall remain the Interim Development Authority for _ — . . the,, purposes ofr AT.the T>IPlanning • Acts* i andj TownPlanntagand valuation Orders and Regulations made thereunder; (b) each local planning authority shall be the authority for the purpose of discharging the functions of a local planning authority under section 1 of the Town and Country Planning Act, 1944 ; (c) each constituent authority shall be the responsible authority in respect of pro­ visions in operative planning schemes to the extent to which it is a responsible authority at present. Provided always that a copy of any application made to the Minister by a local planning authority, being a constituent authority, for an order under section 1 of the Town and Country Planning Act, 1944, shall at the same time be transmitted to the Joint Committee. 6. In the event of a scheme providing for the acquisition of land in the area of a constituent authority for the purpose of a regional open space, the Joint Committee shall have regard to the benefits, if any, to be derived therefrom by adjoining constituent authorities and shall, if necessary, make provision in the scheme (a) as to the authority in whom the land shall vest ; (b) for appropriate contributions by the County Council and adjoining authorities; and (c) for "the management of the open space when acquired. 7. In the event of any constituent authority objecting to planning proposals made in respect of its area by the Joint Committee, that authority shall be entitled to make representations to the Minister thereon. (2) That Council resolution 3020 (13th January, 1945) be amended by the substitution of the words " Central Mid­ dlesex Joint Planning Committee " for the words " West Middlesex Joint Planning Committee " where they occur in paragraph (1) thereof.
