Introduction: The Water View Overlay Zone was created as a means to protect the water view certain properties have in the Sans Souci neighborhood. Periodic amendments to this overlay zone have occurred to ensure adequate protection is provided to homeowners in the community. As discussed below, a minor expansion of the overlay zone is recommended to continue this protection, and maintain the character of this neighborhood, as originally designed.

Review:

As shown on the accompanying map, the Water View Overlay Zone is located in a residential portion of the City, known as Sans Souci. The underlying zoning is R1-10, which primarily permits single-family homes on a minimum lot size of 10,000 square feet. Given the neighborhood’s topography and proximity to the water, it was developed in a manner that would afford many a water view. Later, the overlay zone was enacted to protect that view from further development that is not in keeping with the original design and goal of the neighborhood. The zoning requires special permit approval from the Planning Board for any new development, addition, structure and so on that might block someone’s water view. The test as set forth in the code is stringent, and the Planning Board firmly holds the applicant to these when under review.

Recent analysis of this neighborhood reveals additional properties that, if developed further, could impact the water view of others. This analysis is based on field observations, including a review of the existing development and landscaping, an analysis of the neighborhood’s topography, and of the existing zoning. As such, staff recommends the following properties, also depicted on the accompanying map, be included in the Water View Overlay Zone (amending Section 331-7 of the City Code), with the underlying zoning remaining as is:

Recommendation: Staff recommends that Council set a public hearing on the proposed amendment and refer same to the Planning Board and Westchester County Planning Board. It is also recommended that the City Council declare itself Lead Agency for the purposes of an environmental review pursuant to the State Environmental Quality Review Act (SEQRA). The Short Environmental Assessment Form (SEAF) is attached. Staff recommends that the Council approve this amendment pending the outcome of the public hearing and responses from the City’s Planning Board, and the Westchester County Planning Board.

Introduction: The City has received a petition by Youth Study Basketball, LLC to amend the zoning map (Section 331-7 of the zoning code) as it pertains to two parcels located along the western boundary of the City, abutting the Village of Pelham. The parcels are identified as Section 5, Block 1490, Lots 9 (partial) and 77. The site is currently zoned NB-Neighborhood Business, and the petitioner is requesting that the property be designated as NB-2.0 - Neighborhood Business 2.0.

Review: The submitted petition pertains to a vacant piece of property that will allow an existing business to expand its footprint. The existing business is in Pelham, and is located to the south of the vacant site. Other commercial and light industrial uses are across the street, also in Pelham. A parking lot is located to the north of the site, serving a multi-family development to the northeast. Finally, lower density residential is located to the east, setback from the subject site with an existing vegetated buffer.

The site has been vacant for a significant period and would greatly benefit from the application of the NB-2.0 zoning. Compared to the existing zoning, the NB-2.0 zone allows the same uses, but a slight increase in height, an FAR of 2.0 versus 0.5, and a lot coverage of 100-percent as opposed to 50-percent. The preliminary design depicts how under the NB-2.0 zoning the site could be developed in an appropriate manner, providing a benefit to the City, improving the property, with minimal negative impacts on the surrounding.

New Rochelle established a 10-year vision for the future of downtown New Rochelle with its adoption of the Downtown Overlay Zone (“DOZ”) and corresponding Theoretical Development Scenario (“TDS”) in 2015. To date, a large part of this vision has come to fruition in the form of several downtown development and redevelopment projects approved and under construction.

The TDS originally conceived that, in addition to 6,370 new housing units, millions of square feet of nonresidential uses would be developed as well. Additionally, City Council has taken previous actions to amend the TDS to be responsive to real development demand in the downtown.

Today, the City continues to see residential demand in the downtown. The proposed amendment before City Council accommodates this additional demand in the DO-1 and DO-2 districts by reducing 53,000 square feet of nonmedical office space in DO-1 (from 853,000 to 800,000) and reducing 64,000 square feet of nonmedical office space in DO-2 (from 364,000 to 300,000).

Recommendation: Staff recommends that Council set a public hearing on the proposed amendment and refer same to the Planning Board and Westchester County Planning Board. It is also recommended that the City Council declare itself Lead Agency for the purposes of an environmental review pursuant to the State Environmental Quality Review Act (SEQRA). The Short Environmental Assessment Form (SEAF) is attached. Staff recommends that the Council approve this petition pending the outcome of the public hearing and responses from the Planning Board and the Westchester County Planning Board.

