116/20Welcome and Apologies for Absence:

The Chair welcomed members to the meeting. Apologies for absence were received from Cllr G Baker.

117/20Declarations of Interest :

Members were reminded that they must declare the existence and nature of any personal and/or prejudicial interests. None were declared.

118/20Minutes :

a) Resolved to approve and sign, as a correct record, the minutes of the last meeting, held on 6 th October 2020. b) The Clerk submitted, for information, the notes from the Remembrance Sunday Working Group meeting held on 20/10/2020, which were noted by members. Members were asked to share the Press Release with all the details.

119/20Matters arising from the Minutes:

Min 98/20(a): BT Kiosk, Abergele Road: The Clerk submitted: (i) An email from Conwy CBC regarding the adoption process. (ii) An email from BT regarding the condition of the kiosk. (iii) The draft contract, should the Town Council wish to pursue adoption of the kiosk on Abergele Road. (iv) Data from NHS 11 Site on the current locations of defibrillators and the link to the website.

The Clerk informed members that Cllr Barton would like to use the funding allocated from his ward allowance, plus other funds raised locally, to see eight defibrillators located at approximately 3 minute walking intervals, from the fire station to Aldi in . It was noted that the defibrillator at Ysgol Hen Golwyn is not included on the NHS 111 map, as it is not currently operational (a new battery will cost approximately £400).

Members agreed that the kiosk was not ideal, due to its poor condition and the concerns about its location received from other interested parties, including and the Secretary of OCRA (Old Colwyn Residents Association).

Cllr Barton confirmed that he was awaiting pictures to evidence the poor condition of the kiosk and that he was also investigating other suitable locations in the vicinity.

Resolved to defer the signing of the BT contract to adopt the kiosk to await feedback from Cllr Barton on other potential sites.

Members were asked to look at the NHS 111 site to help identify any defibrillators in their ward that were not on the map and consider any gaps in coverage across the town council area.

120/20Conwy CBC:

a) Temporary Traffic Regulation The Clerk submitted, for information: (i) TTR for Abergele Road (Welsh Baptist Church to the bus stop o/s the fire shop) from 09/11  12/11 (Gas Work). (ii) TTR for Ivy Street Carpark from 25/11  27/11 (Gas Work). (iii) TTR for Road (Jnct Nant y Glyn Rd to Jnct St Andrews Rd) from 30/11  03/12 (BT Work). (iv) TTR for Llewelyn Road from 1/11/2020 (parking Prohibition)

b) IMAGINE project : The Clerk gave a verbal report on the recent Imagine Steering Group meetings. It was noted that despite the Co-Vid restrictions and the impact that these had had on face-to-face activities, there had been a lot going on behind the scenes The Clerk updated the committee on a number of the ongoing activities: Culture Strategy; Recollection; Bay of Colwyn Branding; Creative & Digital Training Bursary and the Imagine Augmented Reality Trail. There were also lots of projects/activities in development including: Sculpture trail/installations and the state of Independence/Shop local project, which has received grant funding from the Town Council. This will now be a Christmas campaign to encourage local shopping. The Imagine project officer has also been working with Chris from the Harlequin Puppet Theatre on plans is to film his show and record the built and social history of the Theatre in another film to include archive footage, which will need digitising. The Imagine project has recently been extended to September 2021, due to the impact of Co-Vid on its projects/activities.

121/20 Noticeboards:

The Clerk asked the members to check their noticeboards in their wards, as the quarterly inspections were now overdue. Members were reminded to observe lockdown rules and to only inspect the noticeboards as part of their daily exercise. Members were asked to report back to the Assistant Clerk with details of any maintenance needed. 122/20 Awel y Mor:

The Clerk submitted a letter and briefing note regarding a virtual consultation on proposals to extend the Gwynt y Mor windfarm. Members noted the correspondence and were asked to share the information.

Resolved to request that the assistant Clerk shares this information with all Town Councillors.

123/20 Abandoned Outbuilding at Rainbow Bridge Headland:

The Clerk submitted an email from Conwy CBC, which was noted by members.

124/20 Transport for Wales:

The Clerk submitted an email from Transport for Wales asking for suggestions for improvements at the Colwyn Bay train station.

Resolved to defer this item to the next meeting and forward the email to all members of the Council to ask for suggestions for improvements.

125/20 Fields in Trust:

The Clerk submitted information on the Green Spaces for Good programme, which can protect any publicly accessible park, playing field or nature reserve.

Resolved to request that this information be sent to all Town Councillors and that any suggestions be brought back to a future meeting of this committee for consideration.

126/20 Planning:

a) The Clerk submitted, for consideration, the planning applications received from CCBC.

Resolved to submit observations on these applications, as detailed in Schedule A attached.

b) Resolved to receive a copy of the Planning Decisions issued by CCBC for the period 21/09/2020 - 18/10/2020.

Hi Tina.I have checked the notice board in Old Colwyn, the board is sound. the notices on the board could be sorted out to make room for new ones.

I also checked out the phone box.There are 4 panes of glass missing, it need a lot of work inside and outside to make it presentable,,the door hinges are suspect and it needs rubbing down and re painting.It is situated in a cold damp area and has over grown vegitation at sides and the rear from the land at the back.A lot of work required and expence before even thinking of putting a machine in there. In my opinion there are a lot more ideal locations to place this machine than this phone box.

Also for your information, The notice board on Groes Road Colwyn Bay Ok but Ivy starting to grow over the board and around the fence Colwy bay board ok.I have drove passed the one in Old Colwyn and it looks ok, I will be in Old colwyn tomorrow so I can have a closer look and look at the phone box at the same time. We are happy to announce Council is being awarded a Local Places for Nature preparatory works grant from Welsh Government, for the completion of a detailed and costed tree planting and maintenance delivery plan.

