Plato, Laws IV 709. 1 PACE INT'L LAW REVIEW [Vol. 5:211 INTRODUCTION Should the Persian Gulf Crisis of 1990-91 (hereafter Second Gulf Crisis)' be characterized as a United Nations Security Council "international enforcement action" under Articles 42 through 50, or as an Article 51 "collective self-defense action" subsequently sanctioned by the Security Council? The founding fathers of modern international law, preoccupied with the "just- ness" of war, would not have been unduly concerned with the answer.4 However, in our age, the name of the rule has assumed a fundamental importance, for at least some of its perceived au- 3. The word "crisis" also helps to distinguish it from the recent Iran-Iraq War, which was a formally declared war not conducted under Security Council auspices or under the recognized parameters of self- defense. The "First Gulf Crisis" refers to the 1987-88 involvement of the United States in vessel escort operations in the Persian Gulf during the Iran-Iraq War, including the September 21, 1987 attack on an Iranian Navy ship laying mines. 4. Kennedy explains this issue differentiation: Traditional scholars begin with the sovereign act, assess its status as public or private, and come to some conclusion about the legal sphere which it structures. They might suggest, for example, that all wars publicly declared by a sovereign are just. In contrast, the primitive scholars begin with an idea of justice, grounded in a moral/legal order which defined sovereignty and the capacities of sovereigns. Justice entrusts sovereigns with certain prerogatives, among them the capacity to engage in wars. Private wars, not expressive of sovereign capacity, are unjust. Id. at 9. However, the "primitives" would have had a more critical interest in the issue than nineteenth century jurists, for whom war was "value-neutral and ultimately power- based." In the nineteenth century, "states were free to employ force and go to war for any reason or no reason." Military and Paramilitary Activities (Nicar. v. A decision to use force was regarded as simply a method of conducting international relations-one choice among many, and it "enjoyed close to a full measure of legitimacy under international law." Edward Gordon, Article 2(4) in Historical Context, 10 YALE J. INT'L L. 271 (1985). Even into World War I, war was not only "legal", but had the effect of suspending the operation of law. Philip Marshall Brown, War and Law, 12 AM. J. INT'L L. 162, 163 (1918). ("Once war has arrived, however, the maxim inter arma silent leges must prevail. War is the abandonment of litigation and argument. It is the negation of law.") It was "[o]nly when the universal liberty to go to war was eliminated," that issues of self-de- fense and collective security could emerge and gain claimants right-holders' status. Even the most fondly treasured max- ims can lose their legitimacy once their dubious parentage is laid bare.' Moreover, the choice of characterizing the Second Gulf Cri- sis and its definitive work product, Security Council Resolution 678,1 inevitably gives rise to other issues. Rejecting an Article 42 interpretation, and forcing the Second Gulf Crisis into the clas- sification of an Article 51 action, effectively steers away from any pretense of Security Council oversight, never mind control. Article 51 proponents will tolerate some Security Council med- dling but arduously insist that Article 51 is little more than a license to wage a war of self-defense without de facto Security Council authorization; anything less would be an impermissible surrender of sovereignty.8 5. Congress sometimes affected the war by what it did and, at other times, by what it did not do. Several themes are addressed in this project. One is how Truman and the congressional Democrats failed each other during the war. The president did not dedicate adequate attention to congressional relations early in his term, and was slow to react to charges of corruption within his administration, weakening his party politically.

At the core of this story is a political puzzle: Why did a largely successful policy that mostly stripped Iraq of its unconventional weapons lose support in American politics to the point that the policy itself became less effective? I argue that, within intellectual and policymaking circles, a claim steadily emerged that the only solution to the Iraqi threat was regime change and democratization. While this “regime change consensus” was not part of the original containment policy, a cohort of intellectuals and policymakers assembled political support for the idea that Saddam’s personality and the totalitarian nature of the Baathist regime made Iraq uniquely immune to “management” strategies like containment. The entrenchment of this consensus before 9/11 helps explain why so many politicians, policymakers, and intellectuals rejected containment after 9/11 and embraced regime change and invasion.

"While the colorful space competition held the forefront of public atten- tion," Hohenberg remarks, "the trained diplomatic correspondents of the major newspa- pers and wire services in the West carried on almost alone the difficult and unpopular East- West negotiations to achieve atomic control and regulation and reduction of armaments. The public seemed to want to ignore the hard fact that rockets capable of boosting people into orbit for prolonged periods could also deliver atomic warheads to any part of the earth. It continued, therefore, to be the task of the responsible press to assign competent and highly trained correspondents to this forbidding subject. They did not have the glamor of TV or the excitement of a space shot to focus public attention on their work. Theirs was the responsibility of obliging editors to publish material that was complicated and not at all easy for an indifferent public to grasp. It had to be done by abandoning the familiar cliches of journalism in favor of the care and the art of the superior historian .. On such an assignment, no correspondent was a 'foreign' correspondent. The term was outdated.

It examines the relationship between ethics, politics and power by discussing how Kurdish issues have been shaped by the political landscape of the twenty- first century. It opens up a dialogue on the contested meaning and shape of human rights, and enables a new avenue to think about foreign policy, ethically and politically. It bridges political theory with practice and reveals policy implications for the Middle East as a region. Using the approach of a qualitative, exploratory multiple-case study based on discourse analysis, several Kurdish issues are examined within the context of democratization, minority rights and the politics of exclusion. Data was collected through semi-structured interviews, archival research and participant observation. Data analysis was carried out based on the theoretical framework of critical theory and discourse analysis. Further, a discourse-interpretive paradigm underpins this research based on open coding. Such a method allows this study to combine individual narratives within their particular socio-political, economic and historical setting.

    “We Shall Overcome and the Southern Black Freedom Struggle” David J. Garrow On October 22, 1945, 1,000 members of Local 15 of the Food, Tobacco, Agricultural, and Allied Workers Union (FTA) went on strike at an American Tobacco Company cigar factory in Charleston, SC, seeking to increase their pay to 30 cents-per-hour. The biracial group of strikers began picketing outside the brick factory building, and in later years surviving participants would recall two African American women, Delphine Brown and Lucille Simmons, as important song leaders who led the strikers in singing. Simmons was a choir member at Jerusalem Baptist Church, and fellow union members would remember her singing a well-known hymn, “I’ll Be All Right,” and altering it to give voice to the striking workers’ own aspirations: “We Will Overcome.”1 1. Library British Library of Political and Economic Science Abstract: This study presents an original effort to explain referendum use through political science institutionalism and contributes to both the comparative referendum and institutionalist literatures, and to the political history of South Africa. Its source materials are numerous archival collections, newspapers and over 40 personal interviews. This study addresses two questions relating to F.W. de Klerk's use of the referendum mechanism in 1992. The first is why he used the mechanism, highlighting its role in the context of the early stages of his quest for a managed transition.
