ADMINISTRATIVE ARRANGEMENTS ACT 1994 Delegation under Section 9 I, Stephen Campbell Mullighan, Minister for Housing and Urban Development, hereby delegate pursuant to section 9 of the Administrative Arrangements Act 1994 all of my functions and powers under the Urban Renewal Act 1995 with respect to the activity described in schedule 1 of this instrument to Leon Bignell, Minister for Agriculture, Food and Fisheries. FISHERIES MANAGEMENT ACT 2007 SECTION 115 Exemption No. ME9902987 TAKE NOTICE that pursuant to section 115 of the Fisheries Management Act 2007, Mark Short of Urban Virons Group, 488 Churchill Road, Kilburn, SA 5084 (the ‘exemption holder’) or a person nominated as his agent in this notice are exempt from section 70 of the Fisheries Management Act 2007, and regulation 5 and 10, clause 74(a) of schedule 6 and ‘other waters’ as defined in schedule 7 of the Fisheries Management (General) Regulations 2017, but only insofar as they may take non-native species in the waters set out in Schedule 1 using the gear specified in Schedule 2 (the exempted activity), subject to the conditions set out in Schedule 3, from 13 February 2018 until 12 February 2019, unless varied or revoked earlier. SCHEDULE 1 • All freshwater lakes, rivers, streams and wetlands within the Adelaide metropolitan region. SCHEDULE 2 • 1 x seine net with maximum dimensions of 100 m x 2 m. SCHEDULE 3 1. The exemption holder may only take non-native species and must immediately destroy them humanely. 2. Non-native species of fish taken under this exemption cannot be sold and must be disposed of appropriately at an approved waste facility and must not be used for any commercial purpose. 3. The exemption holder must immediately return to the water any native fish captured incidentally while undertaking this exempted activity. 4. Before conducting the exempted activity, the exemption holder must treat all containers that will hold native fish with a sterilising agent to reduce the risk of translocation of any disease or pathogen. 5. FISHERIES MANAGEMENT ACT 2007 SECTION 115 Ministerial Exemption Number: ME9902989 TAKE notice that pursuant to section 115 of the Fisheries Management Act 2007, the holder of a Commercial Fishery Licence in the Marine Scalefish Fishery, Restricted Marine Scalefish Fishery, Lakes and Coorong Fishery, Southern Zone Rock Lobster Fishery or Northern Zone Rock Lobster Fishery (the ‘exemption holders’) or their registered master and agents are exempt from Sections 70 and 72(2)(c) of the Fisheries Management Act 2007, Regulation 5, and clause 113(2) of Schedule 6 of the Fisheries Management (General) Regulations 2017 in that the exemption holder shall not be guilty of an offence when taking Wrasse species (other than Western Blue Groper) that are greater than 35 cm from State waters as described in Schedule 1, subject to the conditions specified in Schedule 2 from 12:01 am on 25 February 2018 to 11:59 pm on 24 February 2019, unless varied or revoked earlier. SCHEDULE 1 Coastal waters of the State excluding waters within a Sanctuary Zone or Restricted Access Zone of a Marine Park, or an aquatic reserve, or the Adelaide Dolphin Sanctuary, or the River Murray. SCHEDULE 2 1. The exemption holder may take Wrasse species (other than Western Blue Groper) that are greater than 35 cm in length when measured from the foremost part of the head to the end of the tail. 2. The exemption holder must record all Wrasse taken within the terms of this notice in the South Australian Commercial Marine Scalefish Fishery Daily Catch and Effort Logbook. 3. The exemption holder or their registered master must also complete the Wrasse Research Fishing Log Sheet daily, and within 15 days of the end of the month to which it relates, post or deliver the log sheet to SARDI Aquatic Sciences, PO Box 120 Henley Beach SA 5024 and marked Attention: Dr Michael Steer. The log sheet must be dated and signed to certify that the information contained in the log sheet is complete and accurate. 4. While engaging in the exempted activity, the exemption holder must be in possession of a copy of this notice. This notice must be produced to a Fisheries Officer if requested. 