UPDATING the ELECTORAL COLLEGE: the NATIONAL POPULAR VOTE LEGISLATION the Electoral College Is an Anomaly of the American Democracy RECENT DEVELOPMENT UPDATING THE ELECTORAL COLLEGE: THE NATIONAL POPULAR VOTE LEGISLATION The Electoral College is an anomaly of the American democracy. The United States is virtually alone in entrusting the election of its President to a small, largely anonymous group of individuals, rather than to its citizen voters.1 On February 23, 2006, National Popular Vote (“NPV”),2 an or- ganization led by several former national legislators of both parties,3 un- veiled the proposed text for legislation (“NPV legislation”) that would guarantee a majority in the Electoral College to the winner of the national popular vote for President.4 The NPV legislation would effectively abol- ish the Electoral College by having states pass an interstate compact to pledge their electoral votes to the winner of the national popular vote. The NPV legislation promises to revive the centuries-old debate over the method for selecting the President5 and raise important questions about the founda- tions of American democracy. This Recent Development evaluates the National Popular Vote legis- lation and its likely effect on the Presidential election process. In Part I, this Recent Development discusses the Electoral College—the current system for selecting the President—ªrst by describing its origins at the Constitutional Convention, and then by commenting on the evolution of this institution over time. Part II explains the provisions of the NPV legisla- tion and examines the legislation’s progress in several states. Part III pre- sents the views of supporters and critics of the NPV legislation on the likely effects of the legislation’s enactment. However, such beneªts would come at the potential cost of increased spending on Presidential campaigns and the introduction of structural precariousness into the Presidential election system. I. The Electoral College System Selection of the President is governed by a combination of the Con- stitution (speciªcally Article II and the Twelfth and Twenty-third Amend- ments), state law, and customary practice. Article II of the Constitution mandates election of the President through the Electoral College, which is composed of electors appointed by each state and the District of Co- lumbia.6 The number of electors for each state is equal to the sum of the number of senators and representatives to which that state is entitled.7 State legislatures have complete discretion over the appointment of electors.8 The federal Constitution does not guarantee individuals a right to vote for Presidential electors, and only one state grants its citizens a state consti- tutional right to vote for Presidential electors.9 Despite freedom to choose the appointment process, virtually every state assigns its entire electoral slate to the winner of that state’s popular vote (the “winner-take-all” rule).10 Only Maine and Nebraska use the district system, which assigns an elec- tor to the winner of each congressional district’s popular vote and two electors to the winner of the state’s popular vote.11 However, neither has actually split its electoral slate between two Presidential candidates since instituting the district system.12 Once appointed, the electors meet in their 6 See U.S. Const. art. Ann. § 32-714 (2006). 12 See Koza et al., supra note 4, at 54. 2007] Recent Developments 207 respective states on the same day to cast separate ballots for President and Vice President.13 After electors cast their ballots, the Vice President of the United States, in his capacity as President of the Senate, opens and counts the electors’ votes in the presence of the House and Senate.14 To be elected outright, a Presidential candidate must have a majority of the electoral votes.15 If no candidate wins a majority, the House elects the President using the House contingency procedure. Under this procedure, the House chooses among the three candidates with the highest electoral vote totals; when voting, the delegation from each state has one vote.16 The states’ delegations con- tinue to vote until one candidate receives a majority and thus is elected.17 The Electoral College can be best understood through an examina- tion of both its origins at the Constitutional Convention and its subsequent development. Like much of the Constitution, the Electoral College was the product of compromise after protracted disagreement.18 James Wilson, dele- gate to the Constitutional Convention from Pennsylvania, called the issue of Presidential selection “the most difªcult . on which we have had to decide.”19 Under the ªnal formulation, apportionment of electoral votes was es- sentially population-based, except for the automatic award of two electoral votes to every state.20 Delegates recognized that the House contingency procedure, which gave each state only one vote, was a major concession to small states.21 They probably also understood that the Electoral College, which assigns state electoral votes based not on voter turnout but on popula- tion alone, would beneªt southern states, as slaves could not vote but were 22 still included in the states’ population count. 13 See U.S. Const. amend.   • The 2020 Presidential Election: Provisions of the Constitution and U.S. Code
    PREFACE The National Archives and Records Administration (NARA) is proud to acknowledge its role in the Presidential election pro- cess. NARA’s Office of the Federal Register (OFR) acts as the administrator of the Electoral College and carries out the duties of the Archivist. In this role, the OFR is charged with helping the States carry out their election responsibilities, ensuring the completeness and integrity of the Electoral College documents submitted to Congress, and informing the public about the Presidential election process. The Electoral College system was established under Article II and Amendment 12 of the U.S. Constitution. In each State, the voters choose electors to select the President and Vice President of the United States, based on the results of the Novem- ber general election. Before the general election, the Archivist officially notifies each State’s governor and the Mayor of the District of Columbia of their electoral responsibilities. OFR provides instructions and resources to help the States and District of Columbia carry out those responsibilities. As the results of the popular vote are finalized in each state, election officials create Certificates of Ascertainment, which establish the credentials of their electors, that are sent to OFR. In December, the electors hold meetings in their States to vote for President and Vice President. The electors seal Certificates of Vote and send them to the OFR and Congress. In January, Congress sits in joint session to certify the election of the President and Vice President. In the year after the election, electoral documents are held at the OFR for public viewing, and then transferred to the Archives of the United States for permanent retention and access.

