4 De Marzo De 2021 T459 T459 DISTRIBUYE RECURSOS, FIJA SELECCIÓN, LISTA DE ESPERA, NO SELECCIÓN, NO SELECCIONABILIDAD Y NO ELEGIBILIDAD DE PROYECTOS EN EL MARCO DE LOS CONCURSOS PÚBLICOS DEL FONDO NACIONAL DE DESARROLLO SLP/CGC/CPAM CULTURAL Y LAS ARTES, PARA LAS LÍNEAS QUE SE INDICAN, ÁMBITO NACIONAL DE FINANCIAMIENTO, CONVOCATORIAS 2021 EXENTA Nº 377 VALPARAÍSO, 4 de marzo de 2021 VISTO Lo dispuesto en la Ley Nº 21.045 que crea el Ministerio de las Culturas, las Artes y el Patrimonio; en la Ley N° 19.880, que establece las Bases de los Procedimientos Administrativos que rigen los Actos de los Órganos de la Administración del Estado; el Decreto con Fuerza de Ley Nº 1/19.653, de 2001, que fija el texto refundido, coordinado y sistematizado de la Ley Nº 18.575 Orgánica Constitucional de Bases Generales de la Administración del Estado; en la Ley N° 19.891, que crea el Fondo Nacional de Desarrollo Cultural y las Artes y en su Reglamento; en la Ley Nº 21.289, que aprueba presupuestos para el sector público para el año 2021; en la Resolución N° 7, de 2019, de la Contraloría General de la República, que fija normas sobre exención del trámite de Toma de Razón; y en las Resoluciones Exentas N° 1.162, 1.163, 1.164, 1.165, 1.166, 1.167, 1.168 y 1.176, todas de 2020 y de la Subsecretaría de las Culturas y las Artes, que aprueban Bases de Concursos Públicos del Fondo Nacional de Desarrollo Cultural y las Artes, en las Líneas de Artes de la Visualidad; Infraestructura Cultural; Fomento a la Economía Creativa; Diseño; Becas Chile Crea; Artesanía; Arquitectura y Organización de festivales, ferias y encuentros, todas ámbito nacional de financiamiento, Convocatorias 2021; en la Resolución Exenta N° 1.268, de 2020, que fija nómina de personas que desempeñarán la función de integrantes de Comités de Especialistas, Comisión de Becas y Jurados; en la Resolución Exenta Nº 2.421, de 2020, que formaliza postulaciones inadmisibles; en la Resolución Exenta Nº 127, de 2021, que resuelve recursos de reposición para las líneas que se indican; en la Resolución Exenta Nº 208, de 2021, que resuelve recursos jerárquicos; y en la Resolución Exenta Nº 2529, de 2020, que fija selección, lista de espera y no elegibilidad; todas dictadas por la Subsecretaría de las Culturas y las Artes, en el marco de los concursos públicos en las líneas que se indican del Fondo Nacional de Desarrollo Cultural y las Artes. CONSIDERANDO Que la ley N° 21.045 creó el Ministerio de las Culturas, las Artes y el Patrimonio, cuyo objeto será colaborar con el Presidente de la República en el diseño, formulación e implementación de políticas, planes y programas para contribuir al desarrollo cultural y patrimonial armónico y equitativo del país en toda su diversidad geográfica y las realidades e identidades regionales y locales, conforme a los principios contemplados en la ley. Asimismo, el artículo 3 numeral 1 de la ley, establece como función del Ministerio promover y contribuir al desarrollo de la creación artística y cultural, fomentando la creación, producción, mediación, circulación, distribución y difusión, de las artes visuales, fotografía, nuevos medios, danza, circo, 1 teatro, diseño, arquitectura, música, literatura, audiovisual y otras manifestaciones de las artes. Que la ley N° 19.891, en su artículo 28 creó el Fondo Nacional de Desarrollo Cultural y las Artes, y el Decreto Supremo N° 144, de 2011, del Ministerio de Educación, que aprueba el Reglamento del Fondo Nacional de Desarrollo Cultural y las Artes, en su artículo 5° dispone que la asignación de los recursos del Fondo a los proyectos deberá realizarse por concurso público cuyas bases determinarán el contenido de las respectivas convocatorias a presentar proyectos si éstas son de ámbito nacional o regional y si se orientan a una o más líneas de funcionamiento del Fondo. Que el mismo Reglamento, en su artículo 35, agrega que las bases fijarán las condiciones, plazos de postulación y requisitos de la misma; se establecerán los formularios obligatorios para los proyectos y presentaciones en que deberán constar, al menos, el nombre del proyecto, individualización del responsable, fecha de recepción y material que se adjunta; se señalarán los criterios de evaluación que en cada caso se emplearán y la ponderación que habrá de darse a éstos; las garantías para asegurar el adecuado desarrollo de los mismos; y en general, todas las materias necesarias para llevar a cabo los concursos y seleccionar proyectos acordes a los objetivos del Fondo y sus líneas de funcionamiento, así como todas las demás materias que el reglamento establece como parte de los concursos. Que de acuerdo a lo establecido en el articulo 17 N° 5 de la ley N° 21.045, será de competencia del Consejo Nacional de las Culturas, las Artes y el Patrimonio, proponer al Subsecretario de las Culturas y las Artes los componentes o líneas de acción del Fondo precitado, por lo que en Sesión Ordinaria N° 13/2020, de fecha 09 de julio de 2020, del Consejo Nacional de las Culturas, las Artes y el Patrimonio, le fue presentado a dicho órgano colegiado una