Not Guilty-But Not Innocent: An Analysis of the Acquittal of John Demjanjuk and Its Impact on the Future of Nazi War Crimes Trials INTRODUCTION On July 29, 1993, the Supreme Court of the State of Israel acquit ted John Demjanjuk of charges that he was "Ivan the Terrible," a sadistic Nazi gas chamber operator who assisted in the extermina tion of thousands of Jews at the Treblinka death camp in Poland during World War II.! The acquittal, which overturned the district court's 1988 conviction and death sentence,2 was based on new evidence which created a "reasonable doubt" that Demjanjuk was "Ivan the Terrible" of Treblinka.3 The acquittal of John Demjanjuk comes after a sixteen year legal battle which began in the United States in 1977, when the U.S.

HOLOCAUST ARCHAEOLOGY: ARCHAEOLOGICAL APPROACHES TO LANDSCAPES OF NAZI GENOCIDE AND PERSECUTION BY CAROLINE STURDY COLLS A thesis submitted to the University of Birmingham for the degree of DOCTOR OF PHILOSOPHY Institute of Archaeology and Antiquity College of Arts and Law University of Birmingham September 2011 University of Birmingham Research Archive e-theses repository This unpublished thesis/dissertation is copyright of the author and/or third parties. ABSTRACT The landscapes and material remains of the Holocaust survive in various forms as physical reminders of the suffering and persecution of this period in European history. However, whilst clearly defined historical narratives exist, many of the archaeological remnants of these sites remain ill-defined, unrecorded and even, in some cases, unlocated. Such a situation has arisen as a result of a number of political, social, ethical and religious factors which, coupled with the scale of the crimes, has often inhibited systematic search. This thesis will outline how a non- invasive archaeological methodology has been implemented at two case study sites, with such issues at its core, thus allowing them to be addressed in terms of their scientific and historical value, whilst acknowledging their commemorative and religious significance.

Primarily through loans to build up the economy and diplomatic pressure, the United States and Great Britain helped to maintain an independent Austrian state and prevent an Anschluss or union with Germany from 1918 to 1934. In addition, this study examines the minority of Austrians who opposed an Anschluss . The three main groups of Austrians that supported independence were the Christian Social Party, monarchists, and some industries and industrialists. These Austrian nationalists cooperated with the Americans and British in sustaining an unwilling Austrian nation. Ultimately, the global depression weakened American and British capacity to practice dollar and pound diplomacy, and the popular appeal of Hitler combined with Nazi Germany’s aggression led to the realization of the Anschluss .

UNITED STATES INVOLVEMENT WITH NAZI WAR CRIMES ELIZABETH HOLTZMAN * I very much appreciate the opportunity to be a panelist with such distinguished people and to address such an extraordinarily important subject. I think I can contribute most to this discussion by recounting a little bit of the history of the United States' involvement with Nazi war crimes. Until the mid 1970s, with one or two small exceptions,' the United States government was not particularly interested in the presence of Nazi war criminals in this country.' Indeed, at the very time that it was prosecuting the Nuremberg cases, the United States was sheltering such Nazi war criminals as Klaus Barbie from accountability for war crimes committed in France. In addition, a United States government report found that government officials committed crimes in their effort to protect Klaus Barbie.4 In another case, this one having its situs in Belgium, the United States government again violated either its own laws or foreign laws in protecting Nazi war criminals from local accountability.

In addition, any quotation or abstract must include full attribution. Abstract This thesis explores the life and context of Kesselring the last living German Field Marshal. It examines his background, military experience during the Great War, his involvement in the Freikorps, in order to understand what moulded his attitudes. Kesselring's role in the clandestine re-organisation of the German war machine is studied; his role in the development of the Blitzkrieg; the growth of the Luftwaffe is looked at along with his command of Air Fleets from Poland to Barbarossa. His appointment to Southern Command is explored indicating his limited authority. His command in North Africa and Italy is examined to ascertain whether he deserved the accolade of being one of the finest defence generals of the war; the thesis suggests that the Allies found this an expedient description of him which in turn masked their own inadequacies. During the final months on the Western Front, the thesis asks why he fought so ruthlessly to the bitter end. His imprisonment and trial are examined from the legal and historical/political point of view, and the contentions which arose regarding his early release.
