Annex: Resettlement Monitoring and Assessment Plan 16 pages I General

The expressway from Zhumadian to Xinyang. as the southern extension of the expressway from to . and Zhumadian that runs through the south of province, is the vital passage of the north to south hiighwNay transportation channel in . It is an important part of Beijing-Zhuhai National Trunk-Highway (NTH). It starts from the terminal of Luohe-Zhumadian Expressway. which is now under construction and ends in the east of Xinvang City Where the interchange overpasses the National Highway 312. with total length of 95 .52 kIm.

This section of expressway connects two important regions in south Henan- Zhumadian Prefecture and Xinyang City. It passes through Runan, Queshan and Pingqiao county/district, etc. They are all major agricultural areas in Henan Province. According to statistics of 1997, the area of Zhumadian and Xinyang City/Prefecture is 33618Sq. Km, the total population is 15.49 million and GDP is 43.563 billion- RMB. It takes 10.67%/oof the GDP of Henan Province.

In 1998, the daily traffic volume came to 10.000 vehicle/day within this section of the existing highway, which significantly exceeded the capacity of the existing highway. Therefore, it is necessary to build an expressway from Zhumadian to Xinyang.

Construction of this section of expressway will occupy certain amount of land (include farmland) permanently or temporarily. Some of the ground attachments will be removed. Therefore, the normal life and production of the local people will be influenced at certain level. The Migrant Settlement Plan is prepared to solve and settle these problems properly, offer reasonable compensation and settlement to the people who are influenced by land requisition and removal, protect the migrants' lawful rights, and create conditions for future economic development to keep the migrants' living standard at least the not lower than the form one.

This project shall occupy 9,074mu (604.93 ha.) of land permanently and remove 31317Sq.m of buildings. 1,384mu (92.27 ha.) of land shall be occupied temporarily. The amount for compensation shall be 23 1.86846 million-yuan and 4,20 people shall be affected.

The farmland to be affected is 252,812mu. The permanent land requisition for this project is 3.5% of the total farmland of to be villages of land requisition. Therefore, the influence to the villages is not strong.

This project is planned to start on I June 1, 2000 and complete in June 2003. I 1. Basic Situation of the Project

1. Description of the Project and Its Major Purpose The expressway from Zhumadian to Xinvang is an important part of Beijing-Zhuhai NTH. lt connects the important regions in the south of Henan Province--Zhumadian Prefecture and Xinyang Citv, It is an important passage on north to south highway transportation of China. At present, fully enclosed and elevated expressways from to , and from Zhengzhou to Xuchang and Luohe have been built up. The expressway from Luohe to Zhumadian is now under construction. They are also parts of BeiJing- Zhuhai NTH. The upgrading of Class I highway from Xinxiang to Zhengzhou and the preparatory work for Xinxiang-Zhengzhou expressway are also in process.

Because of the rapid economic development of China since reformation and opening to world, highway traffic volume is increased greatly. The investigated traffic volume between Zhumadian and Xinyang has been more than 10,000 vehicle/day (converted into medium-type vehicle), which significantly exceeded the capacity of the existing highway. Therefore, it is necessary and urgently required to build Zhumadian- Xinyang expressway. It has important significance to improve and realize Beijing- Zhuhai NTH to be functioned as expressway, to clear cross interference, to enhance the capability of highway, to reduce traffic accidents and to promote further development of the national economy.

2. Regions Affected and Benefited by the Projec The expressway from Zhuniadian to Xinyang directly influences Zhumadian Prefecture and Xinyang City, including 12 counties or districts under their administration: , Runan, Queshan, Pingyu, Suiping, Shangcai, Xincai, Zhengyang, Pingqiao, Luoshan, Xixian and Guangshan as well as Luohe City and Hubei Province. It will influence indirectly 5 counties includingXinxian, Huangchuan, Huaibin, Gushi and Shangcheng as well as Nanyang City, Prefecture and Anhui Province. The construction of 95.52km long expressway shall bring vigorous development for the above-mentionedareas, which are main grain, cotton and edible oil producers in Henan Province. Also the investment environment shall be improved and the economical development shall be promoted. It will make great role in poverty fighting.

3. Social and Economical Background of the Regions Affected by the Project Zhumadian Prefecture is located in the south of Henan Province with total area of 15,083Sq.m,753,000 ha. of which is farmland. Its total population is 7.89 million, in which 7.04 million are agricultural people and 850,000 nonagricultural people. Its population density is 523 persons per square meter. The average farmland per capita is 1.6mu. The main scope for agriculture includes grain, cotton and edible oil. Main industry sections include non-metal development,building materials, medicine, textile, machinerv, electricity and chemistry. Its main products include cigarette beverage. alcohol, textile products, machine-madepaper. paper plate, syntheticammonia., plastic products and cement. Its GDP in 1997 was 22.509 billion-yuan, average 2,806 yuan per capita, ranking the 15th in 17 cities and prefectures in the province.

