BRIEF RESUME' OF THE BUSINESS TRANSACTED BY THE RAJYA SABHA DURING ITS TWO HUNDRED AND FIFTIETH SESSION (18-11-2019 to 13-12-2019) SUMMONS Summons for the Two Hundred and Fiftieth Session of the Rajya Sabha was issued to the Members on the 22nd of October, 2019.

DURATION OF THE SESSION The Two Hundred and Fiftieth Session of the Rajya Sabha commenced on the 18th of November, 2019 and adjourned sine die on the 13th of December, 2019 as scheduled. The House sat for 20 days and the actual hours of sittings were 107 hours and 05 minutes (excluding recess intervals). The House was prorogued by the President on the 13th of December, 2019.

For Reference and Record To commemorate the 250th Session of Rajya Sabha, a publication 'Rajya Sabha: The Journey since 1952' was released on 17th November, 2019 (Sunday) on the eve of the 250th Session by the Chairman in the Leaders' meeting held at 6, Maulana Azad Road, New Delhi. A ` 250 coin and ` 5 postage stamp to commemorate the 250th Session was launched by the President of India in the presence of Chairman, Speaker Lok Sabha, Prime Minister and Members of Lok Sabha and Rajya Sabha assembled together in the Central Hall of Parliament on 26th November, 2019 during the function held to commemorate 70 years of adoption of the Constitution of India. A publication "Role of Rajya Sabha in Indian Parliamentary Democracy" was also released by the Vice-President on the said occasion. A Special Logo designed for the 250th Session of Rajya Sabha was reflected on the Rajya Sabha website and the same was pasted on all files being moved during the Session.

PROCLAMATIONS UNDER ARTICLE 356 OF THE CONSTITUTION

th (1) On the 20 of November, 2019, Shri Nityanand Rai, Minister of State in the Ministry of Home Affairs, laid on the Table, a copy each (in English and Hindi) of the following papers:—

(a) Proclamation [G.S.R. No. 837(E)], issued by the President on the 12th November, 2019, under article 356 of the Constitution in relation to the State of Maharashtra, under clause (3) of the said article.

(b) Order [G.S.R. No. 838(E)], dated the 12th November, 2019, made by the President, under sub-clause (i) of clause (c) of the above Proclamation.

RULING BY THE CHAIR On the 25th of November, 2019, the Chairman gave the following ruling:—

"Hon'ble Members, I have received notices under Rule 267 from Shri Binoy Viswam, Shri Elamaram Kareem, Shri K.K. Ragesh, Shri Tiruchi Siva and Shri Anand Sharma with regard to revocation of the President's rule in Maharashtra without following the due procedure and alleged misuse of Office of the Governor, etc. After going through the Rules and earlier precedents, I have decided not to allow them on two counts.

One, as per Rule 238, "(i) refer to any matter of fact on which a judicial decision is pending." Judiciary is hearing it just now. Secondly, "(v) reflect upon the conduct of persons in high authority unless the discussion is based on a substantive motion drawn in proper terms." There is no substantive motion that is given. So, on both these counts, I have disallowed it. 22

As per Article 356 of the Constitution, every Proclamation issued under it either for imposition or revocation of the President's Rule in a State is required to be laid before each House of Parliament. As per the Ruling given by the then Chairman on 24th April 1989, the role of Governor in relation to Proclamation issued by the President under Article 356 can be discussed only when such a Proclamation is laid before the House and becomes its property. No Proclamation with regard to revocation has been laid on the Table of the House. In the instant case of Maharashtra, the Proclamation in question is still to be laid on the Table of the House. Moreover, as per the media reports, the issuance of the Proclamation has been challenged in the Supreme Court and the matter is also sub judice." (Time taken: 02 Mts.)

(I) On the 22nd of November, 2019, the Chairman made some observations regarding the procedure of submission of notices on various 25 parliamentary devices, their admission by the Chair and scrupulous adherence to the Rules of Procedure and maintaining decorum and etiquette by Members in the House.

