Veškeré prameny a zdroje informací, které jsem použil k sepsání této práce, byly citovány v poznámkách pod čarou a jsou uvedeny v seznamu použité literatury. ……………………….. František Kasl Právní stav byl v této práci zohledněn ke dni 1. 6. 2019. Překlady anglických termínů a textu v této práci jsou dílem autora práce, pokud není uvedeno jinak. 3 4 Poděkování Na tomto místě bych rád velmi poděkoval všem, kteří mi s vypracováním této práce pomohli. Děkuji kolegům a kolegyním z Ústavu práva a technologií za podporu a plodné diskuze. Zvláštní poděkování si zaslouží Radim Polčák za nasměrování a validaci nosných myšlenek práce a Pavel Loutocký za důslednou revizi textu práce a podnětné připomínky. Nejvíce pak děkuji své ženě Sabině, jejíž podpora a trpělivost daly prostor této práci vzniknout. Klíčová slova Ochrana osobnosti online; všeobecné osobností právo; svoboda projevu; YouTube; YouTuber; odpovědnost poskytovatelů služeb informační společnosti 7 Title The works of YouTubers through the prism of the right to personality protection of children and adolescents Abstract The rigorous thesis is focused on the issue of interference with the personality rights of children and adolescents in the environment of original works shared with the help of the YouTube platform. Attention is paid to these age categories primarily for their vulnerable stage of development of individual and social identity. Following the introductory chapter comes the presentation of the legal framework for the protection of personality and the analysis of relevant aspects significant to the remainder of the thesis. In the third chapter, the reader is introduced to the social media environment and the specifics of the so-called community sharing platforms, which YouTube is ranked among. From this part, attention is focused on the works of so-called YouTubers, ie creators of online content especially popular among children and adolescents. In the fourth chapter, the opinions and expressions disseminated by YouTubers are assessed from the perspective of balancing the freedom of expression with the risk of interference with the personality rights of the persons concerned. The categories of problematic content that can interfere with personality rights are analyzed and the fact that YouTubers themselves are frequent victims of interference with personality rights, especially through hateful comments, is also taken into account. The fifth chapter puts the discussed issue in the broader context of other risky content for minor online viewers. In the final sixth chapter, the limits of traditional civil law instruments for the protection of the personality of children and adolescents in the social media environment are pointed out. That is why the regulation of liability of internet service providers and related activities on the YouTube platform, which are aimed at minimizing the frequency and impact of interference with user personality rights, not only through the YouTuber's works, are further discussed. • Producers of Popular Science Web Videos – Between New Professionalism and Old Gender Issues
Producers of Popular Science Web Videos – Between New Professionalism and Old Gender Issues Jesús Muñoz Morcillo1*, Klemens Czurda*, Andrea Geipel**, Caroline Y. Robertson-von Trotha* ABSTRACT: This article provides an overview of the web video production context related to science communication, based on a quantitative analysis of 190 YouTube videos. The authors explore the main characteristics and ongoing strategies of producers, focusing on three topics: professionalism, producer’s gender and age profile, and community building. In the discussion, the authors compare the quantitative results with recently published qualitative research on producers of popular science web videos. This complementary approach gives further evidence on the main characteristics of most popular science communicators on YouTube, it shows a new type of professionalism that surpasses the hitherto existing distinction between User Generated Content (UGC) and Professional Generated Content (PGC), raises gender issues, and questions the participatory culture of science communicators on YouTube. Keywords: Producers of Popular Science Web Videos, Commodification of Science, Gender in Science Communication, Community Building, Professionalism on YouTube Introduction Not very long ago YouTube was introduced as a platform for sharing videos without commodity logic. However, shortly after Google acquired YouTube in 2006, the free exchange of videos gradually shifted to an attention economy ruled by manifold and omnipresent advertising (cf. Jenkins, 2009: 120). YouTube has meanwhile become part of our everyday experience, of our “being in the world” (Merleau Ponty) with all our senses, as an active and constitutive dimension of our understanding of life, knowledge, and communication. However, because of the increasing exploitation of private data, some critical voices have arisen arguing against the production and distribution of free content and warning of the negative consequences for content quality and privacy (e.g., Keen, 2007; Welzer, 2016).

  • Celebrity Endorsers Vs. Social Influencers Vrinda Soma a Thesis
Celebrity Endorsers vs. Social Influencers Vrinda Soma A thesis submitted to Auckland University of Technology in partial fulfilment of the requirements for the degree Master of Business (MBus). 2019 Faculty of Business, Economics and Law 1 Abstract The purpose of this research is to measure how effective social influencers and celebrity endorsers are in persuading individuals to like, purchase and/or share information about a brand or specific product. Previous literature has discussed how different source characteristics and endorsers influence individuals. However, rapid change in information and communication channel evolution means that the research on endorsements conducted before social media channels arose is in need of updates and extensions to examine how current forms of communication drive brand conversations. Source characteristics impact how a social influencer or celebrity endorser is effective when communicating to an audience. In the endorsement setting, the most important attributes are trustworthiness, expertise, attractiveness, authenticity and credibility (Erdogan, 1999). As the literature shows, these attributes are the most likely to contribute to attitude change and eventual behaviour change (Erdogan, 1999; Kapitan & Silvera, 2016). These attributes have been individually studied for celebrity endorsers (i.e., Erdogan, 1999), however, the rise of online social influencers makes it important to re-evaluate and compare and contrast social influencers and celebrity endorsers so that brands, endorsers and researchers have a better understanding of what viewers are looking for. Two areas of interest drive the quantitative research undertaken in this thesis: (1) an evaluation between attitudes generated by social influencers and celebrity endorsers and (2) the willingness to purchase an endorsed product or brand depending on endorser type.
