The Board of Supervisors had asked the justices to declare the law in violation of the state Constitution because it takes budgeting power away from elected officials and allows no flexibility during hard financial periods. The 2nd District Court of Appeal, in a one-sentence order Thursday, refused to review the lower court’s finding and said the case must first proceed to trial. At issue is whether supervisors illegally diverted $50 million that should have gone to law enforcement agencies. A law passed by voters in 1993 guarantees that four agencies — sheriff, district attorney, public defender and probation — will share proceeds of a half-cent tax. The sheriff and district attorney sued the Board of Supervisors last year, alleging supervisors illegally altered the funding ordinance.