It is hoped the mature trees and associated infrastructure will be planted and associated infrastructure installed subject to funding in April 2021 to March 2022.

Colwyn Bay has been chosen initially as a community within which there is a deprived ward with lower than average tree canopy cover and whose communities have in the past been receptive to such proposals. The aim is to increase tree canopy cover, restore nature and bring positive health and wellbeing impacts to the local community and hopefully engage them in the stewardship of the trees in the long term.

As a first step would Colwyn Town Council please provide reply to the follo wing?

 Are you supportive of the proposal to plan and implement a tree planting initiative as funding is available?

 If yes, you are invited to identify a suite of potential locations out with the geographic scope of the Colwyn Bay Town Centre Regeneration plan that you deem most appropriate for planting (both planting into pavement with associated infrastructure and soft ground will be considered).

Please send me a map or postal code addresses for locations as most convenient.

 Please provide detail of how you think it would be best to encourage stewardship of the trees by local residents particularly during the first few years of their establishment.

 Additionally I have had recent correspondence from an organisation called Earth watch who are looking for opportunities to create a network of tiny forests across the UK

Tiny forests comprise around 600 native young trees which are planted in a tennis court size plot at high density, producing a fast growing forest with low management requirements that is self-sustaining once established

Yes, it is potential planting locations that Kate needs to know sooner rather than later. I had been under the impression that the consultants who we will be engaging would be starting with a blank sheet of paper and working up possible location from the consultations they undertake. However, because of the complexities of the approvals processes for planting trees within the highway, we now need to narrow potential planting locations down so that the appointed consultants start off with a focussed list of areas / sites to consider.

11 3.2 Priorities for the playwork workforce

Strategic priorities Play Wales will work with Welsh Government and other strategic stakeholders to seek to address the following priorities:

PWS1 Funding for playwork qualications that reduces the burden on learners and employers and allows for increased uptake and accreditation of playwork learners.

PWS2 Identifying funding for the sustainability and development of playwork qualications from level 1 to 5 that most effectively meet the needs of the sector.

PWS3 Ensure that the effect of changes to playwork qualications driven by UK wide factors are incorporated in plans for Wales to work towards a clear sustainable qualication path for those wishing to progress in playwork.

PWS4 Increase the delivery infrastructure for playwork qualications in Wales especially in relation to the numbers and levels of competence of tutors and assessors.

PWS5 Work with key stakeholders to ensure that progression routes for playwork are streamlined, sustainable and achievable for the needs of the workforce.

PWS6 Continue to work with the Playwork Education and Training Council for Wales (PETC Wales) to steer the strategic direction of the quality and status of playwork qualications in Wales and the UK.

PWS7 Work with Qualications Wales and PETC Wales on the quality assurance and designation of playwork qualications eligible for public funding in Wales.

12 Operational priorities Play Wales will work with other partners to address the following priorities:

PWO1 Work with Agored Cymru and Addysg Oedolion Cymru | Adult Learning Wales on the sustainability of quality training delivery for playwork, in particular Playwork: Principles into Practice (P 3), the Level 2 Award in Playwork Practice (L2APP), the Level 3 Award in Managing a Holiday Play Scheme (MAHPS) and the Level 3 Award in Delivering Dynamic Playwork Training (ADDaPT).

PWO2 Support the development of CPD and qualication options that allow playworkers to upskill whilst remaining at the same level.

PWO3 Work with playwork employers and playworkers to identify opportunities and mechanisms to promote CPD.

PWO4 Work with Higher Education institutions to embed competence based playwork qualications into relevant degree courses.

PWO5 Explore options to increase stafng capacity within Play Wales for workforce development.

PWO6 Work with international partners in Europe and the rest of the world to share playwork knowledge, training and qualications. This contributes to Play Wales’ work as an international centre of excellence.

PWO7 Work with stakeholders in Wales and the rest of the UK to review the Level 3 Award in Transition from Early Years to Playwork and explore the feasibility of a transition from playwork to early years.

PWO8 Development of a new quality assurance framework for the playwork sector that meets the needs of registered and unregistered playwork settings. Work with CIW and Welsh Government to ensure that the resulting framework links with the expectations of inspectors and with the ECEC Quality Framework.

PO5 Engage with Further Education and Higher Education institutions to ensure that any qualications and programmes aimed at the play workforce dovetail and respond to priorities within this workforce development plan.

4 1. What is this Consultation About?

1.1 This consultation is seeking your views on our policy intent for the subordinate legislation required to establish the procedure for SDPs to be prepared across Wales by CJCs. The Regulations will be called the Town and Country Planning (Strategic Development Plan) (Wales) Regulations 2021 ( “the SDP Regulations ”).

2. What is the current position?

Local Development Plans and Strategic Development Plans – the current legal framework

2.1 Local Development Plan ( “LDP”) preparation and adoption is governed by provisions in Part 6 of the Planning and Compulsory Purchase Act 2004 (“the PCPA”). The Town and Country Planning (Local Development Plan) (Wales) Regulations 2005, as amended (“the LDP Regulations”), made under that Part, set out the procedure for the preparation of local development plans (“LDPs”) by local planning authorities (“LPAs”). The LDP Regulations have to date facilitated the adoption of 22 initial LDPs and 3 LDP first revisions in Wales.

2.2 The Planning (Wales) Act 2015 ( “PWA ”) gained Royal Assent on 6 th July 2015. Amongst other things, it amends Part 6 of the PCPA for the purpose of introducing SDPs, to be prepared by governance bodies called Strategic Planning Panels (“SPPs”) on the basis of either a voluntary approach by two or more LPAs or a Ministerial direction. It also makes additional provision so that LDPs must be in general conformity with the National Development Framework for Wales (“the NDF”) and any SDP prepared in relation to the geographical area in question, while the SDP itself must similarly be in conformity with the NDF.