    High School Voter Registration FAQ Do you need to be 18 years old to register to vote? No. Although laws vary from state to state, all states let at least some 17 year olds register. Most states only require that a person be at least 18 years of age by the next election. Some set more specific deadlines, such as 17 years and six months, and two states, Florida and Hawaii, even allow people to register at 16 years of age. Do some places already use this type of registration system? Although the 1993 National Voter Registration Act increased access to voter registration materials, governments in the United States still do little to educate voters or encourage voter participation. While many of these other governments use other government records such as a national citizen registry, basing a registration system in high schools is more practical in the United States due to the decentralized nature of our electoral system. Does High School Registration work at either the state or local level? Yes. While it would be great to have entire states using this system, local governments have the authority to implement high school registration at a local level. Local programs would potentially increase participation in local elections, especially ones that directly affect schools, and could also serve as a pilot program for implementation at the state level. I like the idea of helping high school students register to vote; however, I am uncomfortable with making registration a requirement. First of all, remember that compulsory registration is not the same as compulsory voting.

Introduction As six women entered the field of Democratic presidential candidates in 2019, the political media rushed to declare 2020 a new “year of the woman.” In the Washington Post, one political commentator proclaimed that “2020 may be historic for women in more ways than one”1 given that four of these woman presidential candidates were already holding a U.S. Senate seat. A writer for Vox similarly hailed the “unprecedented range of solid women” seeking the nomination and urged Democrats to nominate one of them.2 Politico ran a piece definitively declaring that “2020 will be the year of the woman” and went on to suggest that the “Democratic primary landscape looks to be tilted to another woman presidential nominee.”3 The excited tone projected by the media carried an air of inevitability: after Hillary Clinton lost in 2016, despite receiving 2.8 million more popular votes than her opponent, ever more women were running for the presidency. There is a reason, however, why historical inevitably has not yet been realized. Although Americans have selected a president 58 times, a man has won every one of these contests. Before 2019, a major party’s presidential debates had never featured more than one woman. Progress toward gender balance in politics has moved at a glacial pace. The impact of federal policies on campaigning and electoral rules continues to be contested. With representative democracy as the standard, many political scientists wonder if our current electoral process delivers the best results. To win an election here, candidates must navigate through a maze of rules, regulations and practices many of which are rooted in traditions rather than best practice. Nevertheless, many would argue today that the process of federal elections has grown increasingly democratic. This too is contested. The federal election process has two important stages. The first stage of any electoral process is winning a political party’s nomination. Party candidates used to be selected by the party bosses in small caucuses. Party caucuses were nothing more and nothing less than conversations between small groups of empowered citizens. Benefits were doled out by and for party loyalists. This was called a spoils system. Everyday citizens were left out of the process. Early elites were fearful of common passions. The average person was not trusted to make important party decisions. It did not take long for this to change. As suffrage rights expanded voters demanded more and more power in voicing their candidate preferences. This first manifested itself in political party conventions. These conventions were held so that many more citizens could participate in the nominating process.
