The Hostages of the Northmen: from the Viking Age to the Middle Ages
Part IV: Legal Rights It has previously been mentioned how hostages as rituals during peace processes – which in the sources may be described with an ambivalence, or ambiguity – and how people could be used as social capital in different conflicts. It is therefore important to understand how the persons who became hostages were vauled and how their new collective – the new household – responded to its new members and what was crucial for his or her status and participation in the new setting. All this may be related to the legal rights and special privileges, such as the right to wear coat of arms, weapons, or other status symbols. Personal rights could be regu- lated by agreements: oral, written, or even implied. Rights could also be related to the nature of the agreement itself, what kind of peace process the hostage occurred in and the type of hostage. But being a hostage also meant that a person was subjected to restric- tions on freedom and mobility. What did such situations meant for the hostage-taking party? What were their privileges and obli- gations? To answer these questions, a point of departure will be Kosto’s definition of hostages in continental and Mediterranean cultures around during the period 400–1400, when hostages were a form of security for the behaviour of other people. Hostages and law The hostage had its special role in legal contexts that could be related to the discussion in the introduction of the relationship between religion and law. Numen 68 (2021) 272–297 brill.com/nu The Role of Rulers in the Winding Up of the Old Norse Religion Olof Sundqvist Department of Ethnology, History of Religions and Gender Studies, Stockholm University, Sweden [email protected] Abstract It is a common opinion in research that the Scandinavians changed religion during the second half of the Viking Age, that is, ca. 950–1050/1100 ce. During this period, Christianity replaced the Old Norse religion. When describing this transition in recent studies, the concept “Christianization” is often applied. To a large extent this histo- riography focuses on the outcome of the encounter, namely the description of early Medieval Christianity and the new Christian society. The purpose and aims of the present study are to concentrate more exclusively on the Old Norse religion during this period of change and to analyze the questions of how and why it disappeared. A special focus is placed on the native kings. These kings played a most active role in winding up the indigenous tradition that previously formed their lives. It seems as if they used some deliberate methods during this process. When designing their strate- gies they focused on the religious leadership as well as the ritual system. These seem to have been the aspects of the indigenous religion of which they had direct control, and at the same time, were central for the modus operandi of the old religion. Most of all, it seems as if these Christian kings were pragmatists. Since they could not affect the traditional worldview and prevent people from telling the mythical narratives about the old gods, they turned to such aims that they were able to achieve. -

TOLKIEN Read 25 November 1936 IN 1864 the Reverend Oswald Cockayne wrote of the Reverend Doctor Joseph Bosworth, Rawlinsonian Professor of Anglo-Saxon: 'I have tried to lend to others the con-viction I have long entertained that Dr. Bosworth is not a man so diligent in his special walk as duly to read the books ... which have been printed in our old English, or so-called Anglosaxon tongue. He may do very well for a professor.'1 These words were inspired by dissatisfaction with Bosworth's dictionary, and were doubtless unfair. If Bosworth were still alive, a modern Cockayne would probably accuse him of not reading the 'literature' of his subject, the books written about the books in the so-called Anglo-Saxon tongue. The original books are nearly buried. Of none is this so true as of The Beowulf, as it used to be called. I have, of course, read The Beowulf, as have most (but not all) of those who have criticized it. But I fear that, unworthy successor and beneficiary of Joseph Bosworth, I have not been a man so diligent in my special walk as duly to read all that has been printed on, or touching on, this poem. But I have read enough, I think, to venture the opinion that Beowulfiana is, while rich in many departments, specially poor in one. It is poor in criticism, criticism that is directed to the understanding of a poem as a poem. -

Can Beowulf be used to test the value of the earliest Norse sagas as historical sources? Since at least one, and possibly two, of the persons and of the events mentioned in Beowulf can be corroborated and dated with the help of contem porary chronicles we must, until the opposite can be proved, accept the rest of the accounts as historical. Since several persons who figure in Beowulf are also mentioned in other, independent sagas, Ynglingatal, the Ynglinga Saga and Widsid, we must assume them to be historical and, if so, also the rest of the east of these sagas. The geographical notices in Beowulf also appear to fit reality and the conclusions appear to be confirmed by the distribution of the archaeological material. Thus, those modern historians who have denied the historical value of the sagas appear to bc wrong, since they have not taken into account all the material available.