2.3 The policy intent in respect of SDPs is to introduce a more strategic approach to plan making at a scale greater than individual LDPs. There is an identified need to improve how the planning system addresses issues that cross local authority boundaries, to reflect how people live their lives today and in the future. SDPs will provide a more consistent, cost effective and efficient approach to plan making, with key decisions taken once at the strategic level. This will allow larger than local issues such as housing numbers, strategic housing allocations, strategic employment sites, strategic green infrastructure routes, supporting transport infrastructure which cuts across a number of LPA areas to be considered and planned for in an integrated and comprehensive way. This will result in more efficient and effective planning outcomes for communities.

2.4 The provision in Part 6 of the PCPA which is related to SDPs is made up of procedural provision and powers conferred on the Welsh Ministers for the purposes of making further procedural provisions in regulations. In summary, the key provisions are:

5 The Local Government and Elections (Wales) Bill (LGEB) – context and implications for SDPs

2.5 The Local Government Elections Bill ( “LGEB ”) was introduced into the Senedd in November 2019 . It introduces CJCs as the Welsh Ministers’ preferred means of preparing an SDP, in place of SPPs. Accordingly, the Welsh Ministers intend to introduce amendments to the LGEB which will in turn amend Part 6 of the PCPA, so that the provisions relevant to SDPs are replicated in all material respects, albeit in a new context where the CJC is the sole body responsible for their preparation.

2.6 The LGEB confers a power on the Welsh Ministers to establish CJCs via regulations. The Minister for Housing and Local Government has confirmed the Welsh Government ’s intention to establish the first CJCs as soon as possible. These CJCs will exercise functions relating to the preparation of an SDP, to the development of Regional Transport plans and in addition, will include a power to promote or improve the economic well-being of its area.

2.7 A consultation on the draft regulations establishing the CJCs is being undertaken in parallel with this consultation. This consultation seeks comments on the SDP Regulations alone. Why are the SDP Regulations required?

2.8 The SDP Regulations are necessary for the purpose of making procedural provisions which supplement and bolster that which is set out in Part 6 of the PCPA. This will enable SDPs to be prepared by CJCs and given full effect in accordance with Welsh Government policy.

3. Future work and consultation

3.1 This consultation is concerned with the proposed approach for the drafting of SDP Regulations (see Section 4). It is important to note that there will be future opportunities to engage and influence future guidance and legislation that will assist in the preparation and implementation of an SDP.

SDP Guidance Document

3.2 Welsh Government guidance in the Development Plans Manual ‘the DPM’ gives detailed practical and procedural guidance to LPAs, expanding on and explaining the regulations and procedural issues where relevant. The DPM was subject to a 12 week public consultation and was published in March 2020. The DPM (Chapter 10) contains guidance on the Government’s vision, expectations and policy priorities for SDPs. It also provides the context for the preparation of the SDP Regulations as set out below:

6  Chapter 10: ‘Strategic Development Plans’ sets out the Government’s intention that the Regulations will largely mirror the LDP process. The DPM indicates (Table 36, DPM) that subject to public consultation which LDP Regulations are unlikely to apply to an SDP, as well as key aspects, both in legislative terms and expected plan content.

3.3 The DPM gives a strong steer on the content of an SDP and much of the guidance in terms of the key plan stages, preparation and examination procedures, SEA requirements, the ‘soundness’ tests and evidence base requirements will continue to remain relevant to the process we are proposing for an SDP. It is the intention to prepare specific SDP guidance to assist the CJC relevant to the scale of an SDP and the regulations when they come into force.

3.4 Welsh Government will produce guidance relevant to the preparation of an SDP that will be the subject of public consultation and engagement with CJCs / LPAs and key stakeholders before it is formally published. In addition, a revised Development Plan Community Guide setting out the development plan hierarchy, preparation process and the timings and methods of engagement is also due to be published in summer 2021 for use by local communities, businesses and stakeholders.

3.5 In areas with an adopted SDP, an LDP will still need to be prepared. LDPs prepared under an adopted SDP will be more focussed in nature, dealing with local issues and policies, and will identify site specific allocations, prepared in general conformity with the adopted SDP. They will be shorter and more focused in nature and will be prepared and adopted in around two years. For this purpose, fresh regulations will be required. For the purposes of differentiation in this document and future guidance the LDPs prepared under an SDP are called Local Development Plan ‘Lites’ (LDPL).

3.6 Welsh Government currently anticipates that work will start on these regulations in spring 2021 with a view to the regulations coming into force by spring/summer 2022. A specific consultation and engagement with LPAs on the ‘LDP Lite’ regulations will be undertaken before the regulations are finalised.

4. What are we proposing? The policy intent, broad scope, and principles of the SDP regulations

4.1 The purpose of this consultation is to seek comments on the policy intent of the SDP Regulations. All comments received will assist us to shape and finalise those Regulations.

4.2 It is considered that the current statutory process works effectively and is generally well understood by all users of the system. It is the policy position that it is appropriate that the SDP Regulations should largely mirror (expect those contained in paragraph 4.4) the key stages and plan preparation requirements of the PCPA and associated LDP Regulations, where relevant and applicable to do so. A link to the LDP regulations has been provided on page 2. The key difference between an LDP and an SDP is one of scale and this principle will be reflected in the SDP Regulations.

7 4.3 In addition, a Sustainability Appraisal (SA) incorporating a Assessment and Strategic Environmental Assessment (SEA) are statutory requirements of the plan making process. All plans are subject to the principles and ways of working of the Well-being of Future Generations (Wales) Act (WBFGWA) 2015. These provisions will apply equally to an SDP as they do an LDP.