(II) On the 29th of November, 2019 :—

(a) The Chairman drew the attention of the House to the issue raised by Shrimati Vijila Sathyananth on 28th November, 2019 regarding the alarming issue of pornography on social media and its effect on children and society as a whole and suggested that in view of the gravity of the issue, Members should take an initiative by forming a group and find a meaningful solution thereto after discussions, so that the Minister of Communications and Minister of Information and Broadcasting may be advised to take firm social as well as legislative action.

(b) The Chairman also observed that the time limit for submission of Notices on Matters raised with the permission of the Chair (Zero Hour Matters), both manually and online through e-Notices facility, has been revised upto 9.00 A.M. on the day the matter is sought to be raised.

(III) On the 5th of December, 2019:—

The Chairman further observed that the Group may consult Civil Society Groups, Computer Emergency Response Teams, Social Media Companies etc, and after comprehensive discussion, submit a Report within one month, after which the further course of action will be decided with due deliberation thereon.

(b) The Chairman also made an observation regarding the low attendance of Members in the meetings of the Standing Committees of the House and Department-related Parliamentary Standing Committees and shared his concern on the functioning of these Committees. He mentioned the names of 18 Members of the House with 100% attendance in Committee meetings as a token of appreciation for them and motivation for others. He appealed to the Members to be fully present in the Committee meetings and to the Leaders of all political parties, both inside and outside the House, to ensure quantitative and qualitative functioning of the Committees in whom Parliament has vested an important responsibility. (IV) On the 6th of December, 2019, the Deputy Chairman made the following observation:— "On 22nd November, 2019, the first day allotted for transaction of Private Members' Legislative Business, a Constitution (Amendment) Bill, 2019 (Insertion of a new article 14A and omission of article 44) was listed for introduction in the name of Shri Narayan Lal Panchariya. Before I could call name of Shri Panchariya to move for leave to introduce the Bill, Shri K.K. Ragesh raised a point of order stating that the Bill was against the basic structure of the Constitution and secularism and, therefore, could not be introduced in the House. My observation to his point of order was that 'your point is taken and I would come to this'. Subsequently, when I called Shri Panchariya to move his motion for introduction of the Bill it was observed that he was not present in the House. Therefore, there was no motion before the House for introduction of the Bill.

Rule 67 of the Rules of Procedure and Conduct of Business in Rajya Sabha provides that if a motion for leave to introduce a Bill is opposed, the Chairman after permitting, if he thinks fit, a brief explanatory statement from the Member who moves the motion and from the Member who opposes the motion, without further debate, put the question before the House for a decision. As per well established convention of the House which has been reiterated time and again by various Presiding Officers through their rulings, the Chair has never taken upon himself the responsibility of deciding whether a 27

Bill is Constitutional or ultra vires. It is for the House to take a decision in the matter by voting either in favour or rejecting the introduction of the Bill. In the instant case, Shri Ragesh objected to the introduction of the Bill before a formal motion to introduce the Bill was moved in the House. As there was no formal motion before the House, the objections of Shri K.K. Ragesh were found to be premature and therefore infructuous. There does not seem to be any necessity, therefore, for going into the merits of his objection. However, I have been informed that Shri Panchariya has now withdrawn his Bill."

ANNOUNCEMENT BY THE CHAIR

On the 12th of December, 2019, the Chairman made an announcement regarding formation of an Ad-hoc Committee with the same composition as the Informal Group constituted by him on the 5th December, 2019, through an announcement in the House on that day, with Shri Jairam Ramesh as the Co-ordinator and 13 other Members to study the issue of pornography on social media and its effect on children and society as a whole, to resolve certain logistic problems being faced by the Group due to its informal nature. He also announced that Shri Jairam Ramesh would be the Chairman of the Committee and that the Rules relating to Select Committee on Bills could apply to that Ad- hoc Committee also. He further informed that the Terms of Reference of the Ad-hoc Committee will be –– To study the alarming issue of pornography on the social media and its effect on children and society as a whole, to hold comprehensive discussion on the subject with all the concerned; and submit a Report within one month from that day, without any extension under any circumstances.