EXECUTIVE SUMMARY

This September 2019 Revised Amended Theoretical Development Scenario (“TDS”) analyzes the impacts of adding an additional 630 residential units within the DO-1 and DO-2 districts; 290 units within DO-1 and 340 units within DO-2. These September 2019 TDS revisions also include a total reduction in the amount of nonmedical office space of 117,000; 53,000 within the DO-1 district and 64,000 within the DO-2 district. The September 2019 TDS follows several earlier memos (January, March and July) in 2019 which analyzed a shifting of units within the Downtown Overlay Zone (“DOZ”), and a 2016 TDS which analyzed additional square footage and residential units that were added to the DOZ. The addition of 630 units, as analyzed in this September 2019 TDS would result in an increase of 37 new students generated as compared to the July 2019 TDS. It would also result in traffic trip estimates that are similar to or less than were estimated in the July 2019 TDS. The increase in the number of school children generated is still below what was analyzed in the 2016 TDS, and therefore, the September 2019 TDS will not result in any new school impacts not previously analyzed in the GEIS and 2015 SEQR Findings Statement, as amended in 2016, 2017, and 2019. In addition, as a result of the reduction of nonmedical office space, the number of trips generated under this September 2019 TDS are similar to those analyzed in the July 2019 TDS, therefore no new impacts are anticipated that were not previously addressed in GEIS and SEQR Findings Statement as amended. The additional units have the potential to place additional pressure on the capacity of the City’s sewer infrastructure; however, the City Engineering Department has undertaken a sanitary sewer capacity evaluation and will undertake significant upgrades and improvements to the City’s sewer infrastructure to address capacity issues. The proposed 630 units were contemplated in the City’s capacity analysis; therefore no additional sewer infrastructure impacts will occur as a result of the proposed Amended TDS.

SEPTEMBER 2019 REVISED AMENDED THEORETICAL DEVELOPMENT SCENARIO

In 2015, the New Rochelle City Council led a coordinated review under the New York State Environmental Quality Review Act [6NYCRR Part 617 (SEQR)] of the Downtown Overlay Zone (“DOZ”) and Zoning Map Amendments (the “Proposed Action”). (“GEIS”), which considered potential environmental impacts associated with the proposed DOZ and culminated in the City Council’s adoption of SEQR Environmental Findings on December 8, 2015. The GEIS and SEQR Findings Statement for the DOZ established a Theoretical Development Scenario (TDS) for the DOZ and used the TDS as the baseline for the SEQR analysis (“GEIS TDS”).

While no specific development proposals were identified, the GEIS considered the potential for redevelopment, in order to address potential adverse environmental impacts at the earliest planning stages. The presumed uses and yields were estimated in order to determine the potential impacts of the DOZ as required by SEQR. Ultimately, the GEIS anticipated that the uses and nonresidential intensity/residential density of development that would be proposed on specific sites in the DOZ would be determined by a combination of factors, such as market conditions, property owner preferences and objectives, and economic factors.

In 2016, the City undertook refinements to the TDS as developers and property owners submitted site plan applications, and as specific development proposals began to move forward. The environmental review of the DOZ was generic in nature, and therefore could not anticipate exactly how much development would occur within the DOZ, or on which parcels it would be developed. Since there are multiple factors that influence whether a property owner would opt into the DOZ, it was expected that the TDS analyzed in the GEIS and SEQR Findings Statement would need to be adjusted once actual development proposals moved forward.

Therefore in September 2016, the City expanded the TDS to include additional square footage and residential units and undertook an associated SEQR review process to analyze potential impacts associated with the expanded TDS. In 2016, the TDS was revised to allow for 800 “floating” residential units which could be applied in any of the DO-1 through DO-5 Districts and 70 additional units were allocated to the DO-6 District, for a total of 6,370 units to be allowed throughout the entire DOZ. In December 2017, the City further refined the TDS to reallocate 56 of the designated floating units to the DO-6. In January 2019, the City made further refinements to the Amended TDS to move 22 of the remaining units allocated to DO-3 to the DO-2 District. This reallocation covered a short-fall in the total number of approved and requested units within the DO-2 District; no increase in the total number of residential units was proposed. In March 2019, the City reallocated 376 units from the DO-1, DO-4, and DO-5 to the DO-2 and DO-3. In July 2019, the City shifted 205 units from the DO‐1 to the DO‐2, and 80 units from the DO‐3 to the DO‐2.

