UNDERHILL of

The point where pedigrees emerge is usually, at the earliest, the period of the invention of the family surname. Family names did not exist in until the twelfth or thirteenth centuries, when they began to be invented, and came gradually into general use with the growth of the population. Underhill or Underhull (“hill” and “hull” are variants of the same word in early English) is a good example of a topographical surname. There is no reason to doubt that a family bearing that name derives from an ancestor who lived under a hill. But as there are many hills with dwelling places built under their protection, it is natural that the name was invented more than once, and applied originally to more than one family, in diferent parts of the country.

The place from which the Underhills of took their name can be identifed with certainty. In the parish of Bushbury, which adjoins Wolverhampton on the north east, there is Bushbury Hill, and on its eastern slope, sheltered from the westerly winds, there is a farm house which still bears the name of Underhill. The name can be traced in documents as far back as the year 1308 and it may well be much older than any extant document. The earliest mention in 1308 relates to a “tenement at Underhulle in Bisshebury” and names the then tenant as “Thomas, son of Robert de Underhulle of Bisshebury”. This Robert de Underhulle was the earliest known ancestor of the Underhills of Warwickshire.

Descended from Robert de Underhulle was , who was born about 1450. The marriage in about 1484 of John Underhill with Agnes, daughter of Thomas Porter, marks the beginning of the Underhills’ association with Ettington in Warwickshire. The manor of Ettington has been held by the Shirley family since the conquest, however there have been periods when it has been leased to others. In 1455 Alice, the widow of Sir Ralph Shirley who died about 1443, granted a lease of the manor to Thomas Porter, father of Agnes. In 1509, in what appears to have been a renewal of the lease of 1455, a further lease of the manor was granted to John Underhill for a period of eighty years. In 1517 John Underhill “de Nether Etyngdon in Comitatu Warr, Gentilman” entered into a deed relating to lands in “Woluerehampton Wednesfeld Heth Echelles and Wyllenhall in the County of Staford” “which descended to me by right of inheritance after the death of Nicholas Vnderhull my father”, thus confrming his origins and parentage. John Underhill died on 30 November 1518 and was succeeded at Ettington by his third son Edward.

John Underhill’s eldest son, William, was Clerk of the House of Commons before his death in 1544. William Underhill’s brother, Thomas, of Hunningham, had a son, Edward, who was Member of Parliament for Tavistock in 1553. This Edward Underhill, called “the hot gospeller” achieved earthly mortality by leaving a sparkling account of the most hazardous phase of his career. He had earlier served as one of the gentlemen-at-arms during the French Wars of King Henry VIII. In 1544 he joined the King’s personal troop and took part in the Boulogne campaign. At about this time he became imbued with both radical religious views and the proselytising zeal for which is notorious, but until 1553 not only was the religious tide with him but he had powerful protectors from the Duke of Northumberland down. Edward Underhill was a close supporter of the Duke of Northumberland and his scheme to place Lady Jane Grey on the throne, and it was during her brief reign of only nine days in 1553 that Jane Grey acted as one of the godparents of his new-born son. Although he did not take up arms against Queen Mary, on her return to the throne, he rather rashly published a ballad against popery the day that she was proclaimed Queen in London. He was subsequently arrested and brought before the Privy Council, but was released in September 1553. He was not troubled again for his opinions, and retired to Warwickshire, never again returning to Court.

Thomas Underhill of Hunningham’s second son, Hugh, was Keeper of the Wardrobe to Queen . Hugh Underhill’s son Thomas, was appointed Keeper of Kenilworth Castle and died in 1591. The grandson of this latter Thomas Underhill was Captain John Underhill, who immigrated to New England, North America, in 1630. Captain John Underhill founded the main American branch of the Underhill family, which continues to fourish to this day.

