Annual Report 2018-2019 A Note from the Chair As WFF chair for the period 2017-2019, I am working on gender equity and policy in several different ways. First, as a linguist and social scientist, I am interested in ‘representation’ – that is, the ways in which gender, diversity, and equity are discussed on campus: who focuses on them, how we talk about them, and how we can be more effective in advancing our shared aims of an inclusive campus, where all faculty can do their best work. As a researcher, I am interested in using the data collected by organizations on campus to study the impacts of existing policies and procedures. WFF’s leadership on diversity, equity, and inclusion stems from three principles: first, we reject the idea that there is a trade-off between diversity and excellence. Diversity is excellence. As researchers, we understand that knowledge and insight come through many different paths. Secondly, inclusion and respect are at the base of good scholarship. No one can do their best work if they are being undermined or intimidated. Ideas are valued on their merits, and should not be revalued according to who says them. And, finally, we strive to build these principles into what we do at the foundation, not as a nod to some token idea of “diversity talk” or “virtue signaling” at the end. WFF, as one of the few organizations on campus which reaches across Schools and Divisions, has a vital role on campus as a place for research, for advocacy, and for community and mentoring. -

Locating a Moral Justification for State Funded Gender Affirmative Health Care
LOCATING A MORAL JUSTIFICATION FOR STATE FUNDED GENDER AFFIRMATIVE HEALTH CARE Diksha D Sanyal* The judgment of the Supreme Court in National Legal Services Authority v. Union of India while a landmark development in recognition of transgender rights, threw open a Pandora’s box full of questions having moral and legal dimensions. One such question pertains to the obligation of the state to fund gender affirmative healthcare services such as sex reassignment surgeries (‘SRS’). Given how prohibitively expensive they are, this paper interrogates whether the state has a duty to provide for such healthcare services and attempts to provide a normative justification for the same. In the process, it rejects the two most popular reasons advanced for state funding – the identity thesis, and the autonomy framework. Drawing from Amartya Sen and Martha Nussbaum’s capability approach, it instead argues for a shift towards an assessment based on the impact healthcare services have on the ‘quality of life’ of transgender persons. I. INTRODUCTION In 2014, the judgment in National Legal Services Authority v. Union of India (‘NA LSA’)1 recognised the right to self-determine one’s gender identity. This gave rise to obligations on the part of the State to provide for the rights and welfare of transgender persons. Among them, affordable healthcare is one of the most important obligations of the State which needs to be exam- ined. Since India lacks a systemic right to health,2 debates regarding whether the State should fund gender affirmative healthcare services are controversial. Women involved in the most recent wave of the #MeToo movement have rightly received praise for breaking long-held silences about harassment in the workplace. The movement, however, has also rightly received criticism for both initially ignoring the role that a woman of color played in founding the movement ten years earlier and in failing to recognize the unique forms of harassment and the heightened vulnerability to harassment that women of color fre- quently face in the workplace. This Essay highlights and analyzes critical points at which the con- tributions and experiences of women of color, particularly black women, were ignored in the mo- ments preceding and following #MeToo’s resurgence. -

MARCH/APRIL 2017 DRIVING NOWHERE WITH NEUTRALITY Can’t journalists be both storytellers and humans with perspectives, and in so doing still arrive at a truthful destination? ANNUAL ETHICS ISSUE The Sigma Delta Chi Foundation announces the Eugene S. Pulliam First Amendment Award to honor a person or persons who have fought to protect and preserve one or more of the rights guaranteed by the First Amend- ment. Mr. Pulliam, who passed away in January 1999, was well-known for consistently using his own considerable influence and that of his newspaper to support activities that educated the public about First Amendment rights and values. The Sigma Delta Chi Foundation has established this annual award to honor those committed to the same goals as a tribute to the professional contributions that Eugene S. Pulliam made to journalism and to the freedoms outlined in the First Amendment. At the Excellence in Journalism 2017 Conference, the Sigma Delta Chi Foundation will honor an individual, group of individuals or organization with a $10,000 cash award and an engraved statue. The honoree(s) also will receive transportation to the conference in New Orleans, La. Nominations are open to any person, persons or organization in the U.S. or its territories who have worked to protect the basic rights provided by the First Amend- ment. Honorees do not have to be journalists. In fact, the Foundation encourages recognition of those outside the journalism profession for their First Amendment efforts and initiatives, such as, but not limited to, public officials, members of the legal profession, scholars, educators, librarians, students and ordinary citizens.
