Emor Kohanim – Agents of God or Man? -Rabbi Moshe Pinchuk- Parahsat Emor is rife with questions. The Talmud lists eight passages that were related to Moshe upon the consecration of the Tabernacle, on the first of the month of Nissan. The appropriate place for these passages is in the parasha of Shemini, which opens with the dedication of the Tabernacle: “Eight sections were given forth on the day on which the Tabernacle was set up. They are: the section of the priests, the section of the Levites, the section of the ritually unclean, the section of the sending of the ritually unclean [out of the camp], the section commencing ‘After the death’…” Several of these passages are set forth in this week’s parasha, Emor: A. The section of the priests (kohanim): Rashi makes the following comment: “The section of the priests – “Speak to the kohanim,” which contains the laws of the kohanim. Because these laws were required that day in order for the kohanim to work in the Tabernacle, it was necessary for Hashem to convey them at that time.” According to Rashi, the “section of the priests” mentioned in the Talmud is the passage comprised of the first several verses of Parashat Emor. These verses set forth prohibitions relating to priestly ritual uncleanliness and marriage, as well as physical defects that disqualify a priest from working in the Tabernacle and the Temple. Why was this passage relocated from the parasha of Shemini to the beginning of Emor? B. The section of the ritually unclean: This section is identified as the passage beginning with the words “that they shall separate themselves from the holy [sacrifices] of the children of Israel.” This passage sets forth the laws of ritual cleanliness that pertain to the consumption of terumah (priestly contributions) and kodashim (holy sacrifices). -

Moses dedicates the Mishkan – the Tent of Meeting, invests Aaron and his sons with priestly authority, and declares a week- long festival. It is now the 8th day of the festival and the final offerings are being performed with the entire community in attendance. Then disaster strikes: For whatever reason, Aaron’s sons Nadab and Abihu decide on their own to bring an offering of incense. But since they were not commanded to do this, but simply took it upon themselves, HaShem regards it as “eish zarah” – foreign, strange fire, consuming them in their own blaze. Aaron remains silent as Moses tells their cousins to carry their bodies by their tunics outside of the camp and orders the entire group to mourn. What follows is a list of new commands for the high priests, which include not drinking “intoxicating wine” before entering the Tent of Meeting. It is an eternal law, set in place to enable us to clearly distinguish between sacred and secular and between unclean (unfit for sacred use) and clean. We are all dressed in white, simple pure and and clean, and the same for everyone - men and women, rich and poor. All distinctions cease. When we fast on Yom Kippur it is not a punishment – it is only to help us be lighter like the angels, and like the souls of those who have died. We wear white, sometimes even the exact garment in which we expect to be buried -- – like a kittel– -- because we understand that Yom Kippur is designed to bring us to the edge of our own death. We know that the most scrupulous honesty we may ever engage in might well be on our deathbed, as we review our lives and make amends if we still can. The honesty of one who faces death is amplified by the uselessness of pretending and lying any more. -

The positions included: • R’ Elyahu Mizrachi (15C Turkey) - kabbalistic concepts are highly esoteric and, although special individuals are free to adopt them, ordinary people are not required to follow them. • Radvaz (16C Egypt) - kabbalistic practices are acceptable as chumrot, but not where they contradict the Talmud. • Beit Yosef (16C Eretz Yisrael) - incorporates selected halachot of the Zohar into the mainstream halacha. Where the Zohar conflicts with Talmud, the Talmud prevails. However, where the Zohar conflicts with the post-talmudic poskim, the Zohar prevails. • The Rema (16C Poland) - disagrees with the Beit Yosef on the latter point. According to the Rema, the Zohar cannot even override the post-talmudic poskim. • The Maharshal (16C Poland) - is concerned in many cases about the problems of integrating kabbala into halacha. • The Maseit Binyamin (17C Poland) - considers that the Zohar outweighs all the post-Talmudic poskim put together! • R. Ya’akov Emden (18C Germany) - whilst skeptical about the origins of every word of the Zohar, maintains that, although in any dispute between the Zohar and the Bavli we follow the Bavli, where the Bavli is unclear and subject to many interpretations and the Zohar can clarify the position, we are to look to the Zohar. The Zohar should not be rejected in halacha, provided it does not directly contradict the Bavli and we should try wherever possible to reconcile the Zohar and the Bavli. -