Edward Underhill, who succeeded at Ettington, was born in 1486 and was a party with his father to the sale of land at Pebworth in in 1503. He was admitted to Lincoln’s Inn in November 1515 and embarked on the study of law. However after his marriage to Margaret Middlemore and the death of his father in 1518 he returned to the family estates at Ettington. In 1541 he secured the Underhill family’s tenure of the manor of Ettington for three more generations by obtaining a renewal of the lease of Ettington manor for 100 hundred years. Edward Underhill died on 7 March 1546/7 and was buried in Ettington Church.

At Edward Underhill’s death the lease of Ettington manor passed to his eldest son Thomas, who was lord of the manor for over ffty years and was regarded as head of the Warwickshire family. By his wife, Elizabeth Congreve, Thomas was the father of twenty children. Elizabeth’s sister had married Sir Francis Shirley of the same family that continued to own the freehold of Ettington. At Thomas Underhill’s death in 1603 the lease passed to his son Edward, and then in 1611 on Edward’s death to Edward’s son, Sir Edward Underhill. Sir Edward was educated at Magdalen College, Oxford, and married a daughter of Sir William Uvedale, Treasurer of the King’s Household. He was knighted by King James I in 1613 and was Sherif of Warwickshire in 1638. Sir Edward Underhill died in 1641, the year the lease of Ettington manor expired and the property was returned to the possession of the Shirley family, absent since the manor was originally leased to Thomas Porter in 1455. The second son of Edward Underhill (Died 1611), Thomas (1546-1622), was the father of Sir John Underhill. Sir John was knighted in 1626 and married Alice, the widow of Sir Francis Bacon, Lord Chancellor of England.

William Underhill (1524-1570), second son of Edward Underhill (died 1547), was admitted to the Inner Temple in 1551 and qualifed as a lawyer. In 1568 he purchased the manor of in Warwickshire near Ettington. His frst wife was the sister of the wife of his brother Thomas of Ettington, and his second wife was the sister of Sir Christopher Hatton, Lord Chancellor of England. William’s son, William (1555-1597), inherited Idlicote on his father’s death in 1570 and it was he who sold the house in Stratford-on-Avon called “New Place” to on 4 May 1597. This William Underhill was poisoned to death by his eldest son, Fulk, in July 1597. Fulk Underhill was hanged for his crime in March 1598/9. Idlicote then passed to Fulk’s brother, Sir Hercules Underhill. Sir Hercules married Bridget, daughter of Dudley Carlton, 1st Viscount Dorchester and British Minister to the Hague. Sir Hercules was knighted in 1617 but died in 1658 without children when Idlicote passed to his nephew, Sir William Underhill.

Sir William Underhill was born in 1624 and married Alice, daughter of Sir Thomas Lucy, of . He fought on the royalist side during the Civil War, whereas the branch of the family at Ettington supported the parliamentary cause. Sir William retired to his estate at Idlicote after the civil war, where he died in September 1710. Idlicote was inherited by Sir William’s son, Hercules (died 1730) and then by Hercules’ son Samuel. Samuel Underhill, the last of the family to be lord of Idlicote manor, sold the Idlicote estate in 1755 for £22,000.

At the death of Edward Underhill of Ettington in 1547 his third son, John, inherited lands in the parish of Whitchurch near Ettington. John married Margery Wylmer at in Gloucestershire on 27 November 1547 and was recorded as the principal tenant of the manor of Whitchurch. John Underhill’s eldest son, Nicholas, was educated at Oxford University and became Rector of Whitchurch. Younger sons of John Underhill, Thomas and Clement, settled in London and became freemen of the Haberdashers Company and the Drapers Company respectively.

