Milazzo To stave off the collapse of the feeble and bankrupt U.S. railroad industry in the 1970s, federal policymakers enacted major regulatory reforms. The creation of Amtrak and Conrail, significant rehabilitation projects, and an overhaul of transportation laws enabled the railroads to pare down their lines and retool their businesses. Each of these rapid developments in economic and business policy also reshaped natural and built landscapes. Using congressional and executive documents and secondary materials, this thesis shows how environmental regulations, historical preservation, and public awareness of ecology and resource scarcity informed the process of railroad reform. The environmental impact statement redefined how federal bureaucrats approached railroad infrastructure projects and line abandonment, while new pollution rules and energy- efficiency programs affected the rails’ biggest customers, like coal and manufacturing. Two important trends in postwar domestic policy—new social regulation and economic deregulation—intersected to jumpstart U.S. railroading in the 1970s. INTRODUCTION Congress enacted the Staggers Rail Act of 1980 (the Act) to remove "un- necessary and inefficient" regulations and deregulate the competitive segments of the railroad industry. This legislative effort to return certain portions of the industry to the market-directed sector of the economy is conceptually appeal- ing. Because regulation was presumably imposed to protect the public from monopoly abuses," it should logically be eliminated in areas where effective competition arises. In theory, allowing the market to operate freely in these areas should result in a more efficient allocation of resources and social welfare gains. Unfortunately, the scheme of partial deregulation adopted in the Stag- gers Act is likely to produce opposite results: a decline in allocative efficiency and social welfare losses.

ABSTRACT Railroad deregulation helped reduce grain transport costs. Shippers now benefit from increased competition among railroads, and from reductions in rail costs, as railroads abandoned unprofitable branch lines, upgraded remaining lines, and restructured rates to provide incentives to shippers to use less costly methods. This report details how the early effects of rail deregulation changed grain transportation after Congress passed the Staggers Rail Act in 1980. CAPTIVE REGULATORS, CAPTIVE SHIPPERS: THE LEGACY OF MCCARTY FARMS Anthony Johnstone* Montana has more than five thousand farms growing grain and one railroad shipping it.1 In a typical year Montana produces 150 million bush- els of wheat (approximately 500,000 farm trucks), ships 140 million bush- els out of state (approximately 50,000 railcars or 450 110-car grain shuttle trains), and exports 100 million bushels from terminals in the Pacific North- west (approximately fifty 62,000 ton freighter ships).2 The value of this volume of grain depends on its movement to national and world markets beyond Montana's borders. Transporting it from the high plains to these markets requires railroad service to the extent that more than 97% of wheat shipments out of Montana travel by rail.3 Without competitive transporta- tion alternatives to rail, or competitive railroad alternatives to the dominant statewide carrier, Montana's grain producers, and the grain elevators that intermediate between the producers and the railroad, are "captive ship- 4 pers." By definition, the prices offered to captive shippers by a railroad mo- nopoly are not effectively constrained by market competition.