Provision in the LDP Regulations which is not intend for inclusion in the SDP Regulations

4.4 Due to the strategic nature of an SDP the following stages of LDP preparation will not be taken forward:

 It is proposed not to have a short form procedure to prepare an SDP equivalent to that set out in Part 4A of the LDP Regulations. This procedure is considered appropriate where there are very limited alternatives to the strategy of a plan, options, policies etc. However, due to the strategic nature of an SDP, its complexity, degree of influence, breadth of potential options, strategies and locations for change, this approach would not be appropriate.  Joint plan provisions equivalent to those in Part 6 of the LDP Regulations will not be applied to an SDP, as by its nature an SDP is a strategic approach to planning covering several LDPs areas. 4.5 This document sets out the proposed key stages and plan preparation requirements for the SDP regulations and asks relevant questions. When responding to the questions, can you please be clear on why you are agreeing or disagreeing and the changes you propose.

Stage 1: The Community Involvement Scheme (incorporating a timetable for plan preparation)

4.6 A core aim for the development plan system in Wales is early, effective and meaningful community involvement in the process with the aim of building a broad consensus on the spatial strategy, policies and proposals. This principle applies to both LDPs and SDPs.

4.7 Before work on the SDP formally commences, the CJC must engage with its communities, including general and specific consultation bodies, on the content of a Community Involvement Scheme ( “CIS ”) and timetable for plan preparation, collectively called the Delivery Agreement ( “DA ”). This will be the key mechanism setting out how and when communities will be involved in the SDP process so they can effectively shape and influence their area. A proposed list of the general and specific consultation bodies is contained within Annex 1. The following principles will be reflected in the SDP Regulations:

8  The DA and any subsequent revision must be agreed by resolution of the CJC and submitted to the Welsh Ministers for approval. A CJC cannot commence formal plan preparation until a DA has been agreed. The regulations will specify that Welsh Government must respond within 4 weeks of a request to agree the DA. Agreement of the DA marks the formal start of the plan preparation / revision process. The CJC is committed to the stated timescales and consultation processes.  The DA must set out how, when and where communities can engage in the SDP process, including engagement in the SA and monitoring procedures.  The DA will set out the timescales for each stage in the plan preparation process. The stages proposed are explained in this consultation document.  The DA must set out how any responses and representations received at each stage of engagement / consultation will be published and taken into account by the CJC.  Publication arrangements for the DA and where it can be accessed.  There will be an emphasis throughout the regulations on the use of electronic communications. However, provision will still be made for key documents to be available in hard copies at principle offices and key locations specified by the CJC in the CIS.

4.8 It is proposed that an SDP should be capable of being prepared and adopted within 4 years, similar to the current LDP process. The only difference is one of scale on the issues being considered. The key aim is to devise a legislative process that is not unduly long or complicated, and provides opportunities for communities and stakeholders to influence and make representations at key stages of the emerging SDP.

4.9 In addition, the requirements in respect of sustainable development provided for by the WBFGWA will also be central to the preparation of an SDP. The requirements of the Sustainability Appraisal (SA) incorporating a Strategic Environmental Assessment (SEA) and impacts of development on the Welsh language will form an integral part of SDP preparation and engagement. It is proposed that the statutory SA/SEA requirements will be fully integrated into the SDP process and provide the framework, options and evidence necessary to help inform the SDP spatial strategy and policy choices.

4.10 Four years is considered a reasonable time to prepare a robust evidence base and allow opportunities for public engagement to test and seek views on the issues and

9 options, spatial strategy, proposed allocations and supporting evidence in a robust and transparent manner, including alignment and integration with SA and Welsh language requirements. On this basis, it is proposed to retain a two stage approach as set out in the current LDP regulations. There will be a preferred strategy and a deposit plan before the SDP is submitted for public examination.

Stage 2: Pre-Deposit Engagement – the CJC will ask for sites to be included and consider a range of strategies and options

4.11 Effective public involvement at the preferred strategy stage is essential for meaningful community and stakeholder involvement. Early discussion on the evidence base, strategic options, strategy and related proposals, including strategic locations and sites, will be critical for consensus building and to ensure there are no major impediments to the delivery of the preferred strategy. Consultation with specific and general consultation bodies is essential. The following principles will be reflected in the regulations:

 The call for strategic locations and sites will form the initial building blocks of the SDP. The regulations will specify t hat a ‘call for strategic locations and sites ’ must be undertaken before a CJC can formally consult on its Preferred Strategy. Strategic locations and sites can either be proposed by the CJC or by other interested parties. All strategic locations and sites received will be published in a ‘Candidate Strategic Locations and Sites Register’, which will be published alongside the Preferred Strategy, enabling people to comment. The CJC must consider any strategic locations and sites submitted before determining the content of the Deposit Plan. The SDP Regulations will not preclude a further ‘call for strategic locations and sites ’ before the Deposit Stage if the CJC consider it appropriate.

 Generating issues and options and engagement – The regulations will set out that before a CJC finalises and formally consults on its Preferred Strategy, it must engage with specific and general consultation bodies, and others as the CJC thinks appropriate (as set out in the CIS) on the range of strategies and options considered and seek views on them. The regulations will be flexible in this respect and it will be for the CJC to decide on the specific detail on what it consults on at this stage in the process. However, compliance with the participation and public consultation requirements of the SDP Regulations must also meet the requirements of the SEA Regulations to ensure reasonable alternatives to the plan are identified and evaluated.

