Basic Conditions

Introduction

This Basic Conditions Statement has been prepared to accompany the Bremhill Parish Neighbourhood Plan. This covers the plan period 2016-2030.

Paragraph 8 of Schedule 4B of the Town and Country Planning Act 1990 requires that Neighbourhood Development Plans (NDP) must meet the following basic conditions:

(i) the NDP must have appropriate regard to national policies and advice contained in the National Planning Policy Framework (NPPF); (ii) the NDP must contribute to the achievement of sustainable development; (iii) the NDP must be in general conformity with the strategic policies contained in the development plan for the area of the local planning authority, in this case Core Strategy; and (iv) the NDP must meet the relevant EU obligations.

This Basic Conditions Statement addresses these requirements in four sections:

Section 1 demonstrates the conformity of the Bremhill Parish Neighbourhood Plan with the NPPF; Section 2 shows how the Bremhill Parish Neighbourhood Plan will contribute to sustainable development; Section 3 demonstrates the conformity of the Bremhill Parish Neighbourhood Plan with the Wiltshire Core Strategy and Policies and; Section 4 demonstrates compliance with the appropriate EU obligations.

Conformity is shown against the five Bremhill Parish Neighbourhood Plan Policies – BPNPP1-5. In addition the Neighbourhood Plan contains the following, that are not separate policies: 1) The five Bremhill Parish Design Statement Policies – DSP1-5 – these are a part of Bremhill Parish Neighbourhood Plan Policy 1 on “Local Homes and Businesses”. 2) Bremhill Parish Neighbourhood Plan Community Priority Actions (CPA) in the areas of local economy, transport or wellbeing and leisure. These are actions that the Parish Council will focus on in the plan period, that are outside the remit of Neighbourhood Plan policies. To show parishioners that all areas of the NPPF, sustainable development and Wiltshire Core Strategy and Policies are considered in developing this Neighbourhood Plan, we show the alignment of these areas with DSP’s and CPA’s.

Submitting Body The Bremhill Parish Neighbourhood Plan is submitted by Bremhill Parish Council, which is a qualifying body as defined by the Localism Act 2011.

Neighbourhood Area The Plan applies to the Parish of Bremhill Parish in Wiltshire. The area of the Neighbourhood Plan matches the Parish boundary as in 2016, is shown in Figure 1 above and was approved by Wiltshire Council in April 2014.

Bremhill Parish Council confirms that this Bremhill Parish Neighbourhood Development Plan relates only to the Parish of Bremhill Parish and to no other Neighbourhood Areas; and Bremhill Parish Neighbourhood Plan: Basic Conditions Statement.

The map in Figure 1 shows the general location of the Parish and Neighbourhood Plan area.

Section 1 – Conformity with the National Planning Policy Framework

The National Planning Policy Framework (NPPF) must be taken into account in the preparation of local and neighbourhood plans, and is a material consideration in planning decisions. Planning policies and decisions must reflect and, where appropriate, promote relevant EU obligations and statutory requirements and contribute to the achievement of sustainable development

Sustainable development is about positive economic, environmental and social growth for existing and future generations, so that the NPPF has a presumption in favour of sustainable development.

The Bremhill Parish Neighbourhood Plan contributes to the achievement of sustainable development by:

Planning positively for housing growth to meet the needs of existing and future generations Planning for good, high quality design Protecting and enhancing the natural built and historic environment of Bremhill Parish Promoting healthy communities Promoting sustainable transport Building a strong and competitive local economy

The NPPF sets out a number of planning principles which should underpin plan making and decision taking as follows:

1.1 Building a strong, competitive economy

The NPPF (paragraph 21) requires positive planning for local inward investment and support should be given to existing businesses together with identifying priority areas for infrastructure provision and environmental enhancement.

Bremhill Parish Neighbourhood Plan aims to strengthen and support local economic activity whilst preserving the landscape, character, visual amenity and biodiversity of Bremhill Parish and sets out the following specific policies intended to support and strengthen the local economy: BPNPP 1: Local Homes and Businesses DSP5: Small scale business developments, workshops and bed and breakfast facilities CPA: Local Economy 1.2 Ensuring the vitality of town centres

The NPPF (paragraph 23) recognises that planning policies should be positive and promote competitive town centre environments. This does not apply to Bremhill Parish which contains one small village and open countryside. However, the Neighbourhood Plan has been written considering the interaction of the Parish with the neighbouring towns of and , which provide many of the services for Parish residents.

