Minutes of the 12th EU-Moldova PCC

The 12th meeting of the EU - Moldova Parliamentary Cooperation Committee (PCC) opened on 16 February 2010 at 15h.30 under the co-chairmanship of Mr. and Mrs Monica Luisa MACOVEI.

Co-Chairman Mr. CORMAN welcomed the participants. He stressed the importance of the Parliamentary Cooperation Committee. He also underscored the importance that Moldova attaches to the relations with the EU, including bilateral cooperation with its member states. He expressed the gratitude of the Moldovan Delegation for launching the negotiations on a EU-Moldova Association Agreement. He also noted that the DCFTA and visa facilitation remain the priority directions of Moldova.

Mrs. MACOVEI, co-chair, welcomed the 12th PCC meeting and expressed the readiness to work together with the Moldovan authorities. She also supports the process of reforms in Moldovan. In this respect she underlined the importance for Moldova to share this experience with . In her words, membership of the EU can become possible only after conducting reforms in key areas.

The draft agenda of the 12th meeting of the EU-Moldova PCC was adopted without debate.

The minutes of the 11th meeting of the EU-Moldova PCC, which was held in Strasbourg on 22-23 October 2008, were adopted without debate.

Joint debate on topics 3 - 5

Mr. LEANCA - Minister of Foreign Affairs and European Integrate of the Republic of Moldova, welcomed the support of the European Parliament to democratic values in the region and in the Republic of Moldova. As he noted, the values and objectives that the European Parliament promotes and supports represent the reference points to Moldova's efforts to democratise its society. In this context he referred to the European Parliament resolution of 07 May 2009 as a strong signal of encouragement sent to the Moldovan society at a critical moment and expressed his gratitude for this. The speaker referred to the new political reality in Chisinau, which has a special significance in terms of relations with the EU. Within the framework of cooperation with the EU, Moldova has started to deliver on the commitments it made. Moldova's previous messages were ambiguous. He referred to the perspectives of the EU- Moldova dialogue. In the opinion of the Moldovan authorities, the Common Declaration of the Cooperation Council of 21 December 2009 confirms the ambitious

D-MD\PV\871462\EN 1 PE 467.616 agenda of Moldova for its European direction and it also proves the unprecedented openness of the EU and its Member States to support Moldova on this hard and necessary path towards the European integration. The EU and Moldova have started the dialogue on the liberalisation of the visa regime. As he noted on 1 March 2010, there will be evaluation of the experts´ mission which is meant to evaluate the readiness of Moldova to start the dialogue on the liberalisation of the visa regime. This dialogue is political as well as technical. On the technical side, Mr LEANCA pointed to the fact that Moldova is trying to meet the EU requirements. As regards the political viewpoint, it is up to the EU to create a politically positive environment for visa facilitation in Brussels and in the member states. The June meeting of the Association Council will be a good opportunity to give the Commission the necessary mandate to start negotiations. In the opinion of the Moldovan side the negotiations on the Association Agreement (AA) and Eastern Partnership will be successful. He also spoke on the importance of the Eastern Partnership for Moldova. On the financial component of the EU's support he noted that - due to the global financial crisis - Moldova is confronted with budgetary difficulties. Moreover, the inheritance from the previous regime resulted in Moldova´s need of assistance from its international partners. In this respect he mentioned that the recent agreements with the IMF create a favourable environment for external financing to Moldova. The decision of the EU and the World Bank to co-chair a consultative group on Moldova on 24 March is very important for Moldova and hopefully there will be a possibility to identify the necessary resources to overcome the existing financial crisis in Moldova. The speaker also asked for the macro financial assistance for Moldova and underlined that the memorandum approved by the IMF on 29 January 2010 creates the favourable environment for further steps in the negotiations with the Commission. He also spoke on the importance of the EU's support to Moldova's EU approximation.