Stage 3: Preferred Strategy – Pre-Deposit Public Consultation & Summary of Responses Received

4.12 The Preferred Strategy is the first statutory consultation stage in the SDP process. The Preferred Strategy and supporting evidence will be subject to a minimum of 6 weeks statutory consultation. It sets out the broad approach to the scale and location of growth and ensures development is planned in a sustainable manner. It provides the strategic framework for more detailed policies, proposals and specific land use allocations, which will subsequently be included in the Deposit SDP. The regulations will specify that it must contain a preferred spatial strategy, options and proposals for the

10 SDP and the implications of these, with earlier alternatives and implications made explicit (See also SA and Stage 2). The following principles will be reflected in the regulations:

 Publication arrangements and locations where people can access documents, i.e. electronically or in hard copy at principal offices of the CJC and the LPAs within the CJC geographical area.  Minimum content and documentation requirements including; the Preferred Strategy, supporting evidence as the CJC considers appropriate, initial SA report, strategic locations and sites register and any review report. The Preferred Strategy will contain policies and reasoned justification.  A list of general and specific consultees to be engaged (see Annex 1) in addition to any general consultation body that the CJC considers have an interest in matters relating to the development of the CJC area. This will also include mandatory consultation with any neighbouring CJC and LPA.  Details about the submission and handling of representations which must be made in the timescales set out by the CJC and sent to the address specified, either in hard copy or electronically.  The CJC must consider any representations made in relation to the Preferred Strategy before determining the content of the Deposit Plan.  Following consultation on the Preferred Strategy, the CJC must prepare a Consultation Report setting out the number of representations received, including who it has engaged and notified, and summarise the main issues raised in and responses from all engagement and consultations up to this point. The Consultation Report must set out to what extent the issues raised have been addressed before finalising the content of the Deposit Plan. This ensures there will be a transparent audit trail for communities to understand how their comments have been taken into account in the SDP process.

Stage 4: The Deposit Plan – Public Consultation and Summary of Responses Received

4.13 The Deposit Plan is the plan the CJC considers ‘sound ’ and intends to submit for examination following consultation and is able to be adopted. The Deposit Plan must be consulted on for a minimum of 6 weeks. It will include the final spatial strategy for all land uses, including strategic site allocations. It will be supported by a proposals map / maps. It will be accompanied by a supporting evidence base and final SA/SEA reports. All policies and proposals that have a spatial implication will be reflected on an OS based proposals map / maps. The Deposit Plan will contain policies and reasoned justification for the range of topic areas relevant to the CJC area. The following principles will be reflected in the regulations:

 Publication arrangements and locations where people can access documents and representations received, i.e. electronically or in hard copy at principal offices of the CJC and LPAs within it.  Minimum content and documentation requirements including the Deposit Plan, supporting evidence as the CJC considers appropriate, SA report, Habitats Regulations Assessment report, updated strategic locations and sites, the consultation report and any review report.

11  Details about the submission of and handling of representations which must be made in the timescales set out by the CJC, and sent to the address specified, either in hard copy or electronically.  Following consultation on the Deposit Plan and before the plan is submitted for examination, the CJC must update the Consultation Report setting out which bodies the CJC has engaged, consulted or notified at Deposit stage. A summary of the main issues raised, responses and representations made as a result of the engagement, consultations or notification. The total number of representations received and the CJCs recommendations as to how it considers the main issues raised through each of the representations received should or should not be addressed in the SDP. This will be considered during the examination process. The report will set out if there has been any deviation from the community involvement scheme and robust explanation and justification for doing so.

Stage 5: Submission of the Deposit Plan for Public Examination & Adoption

4.14 The CJC must not submit the SDP to Welsh Ministers unless it has considered all the representations made at Deposit Stage. The CJCs response to the representations received at Deposit will be documented in the updated Consultation Report.

4.15 The Consultation Report will be considered as part of the examination process, during which the Planning Inspectorate will consider the plan and supporting evidence on behalf of Welsh Ministers. When a plan is submitted for examination, the plan is within the remit of the Planning Inspectorate.

4.16 The SDP regulations will specify the notification, publication and documentation requirements for submitting the plan for examination. This will ensure that all interested parties are aware of the examination procedures, the name of the appointed inspector and the timescales and venue/s for the examination hearings. The specific examination submission documents are:

 The Deposit Plan and supporting proposals map/s  All relevant supporting evidence relating to the preparation of the SDP  Updated Consultation Report containing the summary of issues raised and representations received at Stages 2-4 and the CJC response (see paragraphs 4.12 - 4.13)  Updated SA and HRA reports

12  Any relevant Review Report  ‘Strategic locations and sites ’ register  Copy of the representations received at Deposit Stage  The Delivery Agreement

4.17 The appointed inspector must consider all ‘duly made ’ representations and determine if the SDP is ‘sound’. The function of the examination is to assess whether the preparation requirements have been followed and whether the submitted LDP meets the tests of soundness. The soundness tests are contained in Table 37 of the DPM and will remain relevant for an SDP, albeit they will be updated in the guidance produced in respect of the preparation of an SDP.

4.18 When the examination process has concluded, the Inspector will make binding recommendations (in the Inspectors Report), either to adopt the plan as it is or with the changes set out. The CJC may adopt the plan, based on the Inspectors changes, within 8 weeks of receiving the report. The CJC must publish the Inspectors report (on its website and at principal locations) on or before the day the SDP is adopted.

4.19 Following adoption of the SDP, the CJC must prepare an Adoption Statement which will state the date the SDP is adopted and make clear that if a person is aggrieved by the SDP they may make an application to the High Court under Section 113 of the PCPA. This section provides that a person can make a legal challenge in the 6 weeks following the date of adoption. The CJC will publicise the adoption and notify all those who have asked to be notified and set out the availability of key documents. The CJC will make the following documents available online and at the key locations identified by the CJC:

 The SDP & Proposals Map/s  Adoption Statement  The SA Report  The Inspectors Report

4.20 The CJC must send one hard copy of the SDP and Adoption Statement to Welsh Ministers.

Stage 6: Monitoring, Review and Revision

4.21 Monitoring is a continuous process and does not end once a plan is adopted. It represents an essential feedback loop within the cyclical process of achieving sustainable development. Monitoring and review should be an ongoing function of the plan led system and is a vital aspect of evidence based policy making.