Xinyang City, which connects with Hubei Province. is located in the south end of Henan Province. It has 18,915sq.m of land with 520,000ha. farmland. It has 7.6 million people including 6.6 million agriculturalpeople and I million non-agricultural people. The population density is 402 per square meter. The average farmland per capita is 1.2mu.The main scope for agriculture includes grain, cotton, red ramie and tea. Main industry sections include machinery, electricity, medicine, building materials, foodstuff, feedstuff, textile and chemistry. There are 38 kinds of explored valuable mine resources,including serpentine and pearlite whose storage ranks first in China. Its GDP in 1997 was 22.054 billion-yuan, average 2,785 yuan per capita, ranking the 16th in 17 cities and prefectures in the province.

Zhumadian Prefecture and Xinyang City are both under-developed regions in economy of the province. The backward situation in economy needs to be improved.

4. MeasuresTaken to Minimum Migrants A lot of work has been done to minimum the influence caused by land requisition at the stage of feasibility study of the project. The alignment of this proposed expressway is determined according to the result of aerial photography,the land and the buildings to be influenced can be clearly distinguish in the photograph.

In order to minimum the influence to the local people caused by land requisition of this project, Henan Provincial CommunicationsPlanning, Survey & Design Institute discussed with the leaders of highway construction departments and local governments along the route to work out the scheme of alignment. A 1:2000 topographic map is finally adopted, with the purpose to take the influence of removal and resettlement into consideration, to determine the scheme of alignment. From the stage of preliminary design, land requisition and migrant settlement has been the main factors that decide the project design and alignment. Because a lot of work has been done in survey and design stage, best efforts have been paid to minimumthe influence of land requisition.

In order to minimum the quantity of land occupation and removal, further adjustment for horizontal alignment is made during final design period, to avoid the alignment goes through those villages whose population is large. Also, the longitudinal gradient is reasonably adjusted to shorten the height of fill and the depth of cut, and the interchanges are arranged properly.

In addition, effort shall be made to minimum the influence caused by land requisition and settlement during construction period. The temporary land used shall be focus on

3 existing buildings and waste vards (e.g. township enterprises that-have been closed). Also, best effort shall be made to balance the earthwork during construction period. borrow sources shall be arranged in the waste land or waste hills.

S. Economicaland Technical Feasibility Study The preparatory work for this project is arranged earlier because of the big scale and the large investment of this project.

In August 1990, "Pre-feasibilityStudy for Henan Section of Beijing-Shenzhen NTH" was completed by Henan Provincial CommunicationsPlanning, Survey & Design lnstitute. In 1995, "Pre-feasibility Study for Beijing-Zhuhai NTH in the Section between Luohe and Xinyang"' was completed. In 1998, "Pre-feasibility Study for Beijing-Zhuhai NTH in the Section between Zhumadian and Xinyang" and "Feasibility, Study for Zhumadian-XinyangExpressway of Beijing-Zhuhai NTIH' were completed.

6. The PreliminaryDesign and ConstructionDesign The Preliminary Design for this project has been completed during the period of October 1998 to January 1999, the ConstructionDesign has been started in May, 1999 and shall be completed in October 1999 by Henan provincial Cominunications Planning, Survey & Design Institute.

7. Ownership and OrganizationalStructure of the Project Zhumadian-Xinyang Expressway is one part of the Beijing-ZhuhaiNational Trunk Highway, which characterizedas stated-ownedhighway. The Henan Communications Department and the High-grade Highway Construction and Management Bureau under it shall responsible for the said project's construction, management and maintenance. During the implementation period, all levels (county/district. prefecture/city and province) of construction authorities and the offices under them shall responsiblefor land requisition& removal and migrants settlement.

8. Social and Economical Survey The social survey for this project was carried out by the design unit and communication authorities at city, county (district) levels under the requirement of Henan Provincial Communications Department. The survey groups involved the Design Institute, communicationsbureaus at city and county levels, villages and households influenced. The survey period was from March 23, 1999 to June 4, 1999, totally 74 days. The survey was focus on economicalsituation of the counties, towns and villages along the expressway,including basic production conditions, geological environment, production forms, living habits, living levels, people constitution, soil quality, attachment quantity, market price of local materials and the attitude of the local people towards this project. The survey forms mainly included checking statistic data of 1998,1997 and 1996 in statistic bureaus at county level, visiting officers at county, township and village levels and the people who are involved in land

4 requisition and removal. Permanent land requisition and the ground attachments that shall be removed were registered in details to be used as the basis in preparing this implementationplan.