Mr. Dirk SCHUBEL, Head of the EU delegation to Moldova, made a reference to the opening of a bridge, which he attended the day before the meeting, in the North of the country. In his words building of bridges between the EU and Moldova, which was closed for 66 years, is symbolic in this very moment and also demonstrates what can be achieved in Moldova with the help of the EU. He dwelt on last years achievements in domestic policy of Moldova and in its bilateral relations with the EU. Opening of negotiations on the Association Agreement is the most important step in this respect. He expressed his hope that, at a later stage, negotiations on the Free Trade Agreement will start. He also pointed to the number of fields where the EU and Moldova have made progress together. Visa facilitation and readmission agreements have been in force since 1 January 2007 and their implementation is going smoothly. He mentioned the Common Visa Application Centre, which for the Moldovan citizens has facilitated the procedures of obtaining the visas for Schengen states and other EU member states. With respect to the relations between the EU and Moldova, he also mentioned the "Mobility Partnership". The EU annual support to Moldova, only on bilateral level, is of approximately 60 millions euro. In 2010 another 41 millions euro will be allocated by the EU for the institution building programme, under the Eastern Partnership. In addition, Mr SCHUEBEL spoke about the founds available for the EU in order to sustain energy prices. The EUBAM (European Border Assistance Missions) is also a substantial element in the relations between the EU and Moldova. In March 9 High Level Advisors will help strengthen the key policy making institutions of Moldova. He mentioned the Democracy Support Package that will be implemented by the Council of and will support Moldova in further reforming the judiciary.

D-MD\PV\871462\EN 2 PE 467.616 Budgetary support has been allocated to health, social and water sectors, and,, this year rural development will be supported with considerable funds. He added that micro financial assistance will certainly be granted by the EU. He expressed hope about additional funds being granted to consultative group meeting on Moldova on 24 March.

With respect to Transnistria Mr SCHUEBEL spoke on the support to the people in Transnistria, through confidence building measures, which include the creation of a "Euro Region" and the "Railway Package". He also discussed those measures in detail.

Mr. MASTALKA commented that both parties want Moldova to join the EU. However, what price does the EU have to pay for this? He also spoke about discussions concerning reforms and visa facilitation. Finally he stated that there was cooperation with the previous government for example there were 8 years of cooperation with the members of Moldovan Parliament and consequently there are some foundations laid down and everything which is positive should be used.

Mr. STOLOJAN stated: "there are two essential conditions: that Moldova manages, first of all is the political stability. There is an Alliance for European Integration which is strongly committed to push Moldova towards the EU and this commitment is strongly supported by the EU". So he put the following question: how is Moldova going to maintain its political unity within this Alliance in the next 2 years?". With regard to the economic stability, which should consists of stability of budget and exchange rate, and as it was said by the Moldovan side that Moldova can not make it without the external aid. Concerning the external aid, he asked the second question about how would Moldova manage to keep the agreements which it has concluded on the external aid?

Mr. BUŞOI commented on the state of play of EU-Moldova cooperation. He noted that the wish of Moldova to get closer to the EU should be implemented through reforms. Support for democracy, rule of law and market economy are the principles which were used by the states that recently joined the EU. He commented on the intervention of the Deputy Prime Minister and underscored that the EU should support a liberalised visa regime in order to promote exchange of experience, stimulate business. Clearly in business there are mutual interests and opportunities as well. These are as important as cultural and historical identities. As for the Eastern Partnership, the new initiative of the EU, he said that he encourages using this initiative because, in his words, "it is a very important instrument to promote closeness of the EU and Eastern Partnership Countries". Regarding the financial component he noted that in the European Parliament there is no obstacle for granting the financial aid by the EU. There are new procedures introduced by the Lisbon Treaty for granting the assistance and it requires time, but, together with the colleges, they will make efforts in the European Parliament to speed up those procedures.

Mr. CORMAN commented that Moldova needs aid in order to advance towards the EU integration.

D-MD\PV\871462\EN 3 PE 467.616 Mr. IVAN, addressed the EU enlargement process, and referred to culture as the main issue, instead of economy. He underlined the fact that more discussions should be carried out on culture. As he said it is culture that makes Moldova a European state.

Mr. GODEA spoke about the recent political developments in Moldova, which brought historical new era in Moldova. He underlined last year's two election processes in Moldova and developments in this respect. He recalled the tragic events of 7 April and the aftermath, when hundreds of people where arrested, tortured and some of them even killed. So, the EP resolution of 7 May 2009 was a very strong signal for the democratic parties of Moldova to keep fighting for democracy. The 29 July 2009 elections brought a new majority in the Moldovan Parliament, with an alliance being formed with a majority of fifty-three seats in Parliament. On 25 September 2009 the government was sworn in. After taking over power, it passed the agreements on the Memorandum with the IMF, saving the country from financial collapse. However, the Parliament failed to elect the President of the Republic. Discussions are ongoing on constitutional reform and Moldova will follow the recommendations of the international community. The speaker continued speaking on key reforms ongoing and being planned in the country.

