Gaza-Israel: The Legal and the Military View Transcript Date: Wednesday, 7 October 2015 - 6:00PM Location: Barnard's Inn Hall 07 October 2015 Gaza-Israel: The Legal and Military View Professor Sir Geoffrey Nice QC General Sir Nick Parker For long enough commentators have usually assumed the Israel - Palestine armed conflict might be lawful, even if individual incidents on both sides attracted condemnation. But is that assumption right? May the conflict lack legality altogether, on one side or both? Have there been war crimes committed by both sides as many suggest? The 2014 Israeli – Gaza conflict (that lasted some 52 days and that was called 'Operation Protective Edge' by the Israeli Defence Force) allows a way to explore some of the underlying issues of the overall conflict. General Sir Nick Parker explains how he advised Geoffrey Nice to approach the conflict's legality and reality from a military point of view. Geoffrey Nice explains what conclusions he then reached. Were war crimes committed by either side? Introduction No human is on this earth as a volunteer; we are all created by an act of force, sometimes of violence just as the universe itself arrived by force. We do not leave the world voluntarily but often by the force of disease. As pressed men on earth we operate according to rules of nature – gravity, energy etc. – and the rules we make for ourselves but focus much attention on what to do when our rules are broken, less on how to save ourselves from ever breaking them. That thought certainly will feature in later lectures on prison and sex in this last year of my lectures as Gresham Professor of Law but is also central to this and the next lecture both on Israel and on parts of its continuing conflict with Gaza. -

By Tally Helfont Tally Helfont is an FPRI research fellow. Her research focuses on Middle East-related issues and radical Islamic movements. She has also instructed training courses on behalf of K3 Enterprises in Civil Information Management to U.S. Military Civil Affairs Units and Human Terrain Teams assigned to Iraq and Afghanistan. September 2010 marked the beginning of renewed peace negotiations in the Middle East. The American-brokered talks took some time to restart—18-months to be exact—and its two primary participants, Israeli Prime Minister Benjamin Netanyahu and Palestinian President Mahmoud Abbas, were reluctant at best. The parties met on three separate occasions: in Washington D.C. from September 1-2, in Sharm El-Sheikh from September 13-14, and at the Israeli Prime Minister's official residence in Jerusalem on September 15. It is difficult to say whether there was any tangible progress achieved during these meetings, but as it currently stands, the continuation of these efforts is uncertain, and some would even say, unlikely. The United States, on the one hand, and Egypt, Jordan, and Saudi Arabia on the other, are exerting significant diplomatic pressure to bridge the current gaps and bring the two sides back to the negotiating table. But what about those who seek to obstruct such efforts? Chief among this camp is the Islamic Resistance Movement, Hamas. Through numerous statements and acts of violence, Hamas seemed intent on attracting attention during this period of negotiations. -

United States of America) Arkansas Model United Nations (AMUN) November 20-21, 2020 Teeter 1 Historical Context For years, there has been a consistent struggle between the State of Israel and the State of Palestine led by the Palestine Liberation Organization (PLO). In 2018, United States Secretary of State Mike Pompeo announced that the U.S. embassy located in Tel Aviv would be moving to the city of Jerusalem.1 Palestine, angered by the embassy moving, filed a case with the International Court of Justice (ICJ) in 2018.2 The history of this case, U.S. relations with Israel and Palestine, current events, and why the ICJ should side with the United States will be covered in this research paper. Israel and Palestine have an interesting relationship between war and competition. In 1948, Israel captured the west side of Jerusalem, and the Palestinians captured the east side during the Arab-Israeli War. Israel declared its independence on May 14, 1948. In 1949, the Lausanne Conference took place, and the UN came to the decision for “corpus separatum” which split Jerusalem into a Jewish zone and an Arab zone.3 At this time, the State of Israel decided that Jerusalem was its “eternal capital.”4 “Corpus separatum,” is a Latin term meaning “a city or region which is given a special legal and political status different from its environment, but which falls short of being sovereign, or an independent city-state.”5 1 Office of the President, 82 Recognizing Jerusalem as the Capital of the State of Israel and Relocating the United States Embassy to Israel to Jerusalem § (2017). -

Charts of villages evacuated by area, noting the causes for migration and migration trajectories for every village General introduction The purpose of this overview is to attempt to evaluate the intensity of the migration and its various development phases, elucidate the different factors that impacted population movement directly and assess the main migration trajectories. Of course, given the nature of statistical figures in Eretz Yisrael in general, which are, in themselves, deficient, it would be difficult to determine with certainty absolute numbers regarding the migration movement, but it appears that the figures provided herein, even if not certain, are close to the truth. Hence, a margin of error of ten to fifteen percent needs to be taken into account. The figures on the population in the area that lies outside the State of Israel are less accurate, and the margin of error is greater. This review summarizes the situation up until June 1st, 1948 (only in one case – the evacuation of Jenin, does it include a later occurrence). A resolution to urge the President of the United States, the United States Congress and the United States Department of State to consult with appropriate officials in Syria, Lebanon, and the Palestinian Authority regarding the status of missing Israeli soldiers and demand the immediate and unconditional release of three Israeli soldiers currently believed to be held by Hamas and Hezbollah. Whereas, The United States Congress expressed its concern for Israeli soldiers missing in Lebanon and the Hezbollah-controlled territory of Lebanon in Public Law 106-89 (113 Stat. 1305; November 8, 1999) which required the Secretary of State to probe into the disappearance of Israeli soldiers with appropriate government officials of Syria, Lebanon, the Palestinian Authority, and other governments in the region, and to submit to the Congress reports on those efforts and any subsequent discovery of relevant information; and Whereas, Israel completed its withdrawal from southern Lebanon on May 24, 2000. On June 18, 2000, the United Nations Security Council welcomed and endorsed United Nations Secretary- General Kofi Annan's report that Israel had withdrawn completely from Lebanon under the terms of United Nations Security Council Resolution 425 (1978). Briefing Israeli–Palestinian Peacemaking January 2019 Middle East and North The Role of the Arab States Africa Programme Yossi Mekelberg Summary and Greg Shapland • The positions of several Arab states towards Israel have evolved greatly in the past 50 years. Four of these states in particular – Saudi Arabia, Egypt, the UAE and (to a lesser extent) Jordan – could be influential in shaping the course of the Israeli–Palestinian conflict. • In addition to Egypt and Jordan (which have signed peace treaties with Israel), Saudi Arabia and the UAE, among other Gulf states, now have extensive – albeit discreet – dealings with Israel. • This evolution has created a new situation in the region, with these Arab states now having considerable potential influence over the Israelis and Palestinians. It also has implications for US positions and policy. So far, Saudi Arabia, Egypt, the UAE and Jordan have chosen not to test what this influence could achieve. • One reason for the inactivity to date may be disenchantment with the Palestinians and their cause, including the inability of Palestinian leaders to unite to promote it. However, ignoring Palestinian concerns will not bring about a resolution of the Israeli–Palestinian conflict, which will continue to add to instability in the region. If Arab leaders see regional stability as being in their countries’ interests, they should be trying to shape any eventual peace plan advanced by the administration of US President Donald Trump in such a way that it forms a framework for negotiations that both Israeli and Palestinian leaderships can accept.