1.3 Supporting a prosperous rural economy

The NPPF (paragraph 28) recognises that economic growth in rural areas should be supported in order to create jobs and prosperity by taking a positive approach to sustainable new development. The Bremhill Parish Neighbourhood Plan sets out the following specific policies intended to support a prosperous rural economy: DSP5: Small scale business developments, workshops and bed and breakfast facilities CPA: Local Economy 1.4 Promoting sustainable transport

The NPPF (paragraph 35) states that planning policies should promote sustainable transport, prioritise pedestrians and cyclists, create safe trac environments and consider the needs of disabled people. The Bremhill Parish Neighbourhood Plan sets out the following specific policies intended to support a prosperous rural economy: CPA: Transport

1.5 Supporting high quality communications infrastructure

The NPPF (paragraphs 42 & 162) refers to infrastructure, particularly telecommunications infrastructure involving broadband technology which is essential for sustainable economic growth and which plays a vital role in the provision of local community facilities and services. Bremhill Parish is very poorly served with regard to the provision of broadband connectivity. The Bremhill Parish Neighbourhood Plan sets out the following specific policies intended to maximise the opportunities for the development of broadband connectivity and high speed broadband: CPA: Local Economy

1.6 Delivering a wide choice of high quality homes

The NPPF (paragraph 54) states that local planning authorities should be responsive to local needs, particularly for the provision of aordable homes. The Bremhill Parish Neighbourhood Plan sets out the following specific policy intended to support the provision of aordable homes: BPNPP1: Local Homes and Businesses

1.7 Requiring a good design

The NPPF (paragraphs 56 and 58) states that good design is a key aspect of sustainable development and that neighbourhood plans should set out robust and comprehensive policies for the quality of development in the designated area. The Bremhill Parish Neighbourhood Plan sets out the following specific policies intended to ensure that all developments in Bremhill Parish must be of a good design which promotes sustainable development: BPNPP1: Local Homes and Businesses Bremhill Parish Design Statement Policies DSP 1-5

1.8 Promoting healthy communities

The NPPF (paragraphs 69, 73, 74 and 76) recognises that the planning system can play an important role in facilitating social interaction and creating healthy, inclusive communities with high quality community assets and public open spaces for sports and recreational provision. The Bremhill Parish Neighbourhood Plan sets out the following specific policies intended to ensure that all developments in Bremhill Parish promote healthy communities: BPNPP1: Local Homes and Businesses BPNPP3: Enhancing the Marden Valley BPNPP4: Protecting our Watercourses BPNPP5: Green Space at Loderwicks CPA: Wellbeing and Leisure

1.9 Protecting green belt land

The NPPF (paragraph 76) states that local communities should designate local green space to rule out new development other than in very special circumstances. This is

The local green space designation should be in reasonable proximity to the community it serves, particularly where the green space is local in character and not an extensive tract of land, for example a playing field. Bremhill Parish is situated in open countryside between Calne and Chippenham and the dwellings of Bremhill and lie within a designated conservation area. The Bremhill Parish Neighbourhood Plan identifies the open countryside between the Parish and the towns of Calne and Chippenham as areas for protection. The Bremhill Parish Neighbourhood Plan sets out the following specific policy intended to ensure that green spaces are protected: BPNPP2: Protecting our open countryside BPNPP3: Enhancing the Marden Valley BPNPP4: Protecting our Watercourses BPNPP5: Green Space at Loderwicks

1.10 Meeting the challenge of climate change, flooding and coastal change

The NPPF (paragraph 95) refers to the need to move to a low carbon future so that new and existing developments reduce greenhouse gas emissions via energy eciency improvements. The Bremhill Parish Neighbourhood Plan sets out the following specific policies intended to ensure that the carbon footprint is minimised, that renewable energy is promoted and that the environmental impact of climate change, particularly the risk of local flash flooding is minimised where possible. This is particularly important with Bremhill Parish having the Rivers Marden and Avon upstream of the town of Chippenham, with a potential major impact on homes and businesses in the town. Also the watercourses of Fishers Brook, Cade Burna and Cowage Brook have capability of causing local flash flooding. BPNPP1: Local homes and businesses BPNPP4: Protecting our watercourses

1.11 Conserving and enhancing the natural environment

The NPPF (paragraph 109) states that the planning system should protect and enhance valued landscapes, geological features, biodiversity and the ecosystem by preventing both new and existing development from adversely aecting air quality, soil, water and noise pollution. The majority of the land within the designated area is managed to a high environmental standard via a variety of agri-management schemes which provide extensive protection to the diverse flora and fauna. The Bremhill Parish Neighbourhood Plan sets out the following specific policies intended to ensure that the natural environment is conserved and enhanced: BPNPP2: Protecting our open countryside BPNPP3: Enhancing the Marden Valley BPNPP4: Protecting our Watercourses