propuesta de componentes para el Fondo Nacional de Desarrollo Cultural y las Artes en relación al ejercicio presupuestario del año 2021. En el marco de dicha propuesta el mencionado Consejo realizó una serie de observaciones, conforme consta en acta de dicha sesión, dándose cumplimiento de esta forma a lo establecido en el artículo 17 numeral 5 de la ley N° 21.045. Que en razón de lo anterior, mediante Resoluciones Exentas N° 1.162, 1.163, 1.164, 1.165, 1.166, 1.167 y 1.168, todas de 2020 y de la Subsecretaría de las Culturas y las Artes, fueron aprobadas las Bases de Concursos Públicos del Fondo Nacional de Desarrollo Cultural y las Artes, en las Líneas de Artes de la Visualidad; Infraestructura Cultural; Fomento a la Economía Creativa; Diseño; Becas Chile Crea; Artesanía; y Arquitectura, todas ámbito nacional de financiamiento, Convocatorias 2021. Que conforme lo disponen las respectivas Bases de concursos y el Reglamento del Fondo, en los concursos públicos que se convoquen, los proyectos serán evaluados y seleccionados por Comisiones de Especialistas y/o Jurados, según corresponda, compuestos por a lo menos tres personas, con destacada trayectoria, lo cual fue formalizado por la Resolución Exenta N° 1.268, de 2020, de esta Subsecretaría. Que con respecto a los concursos públicos de las Líneas de Infraestructura Cultural y Artes de la Visualidad, luego del proceso de admisibilidad de las postulaciones, los respectivos Comités de Especialistas procedieron a evaluar los proyectos de conformidad con los criterios establecidos en las respectivas bases concursales. Asimismo, los proyectos que tuvieron la calidad de elegibles pasaron a conocimiento de cada Jurado, a quienes corresponde la selección y determinación de asignación de recursos. 2 Que según consta en actas de los respectivos Jurados, estos procedieron a seleccionar y a determinar la asignación de los recursos a los proyectos que en su opinión fundada califican para ser financiados de entre la nómina de proyectos elegibles confeccionada por los especialistas. Que por otra parte, en relación a las Líneas de Fomento a la Economía Creativa, Diseño, Becas Chile Crea, Artesanía y Arquitectura; y de conformidad con el procedimiento concursal y luego del proceso de admisibilidad de las postulaciones, los respectivos Comités de Especialistas o Comisión de Becas, según correspondiese, encargados de la etapa de evaluación y de selección, evaluaron los proyectos y resolvieron la selección y determinación de asignación de los recursos. Que si bien los recursos del Fondo Nacional de Desarrollo Cultural y las Artes, para la convocatoria 2021, en su ámbito nacional de financiamiento, ya fueron distribuidos preliminarmente por esta Subsecretaría de las Culturas y las Artes, a través de los referidos actos administrativos que aprobaron las bases de concursos teniendo como referencia la distribución presupuestaria de convocatorias anteriores, el monto definitivo de tales recursos (incluyendo los respectivos incrementos) fue determinado por la ley Nº 21.289, sobre presupuestos del Sector Público correspondientes al año 2021, en su Partida 29, Capítulo 01, Programa 02, Subtítulo 24, Ítem 03, Asignación 097, Glosa 06 “Fondo Nacional de Desarrollo Cultural y las Artes”. De esta forma y de acuerdo a lo establecido en las respectivas bases la Subsecretaría de las Culturas y las Artes, en caso de contar con recursos podrá aumentar la disponibilidad prseupuestaria de las convocatorias con la finalidad de financiar una mayor cantidad de proyectos elegibles. Que por otra parte, luego de determinada la selección por parte de los Comités de Especialistas, Comisión de Becas y Jurados, existieron montos remanentes, los que de acuerdo a bases de convocatorias: “Se generarán recursos remanentes cuando no existan proyectos elegibles o bien, cuando estos no sean suficientes para agotar los recursos disponibles (…) La Subsecretaría podrá reasignar estos recursos remanentes a los fines que estime pertinentes, de conformidad con lo establecido en la respectiva normativa legal.” Que en virtud de lo anterior es que esta Subsecretaría ha estimado conveniente incrementar los montos disponibles en las líneas Artes de la Visualidad; Fomento a la Economía Creativa; Diseño; Becas Chile Crea; Artesanía; Arquitectura y Organización de festivales, ferias y encuentros, de acuerdo a lo que se indican en la parte resolutiva de la presente resolución, provenientes del aumento presupuestario y remanentes, con el fin de financiar proyectos que se encontrarían en lista de espera. Que se hace presente que respecto de la línea de Organización de festivales, ferias y encuentros, ya fue fijado la selección y listas de espera mediante la Resolución Exenta Nº 2529, de 2020, de esta Subsecretaría, pero al verse inyectado nuevos recursos, de acuerdo a lo ya explicado, se podrá financiar proyectos que actualmente se encuentran en lista de espera, por lo que se fiajarán en el presente acto administrativo aquellos que resultan beneficiados individualizando los nuevos puestos en lista de espera, para dicha línea.