Based on the 2016 SEQR analysis and subsequent SEQR reviews of each set of refinements made (last update in July 2019), it was found in each instance that the Amended TDS did not result in any new impacts not previously analyzed in the GEIS and 2015 SEQR Findings Statement. Table 1 below provides a breakdown of the July 2019 Adopted Amended TDS.

Now in the fourth year of project implementation, the residential component of the TDS is reaching its maximum build-out, and as specific projects move forward, additional refinements to the Amended TDS are again needed. DO-2 districts. Specifically, the City is seeking to allow an additional 290 units within the DO-1 district and 340 units within the DO-2 district for a total of 630 additional units. This would bring the total number of residential units allowed under the DOZ TDS to 7,000. To balance potential traffic impacts within the DO-1 and DO-2 districts, the City is also proposing to reduce the square footage of allowable nonmedical office space by 53,000 in the DO-1 district and 64,000 in the DO-2 district.

Table 2 below provides a breakdown of the proposed allocation of additional residential units and the reduction in nonmedical office space. Based on applications received, the City is seeking to allow for additional residential density. In addition, to balance potential impacts, the City is also seeking to reduce the amount of nonmedical office space allowed within the DO-1 and DO-2 districts. The City is proposing a reduction of 117,000 square feet of nonmedical office space with 1.76 million square feet still allowed under the TDS.

According to the SEQR Findings Statement, “[t]he DGEIS, FGEIS, and Findings Statement evaluations are applicable to any application which is submitted in accordance with the DOZ Amendments, to the extent the thresholds set forth in [SEQR Findings Statement] Table 1 are not exceeded in aggregate and by DO Zone.” Therefore, the act of amending the TDS requires a reassessment of the potential impacts analyzed in the GEIS. This analysis is to ensure that no new potentially significant adverse impacts not previously analyzed in the 2015 GEIS and 2016 TDS arise from the reallocated units.

This technical memorandum provides a review of the current amendments to the TDS to determine whether the addition of units within the DOZ as outlined (and below in Table 2) will result in any new significant adverse environmental impacts not previously analyzed in the GEIS. Technical analyses are provided, where necessary, to demonstrate that the Amended TDS will not result in any new environmental impacts not previously analyzed. Based on the analysis provided herein, the Amended TDS will not result in any new impacts not previously analyzed in the GEIS and 2015 SEQR Findings Statement, as amended in 2016, 2017 and 2019. In addition, all of the mitigation measures, including the requirement that site-specific developments pay into a fair share mitigation fund, and other conditions set forth in the SEQR Findings Statement apply to the Amended TDS.

ENVIRONMENTAL CONDITIONS, EXPECTED IMPACTS AND FINDINGS

The SEQR Findings Statement, as amended, provides a summary of the impacts associated with adopting the Proposed Action, based on the evaluation of the TDS examined in the DGEIS, FGEIS and subsequent SEQR analysis in 2016, 2017 and 2019. An exceedance of these thresholds either in aggregate or by DO Zone requires further SEQR review. Table 3 below, includes the July 2019 Amended TDS impact parameters and provides a summary of exceedances of the TDS impact parameters associated with the addition of 630 units in DO-1 and DO-2. As demonstrated in Table 3, the Amended TDS will result in an increase in residential use, resident population, required parking spaces (increase of 0.7%) and water/wastewater usage (increase of 4%). The hourly traffic generation and the estimate of school-aged children are similar to what was previously analyzed (1 additional trip in the PM Peak Hour). The amendments to the TDS will result in a decrease in commercial square footage (117,000SF) and a corresponding decrease in the worker population of 376 workers. However, the additional residential units will result in more than $2.4 million1 in additional property tax revenues and $2.14 million in additional Faire Share Mitigation Funds (not shown in Table 3 - see Appendix A).

After review of the GEIS and subsequent SEQR analysis, it was determined that the addition to the TDS as outlined in Table 2 will not result in any new impacts to land use, zoning or public policy; community character; police and fire protection services; solid waste management; recreation; socioeconomics; parking; water resources; geology, soils and topography; air and noise; and construction. As currently required, development under the Amended TDS would also be required to pay into the Fair Share Mitigation Fund outlined in the GEIS and 2015 SEQR Findings Statement, as amended. All other mitigation measures required by the Findings Statement would also apply to the Amended TDS. Further, the need for site-specific impact investigations and the need for associated mitigation measures will be determined by the Planning Board during site plan review in conjunction with future site-specific SEQR (6 NYCRR Part 617) analysis. Collectively, these requirements ensure that the Amended TDS will not result in any new impacts not previously addressed during the SEQR review process.