Annual Monitoring Reports

13 4.22 The CJC (following resolution) must publish and send an Annual Monitoring Report (“AMR”) to the Welsh Ministers by 31st October each year following adoption. The SDP regulations will state:

 That the AMR must set out what policies are not being implemented, including any remedial actions to address any deficiencies.  The AMR will conclude on whether a revision of the SDP is required.  The AMR should be published on the CJC website.

The Review and Revision Process

4.23 The AMR should assess the extent to which the plan’s strategy and key policies, sites and infrastructure requirements are being delivered. Each AMR will be based on the results and commentary of the preceding financial year. This will enable trends to become clear with more refined commentary and analysis. This will assist the CJC in having documentation to inform the review and revision of the SDP. The SDP regulations will specify that:

 The CJC must review its LDP no longer than 4 years from the date of adoption. A CJC can decide to review its plan earlier if evidence from the AMR, or publication of the National Development Framework suggests this is the most prudent course of action to deal with the issues, or to make the SDP in conformity with the NDF.  When the CJC commences a review of its SDP it must, within 6 months of commencing a review, submit a Review Report to Welsh Ministers. The Review Report must be agreed by resolution of the CJC before it is submitted to Welsh Ministers.  The content of the Review Report will be set out in guidance, currently the DPM.

Withdrawal of an SDP

4.24 The SDP regulations will contain detail about the application, notification and publication procedures in respect of withdrawal of an SDP.

Withdrawal in the absence of a direction

4.25 A CJC may withdraw an emerging SDP before it is submitted for examination. The CJC must notify Welsh Ministers of its intention to withdraw the plan prior to the actual withdrawal. The SDP Regulations will state that if a CJC intends to withdraw and cease work on its SDP, within 7 days of the CJC resolution to withdraw, the CJC must supply Welsh Ministers with the following:

14  Planning reasons for withdrawal of the SDP  A copy of the report to the CJC recommending the proposed withdrawal  A copy of the resolution to withdraw the SDP

4.26 The Welsh Ministers can by direction ask for additional information if what is provided is not sufficient or does not comply what is required, and extend the time period to respond beyond the 6 weeks that is specified.

4.27 Where an SDP is withdrawn, the SDP Regulations will also specify the notification and publication arrangements for the withdrawal to make clear to stakeholders that the plan is withdrawn. As soon as reasonably practical after an SDP is withdrawn, the CJC must publicise the fact and remove all documents relating to the plan from the public domain.

4.28 The SDP Regulations will set out the procedures, publication and notification arrangements for the application of the Welsh Ministers’ powers of intervention . If in exceptional circumstances powers of intervention are used in the SDP process, Welsh Ministers will operate in a transparent manner and the regulations will make provision on:

 Publicising the reasons and rationale for using intervention powers  The procedures to be followed in the remaining plan process  Where and how people can make comments and the timescales for doing so  How and where documentation can be accessed  Welsh Ministers must give due consideration to any representations received  If a person is required to be appointed to examine the plan, this will follow a transparent process, akin to current examination procedures, and a report will be published setting out the conclusions and rationale for them.

The Association is aware that when consultations are held the documents are bulky and unintelligible to anyone not within the professions related to planning. The summary referred to by the Association is so important and should be in plain language and not too long.

Q10 Other questions We would like to know your views on the effects that the proposals would have on the Welsh language, specifically on opportunities for people to use Welsh and on treating the Welsh language no less favourably than English. What effects do you think there would be? How could positive effects be increased, or negative effects be mitigated?

The Association supports the Welsh Language but does not see how this is relevant to this process other than material being in bot h Welsh and English. In the interests of ‘saving the planet ’ documents should be available separately and not a combined Welsh/English. This will save paper as people could request one or the other. It is assumed that most of the material will be web based only.

The response to questions 1 and 2 on the Town Councils comments are as follows:

Question 1. The location of the facility, due to its close proximity to Eirias Park/ play space. More information is requested on what the Short Term Assessment Centre is to be used for, with concern it may become a temporary bail type facility (which would not be suitable at this location). Its intended use has been queried by a local County Councillor, but a response has not been received. Have other locations/vacant sites been considered?

Response

a.) Use of the Childrens Assessment Centre

In order to develop this much needed facility in Conwy, the like of which there is no other in the whole of North Wales, Conwy County Borough Council (CCBC), County Council (DCC) and Betsi Cadwaladr University Health Board (BCUHB) have been awarded Welsh Government (WG) Capital funding from the Integrated Care Fund (ICF) with which to partially meet the Capital costs of developing the Childrens Assessment Centre on the Meadow Lodge site and WG Transformation funding to set up and run a peripatetic Team of Professionals, and whom will be based in the Childrens Assessment Centre once it becomes available, to support children in need. To be awarded and to retain both of these funding streams there is strict criteria which the Partnership have to adhere to, failing to do so would lose us the funding. To ensure that we are spending the monies in the correct fashion to meet our stated aims and objectives we have to report back to WG on a quarterly basis to account for how the monies have been spent and progress made. Once built, the Centre will be registered with the Care Inspectorate in Wales (CIW) under the Regulation & Inspection of Social Care (Wales) Act 2016 for children aged 6  17 years of age with CIW having the right to carry out inspections without giving prior notice.

The Family Support & Intervention Service Manager has started work on the official CIW application, and below has been taken from this CIW application explaining the stated Purpose & Function of the Childrens Assessment Centre plus the Eligibility Criteria for a child to be referred for admission there:

Summary of Purpose & Function of the Childrens Assessment Centre

The assessment unit will provide two main elements of a comprehensive service for children at risk of long term accommodation. First element is access to a multi-disciplinary team led by CAMHS & Social Service practitioners and consisting of a Clinical Psychologist, Social Workers and Family Support Workers. The team will provide assessment and intensive support services to assist families to address any presenting issues and remain together. Following assessment and formulation of the presenting difficulties, the multi-disciplinary team will devise support plans in collaboration with parents/carers and can access short term accommodation if considered beneficial to the long term plan.