5. The exemption holders shall not contravene or fail to comply with the Fisheries Management Act 2007, or any regulations made under that Act except where specifically exempted by this notice. This notice does not purport to override the provisions or operation of any other Act including, but not limited to, the Marine Parks Act 2007. The exemption holders and their agents must comply with any relevant regulations, permits, requirements and directions from the Department of Environment, Water and Natural Resources when undertaking activities within a marine park. REPORT OF THE REMUNERATION TRIBUNAL NO. 1 OF 2018 Supervising Regional Manager Allowance – Magistrates PREAMBLE The Remuneration Tribunal (“the Tribunal”) has jurisdiction under Section 13 of the Remuneration Act 1990 (“the Act”), to determine the remuneration payable to judges, magistrates and the holders of public offices listed in that section of the Act. Section 13 of the Magistrates Act 1983 confers jurisdiction on the Tribunal to determine additional remuneration for a magistrate, for the period that magistrate performs special duties, insofar as those duties are directed by the Chief Magistrate, with the concurrence of the Attorney-General. On 18 December 2017, the Tribunal received an application from the Honourable Chief Magistrate Hribal (“the Chief Magistrate”), for determination of a special duties allowance payable to a magistrate who performs the duties of the newly established position of Supervising Regional Manager. PROCEDURAL HISTORY On 16 January 2018, the Tribunal invited submissions from the Premier, the Judicial Remuneration Coordinating Committee (“JRCC”), the Magistrates Association of South Australia (“MASA”) and the Chief Magistrate. Submissions were received from the Chief Magistrate and the Crown Solicitor’s Office (“CSO”), on behalf of the Premier. A hearing was conducted by the Tribunal on 2 February 2018. The Chief Magistrate attended to make short oral argument in relation to her application and Ms Lucy Hodge of the CSO attended on behalf of the Premier, to make oral submissions in the public interest. SUBMISSIONS The Chief Magistrate submitted that the proposed allowance ought to be payable at the rate of $30,730, or such higher amount as determined by the Tribunal from time to time. Furthermore, the Chief Magistrate submitted that the proposed allowance should only be payable if directed by the Chief Magistrate, with the concurrence of the Attorney-General, having regard to section 13(1a) of the Magistrates Act 19831. The CSO on behalf of the Honourable Premier submitted that the Premier neither opposes or supports the Chief Magistrate’s application and is pleased to leave the matter in the hands of the Tribunal. 1 (1a) A magistrate, while performing special duties for the time being directed by the Chief Magistrate with the concurrence of the Attorney- General, is entitled to such additional remuneration as may be determined by the Remuneration Tribunal. CONSIDERATION OF ALLOWANCE The position of Supervising Regional Manager is a newly created position in relation to the office of magistrate, which has been created due to the abolition of the office of Deputy Chief Magistrate pursuant to section 16 the Statutes Amendment (Attorney-General’s Portfolio No 3) Act 2017. That legislative provision comes into effect on 8 July 2018. Through written and oral submissions, the Tribunal has heard that the duties of the position of Supervising Regional Magistrate have been documented and will involve supporting the Chief Magistrate in the efficient administration of the Magistrates Court, including acting as the Chief Magistrate when and if required. Accordingly, the duties of the Supervising Regional Manager will include those of the Deputy Chief Magistrate and additional duties. The monetary amount of the proposed allowance is commensurate with the difference in salary of the abolished Deputy Chief Magistrate role and the salary of a Magistrate. As a consequence, the Tribunal’s Determination will not impose an additional impost upon the State budget. The Tribunal has considered the circumstances in which the allowance is proposed. The Tribunal has also considered the level of the allowance proposed. The Tribunal is satisfied that the payment of the allowance is appropriate and concludes that the level of the allowance submitted should be the amount of the allowance.