1.12 Conserving and enhancing the historic environment

The NPPF (paragraph 126) suggests a positive strategy for the conservation of the historic environment, including heritage assets. The designated Bremhill Parish Neighbourhood Plan area contains many assets, detailed in the Asset Register. The Bremhill Parish Neighbourhood Plan sets out the following specific policies intended to ensure that the historic environment is conserved and enhanced: BPNPP2: Protecting our open countryside BPNPP3: Enhancing the Marden Valley BPNPP4: Protecting our Watercourses CPA: Wellbeing and Leisure

1.13 Facilitating the sustainable use of minerals

The NPPF (paragraph 143) suggests that local planning authorities should identify minerals resources and take account of the contribution that substitute recycled materials and minerals waste might make before sourcing minerals indigenously. Whilst there are known sand and gravel deposits just outside the Parish which are currently being extracted, there are not thought to be any major minerals deposits within the Parish and, in any event, the proposed development plan does no impact on those deposits in any material way.

Section 2: Delivering Sustainable Development

2.1 Requirement

The Bremhill Parish Neighbourhood Plan must contribute to sustainable development (as defined in the NPPF and summarised in section 1.1 of this Basic Conditions Statement) and presented (paragraph 7 of the NPPF) as consisting of three dimensions: • to contribute to building a strong, responsive and competitive economy, • to support strong, vibrant and healthy communities; and • to contribute to protecting and enhancing the natural, built and historic environment

This section demonstrates how the Bremhill Parish Neighbourhood Plan proposal delivers sustainable development.

The table shows, for each dimension of sustainability, alignment of the Bremhill Parish Neighbourhood Plan with the aims of the NPPF.

2.2 Fit of Bremhill Parish Neighbourhood Plan Objectives with Sustainable Development

Bremhill Parish A Viable Community: Neighbourhood Plan • Aim to enhance local employment opportunities especially Vision and Objectives for small start-up businesses and provide the community with better facilities and services. Housing: The Plan will provide for up to 0 dwellings to meet local 2 needs. It will do this through: • permitting small-scale infill sites and conversions within the Parish. • supporting the redevelopment of some brownfield sites to mixed uses. • making sure that developments include a mix of housing suited to local needs. The Economy and Jobs: The Plan will help business support existing and new jobs by: • making sure that existing employment sites are kept for employment use wherever possible and appropriate. • supporting new business premises in suitable locations. • ensure implementation of fast broadband to support businesses, home working and domestic use. • encouraging appropriate and sustainable rural tourism activities. Bremhill Parish BPNPP1: Local Homes and Businesses Neighbourhood Plan CPA: Local Economy Policies Commentary These Bremhill Parish Neighbourhood Plan policies contribute to economic sustainability by: • improving the opportunities for home working and for local businesses to promote themselves more widely; • ensuring existing buildings could be converted and be available for new businesses; and • ensuring that potential businesses are not deterred by trac congestion.

Delivering Social Sustainability

Commentary These Bremhill Parish Neighbourhood Plan policies contribute to social sustainability by: • Identifying indicative areas for housing within the context of open countryside dominating the Parish; • Specifying housing which recognises the need for aordable housing, housing for young families and housing for a Parish population which is aging; • Protecting valued community assets, such as local open spaces and • Seeking to improve pedestrian, cycling and bridleways. Delivering Environmental Sustainability

NPPF Definition Contribute to protecting and enhancing our natural, built and historic environment; and, as part of this, helping to improve biodiversity, use natural resources prudently, minimise waste and pollution, and mitigate and adapt to climate change including moving to a low carbon economy.

The Bremhill Parish Neighbourhood Plan objectives (1-10), policies (CBNPP 1-10), Community Priority Actions (CPA’s) and Design Statement policies (DSP 1-30) have been mapped onto the Wiltshire Core Strategy and Policies to demonstrate conformity.

Environmental Impact and Habitat Regulations

Following a screening assessment undertaken through Wiltshire Council with statutory consultees, there are no sites where Habitat Regulations apply. A Strategic Environmental Assessment (SEA) was judged by Wiltshire Council and statutory consultees not to be required and undertaken as part of the preparation of the Neighbourhood Plan. These are attached as separate documents with the Neighbourhood Plan.

Human Rights

An equalities impact assessment has not been undertaken, as no longer required under the Equalities Act 2010, and it is not considered the Plan discriminates unfairly or in a manner which is contrary to the Human Rights Act 1998.
