We need to be better prepared in future for both flood and droughts, and ensure that we manage our water resources sustainably. The draft Flood and Water Management Bill, is an important part of the UK Government’s response to Sir Michael Pitt’s Report on the Summer 2007 floods. It also gives effect to a number of commitments in both the UK Government’s ‘Future Water’ document and the Welsh Assembly Government’s ‘Environment Strategy’ and ‘Strategic Policy Position Statement on Water’. We are publishing our proposals in draft to enable public scrutiny and to encourage full debate on the measures proposed. There are also two major independent reviews whose recommendations will need to be considered; these are Martin Cave’s Review of competition and innovation in water markets and Anna Walker’s Review of charging and metering for household water and sewerage services. We will consider recommendations arising from these reviews, including those which require primary legislation. We will also be consulting shortly on the options for time-limiting abstraction licenses which may also need to be reflected in legislation. The aim of all this is to help protect ourselves better from flooding, to manage water more sustainably and to improve services to the public. We all share an interest in making this happen. This consultation paper seeks comments on a draft Flood and Water Management Bill and on other matters where we wish to seek views before drafting legislation. It sets out the main reasons why the UK and the Welsh Assembly Governments believe we need to change the law and how we propose to change it. ii. The draft Bill aims to give effect to the UK Government’s response to Sir Michael Pitt’s Review, ‘Learning Lessons from the 2007 Floods’ (June, 2008) published in December 2008 and ‘Future Water’ the UK Government’s Water Strategy for England published in February 2008. The draft Bill also aims to give effect to the flood and water aspects of the Welsh Assembly Government’s ‘Environment Strategy’ its ‘New Approaches Programme’ including addressing issues identified by Sir Michael Pitt’s Review and the Welsh Assembly Government’s ‘Strategic Policy Position Statement on Water’. iii. The draft Bill will create a more comprehensive and risk based regime for managing the risk of flood and coastal erosion, which for the first time embraces all sources of flooding. It will also enable better management of water resources and quality. The Bill will help us to manage and respond to severe weather events such as flood and drought which are set to become more frequent as a result of climate change. iv. The draft Bill also ensures that those managing the risk of flood or coastal erosion will take account of other concerns such as sustainability, biodiversity and the whole water cycle. v. In addition to consulting on the issues covered by the provisions in the draft Bill, which are contained in Sections 2 and 4 of this document, we are also consulting in Sections 3 and 5 on the detail of how to implement a number of other policies to be included in the resulting legislation to be introduced into Parliament. vi. These include consulting on whether a case exists for wider reforms to the way in which flood and coastal risk activity is funded; reforms to Internal Drainage Boards; and the means for resolving neighbourhood disputes over flooding issues. vii. Matters of interest to the Welsh Assembly Government are set out in Annex A, which details their policy position and invites comments on a number of policy proposals for Wales. viii. In addition to the issues mentioned above, the UK Government and Welsh Assembly Government will each assess the recommendations of Martin Cave’s Review of competition and innovation in water markets and Anna Walker’s Review of charging and metering for household water and sewerage services. Where they believe it necessary to legislate to implement any changes as a result of these reviews they each intend to do so as part of this Bill. Defra will issue a consultation before the Summer Recess on the retail competition package. The UK Government and the Welsh Assembly Government will be consulting separately on the time limiting of abstraction licenses. 10 ix. The draft Bill has several aims but they can be grouped under the three themes of security, service and sustainability. The draft Bill will provide: • greater security for people and their property from the risk of flooding and coastal erosion by creating clearer structures and responsibilities for managing that risk, building on the Government’s response to Sir Michael Pitt’s Review. It will improve leadership on flood risk, and enable better planning for and prediction and warning of floods. It will introduce a targeted approach to reservoir safety based on risk. It will deliver greater security of water supply in the event of water company failure, and improve the protection of essential supplies during drought; • better service for people through new ways of delivering major infrastructure projects, better protection of essential water supplies during drought and improving complaints and enforcement procedures; and • greater sustainability by helping people and their communities adapt to the increasing likelihood of severe weather events due to climate change, encouraging sustainable drainage systems in new developments, protecting communities and the environment better from the risk of flooding, and protecting water resources and improving water quality.