The second element of the model is the provision of accommodation within the assessment unit where the MDT is based (either in the Planned Accommodation or Unplanned Short Term Accommodation). Accommodation can be used for respite purposes to prevent crisis or to respond to crisis. It can also be used for a 12 week assessment period in order to fully understand the issues preventing the child living at home and to work intensively with families to overcome the barriers.

If the comprehensive assessment concludes that return home after 12 weeks is not viable the information and analysis will be used to inform future placement identification. If assessed as appropriate, work may continue with the family to facilitate reunification as a longer term aim.

Eligibility Criteria

Referrals will be accepted for the following:

 Family in crisis and child has to leave the family home  Respite accommodation has been identified as a viable support to maintain child at home  Child is at risk in the family home and requires accommodation whilst work continues  Care proceedings are instigated and PWP or Supervision Order is a viable alternative  Emergency intervention required to maintain child at home  Emergency accommodation and assessment of needs is required b.) Have other Locations/Vacant Sites been considered and the reason for the selection of Meadow Lodge for the Childrens Assessment Centre

 Early on in the Project an extensive exercise was carried out when CCBC, BCUHB and DCC undertook searches within their respective property portfolios to identify a suitable location and/or property for the proposed Regional Childrens Assessment Centre. Searches were also undertaken via Rightmove

 On CCBC side discussions took place with the County Valuer and Asset Manager and the Authority was able to identify only one site that was suitable. Denbighshire Council and BCUHB were unable to identify any suitable alternative options.

 Meadow Lodge is central to Conwy county, and is convenient for access to public transport.

 Historically Meadow Lodge was an old farm. The site was comprised of an old cottage and farm building, both of which were derelict. The site is currently unused, and any development requiring full demolition of the old buildings.  The Meadow Lodge site is bordered to the East/SE by Lletyr Dryw, a Grade II listed building, which will have an impact on the visuals of the completed development.

 Early discussion took place with Conwy County Borough Council Planning and Conservation Officers. At that stage no concerns were raised with regards to the proposed development and the Conservation Officer confirmed that although it is an old site, the original buildings had been altered beyond recognition with not enough remaining of the original structures to warrant giving the buildings of Meadow Lodge listed status.

 CCBC have held Meadow Lodge on the Empty Property Register for over 10 years. Prior to this the site was used both as offices and stores. The location of the property, adjacent to Eirias Park (also owned by CCBC) means that Social Care can be reasonably flexible with the required site dimensions for the development and it has been indicated that there is potential to extend the boundary slightly and take up a small portion of unused land currently within the curtilage of Eirias Park.

 The site is in a discrete location, not too close to neighbouring residential properties but adjacent to Eirias Park providing additional outdoor facilities to the space within the development.

 It has a short driveway directly from the A547 that runs through Colwyn Bay and is on a major bus route connecting to all areas along the North Wales coastal belt and inland and within walking distance of the train station.

Question

2. S23 Crime & Disorder Act  this applies to planning applications and should be considered in respect of this application (it has not been referenced within the application) re: potential impact with regards to both the likelihood of an increase in crime / anti-social behaviour or the perception of an increased likelihood of crime.

Response

The likelihood of an increase in crime / anti-social behaviour was not referenced within the Planning Application as the proposed facility is not considered/perceived likely to introduce such a risk. The basis for this judgement comes from a complete lack of evidence of such occurrences over the past 12 years of running the Glan Yr Afon Childrens Residential Home, Mochdre. Glan Yr Afon opened its doors in 2008, and since then there has been no sign of an increased level of crime / anti-social behaviour in the area, and the neighbours have not raised any complaints / issues with us during that time.

4. The appeal site relates to an existing two storey detached dwelling with attached flat roofed garage known as Nant Uchaf Farm, that sits on raised ground above an adjacent minor road which overlooks a valley within gently undulating open countryside near to the town of Colwyn Bay. The dwelling is also located within a ‘green wedge ’ as designated in the adopted Conwy County Council Local Development Appeal Decision APP/T6905/A/20/3254901

Plan (LDP). On the opposite side of the minor road on lower ground are a collection of farm buildings connected to the appeal property.

5. The appeal property has over the years been subject to a number of previously granted permissions for extensions 1. The proposed development would replace an existing single storey extension located to the side of the property with a two storey extension that would also include a balcony feature; the proposed development also includes a detached double garage with storage above located to the rear of the site.

6. The Council ’s first refusal reason refers to the development being refused due to its, size, massing, scale, overbearing impact on the locality, and overdevelopment of the site. Policies DP/1, DP/2, DP/3 & DP/4 of the LDP are cited in the first refusal reason, along with adopted Supplementary Planning Guidance LDP1: Design Guide for Householders (SPG); these collectively seek in broad terms to safeguard visual amenity and character of an area.

7. The appellant draws attention to the Council ’s use of the term overbearing as referred to in its SPG which in that instance focuses on the effect of development on neighbours. The word overbearing is a relatively general term that can also be used to describe the impact of any development on its surroundings, in matters such as its scale, massing, etc, and therefore it’s use by the Council in their refusal reason is reasonable, irrespective of the way the term is used in the SPG.

8. The existing dwelling on the site despite having been extended previously with a single storey garage to one side and a part two storey/single extension, retains the traditional appearance of a relatively modest property commensurate with its rural setting and is reflective of a number of properties in the wider rural area.