The investigation group included the following members (I ) Hu Chaoyin: Deputv chief of the First Design Department of Henan provincial CommunicationsPlanning. Survey and Design institute (HPC.PSD1),senior enginee., who in charge this investigation; (2) Wang Jianshen: Engineer of Planning & Economy Department of HPCPSDI, who responsible for investigating the population, land, output and rate of crops for each village, township and county; (3) Zhang Xinagjian: Assistant Engineer of Planning & Economy Department of HPCPSDI, who assist to investigate the population, land, output and rate of crops for each village, township and county' (4) Du Junwang: Engineer of the First Design Department of HPCPSDI, who responsible for investigatingthe quantity of various land occupied and the quantity of structures, attachments,power and telecommunicationfacilities on various land along the proposed highway; (5) Du Zhanjun: Assistant Engineer of the First Design Department of HPCPSDI, who assist to investigate the quantity of various land occupied and the quantity of structures, attachments,power and telecommunicationfacilities on various land along the proposed highway; (6) Zhang, Zhongmin: Senior Engineer of Geological Exploring Department of HPCPSDI, who responsible for investigating soil property. geological environment and natural resources in the areas along the proposed highway; (7) Wu Jingshun: Chief of Planning Division of CommunicationBureau ofZhumadian Prefecture, who responsiblefor investigatingthe economical condition of each village, township and county along the proposed highway; (8). Miao Baogu: Chief of Engineering Division of Communication Bureau of Zhumadian prefecture, who responsible for investigating the economicalconditionof each village, township and county along the proposed highway; (9) Zhang Baogang: Chief of Design Division of Highway Management Department of Xinyang City, who responsible for investigatingthe economical condition of each village, township and county along the proposed highway; (10) Peng Zigang: Chief of Planning Division of Highway Management Department of Xinvang City. who responsible for investigatingthe economical condition of each village, township and county along the proposed highway.

9. Preparation of the Migrant SettlementPlan (I) The design unit shall provide land requisition quantity, attachment quantity and population affected by land requisition and removal according to ConstructionDesign. It will also provide economical situation of the project area, traffic volume forecast after completion of this project and the foreseeing of economical development based on Feasibility Study Report. (2) Set up migrant settlementorganization. The constructionauthonities of this project at provincial and city levels will be established in December1999. By that time, the relevant authoritiesor leadinggroups in Xinyang and Zhumadian City/Prefecture,and * Pingqiao, Runan, Queshan counties/districtsas well as townships (towns) under their administrationwill be set up. The Authorities at different levels will be in charge of passing through land requisition formalities, carrying out removal plan. releasing compensation fee, settling down affected people, guarding social security. coordinating relationshipbetween the Contractors and local people, solving problems based on contracts or authorizationof the higher authorities. (3) Giving publicity of the significanceof the project and the laws and rules on which compensation policy is made. The propaganda should be extended to every family and every person. (4) The construction authorities and the offices under them at county and district levels are in charge of making up migrant settlementplan. especiallv land adjustment plan.

10. 11. Permission of Land Utilization,Resettlement and Construction The total permanent land occupation for this project is 9,074mu and the temporary occupation of land is 1,384mu. The plan of land utilization and other relevant documents shall be submitted for approval before December 1999, the best effort shall be made to get the approval from the State Land AdministrationBureau before May 1, 2000. The people influenced by land requisition shall be resettled through rearrangement of land. And the rearrangement of land shall be made properly before commencement of the works

12. Unfavorable InfluenceAppeared after Implementation None. Because at present, this project is waiting for appraisal.

i. Polices

1. In China. there are three levels of policies regardinu land requisition and migrant settlement. * Basic policy frameworklset up by central governmentthrough issuing state laws and enforcement regulations. * Comprehensive/specialregulations and enforcement methods on carrvingzout state laws issued by provincial governments. * Relevant regulations issued by Prefectures/cities. which are accorded with the state/provincial laws and regulations, and are only applicable in the specified jurisdictional areas.

The Migrant SettlementPlan is prepared accordingto the following laws. regulations and the Guideline of Non-volunteer Migrants (OD4.30)issued by the World Bank. The implementationof the Migrant Settlement Plan shall be based on the said law framework.

2. Laws and RegulationsRegarding Compensation I ) State laws and regulations The following laws contain the key policies about land, grasslandand forest: A "Land Management Law of the People's Republic of China". It is approved by the 16th session of Standing Committee of the 6th National People's Congress in June 1986, and is revised on Aug. 29, 1998. It comes into force since Jan. 1, 1999. B. "Enforcement Regzulationsfor Land Management Law of People's Republic of China". it is approved by the Standing Committee of the State Council on April 24. 1998 and comes into force since Jan. 1, 1999. C. "State Forest Law " and its implementing regulations.

(2) The major provisions of the Land Management Law (the most important part) are shown as follows:

Ownership (1) The people's Republic of China carries out socialist public ownership for land. That is national ownershipsystem and collective ownership system. The land in urban area belongs to the state. The land in countryside and suburb, apart from those that belongs to the state by law, belongs to collective of farmers. Homestead & household plots and household hills belong to collective of farmers (Clause 8 of "Land Management Law of China").

