Koch, Jr., the Dudley Woodbridge Professor of Law at the William and Mary Marshall–Wythe School of Law, was an administrative law expert of the first order and played an important role in the history of the Administrative Law Review. We are saddened at his passing and invite our readers to join us in reflecting on his many contributions and achievements in the study of administrative law. The Administrative Law Review is unique among law reviews in that it has had several different homes. From 1989 to 1996, while the Administrative Law Review was housed at William and Mary and operated as a faculty-run journal, Professor Koch served as editor in chief and supervised student staff members who assisted in the production of regular volumes. We are grateful for his careful custodianship of the law review and salute his leadership in our field. Truly, he was a luminary. A graduate of the University of Maryland and The George Washington University Law School, Professor Koch also earned an LL.M. from the University of Chicago Law School. He worked at the Federal Trade Commission for five years before beginning his teaching career at DePaul University College of Law in Chicago in 1975. In 1979 he joined the faculty at William and Mary and remained there until his death on February 18, 2012. Professor Koch was a prolific author of books and articles on administrative law. His works include eight articles published in the Administrative Law Review and many more published in other journals. He was the author or co-author of numerous practice books and annual supplements, including portions of Federal Practice and Procedure, Federal Administrative Practice, and the third edition of Administrative Law and Practice. He was the lead author of the celebrated casebook, Administrative Law: Cases and Materials (with co-authors William Jordan and Richard Murphy), now in its sixth edition. Beyond his scholarship, Professor Koch served our field in so many other ways. For the past seven years, he was assistant chief reporter for the American Bar Association project on Administrative Law of the European Union. He also served as the chair of the Association of American Law Schools (AALS) Administrative Law Section from 1999–2000 and chair of the planning committee for the AALS Workshop on Administrative Law in 2000. He served twice as a consultant to the Administrative Conference of the United States. Changing Categories ................................................................. 54 Conclusion ................................................................................................... 55 INTRODUCTION The Supremacy Clause is a slippery thing, considering its few, straightforward words.1 The U.S. Supreme Court says the Clause “is not a source of any federal rights” but merely governs the priority of rights and duties when our sovereigns’ laws conflict.2 Nonetheless, the Clause gives rise to a stand-alone private cause of action for preemption of state (and local3) laws.4 Preemption claims are therefore available to members of the regulated

LEGAL ASPECTS OF THE COMMODITY AND FINANCIAL FUTURES MARKET IN CHINA Sanzhu Zhu* I. INTRODUCTION The establishment of China’s first commodity futures exchange in Zhengzhou, Henan in October 1990 marked the emergence of a futures market in China. The Zhengzhou Commodity Exchange was created in the wake of the country’s economic reform and development, and it became the first experimental commodity futures market approved by the central government. The Zhengzhou Commodity Exchange provided a platform and facilitated a need for commodity futures trading arising alongside China’s economic reform, which had begun in 1978, and which was moving towards a market economy by the early 1990s.1 Sixteen years later, the China Financial Futures Exchange (CFFEX) was established in Shanghai.2 This was followed by the opening of gold futures trading on the Shanghai Futures Exchange on January 9, 2008.3 China gradually developed a legal and regulatory framework for its commodity and financial futures markets beginning in the early 1990s, * Senior Lecturer in Chinese commercial law, School of Law, SOAS, University of London.

Studies on township governments are often discussed in the context of intergovernmental relations, and emphasize the hierarchy of the government’s power system and aspects of policy enforcement. Studies on villages, on the other hand, are frequently discussed in the context of villagers’ autonomy, with attention paid to factors such as the election systems and autonomy issues. This paper examines how collective economies and village election shape the relationship between township governments and villages (village chiefs) from the perspective of the principal-agent approach, based on case studies of China’s coastal region. A regional style of Chinese shadow theatre, Daoqing has undergone dramatic transformation from 1949 to 2013, from being labeled in socialist China as a form of “feudal rubbish” to be eradicated, to being safeguarded as “national treasure”. The changes in Daoqing’s social identity, function, value, interpretation, transmission and safeguarding efforts can be observed in the discourses of both the authorities and the practicing community. These changes may be understood as part of three different stages in the political and economic transformation of socialist China. The researcher has collected governmental archives and conducted semi-structured interviews with Daoqing inheritors in an interpretative phenomenological analysis approach. This thesis analyses how, following Hobsbawm’s argument, Daoqing as an intangible cultural heritage involves an “invention of tradition” through joint actions of the Chinese government and the Huanxian community.

This has seen the emergence of a major effort to draw upon the law reform experiences of other countries, especially in the area of economic law reform. As the securities industry is a key component of an increasingly corporatised market economy, it has been necessary to adopt an effective body of securities laws. Disclosure is the fundamental issue of securities laws as it exists in market transactions and the conduct of market participants. As such, the development of an appropriate body of disclosure law and practice is vital to the integrity of securities law and ultimately to the market economy. It is for this reason that this dissertation looks at the development of China’s securities market and corporate disclosure laws, and identifies the forces that have led to its current form and content.

It continues the urban pattern of more than 800 years ago. Suzhou gardens are the essence of Chinese gardening art, as well as the valuable world cultural heritage site. This paper compared the evolution in the distribution and scale of Suzhou gardens among five historical periods, and discussed the influence of urbanization on gardening. It revealed that: (1) The distribution of Suzhou gardens was affected by the layout and changes of the political centre and commercial centre of Suzhou city; (2) The scale of Suzhou gardens was mainly affected by the available land scale within the city and the wealth of its owner; (3) The cityscape of ‘half city occupied by gardens’ was largely resulted from the rapidly increasing number of small courtyard gardens in the Qing Dynasty; (4) The evolution of Suzhou gardens’ distribution and scale affected interior layouts. The evolution and social development of ancient cities can affect the distribution and scale of gardens. At the same time, the popularization of gardening art also optimizes the cityscape.