Mr. PETRENCO, representative of the opposition, welcomed the PCC meeting, and enumerated briefly the recent political developments. In particular he spoke on last year's two elections. In his speech he criticised the Alliance for the European Integration for human right violations. He also spoke about the Communist Party of Moldova and noted that it is a pro-European party and underlined the achievements made together with the EU so far. He also noted that the previous communist government created the ground for further visa facilitation and EU approximation. He concluded by expressing the hope that comments and remarks of opposition will be reflected in joint declaration of the meeting.

Mr. MUNTEANU provided the details of last year's elections and spoke about the issues of non recognition and recognition of the elections by the opposition of that time. Regarding the illegal treatment of the youth in police stations, he mentioned that none of the cases were clear; even an international investigation could not prove those facts. To that end he recalled the fact that during the events of 7 and 8 of April there were more then 300 police officers injured and none of them was visited by any representatives of the Alliance for European Integration. He also referred to the position of Mr. GODEA: loans from the IMF saved Moldova from insolvency and added that it is impossible to save a country with a budget of 2 billion USD by 60 million US dollar annual loan. In his speech he also analysed the previous and current economic situation of Moldova and stated that Moldova is not an insolvent country.

Mr. UNGUREANU talked on Moldova's relations with Romania and noted that, for Moldova, Romania - due to its geographical location - is a gateway to the EU. He also called upon the government of Moldova to maintain the course towards the EU integration.

Mrs. ZDANOKA pointed out that the EU integration should not be a value in itself and only a national idea. As she mentioned, it should serve to improve the living standard of the citizens. With respect to the idea of the EU integration she presented the example of Latvia.

D-MD\PV\871462\EN 4 PE 467.616 Mr. CZARNECKI called on his personal experience in the Polish government and Polish experience itself on its way to European integration and gave several examples in this respect. Further he encouraged the government of Moldova to continue its reforms and to achieve EU integration.

Mr. MUNTEANU asked Mr. CZARNECKI to repeat his message continuously for his Romanian colleges in order for them to stop bringing up the politicised issue of 7 and 8 April 2009.

Mrs. IOTOVA raised the issues of ethnic minority rights and asked how Moldova can protect and defend the human rights of ethnic minorities? She also asked a question about the independence of media.

The Minister of Justice of Moldova, Mr. TANASE, dwelt on the existing situation and problems in the justice system of Moldova and provided information on the reform of the justice system by the Government, which includes procedural reform, clarification of procedures in criminal and civil matters; administration of the justice system, change of judicial system by eliminating specialized courts, etc. He further discussed the details of abovementioned reforms, which also involve the reform in the penitentiary system. In his speech he referred to the rights and freedoms of individuals: freedom of expression, freedom of association, religious freedom, which are priorities of the Moldovan Government. Mr TANASE added that there are no cases of violation of those rights by the current government. He welcomed the fact that representatives of the opposition are also participating in the PCC meeting, and continued speaking on the tolerance and understanding between political powers as one of the important preconditions to advance towards Europe.

Mr. IONIŢĂ mentioned the main concerns of Moldova's economy and insurance competitiveness. In his speech he analysed the existing situation in the energy sector of the country and provided information on reforms planned and carried out in this sector. He further analysed the reforms in the economic sector mentioning the developments in the Court of Auditors as well. The speaker also underlined the efforts of liberalizing the currency market in order to promote a better export capacity.

Mr. LAZAR, Deputy Minister of Economics, spoke about the economic situation in Moldova. He presented information on problems in the economy before 2009 and the steps taken by the new government in order to overcome the existing budgetary and economic difficulties. He also mentioned that the Moldovan government has elaborated the economic recovery plan and, in order to stabilize the economy, has undertaken a series of measures; the most important of these measures was the micro economic security programme. He also spoke about the effect of external financial recourses in particular, provided under the agreement with the IMF. Mr LAZAR provided detailed information concerning the reforms in order to facilitate businessesa and create an attractive business climate.