(2) The land that has collective ownership of farmers belongs to collective of farmers of a village by law, shall be managed and operated by the collective economical

12 organization of the village or by farmers' committee of the village- The land thai has collective ownership of farmers belongs to two or more than two of economical organizationsof a village respectively,shall be managed and operated accordingly by the collective economical organizations of the village or by farmers' group of the village. The land that has collective ownership belongs to a tovn/township. shall be managed and operated by the countryside economical organization of the town/township(Clause 10 of "Land ManagementLaw of China)).

(3) The land owned by the collectiveof farmers shall be registered and recorded in the county government. The certificate proving the land ownership shall be issued by the county government after confirmation (Clause II of "Land Mtanagement Law of China").

(4) If the purpose of the land ownership is to be changed, it shall registered (Clause 12 "Land ManagementLaw of China").

(5) The ownership and right of utilization of the registered land by law is protected by law. It is prohibited to violate by any units or individuals (Clause 13 of "Land Management Law of China").

Land usage (I) Units or individuals can use the land that belongs to the state and collective of farmers by law. The land user has the obligationsto protect, manage and properly use the land (Clause 9 of "Land ManagementLaw of China").

(2) Land survey system is set up by the state (Clause 27 of "Land Management Law of China").

(3) Land statistic system is set up by the state (Clause 39 of "Land Management Law of China").

(4) The governments at different levels shall organize to prepare an integral plan for land utilization according to the plan of social and national economy development, requirements for state land renovation and environmental protection, land supply ability and the need of land for constructions (Clause]7 of "Land Management Law of China").

(5) Farmland is strictly controlled being transferred into non-farmland. The state carries out compensation system for farmland occupation. In the event that the farmland is to be transferred to non-agriculturalconstruction land after approval, the unit that occupy it shall be responsible to cultivate another piece of land with the same quality and the same amount according to the principle of "Cultivate the same land as you use". For those who incapable to cultivate or the cultivated land can't meet the requirement, farmland cultivation fee shall be paid according to the relevant

13 regulations.This fee will be specially used in cultivatingnew frarm-land(Clause 3 I of "Land ManagenientLaw of China').

Land used for state construction (1) Procedure for approval If the approved project needs to use state land for construction, the construction unit shall apply to the land administration authorities above county level that have approval right with relevant documents of law and administrative regulations. The application shall be checked by the land administrative authority and reported to the government at the same level for approval (Clause 53 of "Land Management Law of China").

(2) Confirmationfor approval Land used by units and individuals for a specific project shall be handled according to Clause 22 and 23 of "Enforcement regulations of Land Management Law". The authoritv of approval to unused state land for construction projects is that: (a) land less than 2ha. shall be approved by county (city) government; (b) land more than 2 ha. but less than 4 ha. shall be approved by city ( prefecture) government, (c) land more than 4 ha. shall be approved by provincial government.

Apart from paid use land after the project is completed and passed examination for acceptance, "State Land Use Certificate" shall be issued (Clause 36 of "Execution Method for Land Management Law in Henan Province"(revised draft)).

2. Laws and Regulations Regarding Standard of Compensation Permanent land requisition decrees are mainly based on the revised draft of "Land Management Law' executed in Henan Province:

It is marked in Clause 34 of the "Land Management Law" that after the proposal of land used for construction land is approved, the compensation to the unit whose land is in requisition shall be executed according to following rules:

(1) Land compensation fee The requisitioned farmland (including vegetable plot) orchard, fish pond, lotus pond and tea garden in suburb of cities under direct provincial administration shall be compensated by 8-10 times of the annual output value. Other land in suburb of other cities, industry/mining areas and towns under direct administration of county shall be compensated by 7-9 times of the average annual output value for the last 3 years. The land in other places shall be compensated by 6-8 times of the annual output value.

In the requisitioned farmland, the by-products of crops (vegetables excluded) shall be calculated by 15-20% of the output of their corresponding main products. When the orchards where no fruit is growing, newly-built fish pond, lotus pond, reed pond, tea *arden and forest land are requisitioned, the compensation shall be made according to

]4 the lowest standard of the adjacent farmland.

For the land used for residence and the collective land used for public facilities. commonweal benefits or used for individual business. apart from removal subsidy shall be mad, it shall also be compensated as farmland.

If the unused land is to be requisitioned, the compensationshall be made by 3 times of average output value of the adjacent farmland in last three years.

(2) Settlementsubsidy The settlement subsidy for farmland and other land requisitioned shall be calculated accordingthe number of agriculturalpeople to be resettled. That is: the agricultural people to be resettled = the requiisitiontedlantd ihe average farmlantd per capita.

The standard of settlement subsidy for each agriculturalperson to be resettled shall be 4-6 times of the average output value of the correspondingfarmland in last 3 years.