With respect to potential impacts on the provision of educational services, the transportation network, and impact on sewer infrastructure, it was determined that updated analysis of the potential impacts associated with the Amended TDS is warranted. The following presents and analysis of the potential for school, traffic, and sewer impacts.

Educational Services The City of New Rochelle retained WXY Architecture and Urban Design (“WXY”) to conduct a separate analysis of school resources, to determine an estimated number of school children to be generated from future development, and examine options to address the needs of targeted schools that may experience capacity issues as growth under the DOZ TDS occurs. Based on the analyses conducted by WXY, it was determined that impacts requiring mitigation are likely to occur at Trinity Elementary and during the build-out period associated with the TDS. As the 2016 Amended TDS included an additional 870 residential units over what was analyzed in the GEIS, the total number of estimated school children increased by 47 students, from 312 to 362 (see Table 4 below). The 2016 SEQR Technical Memorandum analyzing the increase in total units concluded that the impacts requiring mitigation at Trinity Elementary and New Rochelle High School would persist and that the impacts to these schools from the increase would be minor and that the mitigation measures, in the form of contributions to the Fair Share Mitigation Fund, set forth in the GEIS would serve to mitigate any potential impact. Accordingly, the school generation estimates outlined below in Table 4 were adopted by the City in 2016.

It is important to note that in 2016, when the GEIS school child generation analysis was updated, the update relied on the same assumptions used in the WXY study. At the time the actual breakdown of units approved or planned was not known so the GEIS assumption of 20% studios, 50% one-bedroom, 20% two-bedroom, and 10% three-bedroom were used in the analysis. However, the City now has a list of the actual unit mix of approved and planned developments for all units in each DO district. As of July 2019 the actual unit mix for approved and planned projects using the rates contained in WXY’s “New Rochelle School Capacity Study” is outlined in Table 5 below. Based on these approved and planned projects, the estimated number of school children to be generated as of July 2019 was estimated to be 309 students, rather than the 362 projected in the 2016 Amended Findings (see Tables 4 and 5). However, as the GEIS and Findings Statement, as amended, analyzed the impact of 362 school children, the impact parameter table (Table 3 above) was not been updated in July 2019 as this number is more conservative. The City is currently seeking to add an additional 630 units within the DO-1 and DO-2 districts. The July 2019 TDS reallocation analyzed 309 students, which is 37 students fewer than the 346 students analyzed in this September 2019 TDS. Although this is an increase from the July 2019 TDS, the number of students is still below the 362 students estimated under the 2016 Amended TDS and Findings Statement. Since the overall number of school children generated by the September 2019 TDS is less than what was analyzed in the 2016 SEQR Technical Memorandum and amended Findings Statement, no new significant impacts are anticipated to occur as a result of the current reallocation of units.

In addition to the planned and approved units generating fewer students than were analyzed in the 2016 Amended TDS, birthrates in the United States are also declining, likely due to economic distress caused by the Great Recession between 2008 and 2012. According to the Wall Street Journal, birthrates dropped by roughly 13% from 2007 to 2012. Data published by the Centers for Disease Control and Prevention (CDC) shows that in 2015, the U.S. birth rate reached a 30-year low. This national trend was also observed in Westchester County, where births have declined by 22.8 percent since 2000, and a record low number of births were recorded in 2016.2 Corresponding to these trends, enrollment at both Columbus Elementary and Trinity Elementary has also declined in the three years since adoption of the DOZ and GEIS. As demonstrated in Table 7 below, enrollment at Columbus Elementary and Trinity Elementary has declined by 2.9% (24 students) and 6.2% (56 students), respectively. Given declining enrollment at the two schools most likely to receive new students from the proposed 630 units, coupled with the overall reduction in students analyzed in the 2016 Amended TDS and SEQR Findings Statement, no new significant impacts are anticipated to occur.

This memorandum provides a trip generation comparison for the adopted July 2019 TDS land use program versus the proposed September 2019 TDS land use program (see Tables 1 and 2 above). The September 2019 TDS, would increase the number of residential units and decrease the square footage of the nonmedical office land use in DO-1 and DO-2.

