El señor magistrado Jaime Pardo Leal 7 8 RESUMEN El presente trabajo obedece a la inquietud que surge de observar, en nuestra sociedad contemporánea, diversas expresiones de una criminalidad creciente que evoluciona hacia formas cada vez más imbricadas con el Poder Público vigente y con ciertos intereses de empresas legalmente constituidas que aprovechan los considerables dineros procedentes de la gestión criminal organizada mediante la utilización de mecanismos que trasladan el capital ilegal hacia registros formales blanqueados de esos valores. Para ilustrar estas inquietudes hemos tomado, con el ejemplo del trabajo del profesor CARL GINZBURG, tres casos que nos sirven para entender cómo actúa esta forma de criminalidad en un mundo donde la globalización económica, en sus dimensiones financieras, acopla la actividad del Estado, la organización criminal que aprecia el delito como empresa y la ambición ilimitada de las poderosas empresas necesitadas de nuevas formas de acumulación de capital. Caso especial nos ofrece la doble actuación del movimiento, calificado de subversivo, el M-19 que incurrió en actividades de insurgencia política guerrillera combinadas con incursiones en delincuencia común con finalidades meramente utilitarias. En todos los casos es evidente la participación de funcionarios públicos que, conscientemente o con evidente ineficacia en el ejercicio de sus atribuciones, facilitaron el iter criminis. Palabras clave: 1) Criminalidad 2) Capital ilegal 3) Economía globalizada 4) Palacio de Justicia 5) M-19 ABSTRACT The following research emerged from questioning the diverse expressions of an expanding world of criminality within our contemporary society, that continuously evolve into forms that are increasingly intertwined with current public power and with certain legally established private interests that capitalize on the considerable profits generated 9 from the activities of organized crime through the use of mechanisms that launder illegal capital. We have taken three case studies from Professor Carl Grinzburg in order to help us illustrate and understand how this form of criminality operates in a world where economic globalization, in its financial dimensions, is able to combine the agendas of the state with those of criminal organizations that operate as business firms and the inexhaustible ambition of legal private enterprises in dire need of new forms of accumulation of capital. The incursion into double acts of criminality is seen in the case of the subversive group M-19 that not only committed the crime of guerrilla insurgency against the state but also carried out acts of common delinquency with purely utilitarian ends, making it a special case in the analysis of criminality. In every case the participation of public administrators was evident, whether they were conscious of their acts or an evident reflection of their inefficiency in executing their public tasks, ultimately facilitating the iter criminis. Consideraciones sobre la Segunda Parte y Conclusiones Generales…………………………………………………………………… pág.200 BIBLIOGRAFÍA………………………………………..……………………...…………. pág.212 12 13 INTRODUCCIÓN Es apenas normal que para quien ha estado en la Rama Judicial del Poder Público, no solo en su trabajo del ejercicio profesional de abogado, así sea en la especialidad del derecho público y preponderantemente en el derecho constitucional, sino como juez en las denominadas altas cortes del sistema judicial colombiano, tenga diversas inquietudes sobre el comportamiento de la sociedad en sus diversas posibilidades de acción. De todas ellas destaca la actividad política, la gestión pública, las conductas particulares sobre los aconteceres e intereses económicos y, por sobre todo, las conductas que atacan criminalmente a los asociados. En el espacio de la criminalidad se producen efectos realmente impresionantes porque congestionan el perfil emocional de la comunidad que cotidianamente tiene que enfrentarla. Lo criminal siempre estará en la vitrina de las angustias sociales. Esta afirmación es un hecho notorio que no necesita prueba alguna. Basta señalar, si alguien es excéptico sobre semejante aserto, la inumerable lista de programas que los medios de comunicación, especialmente los televisivos, dedicada a narraciones, dramatizaciones, ficciones y un largo etcétera, sobre todas las variedades, modalidades y presentaciones del crimen, la enorme audiencia que siempre está atenta y puntual a la hora del programa y la avalancha de anuncios publicitarios que disputan, sin importar los costos, un lugar en esos espacios. En Colombia el impacto de la criminalidad ha estado al orden del día en toda nuestra historia. La población ha padecido, vivido y coexistido, a veces, naturalizándose, con las expresiones más violentas de sus agentes, incorporando, posiblemte, a sus costumbres la angustia del ataque criminal. Por esto, las preocupaciones académicas, de todas sus ópticas, se ven obligadas a tratar estos problemas. En lo que nos ocupa, encontramos que un enorme sector de la criminalidad del tiempo presente tiene los elementos propios de la globalización capitalista actual, donde las acumulaciones de capital adoptan estrategias que permiten contar con grandes sumas de dinero, de manera diferente a la antigua o tradicional apropiación del plustrabajo con base 14 en la simple injusticia e inequidad de la plusvalía. La realidad de una economía globalizada con gigantescas corporaciones y asociaciones empresariales de todo orden, requiere de mecanismos novedosos y de extrema eficacia que les aseguren capitales en cantidades suficientes para la dinámica de sus mercados, de lo contrario desaparecerán en medio de las las crisis, cracs, pánicos y voracidad sin límite de sus competidores. Al mismo tiempo entran en escena varias modalidades delictivas que guardan enormes diferencias con el comportamiento de la criminalidad de antes del proceso de globalización actual. En varios delitos evoluciona una característica que si bien existía antes, en estos momentos se ha transformado con otras finalidades. Se trata de la capacidad de producir, mediante el uso del delito, dinero a bajo costo y en gigantescas cantidades con un sentido de permanencia y no de aprovechamiento casual o de oportunidad de la apropiación del bien ajeno. Estos delitos se reconfiguran en una complejidad tal que no se dejan cometer por delincuentes individuales, desorganizados, transitorios o de ocasión. Son conductas cuya rentablilidad atrae asociaciones criminales diseñoides1 que dan la impresión de semejar empresas. De hecho emplean varios mecanismos de gestión propios de ellas. Los agentes que asumen el control de estos delitos son, primero, las organizaciones criminales diversas formadas desde hace varias décadas, aún siglos y, segundo, nuevas organizaciones que, sin la tradición de aquellas como las italianas (mafia, ´ndrangheta, sacra corona unita, camorra), las japonesas (yacusa) o chinas (dragones rojos de Shangai) y otras de semejante tipo, han aparecido en torno a las figuras de conspiradores, asociaciones para delinquir, concursos, etc. Su organización se asienta en el poder implacable de un jefe y subsiste hasta que las autoridades lo capturan o lo eliminan. Son los casos de Al Capone en Estados Unidos, Pablo Escobar en Colombia o los hermanos Rodríguez Orejuela quienes trataron de dar una estructura un poco más empresarial a sus actividades delicuenciales. Segal Myrtle Jean Hale has almost no quite moments; watching him is waiting for him to erupt. But he always remains somehow likable, probably because no one in Massacre is particularly likable.