For suburb under direct administration of the province, it shall be 6 times, For the suburb of other cities, land in industrial and mineral areas and towns under direct administrationof the county, it shall be 5 times. For other land, it shall be 4 times, but the settlement subsidy for per ha. shall be no more than 15 times.

(3) Compensationfor young crops shall be made according to the output value of one harvest.

(4) Compensation method and standard for attached buildings shall be executed according to the regulations made by the provincial government. New attachment built after land requisition bulletin is issued shall not be compensated.

It is marked in Clause 24 of "Land Management Law"'that after land is approved to be used for a project, the land user shall make farmland cultivation scheme for approval of the authorities in charge of land administration. The land user shall be responsible for cultivating farmland that has the same area and quality of the land occupied. If the land user is incapable to cultivate or the cultivated land cannot be accepted, farmland cultivationfee shall be paid.

The collection, use and management of cultivation fee shall be regulated in other regulations of the provincial government. (Note: The cultivation fee is temporarily determined as the same cost of land compensation.

3. Principle for Compensation (1) Avoid land requisition as far as possible. If it is impossible to avoid, land

15 requisition shall be as fewer as possible, then a migrant settlenien- plan and payment for various compensationshall be made accordinLyiv.

(2) Mackesure the living standard, productive ability and income of the people influenced can be resumedto the original level.

(3) Buildings such as residential houses to be removed must be compensated accordingto reconstructionprice.

(4) In principle, the new houses for the migrants shall be ready before the demolition of the old ones, and the removal expense shall be paid. If a transition period is necessary, the units who undertaking the proposed project shall properly pay the corresponding expenses.

(5) The units who undertaking the proposed project shall strictly follow the compensation policy and standard drawn up in the Migrant Settlement Plan. If there are some important or major variations during the implementation period, a report concerningthis case shall be submittedto the WorldBank before they come into force. Whenit is necessary,revision shall be made to the Migrant SettlementPlan.

Information: Initial consultation from Land Management Bureau of Zhuniadian Prefecture and statistic organizations of Xinyang City:

Arranged by Henan ProvincialLand Management Bureau and government of Pinqiao District, Xinyang City, in first of June 1999, the compensation standard for land requisition was preliminary estimated by Land Management Bureau of Zhumadian Prefecture and Statistic Bureau of Pingqiao District, Xinyang City, and a report in writing were furnished. The report shows that the average annual output value for every mu of cultivated land is different form the calculating result, but the difference is slight.

In the "Budgetary Estimate Program for Compensation of Land Requisition" provided by Land Management Bureau of Zhumadian Prefecture in June 15, 1999, the compensation rate is 1,118yuantmu.year, while the calculating result for compensation rate is 1,091yuan/mu.year,the difference is only 2.4%. The annual average output value per mu for the township/townalong the proposed project in year 1998 is 1054.5yuan/mu.year(data provided by Statistic Bureau of Pingqiao District, Xinyang City), while the calculation result is 961.5yuan/mu.year, the difference is 8.8%.

Administration Cost For the organizations that are responsible for migrant settlement and restoration, another 3% of the total compensationfee for their jurisdiction areas shall be drawn as their administration cost. 4. Contingency The estimated cost for implementing Migrant Settlement Plan shall include the changes.caused by unforeseen prices and quantities. The contingency takes 10% of the total estimated compensationcost.

3. Labor Settlement (1) Rearrangement of the village land No city land shall be requisitioned for this project. The agricultural income for the Migrants whose land is occupied is 80% of their annual revenue. The responsibility filed for each labor force is 3mu in Zhuniadian Prefecture and 2mu in Xinyang city. Since land rearrangement shall be made within each of the villages, no rearTangement shall be made among the villages. Because there is no preserved land in the villages affected by this project, the land have to be rearranged.

Since land requisition is not concentrated in one place, the labor forces can still obtain sufficient farmland after land rearrangement. No surplus labor forces will come up. The land compensation shall be arranged by the village committee to develop

23 collectiveproduction.

Along Zhumadian-Xinyang Expressway Project. the residential houses for 225 households will be demolished and relocated. The locations for new houses. according to the request of the migrants, shall be all in the original villages. The locations for new houses to be built shall be arranged by the village committee with a farther distance to the Expressway.

-y (2) Restorationand Developmentof Production During June 16 to 17,1999, a forum was held to consult the opinion of the representatives form Zhumadian Prefecture and Xinvang City (incluing Queshang County and Pingqiao District) and 13 town leaders as well as the farmer along the route. They expressed that the compensationgot form the land requisition shall be well controlled and expended in such way that the agricultural production is not be adversely affected duo to land requisition and removal. They will take this uood chance of obtaining such big amount of money, at first to increase the input of agriculturalproduction, especially in the following aspects, to enable the crops to go up a new stange both in quality and quantity: a, Upgrading the plant pattern, selecting the fine strains, reject the backward strains which lack of market competition (such as Xinyang poor quality rice), and grow high-valuedcrops, such as tobacco, peanuts, etc. b. Develop green houses to plant fruit, melons, vegetablesand medicinalherbs. c. Improve water conservancy facilities, construct pump stations, deep wells, big water pond and perfect the auxiliary facilities for irrigation, enhance ability in combatingnatural disastersto guaranteegood harvest in bad whether condition d. Improve conditionof agriculturalproduction based on actual investment in science- technology. e. Increase investment in science-technologyto improve condition of agricultural production.