    Chapter 11 RAIL TRANSPORT IN CHILE Raimundo Soto 1 Extensive reform was completed in the rail sector in Chile and different models were used, including full privatisation and concessions. Both types of reforms achieved significant efficiency and welfare gains and reforms have improved the industry operations, particularly in freight. Motivation for the reforms was to reduce subsidies: that issue remains, particularly in the passenger sector. 11.1 INTRODUCTION Railways played a significant role in social life in Chile for almost a century. Between 1860 and 1950 railroads were an exemplar of modernisation, integration and economic development. By 1950, however, the industry had started to decline, unable to compete with more efficient means of transportation (buses and trucks). By the mid 1970s railroads were bankrupt, surviving through government subsidies. Two decades later, passenger services had almost disappeared (accounting for less than 1% of total traffic). Freight operations, on the contrary, had been privatised and revitalised, and concentrated on small profitable market niches usually in remote areas of the economy (Thompson & Angerstein 1997). This paper reviews the Chilean case and analyzes the current standing and operations of the industry, focusing on the reforms, public sector involvement, regulation, market entry, vertical integration, externalities and political factors. The Chilean economy underwent a massive restructuring in the mid 1970s. This included opening to foreign trade, complete market deregulation, inflation control, macroeconomic stabilisation and, most importantly for our study, a complete reallocation of government subsidies. In this economic turnaround, despite the waste and inefficiency associated with the publicly-owned railroad monopoly, no specific reforms were devised for railroads.

It has a high concentration of higher education and research activity. How can the Bío Bío Region promote new business formation and the development of the existing small and medium-sized companies?     Disruptive Technologies: Regulation of Digital Platforms Chapter 3 Transport Platforms Abstract This chapter deals with digital transport platforms focusing on ridesourcing or ride-hailing platforms. It provides details of some of the leading active platforms in the country and information on its users and drivers. It presents an estimation model on the efficiency gains granted by the platforms’ technology, which on average imply cost savings of 33%, significantly higher than the 2% derived from savings due to the absence of regulation. Finally, the chapter delivers a set of proposed regulations for the sector. 3.1 Introduction People move within their city to carry out multiple activities, requiring different forms of mobilization (hike, bicycle, car, etc.). These may both be collective or individual, and of public or private access (see Table 3.1). The options of mobilization affect people´s quality of life, and, because of their impact on the use of private and public spaces -such as streets or parking lots – they affect society as a whole. The transport system that moves people and cargo is a critical factor in the modern economy. It allows participation in social activities, economic exchanges, and the spatial distribution of goods. In turn, it generates social costs, such as congestion and pollution. The challenges related to mobility are multiple and complex, which in public transport include rates, waiting and displacement times, exclusive routes, comfort, and safety, etc.; while in the private sector consider road pricing costs, road space rationing, congestion, and access to parking lots, among many others. Less is known about how these emerge in developing countries, and what they can tell us about citizens’ role in innovation to achieve more socially just, good and livable cities. Using a complexity-based approach, this dissertation explores lessons from an anti-highway movement in Santiago, Chile (1997), which challenged authoritarian planning paradigms inherited from the Pinochet regime (1973-1990). In 2000, these leaders of diverse communities founded a citizen institution, Living City (Ciudad Viva), which today is a prize-winning, citizen-led planning institution. Participation is recognized as important to community development, health and urban planning. Nonetheless, a rich literature notes many limitations. Is improving participation just a matter of “getting the process right”?