As shown in Table 8, the September 2019 TDS would result in trip estimates that are similar to or less than the July 2019 TDS trip estimates in DO-1 and DO-2 and no changes in DO-3, 4, 5 and 6. Therefore, the analysis and findings presented for the July 2019 TDS would be applicable to the September 2019 TDS land use program; no new traffic impacts are anticipated as a result of the new residential units within DO-1 and DO-2. .

Sewer The additional 630 residential units have the potential to place additional pressure on the capacity and function of the City’s sewer infrastructure. As outlined above, the new units have the potential to result in a net increase of approximately 103,6753 gpd of additional wastewater. The 2015 GEIS and Adopted Finding Statement, as amended, analyzed the need for improvements to the City’s aging sewer infrastructure resulting from implementation of the DOZ TDS and stated that “the City wastewater and stormwater system will be improved through required infrastructure improvements that will reduce I&I.” The GEIS and Findings Statement further stated that “improvements to the City’s wastewater distribution network were identified as necessary to accommodate future development” and will be funded through the Fair Share Mitigation Fund. Accordingly, the City Engineering Department has undertaken a sanitary sewer capacity evaluation and will undertake recommended upgrades and improvements to the City’s sewer infrastructure to address capacity issues. These improvements will replace old deteriorated piping and manholes that are prone to infiltration that cause storm water leading to the New Rochelle Sewage Plant. To meet the hydraulic capacity requirements and update the sewer system to meet current standards to support the development of DOZ project sites, approximately 20,000 feet of sanitary sewer main and over 120 sanitary sewer manholes in the City of New Rochelle downtown area will need to be replaced. The evaluation study, completed in 2019, includes residential development associated with the TDS as well as potential additional units, including the currently proposed 630 units. Construction of the first phase of the sewer improvements is underway. In addition, the additional 630 units will generate approximately $2.14 million in additional Fair Share Mitigation funds; a portion of these funds will go towards implementation of the sewer evaluation study. Therefore, the proposed 630 units were contemplated in the City’s capacity analysis and associated improvements. Accordingly, no additional sewer infrastructure impacts will occur as a result of the proposed Amended TDS.

Conclusions Per this memorandum, the TDS and TDS Impact Parameters (SEQR Findings Statement Tables 1 and 2) have been updated (see Tables 9 and 10 below) to reflect the Amended TDS described and analyzed herein. Based on the above analysis, the Amended TDS will not result in any new impacts not previously analyzed in the GEIS and 2015 SEQR Findings Statement, as amended. All of the mitigation measures and other conditions set forth in the SEQR Findings Statement apply to the Amended TDS. In addition, the measures set forth in the SEQR Findings Statement that may be applicable to future site-specific development projects in the DOZ also apply to the Amended TDS (see Findings Statement pages 44-47). These mitigation measures and future action requirements ensure that the DOZ, under either the GEIS TDS or the Amended TDS, will not result in any significant adverse environmental impacts.

Amended TDS Tax Revenues and Fair Share Mitigation Payment The Amended TDS will generate additional property taxes over and above the $76.45 million in property taxes projected for the GEIS and 2015 SEQR Findings Statement, as amended in 2016, 2017, and 2019, adding to the fiscal benefits of the project. Introduction: Day-care centers are currently permitted in the DMU-Downtown Mixed Use, DMUR-Downtown Mixed Use Urban Renewal, and the NB-H Neighborhood Business-Hospital districts. Like all land use categories, this use poses its own unique set of challenges. As discussed below, a zoning amendment is recommended to ensure that day-care centers are located in a manner that furthers the goals and objectives of the downtown.

Review: There are numerous day-care operations in the downtown and elsewhere throughout the City. This use provides an important service for families, but can be detrimental to the economy, traffic and parking if there is an overabundance. In order to mitigate negative impacts, it is recommended that this use be restricted by zoning to not be within 500-feet of each other in the downtown area, pursuant to the provisions of Chapter 331-113.6. Draft zoning language is attached.

Recommendation: Staff recommends that Council set a public hearing on the proposed amendment and refer same to the Planning Board, and Westchester County Planning Board. It is also recommended that the City Council declare itself Lead Agency for the purposes of an environmental review pursuant to the State Environmental Quality Review Act (SEQRA). The Short Environmental Assessment Form (SEAF) is attached. Staff recommends that the Council approve this amendment pending the outcome of the public hearing and responses from the City’s Planning Board, and the Westchester County Planning Board.

