Historic Preservation Law: The Metes & Bounds of a New Field NICHOLAS A. ROBINSON* Historic Preservation Law has come to mean that combina- tion of regulations, common-law property principles, tax incen- tives, and adjective law in administrative proceedings, governing historic sites and property within the United States. Although Congress first recognized a need to conserve the nation's wealth of historic amenities in 1906 when it adopted The Antiquities Act,' it was only with the nation's bicentennial that the volume and diversity of laws designed to maintain, protect and preserve historic America grew to the point where it could be said that a new field of law had emerged. Landmarks Preservation Commission November 22, 2016, Designation List 490 LP-2579 YALE CLUB OF NEW YORK CITY 50 Vanderbilt Avenue (aka 49-55 East 44th Street), Manhattan Built 1913-15; architect, James Gamble Rogers Landmark site: Borough of Manhattan Tax Map Block 1279, Lot 28 On September 13, 2016, the Landmarks Preservation Commission held a public hearing on the proposed designation of the Yale Club of New York City and the proposed designation of the related Landmark Site. The hearing had been duly advertised in accordance with provisions of law. Six people spoke in support of designation, including representatives of the Yale Club of New York City, Manhattan Borough President Gale A. Brewer, Historic Districts Council, New York Landmarks Conservancy, and the Municipal Art Society of New York. The Real Estate Board of New York submitted written testimony in opposition to designation. State Senator Brad Hoylman submitted written testimony in support of designation. Summary The Yale Club of New York City is a Renaissance Revival-style skyscraper at the northwest corner of Vanderbilt Avenue and East 44th Street. For more than a century it has played an important role in East Midtown, serving the Yale community and providing a handsome and complementary backdrop to Grand Central Terminal. Constructed on property that was once owned by the New York Central Railroad, it stands directly above two levels of train tracks and platforms. This was the ideal location to build the Yale Club, opposite the new terminal, which serves New Haven, where Yale University is located, and at the east end of “clubhouse row.” The architect was James Gamble Rogers, who graduated from Yale College in 1889 and attended the Ecole des Beaux Arts in Paris during the 1890s. -

Federal Railroad Administration Record of Decision For the East Side Access Project September 2012 SUMMARY OF DECISION This is a Record of Decision (ROD) of the Federal Railroad Administration (FRA), an operating administration of the U.S. Department of Transportation, regarding the East Side Access (ESA) Project. FRA has prepared this ROD in accordance with the National Environmental Policy Act (NEPA), the Council on Environmental Quality’s (CEQ) regulations implementing NEPA, and FRA’s Procedures for Considering Environmental Impacts. The Metropolitan Transportation Authority (MTA) filed an application with the FRA for a loan to finance eligible elements of the ESA Project through the Railroad Rehabilitation and Improvement Financing (RRIF) Program. The ESA Project is the MTA’s largest system expansion in over 100 years. The ESA Project will expand the Long Island Rail Road (LIRR) services by connecting Queens and Long Island with East Midtown Manhattan. With direct LIRR service to Midtown East, the LIRR will further increase its market share of commuters by saving up to 40 minutes per day in subway/bus/sidewalk travel time for commuters who work on Manhattan’s East Side. The ESA Project was previously considered in an environmental impact statement (EIS) prepared by the Federal Transit Administration (FTA) in May 2001 and subsequent FTA reevaluations and an environmental assessment of changes in the ESA Project. Construction of the ESA Project has been ongoing since 2001. FRA has reviewed the environmental impacts for the ESA Project identified in the FTA March 2001 Final EIS, subsequent FTA Reevaluations, and the 2006 Supplemental EA/FONSI (collectively, the “2001 EIS”) for the ESA Project and adopted it pursuant to CEQ regulations (40 CFR 1506.3). -

