CONCLUSION AND WAY FORWARD ........................................................................................ 45 2 | P a g e EXECUTIVE SUMMARY The Kenya Coalition on Civil and Political Rights (KCCPR) is a coalition of twelve civil-society organisations that have jointly collaborated on the ensuing report. This report aims to demonstrate the prevailing environment for civil and political rights in Kenya in light of various developments, the most significant being the promulgation of the new Constitution. The report is a partial review on Kenya’s implementation of the International Covenant on Civil and Political Rights (hereinafter, the Covenant) illuminating a limited number of contemporary concerns. The report interrogates a number of articles under the Covenant, citing several instances and examples of violations by the state while making recommendations to ameliorate the situation in each instance. The following are the issues raised within the report and we make the following recommendations: 1. Rights of Minorities and Marginalised Communities 1.1 - Failure to protect the land rights of Marginalised Communities (Articles 1 and 27) i. That the government implements the decision in CEMIRIDE (on behalf of the Endorois Community) versus The Government of Kenya in accordance with the recommendations of the African Commission on Human and Peoples’ Rights. ii. That the enactment of the legislation on community land is undertaken without further delay to provide the legal framework for the use, transfer and management of community land in line with the Constitution. iii. That the enactment of the Evictions and Resettlement Guidelines Bill 2011 is undertaken without further delay to provide the legal framework, including guidelines for evictions that accord with the Constitution and internationally accepted standards; and provide for protection against inhumane and unlawful evictions. iv. That the National Land Commission is duly constituted with a membership that complies with constitutional provisions on diversity, leadership and integrity and has requisite competencies on ascertaining the historical land rights of marginalised communities. v. That the government places a moratorium on creation of any new protected areas, new natural resource extraction and development licensing, extension of existing land and natural resource leases, or large scale development in lands falling within Article 63 of the Constitution for a minimum of two years to allow filing and adjudication of community claims. vi. That the government institutes an implementation and reparations framework for all recommendations emanating from state-sanctioned inquiries and commissions impacting on historical land injustices for marginalized communities. 1.2 - Citizenship based discrimination i. That the government of Kenya upholds the constitutional entitlement of every citizen to a Kenyan passport and any other documents of registration and identification without discrimination. 3 | P a g e ii. That the government of Kenya publishes the rules and regulations to the Citizenship and Immigration Act, 2011 without further delay to prescribe an application process for registration of stateless persons as citizens and introduce non-discriminatory procedures for registration of persons. iii. That the government of Kenya undertakes awareness campaigns on the procedure and timelines for registration of stateless persons as citizens1. iv. That the government of Kenya fully implements the recommendations issued to it by the African Committee of Experts on the Rights and Welfare of the Child in the case of IHRDA and Open Society Justice Initiative (OSJI)(on behalf of children of Nubian descent in Kenya) v Kenya. v. That the government of Kenya up-scales administrative efforts to avail any document of identification to

    KENYA ELECTION HISTORY 1963-2013 1963 Kenya Election History 1963 1963: THE PRE-INDEPENDENCE ELECTIONS These were the last elections in pre-independent Kenya and the key players were two political parties, KANU and KADU. KADU drew its support from smaller, less urbanized communities hence advocated majimboism (regionalism) as a means of protecting them. KANU had been forced to accept KADU’s proposal to incorporate a majimbo system of government after being pressured by the British government. Though KANU agreed to majimbo, it vowed to undo it after gaining political power. The majimbo constitution that was introduced in 1962 provided for a two-chamber national legislature consisting of an upper (Senate) and lower (House of Representative). The Campaign KADU allied with the African People’s Party (APP) in the campaign. KANU and APP agreed not to field candidates in seats where the other stood a better chance. The Voting Elections were marked by high voter turnout and were held in three phases. They were widely boycotted in the North Eastern Province. Violence was reported in various parts of the country; four were killed in Isiolo, teargas used in Nyanza and Nakuru, clashes between supporters in Machakos, Mombasa, Nairobi and Kitale. In the House of Representative KANU won 66 seats out of 112 and gained working majority from 4 independents and 3 from NPUA, KADU took 47 seats and APP won 8. The economy was growing negatively; poverty had set in, in a big way with nearly 70% of the population living below the poverty line. Unemployment had risen sharply as a result of collapse and closure of numerous industries. The level of illiteracy was rising rapidly as a result of declining state investment in education in a poverty stricken society. The media was replete with reports of looting of billions of public funds, grabbing of public land set aside for essential purposes, and plunder of government institutions. Many were reports of private land and other property taken away by public figures, and nothing could happen to them. By October 2002, all these scandals sounded like fairly tales. State institutions collapsed one after the other as a result of corruption in the police, judiciary, and in the entire public service. Economic activities collapsed too, especially farming and industry, with the result that workers were laid off in drones between 1993 and 2001. Crime rate hit an all times high record as more and more people became converted to the belief that corruption and not hard work was their only way of making ends meet.

It focuses on the contestations over access and control of natural resources with specific reference to wildlife. These contestations emanate from competing claims over natural resources between the state and the local communities. The study frames these contestations within the context of a property rights paradigm. It inquires as to whether the state in Africa, as presently constituted, can devolve authority over national natural resource control to communities so as to engender a private property right consciousness that the CBC model is premised on. The study contends that African states as they currently exist are unlikely to devolve property rights to local communities in a way that would induce a private property right consciousness. It demonstrates that the interests of the African state in the distributional gains from national natural resources are perhaps too vested for it to devolve power if that devolution would cost it control of these resources. Moreover, there is the factor of the social forces that the state is embedded in and this complicates both its willingness and capacity to devolve wildlife property rights to local communities.

    AFRICAN HUMAN RIGHTS LAW JOURNAL The bill of rights and constitutional order: A Kenyan perspective Anthony Wambugu Munene* Lecturer in Law, Moi University, Kenya 1Introduction The inclusion of a bill of rights in a constitutional order as a mechanism of ensuring the rights and freedoms of the individual and as a means of regulating state power has increasingly been accepted the world over.1 The United States of America was the first state to break away from the eighteenth century Anglo-Saxon attitude that was hostile to the concept of a bill of rights. The Anglo-Saxon attitude prevailed until the second half of the twentieth century when most African states became inde- pendent. De Smith observes:2 Neither in the British Constitution itself nor in any of those Commonwealth constitutions in which British influence had been predominant was there to be found any comprehensive statement of human rights. Early Commonwealth constitutions that included bills of rights were those of India (1950) and Pakistan (1957). These constitutions, however, were homegrown after independence and are not attributable to Anglo- Saxon initiatives.3 The trend changed in 1959 with the enactment of the Nigerian Independence Constitution, which listed a number of fundamental rights. Most of the bills of rights that emerged thereafter were imposed by colonial authorities as a precondition to independence.