    Battle for the Floodplains: An Institutional Analysis of Water Management and Spatial Planning in England Thesis submitted in accordance with the requirements of the for the Degree of Doctor in Philosophy by Karen Michelle Potter September 2012 Abstract Dramatic flood events witnessed from the turn of the century have renewed political attention and, it is believed, created new opportunities for the restoration of functional floodplains to alleviate the impact of flooding on urban development. For centuries, rural and urban landowning interests have dominated floodplains and water management in England, through a ‘hegemonic discourse alliance’ on land use development and flood defence. More recently, the use of structural flood defences has been attributed to the exacerbation of flood risk in towns and cities, and we are warned if water managers proceeded with ‘business as usual’ traditional scenarios, this century is predicted to see increased severe inconveniences at best and human catastrophes at worst. The novel, sustainable and integrated policy response is highly dependent upon the planning system, heavily implicated in the loss of floodplains in the past, in finding the land for restoring functioning floodplains. Planners are urged to take this as a golden opportunity to make homes and businesses safer from flood risk, but also to create an environment with green spaces and richer habitats for wildlife. Despite supportive changes in policy, there are few urban floodplain restoration schemes being implemented in practice in England, we remain entrenched in the engineered flood defence approach and the planner’s response is deemed inadequate. The key question is whether new discourses and policy instruments on sustainable, integrated water management can be put into practice, or whether they will remain ‘lip-service’ and cannot be implemented after all.

    An introduction to Internal Drainage Boards (IDBs) Association of Drainage Authorities The national representative of IDBs in England & Wales What is an Internal Drainage Board? An Internal Drainage Board (IDB) is a local public authority that manages water levels. They are an integral part of managing flood risk and land drainage within areas of special drainage need in England and Wales. Each IDB has permissive powers to undertake work to provide water level management within their Internal Drainage District (IDD), undertaking works to reduce flood risk to people and property and manage water levels for local needs. Much of their work involves the maintenance of rivers, drainage channels, outfalls and pumping stations, facilitating drainage of new developments and advising on planning applications. They also have statutory duties with regard to the environment and recreation when exercising their permissive powers. The forerunners of today’s IDBs date back to the time of Henry III who established a Commission for drainage of Romney Marsh in Kent in 1252. Most IDBs today were established by the Government following the passing of the Land Drainage Act 1930. The activities and responsibilities of IDBs are currently controlled by the Land Drainage Act 1991 as amended by subsequent legislation. IDBs are also defined as Risk Management Authorities within the Flood & Water Management Act 2010 alongside the Environment Agency, local authorities and water companies. Today, there are 121 IDBs in Great Britain, 120 in Geographical distribution of England and 3 in Wales (2 IDBs cross the border). IDBs IDBs in England & Wales cover 1.2 million hectares of England (9.7% of England’s (Source: Sharon Grafton, ADA) total land area) and 28,500 hectares of Wales (1.4% of the Wales’ total land area).

Introduction In France, Germany, Scotland and England, the control of surface water lies within what can broadly be described as a water resource management framework, which may encompass conservation and enhancement of the aquatic environment, ecology and nature conservation, water supply, water quantity, water quality, sewage and surface water collection, treatment and disposal. Whilst these frameworks have evolved in more recent years to bring water resource management in line with the EU Water Framework Directive and the principles of river basin management, the current approach to water resource management taken by each country can be differentiated. The purpose of this report is to provide a broad, comparative review of the institutional and administrative arrangements for the management of surface water in all four countries. In particular, it examines: (a) the organisation of surface water drainage and sewerage responsibilities amongst public or private agencies; and (b) the administration of surface water drainage and sewerage functions, processes or systems undertaken by public or private agencies. In addition, it notes some of the broad linkages between surface water management systems and those of spatial planning and flood risk management, where relevant. Indeed, it is clear that flood risk and surface water management systems have traditionally been divided in all four countries. However, there has been a growing realisation across Europe as a whole of the interdependent relationship between activities in all three of these sectors.

    Water Management Consortium Information Sheet - January 2016 BACKGROUND Lindsey Marsh Drainage Board, Isle of Axholme and North Nottinghamshire Water Level Management Board and Trent Valley Internal Drainage Board are independent statutory land drainage authorities constituted under the Land Drainage Act 1930 and continued in being by the Water Act 1989 and the Land Drainage Acts 1991 and 1994. The Flood Risk Regulations 2009 and the Flood and Water Management Act 2010 confirmed Internal Drainage Boards as one of the key Risk Management Authorities (RMAs). IDBs were formed to provide water level management and land drainage to areas of special drainage need, that is those areas of England at or below sea level. IDBs were historically tied to agriculture and food production but today the emphasis of their works is extended to flood risk management for urban areas, facilitating economic growth in the areas vulnerable to flood, and the conservation and enhancement of the environment. The offices of Lindsey Marsh Drainage Board are situated at Manby some four miles southeast of Louth, the Isle of Axholme and North Nottinghamshire Water Level Management Board's offices are located in Epworth, North Lincolnshire and the offices of the Trent Valley Internal Drainage Board are located in Newark, Nottinghamshire. WATER MANAGEMENT CONSORTIUM The three Boards work together as a consortium of which, Lindsey Marsh Drainage Board acts as lead Board. The total area of the Consortium is 125,711 ha. The Boards are all statutory constituted corporate bodies and independently maintain their districts with their own operational staff and direct labour organisations. The Consortium arrangements are bound in a deed of agreement signed by all the Boards and it is considered that such an organisation creates a viable and effective unit providing all the necessary professional services required, at an economic cost.