9. The existing dwelling sits within a relatively generous plot, nonetheless, given the steep rising ground within the site to the rear, the overall site plot appears long and narrow, with the bulk of the existing dwelling sitting adjacent to the roadside frontage. I appreciate the proposed extension to the property would broadly reflect in design/appearance the previous extension to the northern gable, nonetheless it would result in a dwelling whose extended elements would dominate the traditional appearance of the original building, and in visual terms fundamentally alter what remains of the relatively simple character of the original structure, albeit it has been extended in the past.

10. The proposed two storey extension with balcony, would significantly elongate the built frontage to the property ’s roadside, with its visual impact given even more prominence due to its raised position relative to the road, its eaves/ridge height, and its front elevation flush with the existing property ’s front wall; this would significantly harm the building’s character and appearance, and as a consequence the general area. The removal of part of the previous extension does not assist the appellant, as the extent of area being removed is modest, and is single storey, albeit with a balcony feature above.

11. The proposed extension, in particular, when viewed against, and with, the existing two storey extension would represent a substantial increase in the scale of the dwelling that would not be subordinate to the original dwelling, contributing to the

overdevelopment of the site in terms of built form, notwithstanding the garden area, and as a result harms the character and appearance of the general area.

12. The proposed garage, notwithstanding that it would be set further back into the site, due to its scale would compound the detrimental impact of the proposed extension on the area by introducing another large block of built development that would draw the eye of observers from views in the locality. Setting aside the fact that I have considered the proposed development on the basis of the drawings as originally submitted, assessed and consulted upon by the Council i.e. an extension with detached garage, the appellant ’s suggested deletion of the proposed garage would not overcome my concerns in regards to the rest of the proposal.

13. For the reasons given above, the proposed extension would result in the overdevelopment of the site that would not only be detrimental to the character and appearance of the host property, but also to the wider rural area. In this respect the proposal conflicts with policies contained within the LDP and the SPG which collectively, and amongst other things, seek to prevent harm to visual amenity and the character of the area.

Green Wedge

14. The Council ’s second reason for refusal refers to the impact of the proposal on the green wedge. Policy NTE/2 of the LDP refers to green wedges being designated to prevent the coalescence of settlements and to retain the open character of the area. The explanatory text to the policy states, designated green wedges safeguard, inter alia, the countryside; this policy broadly reflects and is consistent with the most up-to- date national planning policy in regard to green wedges as set out in Planning Policy Wales Edition 10 (PPW). Policy DP/6 states that development proposals must comply with national planning policy and guidance. PPW states a presumption against inappropriate development, with substantial weight to be attached to any harmful impact which a development would have on a green wedge designation. It confirms that inappropriate development should not be granted planning permission except in very exceptional circumstances where other considerations would clearly outweigh the harm. PPW also states the construction of new buildings within a green wedge is inappropriate development unless it is for, inter alia, the limited extension or alteration of existing dwellings.

15. Open character as referred to in the LDP or openness as referred to in PPW is not defined. The Inspector’s description of openness in the appeal decision referred to by the Council is reasonable and a commonly accepted definition of the term; to my mind the definition is equally applicable to the term open character, as referred to in policy NTE/2. Whilst the proposal would not result in the coalescence of settlements as referred to in policy NTE/2, it would, due to its scale, nonetheless run contrary to the second limb of the policy which refers to retaining the open character of the area, due to a significant part of the site being subject to additional built development; this would unavoidably and significantly reduce the site ’s openness. The proposed development due to its scale, would not be a limited extension or alteration of a dwelling as referred to in PPW, nor would it retain open character as referred to in policy NTE/2; it therefore represents inappropriate development in the green wedge. The proposed development is therefore contrary to policies NTE/2 and DP/6 of the LDP, and PPW.

Very Exceptional Circumstances

16. PPW stipulates that building in the open countryside must continue to be strictly controlled. Notwithstanding the appellant ’s personal future needs, or in terms of accommodating the wider family, or the long-term management of the enterprise, I am not persuaded by the evidence that such needs would justify the proposed works or would carry sufficient weight to amount to ‘very exceptional circumstances ’ to outweigh the identified harm. The presumption of sustainable development as set out in PPW does not apply having regard to the stated sustainability key principles and policy objectives.

17. The proposed development runs contrary to local and national planning policies in terms of development within a green wedge which broadly seek to promote the interests of sustainable development. Given the considerable local and national policy conflicts, and consequent harm that I have previously identified I do not consider that any material consideration in the proposal ’s favour as referred to by the appellant are of such significance as to outweigh the harm by reason of inappropriateness as referred to in local and national planning policy.

Other Matters

18. Bearing in mind, my findings above and the fact that the Council have effectively withdrawn their third refusal reason based on the submitted ecological report, I do not intend to address this matter any further within this appeal.

19. The appellant draws attention to the fact that the previous extension to the property was granted by the Council despite their criticism of its design, however, that extension was permitted many years ago in a different planning policy context and therefore would not justify the current proposal. In any event each proposal is considered on its own merits.

20. I appreciate that the extension would provide additional living accommodation for the benefit of the appellant, the appellant ’s family, and for the running of the farm in the future, however, these matters do not carry sufficient weight to overcome the concerns I have identified. I also note the appellant ’s reference to the Welsh Government’s document ‘Building Better Places ’, which is a planning document published in response to the current coronavirus situation. Whilst the proposed development may align itself with certain aspects of that document, nonetheless, the document also highlights that in terms of the development management process relevant material considerations should still be used in refusing applications which do not demonstrate good placemaking; this applies to the proposal.

Overall Conclusion

21. In reaching my decision, I have taken into account the requirements of sections 3 and 5 of the Well Being of Future Generations (Wales) Act 2015. I consider that this decision is in accordance with the Act’s sustainable development principle through its contribution towards the Welsh Ministers’ well -being objective of building healthier communities and better environments.

22. For the above reasons and having taken account of al l the evidence before me, I conclude that the appeal should be dismissed.