§ 331-113.6 Day-care centers.

The Planning Board may issue a special permit for a day-care center subject to the following:

A. Day-care centers shall be no more than 15,000 square feet in area.

B. Submission by the applicant and acceptance by the Board of a satisfactory transportation management and parking plan showing the proposed utilization of the site and detailing the steps to be taken by the applicant to address traffic flow and safety concerns.

C. Day-care centers shall not be within 500 feet of each other.

Currently, there are no restrictions should a business desire to close off 100% of its window area with blinds, shutters or similar. Should a business want to creatively or artistically cover its windows, there is a restriction that the business cannot exceed 15% of its cumulative window area with signage. The proposed amendment before City Council provides an avenue for businesses to exceed the 15% requirement subject to design and approval by the Municipal Art Commission.

City Staff recommend that Chapter 270, Section 9 Design and Lettering be amended to allow for artistic window displays exceeding 15% of the cumulative total window area as approved by the Municipal Art Commission, and Chapter 270 Attachment 1 Table of Permitted Signs be amended to add the same. Further, City Staff recommend that the corresponding Chapter 133, Fees be amended to include a fee for permanent window coverings.

Recommendation: Staff recommends that Council set a public hearing on the proposed amendment and refer same to the Municipal Art Commission and Westchester County Planning Board. Section 2. § 270-4, Restrictions, of Chapter 270, Signs, of the Code of the City of New Rochelle is hereby amended as follows:

§ 270-4. Restrictions.

I. No sign shall be painted, attached, pasted, covered, wrapped or applied directly onto the exterior of a building or structure except as approved by the Municipal Art Commission.

Section 3. § 270-9, Design and lettering, of Chapter 270, Signs, of the Code of the City of New Rochelle is hereby amended as follows:

§ 270-9. Design and lettering.

C. Permanent and/or temporary signs on windows and doors, including window coverings, shall have letters no larger than 12 inches in height nor occupy more than 15% cumulatively of the total area of windows and doors. Temporary signs on windows and doors shall not require a permit if they do not occupy more than 15% cumulatively of the total area of windows and doors. The fifteen-percent computation shall be based on any window and door areas inside of decorative borders, if any. Permanent signs on windows and doors occupying over 15% of the total area of windows and doors shall require permits and approval from the Municipal Arts Commission. Area should be measured inside of decorative border.

Section 4. Section 133-1, Enumeration of fees, is hereby amended as follows:

§ 133-1. Enumeration of fees.

The following schedule of fees is hereby established with respect to licenses, permits, registrations, documents and activities required or regulated under the provisions of various chapters of the Code of the City of New Rochelle. Specific requirements and regulations for the following shall be as set forth in the chapter to which reference is made below. The following

Introduction: The City’s Historic Landmark Review Board (HLRB) received an application to designate Leland Castle, located on the property (now part of Mercy College), as a local historic landmark. The City’s Historian, Barbara Davis, submitted the application. After reviewing the application, the HLRB voted to recommend to Council that the site be landmarked. Pursuant to the provisions set forth in the City Code, the recommendation is now before Council to review and set a hearing if it chooses.

Review: Completed in 1859, Leland Castle has long been a notable structure in the City of New Rochelle. The Gothic Revival building was originally built as a summer retreat for a wealthy New Yorker, but has most recently been used for as an administrative building for the College of New Rochelle.

In order to be designated as an historic landmark, a building, structure or piece of land must meet one or more the following characteristics:

(1) Association with persons or events of historic significance to the City, region, state or nation. (2) Illustrative of historic growth and development of the City, region, state or nation. (3) In case of structures, embodying distinctive characteristics of a type, period or method of construction or representing the work of a master or possessing unique architectural and artistic qualities or representing a significant and distinguishable entity. (4) Which has been duly included on the National Register of Historic Places maintained by the United States Secretary of the Interior or which has been duly included on the New York State Historic and Natural Districts Inventory or New York State Archaeological Site Inventory maintained by the New York State Board of Historic Preservation.

Leland Castle meets the first three of these characteristics. Based on the application submitted by the City Historian, as well as the recommendation received by the HLRB, it is recommended that Council designate Leland Castle as a historic landmark. Copies of the City Historian’s application, the HLRB resolution, and an Environmental Assessment Form are attached for reference.