Secondly, properly increase living facilities cost from the compensation with the major purposes in building roads and water & power supply facilities for the villages affected. Thirdly, take part of the compensation to strengthen education to the migrants, such as provide night schools, training classes, purchase scientific/technical books and build library to improve the quality of the migrants. The purposes of the land compensationand resettlement subsidy are shown in Table 5.7.

The work of land requisitionand migrant settlement is actually bein£gcarried out and implemented by county land managementdepartments and migrant settlement offices at county/townshiplevel.

28 (2) Municipal constructionauthorities * Accept population statistics data provided by survey and design institute, keep the data as the basis for monitoring; * Sum up the informationprovided by county authorities and correct the data; * Provide training for the staff of county construction authorities and township migrant settlement offices; * Sign implementationcontracts with the Provincial Authority and county authorities" * Allocate the fund form the Provincial Authority to the county authorities; • Guide and coordinate the migrants settlementin counties concerned; * Submit report concerningworking progress to the Provincial Authority and make suggestions.

(3) County constructionauthorities The county construction authorities are the major departments to implement the migrants settlement. They supervise the execution and have the qualified staff to make decision. Also, they have the ability to manage the investigation data, which functions as supervision basis. During the critical period of implementation, they could get the personnel assistance from the department concemed. Computer shall be equipped for them to make population census. Proper training shall be provided for them in keeping and recording the data of migrant settlement. The information provided by them for the municipal authorities shall be used as the basis of interior monitoring for migrant settlement. Their responsibilitiesinclude: - Prepare county migrant implementation plan based on population statistics data provided by investigation and design institute and the policy of the Provincial ConstructionAuthority; - Execute the Migrant SettlementPlan; t Guide and supervisethe activities of township migrant settlementoffices, - Collect migrant settlementcapital for (- collectives--enterprises--individuals); * Provide training for the staff of township migrant settlementoffices; * Submit report to the Municipaland Provincial Authorities.

(4) Township migrant settlement offices - Inspect, monitor and record all of the activities of migrant settlement under their correspondingjurisdictional areas; * Supervise the requisition of land, restoration and removal of the houses, other buildings and attachments,infrastructures, enterprises. * Supervisethe employmentand training of migrants in townshiplevel enterprises.

32 ,,X1. Pubiic Consultation The news briefing meeting shall be made at village level to provide information or compensationstandard o01house. crops and property loss, as well as the determinatiol of the resettlement locations.

The decision made in the meeting shall be included in the Migrant Settlement Plan to reflect the requirementsof the migrants. Table 7.1 briefs the public consultation.

Such meeting shall be held regularly. Its purpose is to let the migrant know the progress of this project and obtained the further consultation of the local people. In formulation of migrant settlement policy, the city and county governments shall also participate actively.

The migrants have been told of the impact to their properties and the possible locations of resettlement.They already explicittheir choice in the preparatory meeting (within the possible options). A brochure (as section 5-1 described) regarding settlement information shall be prepared and it shall be printed out and distributed to each of the migrant families after the Migrant Settlement Plan is reviewed and accepted by the World Bank. The brochure lists the migrant's exact rights.

Consultation has been made with some unit affected to assess the technical impact exerted by this project. According to present and future requirements of the unit concerned, the locations, heights and widths of interchanges/grade separations shall be assessed.

The way of public consultation during the period of migrant settlement is as follows. The migrants have joined in parts of the following mentioned activities, they will continue to take part in such activities during the whole implementationperiod. * Select the locations of resettlement: * Houses built by migrants themselves ( or the migrant select the houses provide by the governments). * Supported by the village committees and migrants,the local settlement offices carr, out Migrant ImplementationPlan.

Though public consultation, a realistic Migrant Settlement and Restoration Plan for this project is prepared. During the period of investigation, the information concerning this project is provide to the migrants and public opinions are collected from the migrants and unit affected by this project. Table 7.1 shows the investigation result.

Requested for comment and suggestion on how to make better use for the compensationfee of land requisitionand removal;

36 V71II.Complaints and Appeals

Since the migrant participation of the w,hole process of the settlement and reconstructionplan, it is expected that there will be no big complaints occur. In order to resolve the problems effectively in land requisition and migrant settlement. the Provincial Authority must set up the detailed procedure to correct the complaints. It is aimed to answer the complaints in a rapid and transparent way. The unit designated shall be of simple, easy accessible, transparent and impartial, aiming at answering complaints in an effective way in stead of via a complicated official channel. The complaints to be resolved via the authorities will boost the progress of this project effectively,the procedure is as follow:

Stage 1: If anybody dissatisfy with the migrant settlement and reconstruction plan, they may put forward their proposal to the village committees or local migrant settlement offices concerned in oral or in written form. If the opinions are in oral form, it shall be written on paper by villages and resolved properly, the complaints shall be resolved within two weeks by village committeesor township migrant settlement offices.

