It meets or exceeds NIEHS Minimum Criteria and U.S. Department of Energy Objectives for this training. This curriculum does not legally interpret the federal codes, and is not intended to take the place of specialized training programs, such as those for confined space, radiation worker, and others, where that specialized training is required. This HAZWOPER 8-Hour Refresher Curriculum includes, for each separate module/topic: 1. “Issues/topics for discussion” to be chosen by the presenter to generally cover a subject and assess the course participants’ knowledge. Presenters should add to this list as future applicable issues emerge. 2. Information presented in question/answer format. Each Q/A is its own subtopic. Presenters may use these questions to quickly poll the course participants to see if they already understand the answers; choose specific, relevant questions to answer in detail. 3. Updates to standards and regulations, where applicable. 4. Glossary “Terms to understand” will be located in the back of the manual.. 5. Optional “hands on” exercises can be used at the discretion of the instructor. 6. Tables and charts to illustrate/supplement course content. Are general contractors ultimately responsible for the subcontractor employees? • What is the best way for employees to learn more about work-related safety and health issues? • What should employees who have concerns about their safety and health do to address work-site problems? • Why do government agencies require annual HAZWOPER refresher training? IUOE NTF National Hazmat Program HAZWOPER October 2012 1-1 Annual Refresher Introduction to Government Regulations Introduction Government regulations to protect workers, the public, and the environment are the foundation for all safety and health requirements at the work site. A basic understanding of these regulations enables workers to determine their rights and whether they are being properly protected. Which government agencies affect workplace safety and health recommendations and requirements? U.S. Department of Labor (1930) develops and administers policies relating to wage earners, working conditions, and employment opportunities. Occupational Safety and Health Act of 1970 established the Occupational Safety and Health Administration (OSHA), a federal agency, within the U.S. Department of Labor. OSHA protects American workers by developing mandatory job-safety and health standards, and enforcing them through worksite inspections, (targeting those workplaces with the highest injury/ illness rate), employer assistance, and by imposing citations or penalties for violations. OSHA publishes permissible exposure levels. The OSH Act also established the National Institute for Occupational Safety and Health (NIOSH). NIOSH, the research agency for occupational safety and health, is part of the U.S. Department of Health and Human Services. NIOSH publishes the Registry of Toxic Effects of Chemical Substances (RTECS) and the NIOSH Guide to Chemical Hazards. Mine Safety and Health Administration (MSHA), enacted in 1969 and strengthened by Congress in 1977, is a branch of the Department of Labor established to protect workers in mining operations. Environmental Protection Agency (EPA) was created in 1970. The Resource Conservation and Recovery Act (RCRA), in 1976, made the EPA responsible for identifying and managing hazardous waste from generation, to transport, to treatment and disposal, cradle to grave. The Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), passed in 1980, established federal funding (Superfund) to clean up hazardous waste. The Superfund Amendments and Reauthorization Act (SARA), in 1986, extends the authority of the federal government to respond to released or threatened releases of hazardous substances. U.S. Department of Transportation (DOT) was established in 1967. U.S. Department of Energy (DOE), established in 1977, runs the largest environmental restoration and waste management program in the world. Government regulations are published in the Code of Federal Regulations (CFR). CFR Parts “1910- General Industry” and “1926- Construction” are most applicable to operating engineers and hazardous materials workers. In this example, “29 “ shows that this is an OSHA or Department of Labor standard, “CFR” indicates that it is from the Code of Federal Regulations, and “1910” indicates that it pertains to General Industry. 29 CFR 1910.120 is the Hazardous Waste

    Lessons From Superfund and RCRA 2 he United States has had nearly 20 years’ experience with hazardous waste operations at Resource Con- servation and Recovery Act (RCRA) and Superfund sites, Much of this work has involved site characteriza- tionT efforts: attempts to identify the nature of site pollutants and to map their locations, concentrations, and environmental trans- port routes. In addition, emergency removals of contaminants have been carried out at about one-third of all (non-Federal) sites 12 on the National Priorities List (NPL). permanent cleanup ac- tivities and construction projects that usually involve more com- plex and lengthy remediation actions are just getting underway at most sites. Nonetheless, the RCRA-Superfund experience of- fers important lessons about protecting the health and safety of workers engaged in environmental remediation—lessons that are directly applicable to cleanup of the Nuclear Weapons Complex. The Mission of the Workgroup is to provide advice, support, and products that ensure a healthy and safe nationally consistent approach to response and removal actions for EPA emergency responders and site workers. There are many laws and regulations in place to protect operators, other employees, and surrounding communities from the potential hazards of working with toxic chemicals like anhydrous ammonia. This manual summarizes the requirements of environmental and safety laws for anhydrous ammonia refrigeration system operators. A list of the federal laws and regulations related to process safety, accident prevention, emergency planning, and release reporting may be found in Appendix C. Many anhydrous ammonia system operators know their systems inside and out. If you are already familiar with the environmental laws and regulations that pertain to your system, then you are invited to test your knowledge by taking the quiz in Appendix E.     Overview and Findings 1 he Manhattan Project-the secret effort to invent and build the first atomic bomb-was accomplished in less than 4 years at a cost of approximately $2 billion.l The project was backed by the resources of America’s largestT and most advanced corporations and engineering fins, and employed the talents of thousands of the world’s best scien- tists, technicians, and workers. A half century later, the institutional descendant of the Man- hattan Project, the U.S. Department of Energy (DOE), cofronts a new mission: cleaning up the environmental pollution left by cold war nuclear weapons production. This new mission pre- sents DOE with daunting technical and organizational chal- lenges as it strives to revise policies that led to widespread pollu- tion throughout the Nuclear Weapons Complex and to restore contaminated environments to safe conditions, It is estimated that cleanup of environmental contamination from nearly 50 years of nuclear weapons manufacture will cost more than $100 billion and require more than 30 years to com- plete. The cost and length of the cleanup are uncertain because DOE is the true extent of pollution and the means to remedy it areas yet only dimly understood, Some areas of the Weapons Complex responsible for may never be restored to pristine conditions.2 The tasks involved in the cleanup of environmental contami- protecting those nation are unfamiliar to DOE.