Mrs. BULIGA, Minister of Labour, spoke about the government policies and measures in the field of social policy. She also addressed the migration issue and the social protection of returnees. She also spoke about the importance of concluding bilateral agreements in order to ensure the social guarantees for the migrant workers.

D-MD\PV\871462\EN 5 PE 467.616 She noted that the reforms in the social system are designated to make the social system more efficient and to support the vulnerable members of the society. In this respect she provided some detailed information on reforms which are going to be conducted by the government and added that, in order to ensure the implementation of these reforms, international assistance is of great importance. In general she provided information on Moldovan Government's efforts to improve the social policy of the country.

Mrs. GRECEANÎI spoke about the importance of ensuring the continuity of positive developments in the field of EU integration and can not be said that everything done by the previous government was wrong and in four month everything has changed for the better. She added that it is essential to improve the institutional scope for European integration and improve planning instruments for this integration. She noted that it is crucial to intensify monitoring of the efficient use of the EU funds granted to Moldova.

Mrs. MACOVEI stressed the need for reforms. With respect to the judicial reform she recalled the experience of Romania and several other Eastern European countries where there were judicial councils and she criticized those councils. So she stressed the importance of carefully conducting the reforms in the judicial system. In connection to this she spoke about the changes of judges which are not compatible with the system. She added the importance of demilitarisation of police. And finally the speaker underlined that Moldova has the support of the European Parliament in this period of tough reforms.

To the question whether the Alliance of European Integration could maintain political stability, Mrs FUSU answered that the Alliance has proved that it is solid, but she also mentioned that if Moldova could not make it through constitutional reforms to elect the President of the Republic and if Moldova would not be able to avoid other elections this political stability might end. She said that the citizens of Moldova do not want new elections. She added that it would also undermine the credibility of Moldova in the view of financial support from international donors. She spoke of the need to reform the judiciary, ensure the respect of human rights and fight corruption. She also stressed the importance on reforming the media sector and spoke about the difficult inheritance and existing problems to be overcome in this field. During the 8 years of communist dictatorship culture, education and mass media have strongly suffered. And, in this respect, she stressed the need of building cultural ties with the EU. The speaker further dwelt on educational and cultural programmes and provided information on existing projects and spoke on the importance of working on such projects together with the EU.

Mrs. DOMENI referred to the particular problems in the social field and to the reforms in the Moldovan society, the social assistance system having been attributed in the Action Plan of 2009, risking putting in danger the entire social system.

Mrs. GUŢU, in response to the question on national minorities, provided information concerning the ethnic composition of the country and mentioned that the necessary conditions were in place to ensure the education in their languages. As regards the media there majority of TV-radio broadcasting is carried out in Russian.

D-MD\PV\871462\EN 6 PE 467.616 Mr. MASTALKA commented on the remarks of Mrs. MACOVEI on judiciary reform, which could risk to divide a society, where as Mrs FUSU referred to stability as opposed to early elections. She on also commented and criticised the remarks about 8 years of dictatorship in Moldova.

Mr. MUNTEANU referred to the programmes of the Moldovan government and in particular to economic stabilisation. He said that this document does not reflect the long-term goals of the economy and national development strategy adopted by the Parliament of Moldova in December 2007 not mentioned in the document. The programme is oriented only towards the external support and does not have long-term vision of development. The speaker further analysed the document and criticized it and also he criticized particular steps made by Moldovan government in the economic field so far.

6. Internal Conflict in Moldova

The Chairman called on point 6 of the Agenda and passed the floor to the Deputy- Prime Minister, Mr OSIPOV.

Mr. OSIPOV stated that the Moldovan government is working on a series of instruments aiming to resolve the conflict. He declared that reintegration of Transdniestria should be based on the fundamental principles of independence, sovereignty and territorial integrity of the Republic of Moldova. He also spoke about the 5+2 format discussions. He underlined the role of the EU and the USA, as they have an observer status. He stated that Moldova wants the increase their role in the process. He mentioned the several meetings that have taken place in the 5+2 format and spoke on the importance and positive results of theses meetings in the process of negotiations. He continued speaking about further problems standing on the way and on the willingness to solve them and also talked about the confidence building measures with Transdniestria. The speaker provided information regarding offering Moldovan passports and issuance of passports to the residents of Transdniestria. The introduction of confidence building measures is a priority of the Moldovan government, which also involves joint programmes of activities. He said that introducing the visa-free regime for the citizens of Moldova will increase the value and attractiveness of Moldovan passports for people living in the Transdniestrian region. As a final point he mentioned that the main objective of the Moldovan government for the reintegration is to extend the reforms of democratisation across the Dniester River.

