LEGISLATIVE COUNCIL NOTICE OF MOTION MrGaysays- Mr PRESIDENT: I give notice that on the next sitting day I will move: 1. That this House notes that: (a) on 14 September 2016, the House agreed to an order for the production of documents in which the House called on the Minister for Racing to require Racing NSW to produce certain documents regarding greyhound welfare, (b) on 12 October 2016, the Clerk tabled correspondence received that day from the Deputy Secretary, Cabinet and Legal, Department of Preimer and Cabinet, advising that the documents referred to in the resolution of 14 September 2016 would be produced by Greyhound Racing NSW and returned directly to the Legislative Council, (c) on 12 October 2016, the Clerk tabled: (i) documents received on 12 October 2016 from the Administrator of Greyhotind Racing New South Wales, together with an indexed list of documents, (ii) a return identifying documents received on 12 October 2016 from the Administrator of Greyhound Racing New South Wales for which privilege is claimed and are available for inspection by members of the Legislative Council only, (d) the return received on 12 October 2016 sought to claim privilege over the index accompanying the documents however, in accordance with the terms of standing order 52 and practice and precedents of the Legislative Council, the indexes were tabled and subsequently made public, and (e) on 10 November 2016, the Clerk tabled: (i) correspondence from the Administrator of Greyhound Racing New South Wales attaching supplementary submissions in which the Administrator requested that the index be treated as privileged and made available for inspection by members of the Legislative Council only, 1:\LC\House Papers\Loqs and Notices 2016\Leader of the Govt\Minister 161109 Greyhound welfare- Index to documents B version. doc (ii) an index of the documents contained in the public and privileged returns provided on 12 October 2016 from which confidential information had been redacted, which would be made public. 2. That this House notes that: (a) the supplementary submission provided by Greyhound Racing NSW states that publication of the index provided on 12 October 2016 poses serious concerns regarding the personal safety of persons ,named therein, and (b) the release of information on the publication of the index can be attributed to the manner in which Greyhound Racing New South Wales has formulated the description of documents in the index, as the index makes extensive reference to the names of individuals, notwithstanding that SO 52(5) (a) requires only that the author of a document be named. 3. That, notwithstanding no provision is made for claims of privilege over an index or a claim of privilege under standing order 52 (3), given the personal safety considerations articulated by the Administrator of Greyhound Racing New South Wales and the will of the House to protect the personal safety of any person: (a) the index from the Administrator and tabled by the Clerk on 12 October 2016 be made available to members of the Legislative Council only, and (b) the redacted index tabled by the Clerk on 10 November 2016 be published on the Parliament's website. That this House notes that the North East Forest Alliance's "Forests Forever" position statement: (a) identifies that the Forest Agreements for upper and lower north east New South Wales have not delivered a comprehensive, adequate and representative reserve system or ecologically sustainable forest management, and (b) calls for a rapid phase-out of the logging of public native forests in order to protect and restore: (i) · threatened and other native species habitat, (ii) water yields, water quality and stream health, (iii) carbon take-up and storage, (iv) forest health and natural processes. (i) · was formed in 1921 and represents the professional and industrial interests of approximately 16,500 members, covering all ranks of sworn police officers in New South Wales, (ii) is non-political, non-sectarian and affiliated with the Police Federation of Australia, Unions New South Wales and the Australian Council of Trade Unions, (iii) is based on fraternalism for and on behalf of police officers and their families in both trying and better times. 2. That this House: (a) congratulates and commends the Police Association ofNew South Wales for: (i) hosting and organising the 69th Commissioned Police Officers Annual Dinner, (ii) its long and laudable service in representing the interests of New South Wales police officers and their families, and (b) congratulates and commends: (i) retired Chief Inspector Dennis Bray for 40 years of service in the New South Wales Police Force, (ii) retired Inspector David Evans for 43 years of service to the New South Wales Police Force, (iii) Lance Corporal Gary Wilson of the Australian Defence Force for his service to