Stage 2: If the complainants disagree with the decision made in stage 1, they can go to the county authorities concerned within one month after receiving the decision made in stage 1. The county authorities shall make a decision on complaintswithin two weeks.

Stage 3. If the decision made by the county authorities still can not accepted by the persons who make complainants, within one month after receiving the stage 2 decision, they can go to the provincial or municipal authorities, the provincial or municipal authorities shall make a decision within three weeks.

Stage 4: If the migrants still have problems to the decision made in stage 3, they can make a suit to the civil court based on civil law of procedure. Fifteen days after receiving the decision made by the provincial or municipal authorities, they may make a suit on every aspect related to migrant settlement and reconstruction plan, including compensationstandard.

The detailed procedure for correction of complaints shall make public on the meeting which participated by migrants, and also sent to village committees,township migrant settlement offices, county authorities, municipal (prefecture) authorities.

Before implementation, this information shall be collected in the brochure to be

RAP shall be kept in coordination division of Zhumadian and Xinvang construction authoritiesfor lookinp up bv the local people whenever needed.

The complaint channel will be guaranteed to be unimpeded. The names. telephone numbers and addresses of the persons in charge of reception of complaints will be open to the public during the executionof this project.

38 IX. Monitoring

1. Procedureof Implementation During the process of implementation. prefecture and municipal construction authorities and county construction authorities shall record implementation information about individuals, families and units from township migrant settlement offices according to models prepared by the monitoring organization. The records regarding the current activities shall be handed over to the Provincial Construction Authority so as to maintain continuous implementation monitorin-g.The Provincial Construction Authority shall conduct regular examination to the township-and village-level (with all townships covered) organizations to verify the reported progress.

In the above frameworkexists a continuousinformation flow from the village-level to the Provincial Construction Authority with a stipulated format, and also regular examination and verification made by the Provincial Construction Authority. Therefore, all migrant settlement organizations at various levels are involved in the system of monitoring.

3. Responsibilities

Living standard investigation Method: Before the start of migrant settlement implementation, an independent monitoring organization shall conduct a basal living standard survey about random migrant samples and.controls. The living standard survey shall be repeated twice each year to monitor the changes in living standard of the migrants. Random interviewing of the migrants and observations are used to supplementand direct interview formats.

9 Improvement of Investigation and Examination Questionnaires for living standard investigation shall be modified and take into account local cultural factors to acquire quantity and quality about living, standards. After the questionnaires are prepared. they shall be examined in practical investigations to determine their efficacy as a measurement tool. and make correction according to the examination results

Training of recorders: Recorders shall get trained in using questionnaires correctly and skillfully.

Investigations editing and coding process: Recorders shall be put under the supervision and examination of a leading group composed of many people. The leading group shall record and edit all questionnaires on the day when the questionnaires are completed

Other organizations responsible for living standard investigations: During the period of living standard investigations, the Provincial Construction Authority shall assist the independent monitoring organization. Local mierant settlement offices shall also assist the independent monitoring organization in its work.

Sample sizes for different migrant groups and control groups: * Migrants 10 %(general) Other migrants 25% ^ Secondary impact 3%

A control group of the same amount selected randomly from the unaffected people in the same region shall also be investigated.

Independent Monitoring Organization (1) Name: Migrant Bureau of Yellow River Water Conservancy Committee (2) Date of contract signed: 7/6/1999 (3) Brief introduction of this organization and the qualification of its staff: Migrant Bureau of Yellow River Water Conservancy Committee is a professional organization in planning, supervision and monitoring of migrant settlement, it is the first one who do such work since the set up of People's Republic of China. It has carried out supervision and monitoring of migrant for many projects, such as Yellow River Dam (Xiaolangdi) project, Wanjiazhai project, etc. It has 6 persons who own doctor and master degree, 12 senior engineers and 15 engineers.

The person who in charge of this project named Yao Songling, he is a senior enginer who owns doctor degree. He has the experience in Yellow River Dam (Xiaolangdi) project, Wanjiazhai project, etc.

40 Public Consultation The independent monitoring organization shall attend village and tovwnishiplevel public consultative conferences. Shortlv after acceptina appointments. it shall send two working staff to attend at least 2 public consultative conferences in each quarter. Through participatingin these conferences, it shall evaluate the effect of participation by migrants and their cooperation with migrant settlement programs. C-amplain:U The independent monitoring organization often visit some places, and meet migrant settlement offices as well as the migrants to find out complaints. The results of resolving complaints shall be monitored uninterruptedly.If necessary, suggestionsfor necessary improvement shall also be put forward as for procedures in order to make the implementationprocess more efficient.