Landmarks Preservation Commission April 14, 2009 Designation List 412 LP-2322 NEW YORK PUBLIC LIBRARY, WOODSTOCK BRANCH, 761 East 160th Street, The Bronx Constructed 1913-1914; McKim, Mead & White, architects Landmark Site: Borough of the Bronx, Tax Block 2657, Lot 30 On January 13, 2009, the Landmarks Preservation Commission held a public hearing on the proposed designation of the New York Public Library Woodstock Branch. Four witnesses spoke in favor of the designation, including a representative of the New York Public Library and representatives of the Municipal Art Society, the Historic Districts Council and the Metropolitan Chapter of the Victorian Society in America. Summary Opened on February 17, 1914, the Woodstock Branch of the New York Public Library is the sixty-first Carnegie branch library built in New York City. It is one of nine in the Bronx (eight still extant) and one of sixty-seven in all five boroughs, constructed when Andrew Carnegie donated $5.2 million in 1901 to establish a city-wide branch library system. The preeminent and nationally influential architectural firm of McKim, Mead & White designed the Woodstock Branch; it was the eleventh of their twelve Carnegie libraries, consisting of three in the Bronx, and nine in Manhattan.1 The library’s classically-inspired style, with its characteristic vertical plan, offset entrance, carved stone ornament, and tall arched first floor windows providing abundant lighting to a simple interior, is characteristic of the urban Carnegie library type. The library has played a prominent role in the neighborhood for nearly one hundred years. DESCRIPTION AND ANALYSIS History of Morrisania2 The Morrisania section of the Bronx was named after the prominent Morris family, local landowners, slaveowners and politicians through several generations from the seventeenth through nineteenth centuries. -

Built 1889-1892; Stanford White of McKim, Mead & White, architect. Landmark Site: Borough of Manhattan Tax Map Block 891, Lot 1. On September 15, 1998, the Landmarks Preservation Commission held a public hearing on the proposed designation as a Landmark of the (Former) James Hampden and Cornelia Van Rensselaer Robb House, and the proposed designation of the related Landmark Site (Item No. 1). The hearing had been duly advertised in accordance with the provisions of law. Eight witnesses spoke in favor of designation, including Samuel G. White, architect with Buttrick, White & Burtis and great-grandson of Stanford White, and representatives of the Murray Hill Association, the New York Landmarks Conservancy, the Beaux Arts Alliance, and the Historic Districts Council. A member of the 23 Park Avenue Realty Corporation, owner of the building, spoke in support of the designation. There were no speakers in opposition to this designation. At its September meeting Manhattan Community Board Six passed a resolution in support of the designation. The Commission has received a letter from the Robbs' great granddaughter, Katherine C. Moore, in support of the designation. In the past the Commission received several letters urging the designation of this building. Summary Built in 1889-92 for J. Hampden Robb and his wife Cornelia Van Rensselaer Robb, this elegant and imposing structure is considered one of the finest urban residences designed by Stanford White of the prominent architectural firm of McKim, Mead & White and was one of the earliest Renaissance Revival townhouses by White. -

I. Introduction & Background This project was initiated by the Duluth Heritage Preservation Commission in order to document the historic resources within an approximately 100-acre, 24-block area of the East End which was defined as follows: properties fronting North 21st Avenue East extending east to North 27th Avenue East and properties fronting East Superior Street on the south extending northward to include properties fronting on East Third Street. Two hundred and twelve residential buildings were documented (see annotated list of properties in Appendix A and maps of area in Appendix B.) The project was paid for by a Certified Local Government grant from the National Park Service through the State Historic Preservation Office at the Minnesota Historical Society and a cash match provided by the Duluth Preservation Alliance. Basic background research on the houses in the East End was begun years ago and can be almost entirely credited to the work of Maryanne Norton, currently a member of the Duluth Heritage Preservation Commission and volunteer research librarian at the Duluth Public Library. The project product is provided in two parts: the first is this report, which is a synthesis of the significant findings concerning the district; the second is a set of survey forms in which each individual property is documented with a written description, photograph and map. The second part is under separate cover. Notes: . For purposes of this report, the term “East End Neighborhood” or “East End” refers to the approximately 24-block area defined above, even though this neighborhood actually includes a more extensive area (the remainder of which is to be surveyed in a second phase). -
