RULES FOR THE HEAVENS: THE COMING REVOLUTION IN SPACE AND THE LAWS OF WAR John Yoo* Great powers are increasing their competition in space. Though Russia and the United States have long relied on satellites for surveillance of rival nations’ militaries and the detection of missile launches, the democratization of space through technological advancements has allowed other nations to assert greater control. This Article addresses whether the United States and other nations should develop the space-based weapons that these policies promise, or whether they should cooperate to develop new international agreements to ban them. In some areas of space, proposals for regulation have already come too late. The U.S.’s nuclear deterrent itself depends cru- cially on space: ballistic missiles leave and then re-enter the atmosphere, giving them a global reach without serious defense. As more nations develop nuclear weapons and intercontinental ballistic missile (ICBM) technology, outer space will become even more important as an arena for defense against weapons of mass destruction (WMD) proliferation. North Korea’s progress on ICBM and nuclear technology, for example, will prompt even greater in- vestment in space-based missile defense systems. This Article makes two contributions. First, it argues against a grow- ing academic consensus in favor of a prohibition on military activities in space. It argues that these scholars over-read existing legal instruments and practice. While nations crafted international agreements to bar WMDs in outer space, they carefully left unregulated reconnaissance and commu- nications satellites, space-based conventional weapons, antisatellite sys- tems, and even WMDs that transit through space, such as ballistic missiles. -

Defining a War: INDOCHINA, THE VIETNAM WAR, AND THE MAYAGUEZ INCIDENT by Lieutenant Colonel Michael Hunter, USA Abstract: Only two weeks after the fall of Saigon in May 1975, Khmer Rouge forces seized the American mer- chant ship SS Mayaguez (1944) off the Cambodian coast, setting up a Marine rescue and recovery battle on the island of Koh Tang. This battle on 12–15 May 1975 was the final U.S. military episode amid the wider Second Indochina War. The term Vietnam War has impeded a proper understanding of the wider war in the American consciousness, leading many to disassociate the Mayaguez incident from the Vietnam War, though they belong within the same historical frame. This article seeks to provide a heretofore unseen historical argument con- necting the Mayaguez incident to the wider war and to demonstrate that Mayaguez and Koh Tang veterans are Vietnam veterans, relying on primary sources from the Ford administration, the papers of the Vietnam Veterans Memorial Fund, and interviews with veterans. The Emergence of Space Law
THE EMERGENCE OF SPACE LAW Steve Doyle* I. INTRODUCTION Space law exists today as a widely regarded, separate field of jurisprudence; however, it has many overlapping features involving other fields, including international law, contract law, tort law, and administrative law, among others.1 Development of space law concepts began early in the twentieth century and blossomed during the second half of the century into its present state. It is not yet widely taught in law schools, but space law is gradually being accorded more space in law school curricula. Substantial notional law and concepts of space law emerged prior to the first orbiting of a man made satellite named Sputnik in 1957. During the next decade (1958-1967), an intense effort was made to bring law into compliance with the realities of expanding spaceflight activities. During the 1960s, numerous national and international regulatory laws emerged to deal with satellite launches and space radio uses and to ensure greater international awareness and governmental presence in the oversight of ongoing activities in space. Just as gradually developed bodies of maritime law emerged to regulate the operation of global shipping, aeronautical law emerged to regulate the expansion of global civil aviation, and telecommunication law emerged to regulate the global uses of radio and wire communication systems, a new body of law is emerging to regulate the activities of nations in astronautics. The SKYLON Spaceplane
The SKYLON Spaceplane Borg K.⇤ and Matula E.⇤ University of Colorado, Boulder, CO, 80309, USA This report outlines the major technical aspects of the SKYLON spaceplane as a final project for the ASEN 5053 class. The SKYLON spaceplane is designed as a single stage to orbit vehicle capable of lifting 15 mT to LEO from a 5.5 km runway and returning to land at the same location. It is powered by a unique engine design that combines an air- breathing and rocket mode into a single engine. This is achieved through the use of a novel lightweight heat exchanger that has been demonstrated on a reduced scale. The program has received funding from the UK government and ESA to build a full scale prototype of the engine as it’s next step. The project is technically feasible but will need to overcome some manufacturing issues and high start-up costs. This report is not intended for publication or commercial use. * The Influence of Space Power upon History (1944-1998) by Captain John Shaw, USAF * My interest in this subject grew during my experiences as an Air Force Intern 1997-98, working in both the Office of the Deputy Undersecretary of Defense for Space, and in SAF/AQ, Space and Nuclear Deterrence Directorate. I owe thanks to Mr. Gil Klinger (acting DUSD(Space)) and BGen James Beale (SAF/AQS) for their advice and guidance during my internships. A primary task of the historian is to interpret events in the course of history through a unique lens, affording the scholar a new, and more intellectually useful, understanding of historical outcomes. This is precisely what Alfred Thayer Mahan achieved when he wrote his tour de force The Influence of Sea Power upon History (1660-1783). He interpreted the ebb and flow of national power in terms of naval power, and his conclusions on the necessity of sea control to guarantee national welfare led many governments of his time to expand their naval capabilities. When Mahan published his work in 1890, naval power had for centuries already been a central determinant of national military power.1 It remained so until joined, even eclipsed, by airpower in this century.