Another son of John Underhill, Humphrey, was educated at Oxford, although he appears not to have obtained a degree. On his father’s death in 1601, Humphrey inherited from his father an estate at Crimscote in the parish of Whitchurch. Later, in 1621 Humphrey Underhill and his son, John, became embroiled in the debts of his son-in-law, William Deane of Aldminister. In a case in the Court of Requests dated 12 June 1621 Humphrey stated that Deane “being of very meane creditt and estate and hardly able to mayntaine himself aboute sixe or seven years synce contrary to the likeinge of the defendte Humfrey Underhill and against his wish did marry with Elizabeth one of the daughters of the said defendte”, but that in spite of this, he and his son John, had become surety for William Deane, out of kindness. It is mentioned that at the time of the case in the Court of Requests, William Deane was in prison for debt. On Humphrey’s death in 1634 he named his frst cousin once removed, Sir Edward Underhill of Ettington, as overseer of the administration of his will.

The second son of Humphrey Underhill, Thomas, settled at in the Parish of Quinton, Gloucestershire, in the near vicinity of Ettington. He was Churchwarden of Quinton in 1629 and made a deposition at on 17 October 1651 describing himself as “of Admington, Glouc., Gentleman, aged 45”. Thomas Underhill died in August 1676 and was succeeded at Admington by his youngest, but only surviving son, George.

Thomas Underhill’s nephew, Humphrey, immigrated to New England, North America, before 1669, and established the second branch of the Underhill family to settle in America. Humphrey Underhill was joined in America by his sister Mary, who married her frst husband, Thomas Naylor, at the Dutch Reformed Church in on 14 February 1666. Mary Underhill married a second time in 1668 to Richard Stites of Westbury, , New York. Humphrey Underhill died in 1722 and his descendants in America are many and scattered.

George Underhill resided at Admington until his death on 23 November 1713. George, and his male descendants, were buried in Quinton Parish Church, where the Underhill arms appear in stained glass. George Underhill’s daughter, Clementia, married William Coldicott of at Shipston on Stour in October 1703. It is from this marriage that the O’Connor family descends.