Mr. SOVA spoke on the approach of Transdniestrian people with respect to the EU integration of Moldova and called for more backing also by the EU for the 5+2 format of negotiations. He stated that the Transdniestrian problem should be raised at the EU- Russia Summit.

Mrs. ZDANOKA asked the question of double citizenship in Moldova and in Transnistria. In particular, she asked how many people living in Transdniestrian have double citizenship.

Mr. OSIPOV, in response to Mrs. ZDANOKA's question provided the following information: in Transnistria there are around 340 000 Moldovan citizens, around 120

D-MD\PV\871462\EN 7 PE 467.616 000 Russian citizens and around 70 000 Ukrainians. There are also people having Romanian and Bulgarian citizenships, and other passports.

Mr. STOLOJAN made a comment on the existing regime in Transdniestria and expressed his hope about the resolution of the conflict.

Mrs. MACOVEI spoke about Russia´s role in Transdniestria, including Russian military presence, assistance in the energy sector and financial support to the existing regime in Transdniestria. And she concluded that only the Russian assistance is keeping the existing regime viable in Transdniestria.

Mr. CORMAN concluded the debate and welcomed the Prime Minister.

Prime Minister welcomed the Members of both Delegations and thanked the European Parliament for its constant support to Moldova in this hard period for the country. In his speech he stressed the importance of launching the Association Agreement negotiations, and visa-free regime with the EU. He also referred to the consultative group on Moldova planed on 24 March and expressed his gratitude for this. The Prime Minister noted that the situation in Moldova, in terms of constitutional reforms, is still complicated. From the economic point of view, he mentioned the agreement concluded with the IMF and the importance of it for Moldova's economy.

Mrs. MACOVEI assured the Prime Minister of the support for his country in the European Parliament, and called upon Moldova to continue the reforms and Europe will continue its support.

Mr. SCHUEBEL took the floor and informed those present that micro financial assistance will be provided; it is just a mater of time. He assured that it will be provided this year. He also repeated that the EU will support Moldova to sustain energy prices as well.

The Prime Minister added that the European Commission has provided the first part of the aid: 1.4 million EUROS. This compensation for increased tariffs is very helpful, although not very substantial, but 250 000 Moldovan citizens should benefit from it.

The Chairman closed the meeting at 6.40 pm.

7. Regional Cooperation.

Mr. CHEVODORVIC, Director responsible for the Bilateral Cooperation Department in the Ministry of Foreign Affaires of Moldova, made a presentation on the developments in bilateral relations of Moldova, especially with Romania and Ukraine. He also mentioned the cooperation with the USA and Russia. He spoke in detail about,, the intensification of relations with Romania on the agreements concluded between Romania and Moldova and further projects of cooperation between the two states. With respect to the relation with the Ukraine, the speaker underscored the recent developments and areas of cooperation. As he mentions the USA-Moldova relations, he conveyed some information on the meetings of Moldova's Prime Minister with the high officials of the US within he framework of his visit to the

D-MD\PV\871462\EN 8 PE 467.616 and highlighted the impact of theses meetings on the future cooperation between the US and Moldova. He also noted that the US officials assured the Prime Minister of Moldova of their support. Finally he described the developments in Moldova-Russia relations and spoke about future projects of cooperation with the Russian Federation. He also mentioned the economic dimension of Moldovan- Russian relations and noted that Russia is an important economic partner for Moldova. Regarding the Transdniestrian conflict he stated that Russia is an important player in this conflict and is able to push 5+2 format negotiations forwards.