Recommendation: Staff recommends that Council set a public hearing on the proposed landmarking and refer same to the Planning Board and Westchester County Planning Board. It has been recognized by the City that increasing traffic congestion and intersection deficiencies at Main Street, Weyman Ave. and King’s Highway have negatively impacted important commercial clusters in the City.

Intersection re-alignment and related signal improvements will upgrade this traffic chokepoint and allow continued economic growth in nearby retail.

The following parcel is included in the acquisition needs:

· 813 Main Street (Section 2 Block 530 Lot 0001)

The City will attempt to acquire this parcel through private negotiations and acquisition. However, it may be necessary for the City to acquire some or all of the properties through the eminent domain process.

Accordingly, City staff is recommending that the City Council initiate proceedings under the New York State Eminent Domain Procedure Law (“EDPL”) to acquire the properties in connection the aforementioned activities. This initial procedure under EDPL will provide the City access to inspect the aforementioned property in order to conduct additional reviews of the proposed facility as required by law.

Recommendation: It is recommended by City staff that the City Council adopt the attached Resolution authorizing the City to initiate proceedings under the NYS EDPL to acquire the property in connection with facilitation of the proposed traffic improvements.

BE IT FURTHER RESOLVED, that the City shall make every reasonable and expeditious effort to justly compensate the owner of the identified property by consensual negotiation and agreement; and

It has been recognized by the City that increasing traffic congestion and intersection deficiencies at Main Street, Weyman Ave. and King’s Highway have negatively impacted important commercial clusters in the City.

Intersection re-alignment and related signal improvements will upgrade this traffic chokepoint and allow continued economic growth in nearby retail.

The following parcel is included in the acquisition needs:

· 813 Main Street (Section 2 Block 530 Lot 0001)

The City will attempt to acquire this parcel through private negotiations and acquisition. However, it may be necessary for the City to acquire some or all of the properties through the eminent domain process.

As you know, City Council initiated proceedings under the New York State Eminent Domain Procedure Law (“EDPL”) on September 17, 2019 to acquire the properties in connection the aforementioned activities. This initial procedure under EDPL will provide the City access to inspect the aforementioned property in order to conduct additional reviews of the proposed facility as required by law.

Recommendation: It is recommended by City staff that the City Council adopt the attached Resolution authorizing the City Manager to direct a public hearing under the NYS EDPL on December 10, 2019 to acquire the property in connection with facilitation of the proposed traffic improvements.

Introduction: The zoning parameters that dictate how a site may develop in the Downtown Overlay Zone (DOZ) include “street type” classifications. The code defines a street type as “a classification assigned to a Street or Pedestrian Way denoting the standards of Public Frontages and Private Frontages.” Essentially, the requirement dictates how wide a sidewalk must be, and how much of the building’s presence must be located near the street. As noted below, a minor amendment to the DOZ street type designations is recommended.

Review: Huguenot Street, between Centre Avenue and Division Street, is identified as an A Street type in the DOZ. Heading east on Huguenot Street into the core of downtown, this designation remains an A Street type, but it changes to a D Street type heading west. With one exception, all adjacent blocks are either B or D street types. B and D Street types require a minimum public frontage of 12-feet, whereas A street types require a minimum of 15-feet. In order to provide greater consistency with the surrounding and recognize this particular block’s slightly irregular curvature and transition away from downtown, it is recommended that its street type be changed from A to B as shown on the attached map.

Recommendation: Staff recommends that Council set a public hearing on the proposed amendment and refer same to the Planning Board, and Westchester County Planning Board. It is also recommended that the City Council declare itself Lead Agency for the purposes of an environmental review pursuant to the State Environmental Quality Review Act (SEQRA). The Short Environmental Assessment Form (SEAF) is attached.

Background: In a continuation of both a holiday tradition and as a part of the overall efforts to promote holiday shopping in New Rochelle, staff is recommending that the City Council approve free parking in Municipal Surface Lots during the holiday shopping season.

Recommendation:

As was done in past years, staff proposes two hours of free parking in the following Municipal Surface Lots controlled by Muni-Meters:

1. City Hall 2. Garden Street South 3. Lawn Avenue 4. Library 5. Library South 6. North Avenue @ Thruway (I-95) 7. Prospect Street 8. Maple Avenue 9. Union Avenue

The property owner at this address has notified us that there have been numerous instances of vehicles parking at this location and blocking their driveway. PD has responded and issued summonses and towed vehicles. DPW review of the location revealed that the property width is 25 feet, including the driveway width. The space available to park a vehicle between adjacent driveways is less than 16 feet, which is not adequate for a parking space. We therefore recommend restricting parking at this location at all times. A photo of the location is attached. The following change to the Municipal Code is required: (Matter underlined added)

Section 1. Section 290-16, Cruising; soliciting passengers, of Chapter 290, Taxicabs, of the Code of the City of New Rochelle, is hereby amended as follows:

§ 290-16 Cruising; soliciting passengers.