Robert Porter held the 31-38 manor in 1444, & died in 1453, when his elder son Thomas Warw Fines III, succeeded. The latter left as his heir a daughter, Agnes, pp 212, 214 & 215 whose husband John Underhill held Lower Ettington of the Dugdale Shirleys. Upper Ettington, however, passed in tail male to N & Q, 3 William, younger son of Robert Porter, who died in 1480, or to his son, another Series, I, p 285 Robert”. He & his wife, described as “one of the daughters & heirs of Thomas Porter”, acquired “the manor of Hunningham, 3 messuages, 500 acres of land, 100 acres of meadow, 40 acres of pasture”, by fne dated 1500/1. For 200 marks of silver he acquired “6 messuages, 8 tofts, a water mill, 6 gardens, 10 virgates of land, 60 acres of meadow, 60 acres of pasture & a certain fshery in the water of the Stour in Crimscote” from Sir Edward Belknap, 1500. In the ‘Victoria County History of Warwickshire’ article for the Parish of Whitchurch it was recorded as follows – “In 1500 Sir Edward Belknap sold the [Crimscote] estate, including 6 messuages, 10 virgates of arable, a water-mill, & fshing rights in the River Stour, with the advowson of the chapel, to John Underhill & Agnes (Porter) his wife. Their second son Edward died in 1547 holding this property, including the advowson of the free chapel, & leaving a son Thomas as his heir. This property, however, passed to Edward's third son John, whose descendants lived in Whitchurch & the adjacent parishes for several generations”. In 1669 Edward Underhill sold what is here dignifed with the title of the manor of Crimscote to Thomas Mariett”. In the ‘Victoria County History of Warwick’ article for Ettington it was recorded as follows – “In 1509 Sir Ralph Shirley leased the manor to John Underhill, originally of Wolverhampton, Stafs., who had married, as her second husband, Agnes, daughter & heir of Thomas Porter of Upper Ettington. This lease was perhaps a renewal, for when John & Agnes were admitted to the Guild of Knowle in 1493 they were living at Ettington”. He made an indenture relating to lands in “Wolverhampton, Wednesfeld, Heth, Echelles & Wyllenhall in the County of Stafs. which descended to me by right of inheritance from Nicholas Underhill my father”, 20 June 1517. Will dated 16 Dec. 1514 – in which he mentioned the “Parish Church of “Netheretingdon”; Abbot & Convent of “Eucsham”; convents of Warwick & Stoneley; Guild of Henley & of “Stratford upon haven”; chapel of St. Stephen in the Lord King’s palace of Westminster; chapel of St. Mary; daughters Susan & Dorothy, unmarried; wife Agnes to have the farm at Netheretyngdon for life; at her death to son Edward. In the ‘Victoria County History of Warwick’ article for Ettington it was recorded as follows – “In 1541 the lease of 1509 [of the Manor of Nether Ettington] was renewed, for a century at an annual rent of 40 marks, to Edward son of John, who had succeeded his father in 1518. Edward was succeeded by his son Thomas, & Thomas by his son, a second Edward, who was born in 1546 & still living in 1619. In 1641, on the expiration of the lease, the Underhills removed to Upthrop in the adjacent parish of (then in Worcestershire), & the manor was resumed by the Shirleys”. In Shirley’s ‘Stemmata Shirleiana’ it was recorded as follows – “It appears by a lease dated April 28, 1541 (33 Hen. VIII) that this Francis Shirley granted the whole of his ancient Warwickshire property, except the right of presentation to the church of Nether Etyngton [sic], to Edward & Thomas Underhill, for a term of one hundred years, reserving the rent of forty marks a year (£26 13s 4d). This lease was the cause of much unpleasant feeling, & of a long series of law-suits, which were not fnally determined till the year 1652. The Underhills were accused of having obtained this valuable lease of the Shirleys’ lands by the procurement of Dorothy, Francis Shirley’s wife, whose daughters Elizabeth & Ursula, by her former husband, Congreve, were the wives of Thomas Underhill of Eatington [sic] & William Underhill of Huningham in Warwickshire. The Underhill family had, however, been previously settled at Eatington [sic], Sir Ralph Shirley having by 1 st of Hen. VIII (1509), granted to John Underhill, & Agnes Porter his wife, a lease of the same property, & on the same favourable terms, for a period of eighty years”. In the ‘Victoria County History of Warwickshire’ article for the Parish of Whitchurch it was recorded as follows – “In 1500 Sir Edward Belknap sold the [Crimscote] estate, including 6 messuages, 10 virgates of arable, a water-mill, & fshing rights in the River Stour, with the advowson of the chapel, to John Underhill & Agnes (Porter) his wife. Their second son Edward died in 1547 holding this property, including the advowson of the free chapel, & leaving a son Thomas as his heir. This property, however, passed to Edward's third son John, whose descendants