Mr. TRZASKOWSKI, regarding the Eastern Partnership, asked whether Moldova has noticed the difference between the Eastern Partnership and the ENP and what particular benefits this new initiative has brought to Moldova. Secondly, he asked about the recent elections in Ukraine. In particular about the impact that they would have on Moldova, if any. He made a comment on EURONEST and underlined its importance. He noted that the greatest concern is with Lukashenko regime in Belarus, because the EU wants to see the opposition represented in the EURONEST and not representatives of this regime's parliament. For clarification of this, he added that - due to the concerns over the elections in Belarus - Lukashenko's parliament is not legitimate. He mentioned that there are signals that a delegation from this parliament is supported by Ukraine, Georgia and Moldova, which in his word is surprising.

Mr. CHEVODORVIC, with respect to Ukraine, replied that Ukraine is a very important economic partner for Moldova and the relations between Ukraine and Moldova, after the inauguration of the President in Ukraine, will continue in the same direction. Ukraine is a partner in the process of resolution of the Transdniestrian conflict. Regarding the influence of the elections in Ukraine on Moldova he said that the developments in Ukraine indeed have an impact on the situation in Moldova. However; no election can have an influence on the strategic and economic developments, because both countries are willing to maintain good relations. With regard to the question of what Moldova expects from the Eastern Partnership he responded that the previous government had a very negative approach towards this initiative. However, the new government believes that the Eastern Partnership is a step towards the EU. Currently Moldova does not see what the clear benefits would the EaP bring. However, he named some general aspects of this initiative which he deems beneficial for the country. He stressed that Moldova wants to move towards the Association Agreement and to have visa-free regime with the EU. He also mentioned that Moldova is a special case and should not only be dealt along with other 5 states in the Eastern Partnership, but more focused on bilateral relations with the EU. Moldova needs the Association Agreement with the EU in the shortest possible time. Regarding the EURONEST, he clarified Moldova's position on Belarus and demonstrated the willingness to cooperate with Belarus.

Mr. PETRENCO, in his brief intervention, spoke about the relations with the neighbours of Moldova: Romania and Ukraine, which, in his words, should be based on the principles of international law. Regarding the relations with Romania he mentioned that there is no border agreement and basic treaty between Romania and Moldova and Moldova still pleads for negotiations on these two agreements to start. There are no major unsolvable issues between Moldova and Ukraine. There are serious concerns on the Eastern Partnership because there are countries among the 6 states, for example Armenia and Azerbaijan, which have never expressed their

D-MD\PV\871462\EN 9 PE 467.616 willingness to join the EU. Moldova, which has declared its clear European aspirations, should have a separate approach. As for the participation of Belarus in the EURONEST the common point has to be found; it is important to have a dialogue with Belarus. However, as Moldova already demonstrated its position, it is supporting all resolution on Belarus issued by the EU institutions. It would have been better if Belarus had accepted the proper position from the beginning which meant involving 5 members of Parliament and 5 from the civil society which was a rational proposal. He also mentioned that the government should select civil society participants which was not supported by Moldova.

Mr STOLOJAN stated that Romania wants Moldova to join the EU, which is a guarantee to introduce the European values in Moldova and guarantee for the development of Moldova as well. The Republic of Moldovan should use the experience of Romania, Hungary, Bulgaria and other new member states of the EU in order to avoid any mistakes on the way towards European integration. He also noted that re-launch of export to Russia and Ukraine - if it happens fast - would be a positive and essential development for Moldova.

8. Adoption of recommendations.

Mrs. GURMAI presented amendments to paragraphs 7, 15 and also proposed the amendment of new paragraph after paragraph 9.

Mr. GODEA proposed the amendment of a new paragraph 1 and amendment to paragraph 2, which before this new amendment was paragraph 1.

Mr .CORMAN also proposed the amendments to paragraphs 1 and 3.

Mr. PETRENCO proposed to change the word "launch" by the word "continuation" of regular human rights dialogue and micro financial assistance.

Mr. GODEA made a remark on Mr PETRENCO's comment and proposed to replace regular dialogue with structural dialogue on these issues.

Mr. TRZASKOWSKI proposed in the text the reference on the Lisbon Treaty and EURONEST to be made.

Mrs. MACOVEI presented the amended text of recommendation and the parties launched an in-depth discussion article by article and after the debates the text with the amendments was adopted unanimously.

9. Date and place of next meeting

The date and the place of the next meeting will be proposed by the Bureau and will be communicated to the both delegations of the PCC by their chairs.

The 12th PCC meeting was closed at 1.30 pm.