A. A driver may only solicit a passenger while sitting in his or her driver's seat and may only use the words "taxi" or "cab" or "taxicab" in connection with such solicitation.

B. A driver may not utilize the services of another person, other than a taxi dispatcher, to solicit a passenger.

C. A driver may not suggest to a passenger that an additional person be accepted as a passenger.

D. A driver may not yell, shout, use his or her vehicle horn or make physical contact with a prospective passenger in connection with solicitation of such passenger.

[E. A driver may only solicit passengers at a duly authorized taxi stand as set forth in New Rochelle City Code § 312-89, entitled "Schedule XVIII: Taxi Stands."]

[F.]E. A driver awaiting employment at a designated taxicab stand, as set forth in § 312-89, may only stand his or her vehicle in a defined parking space at such taxicab stand. At no time may a taxicab remain in the vicinity of a designated taxicab stand when there is no defined parking space available.

Section 2. Section 290-23, Duties and responsibilities of taxicab operators, of Chapter 290, Taxicabs, of the Code of the City of New Rochelle, is hereby amended as follows:

§ 290-23 Duties and responsibilities of taxicab operators.

A. Every person driving a vehicle licensed pursuant to this chapter shall:

(1) Not refuse or neglect to convey any orderly person upon request in the City unless previously engaged or unable or forbidden by the provisions hereof so to do.

(2) Not carry any other person than the person first employing the taxicab unless the person first employing the taxicab consents to the acceptance of an additional passenger.

(3) Keep a written or digital record of all trips on a form approved by the Police Commissioner. Such record shall be retained by the owner for at least six months.

(4) Thoroughly search the interior of the vehicle after termination of each trip for any articles left or lost in the vehicle; immediately take any such property to the Police Department in the City, town or village where the passenger or passengers were discharged.

(5) Report all accidents as required by the Vehicle and Traffic Law and report all accidents to the owner.

(6) Report each change of residence within 48 hours thereof to the Police Commissioner.

(7) Answer all communications and summonses received from the Police Commissioner.

(8) Deliver all fares received to the owner.

(9) Not operate any such vehicle while his taxicab driver's license or chauffeur's license is suspended or revoked.

(10) Not permit another person to use his badge, City operator's license or receipt book.

(11) Return the vehicle to the owner and not leave it nor permit any other person to drive it.

(12) Not smoke while the vehicle is carrying passengers.

(13) Keep the interior of the vehicle clean.

(14) Not recommend to any passenger the name of any hotel, restaurant, cafe or any place operated and maintained in violation of the law.

(15) Proceed with passengers to the destination by the shortest possible route unless otherwise directed.

(16) At all times while on duty have displayed in the interior of his vehicle, in a frame provided therefor, his City operator's license.

(17) Report to the Police Commissioner any conviction of a vehicle and traffic law, penal law or other local law pertaining to the operation of a motor vehicle in any jurisdiction.

(18) Not use the vehicle horn to attract customers.

(19) Not park any taxicab vehicle on a public street in a metered space within 500 feet of a taxicab office.

(20) Not refuse or neglect to convey any person accompanied by a service animal used by a person with a disability. No additional charge shall be charged for conveying such accompanying service animal.

(21) Not operate a taxicab in such a manner or at a speed which unreasonably endangers users of other vehicles, pedestrians or passengers.

(22) Operate a taxicab in compliance with all applicable traffic laws, rules and regulations.

Section 3. Chapter 133-1, Enumeration of Fees, of Chapter 133, Fees, of the Code of the City of New Rochelle, is hereby amended as follows:

§ 133-1. Enumeration of fees.

The following schedule of fees is hereby established with respect to licenses, permits, registrations, documents and activities required or regulated under the provisions of various chapters of the Code of the City of New Rochelle. Specific requirements and regulations for the following shall be as set forth in the chapter to which reference is made below. The following schedule of fees shall expire at the end of each calendar year, commencing December 31, 2006, unless renewed and/or amended prior thereto.