lived in Whitchurch & the adjacent parishes for several generations”. According to a biography of CTG, VI, p 384 Hercules – “Hercules Underhill's paternal grandfather, William Underhill (c.1523 – Morrison, pp 31 March 1570), was an Inner Temple lawyer & clerk of assizes at Warwick, & a 154-5 substantial property holder in Warwickshire. Among his holdings was the manor of N & Q, 3 Series, I, p 286 Idlicote, which he purchased from Lodovic Greville. He also held a 21-year lease on the manor of Newbold Revel from Thomas Throckmorton. In 1567 he purchased New Place in Stratford upon Avon from William Bott, agent of William Clopton, esquire. In addition to these properties he held the manors of Loxley & Barton-on-the-Heath, 'together with other houses and lands in Stratford, Hollington, Hardwick, Meriden, Haselor, Drayton and Easinghall'. William Underhill died 31 March 1570, & was buried at Nether Ettington, where he & his frst wife are commemorated by a marble monument. In his will he directed that his estates were not to be alienated by his heir save in circumstances of 'pressing need'. His three daughters were given marriage portions of fve hundred pounds & a silver spoon apiece. His second daughter was given the wedding ring which had belonged to her stepmother, Dorothy Hatton, & his youngest daughter was given one of her mother Ursula Congreve's rings. William Underhill (d.1597), his only son & heir, was sixteen years of age at his father's death in 1570, & became a ward of the crown. His wardship was purchased in 1571 by his stepmother Dorothy's Hatton's brother, Sir Christopher Hatton. When he came of age in about 1575, William Underhill inherited his father's estates. Shortly thereafter he obtained licence to sell the manor of Loxley to Thomas Underhill, one of his cousins, & about that time married Mary Underhill (d.1590), another cousin. In 1579 he was imprisoned for recusancy, 'but being able to give an explanation to Burghley, was soon released'. In 1581, by reason of pressing fnancial circumstances, he was granted licence to alienate lands in Hollington & Meriden. In 1587 he was appointed escheator for Warwickshire & Leicestershire. In 1590 his wife, Mary, died. She was buried at Idlicote, & after her death he settled his estates in trust on his eldest son and heir, Fulke Underhill. In Easter term 1597 he sold New Place to William Shakespeare for £60 by fnal concord dated 4 May. At the time of the sale the property consisted of one messuage, two barns & two gardens with their appurtenances. In July 1597 he was poisoned at Fillongley near Coventry, & on 6 July made a nuncupative will, naming as executors George Shirley & Thomas Shirley of Staunton Harold, Leicestershire. He left all his lands to his eldest son, Fulke Underhill, £200 apiece to each of his younger sons, & £500 apiece to his daughters Dorothy & Valentine. He died 7 July, & was buried with his wife at Idlicote. Fulke Underhill was not at frst suspected of having poisoned his father; however "either through his own confession or the evidence of others, his guilt afterwards became known", & in 1602 the Court of Exchequer appointed a commission to ‘obtain an account of the possessions of Fulke Underhill of Fillongley, county Warwick, felon, who had taken the life of his father, William Underhill, by poison’. According to Schoenbaum, however, he was hanged at Warwick in 1599 for poisoning his father, & attainted for felony, whereby his estates escheated to the crown, which regranted them to Hercules Underhill when he came of age in 1602. In Michaelmas term 1602, Hercules Underhill confrmed the sale of New Place to William Shakespeare by fnal concord; in order to obtain clear title, Shakespeare paid a fee equal to one quarter of the yearly value of the property, ‘the peculiar circumstances of the case causing some doubt on the validity of the original purchase’. Hercules Underhill was knighted by King James I at Compton Wynyates, Warwickshire, on 6 September 1617, & was appointed High Sherif of Warwickshire in 1625. During the English Civil War he was a royalist, & having been accused of being a 'Popish recusant', was forced to compound his estates for the sum of £1177. He married Bridget Carleton, sister st of Dudley Carleton, 1 Viscount Dorchester, & daughter of Anthony Carleton by his second wife, Joyce Goodwin”. He was mentioned as heir in the I.P.M. of his brother Fulk, 1599. He was sued by his father in the Court of Chancery concerning a settlement previously made by his father on him & in his father’s ‘ Bill of Complaint’ his father stated – “I John Underhill of Crimscote in the countie of Warwick your [indiscernible] that wheras your saide orator for [remainder indiscernible] & solemnized[?] between Humfrey Underhill your saide orators sonne & Jane then his wiefe: And in consideracon [consideration] that your saide orator should have by agremt [agreement] betweene him & the saide Humfrey one hundred [indiscernible] for the marriage of his sonne [indiscernible] porcon [portion] as it was pretended which the saide Humfrey had with the saide Jane then his wiefe & in consideracon of a recompence to be made for that advancement[?] which the saide Humfrey [indiscernible] with his saide wiefe it was agreed and covenanted[?] betweene your saide orator & the saide Humfrey Underhill by certaine Articles of Agremt [indiscernible] made betweene your saide orator & the saide Humfrey [remainder of line indiscernible] December in the six & thirtith yeare of the queenes [indiscernible] reigne that now is in manner[?] & forme followinge that is to saie frst your orator did covenant & grant to and with the saide Humfrey Underhill his Executor [indiscernible] that he the saide Humfrey Underhill & Jane his wiefe & there children should have there tenement chamber in the farm howse at Crimscote where your orator then dwelt with [next few words indiscernible] victuall & keppinge[?] for the saide [indiscernible] Jane & there children duringe the tearme [term] of six & twentie years if your saide orator should so longe live: Also it was promised & agreed that your orator should [indiscernible] & have to his own [indiscernible] use all [remainder indiscernible] given & granted to the saide Humfrey for his marriage which saide sonne was agreed upon & should be one hundred & twentie poundes: also your saide orator did covenant [remainder indiscernible] that he the saide John Underhill at the time of his death should leave unto the saide Humfrey Underhill his Executors Administrators or Assignes one hundred good sheepe ten kyne & one Bull twoo beames[?] whereof [indiscernible] of fyve horses mares or geldinges & the other to be of six oxen or bullocks with a wagne [wagon?] yokes towes[?] & bowes[?] ftt for the saide oxen & with cart and cart geares[?] plowe & plowe geares[?] with harnesse & all the [indiscernible] for husbandrie & tillage of the saide farme in Crimscote aforesaide: And it was further agreed & your saide orator did covenant & grant to & with the saide Humfrey Underhill that your saide orator should [indiscernible] the twentith daie of May come twelveth moneth next after the date of the saide articles stocke & store his comon belonginge to the saide farme with sheepe & so should keepe & manteyne [remainder indiscernible] twentie yeares [indiscernible] yeares if he so longe should live..”, Nov. 1596. seven years, & was elected fence viewer & pounder. It was there that he married Sarah, widow of one of Jamaica's ubiquitous Smiths. Neither her maiden name nor the frst name of her Smith husband is known, but Mrs. Frost suspected she was a sister of John Rowlesson, a Dutchman to whom Humphrey sold his Jamaica house & some twenty acres, Sept. 14, 1675. The last mention of Humphrey at Jamaica was Apr. 6, 1676, when he sold his rights in the town's undivided lands. He removed to Rye, where in 1681 he purchased the "Vineyard Farm" for £700 in provisions. He also acquired land in the White Plains Patent of Rye, & eventually settled in that section of the town. In 1705 he was to build a mill on the Mamaroneck River, where son-in-law Samuel Hunt would grind corn. Humphrey became a prominent citizen of Rye. The town's records often call him Captain, presumably a militia rank. In 1689 he represented the town at a county meeting, & in 1696 was elected one of Westchester County's delegates to the NY General Assembly. In this period Rye, as a border town, also sometimes gave its allegiance to , & in 1692 & again in 1697/8, Capt. Humphrey was a Deputy to the Connecticut General Court at Hartford”. At the baptism of her son Morrison, p George she & her husband were recorded in the baptismal register as “William 203 Coldicoate [sic] & Clementia his wife”, 8 Oct. 1707. At the baptism of her daughter Hannah she & her husband were recorded in the baptismal register as “William Coldicoate [sic] & Clementia his wife”, 21 Aug. 1709. At the baptism of her son Richard she & her husband were recorded in the baptismal register as “William Coldicoate [sic] & Clementia his wife”, 18 June 1711. At the baptism of her son John she & her husband were recorded in the baptismal register as “William Coldicoate [sic] & Clementia his wife”, 20 Aug. 1713. Mentioned in the will of her sister Frances as “my sister Coldicot [sic]”, 25 Aug. 1714. At the baptism of her son Underhill she & her husband were recorded in the baptismal register as “William Coldicoate [sic] & Clementia his wife”, 26 Sept. 1715. At the baptism of her daughter Mary she & her husband were recorded in the baptismal register as “William Coldicoate [sic] & Clementia his wife”, 3 Oct. 1717. Died 11 May 1760 – as recorded on her gravestone. Bur. 15 May 1760 at Ilmington – recorded in the burial register as “Clementia Coldicoat [sic], widow, aged 85”.