Other Responsibilities . 42 X. Report

1. Interior Report A report shall be submitted to the World Bank every half-vear by the Provincial Construction Authority, and the first report shall be furnished in Aprl 2000. The reports from the municipal/prefecture., county construction authonrties to the Provincial ConstructionAuthority shall be submitted level bv level at the start of each quarter

The content and the form of the report shall include: Name of reporting unit, reporting time, report contents, and work plan on yearly basis. The report shall reflect completionof the plan, reasons for the failure in completing the plan, existed problems, resolving efficacy, and problems asking for settlement by the higher authorities.

2. Report Made by Independent Monitoring Organization The independent monitoringorganization collects investigationdata once half a year, and reports them to the World Bank and the Provincial Construction Authority. The report format shall be prepared by the independent monitoring organization. The first -report shall be submitted before the end of June 2000, and the second one shall be submittedby the end of December2000.

I Project Overview

The Zhumadian-Xinvang Expresswax is part of thc national hlghn\av from Beijing to Zhulai. It begins at the endpoint of Luohe-ZliumadcaniExpresswaay (under conismictioni).and stops at Xinnaiig CitN. It passes Runan. Queshan and Pingqiao Counties and its total Icngth is 95.52' km. This projcct also includes roads connecting to cities and county seats along thc wvay.It is expected to commcnce construction on June 1. 2000 and to finiishin June of 2003.

For the main stem of the project. 9074 mu land is to be acquired- 1384 mu land is to be leased. 225 households (868 people) resettledLand the area of houses affected is 31 752m'. Some power supply. telecommunications and water supply facilities are affected to varying degrees. To alleviate the above-mentioned impacts. it is planned to carn- out land adjustmcnt in the 52 affccted villages and resettle the villagers affected by land acquisition. Affected infrastructure w-ill be recovered. The total land acquisition and resettlement investment for the main stem of this project is 231.8685 million yuan.

2 Purpose of Monitoring and Assessment

To ensure resettlement is implemented according to the resettlement action plan. in accordanc wVith the requirements of the World Bank. the Government and the affected population. the Project Employer should hire an organization. which is completely independent from the project implementation organization and government agencies and acknowvledgedby the World Bank-. to carry out independent monitoring of resettlement implementation process and assessment of implementation results. This monitoring organization will have an extensive and long-tcrm viewNpointand monitor and evaluate all resettlement implementation activities in ati objective, fair and comprehensive manner to determine whether:

(1) Resettlement implementation has been carried out in accordance With the principle of the resettlement action plan and the action plan has been strictly followed: (2) The living standards and production facilities of the affected population have been recovered or improved.

3 Duties of Monitoring and Assessment

(I) Comprehensive understanding of project impact in terms of resettlement. and reasonable and feasible determination of monitored samples anidevaluation criteria: (2) Comprehensive and accurate monitoring of resettlement implementation progress. Divergences from the principle/criteria of the resettlement action plan should be monitored and reasons found. Corrections to divergences of different nature should be reported to Zhumadian-XiDnvang Expressxa% Pro1 ecL Henan -Provin,: Resettlement Mionitonng and t x alhuatPonlP'laln

corresponding implemncitation organizations. and warnings should bc given in advance to potential problems. (3) Followvup the changes in major production and livelilhoodindexes (such as resettlers' incomIIC): Solutions to existing problems and potential nsks should be advised. (4) Based on the ovcrall monitorino and ealuation of implemcntation proorcss. advice and improvement measures regardinig the effectiveness and efficiency of tihC resetillcenlt management organizations should be formulated. Botli short-lerm and long-term effects of resettlement are evaluated and forecasted. and feasible improvement mcasures and advice should be providcd. (5) Comprehensive evaluation of resettlcment results should be carried out when the implementation of resettlement action plan is completed.

4 Monitored Targets

4.1 Implementation Progress

4.1.1 Compensation Disbursement

(1) Progress of compensation disbursement to the affected population and entcrprises before the commencement of project construction: (2) Monitor and mak-e detailed records of compensation types and criteria. amount and date of compensation payment and recipient of compensation.

41.2 Housing

(I) The acknowledgement of the affected population wkiththe reasonableness and fairness of the selection of new housing location: (2) The nexvlocations should be close to the original locations. (3) Compensation for self-built houses should be made according to the construction criteria and individual characteristics and approximately equal to the re-construction cost of the houses (wNithoutdeducting the value of depreciation and utilizable materials): (4) Monitor and make detailed records of housing requirements of the affected population. date they move into the new houses and housing relocation etc. (5) Compensation should be paid to the affected population on time, including moving subsidy; subsidy for the transition period and awards. etc.

4.1.3 Enterprise Relocation

4.3 Social and Economic Conditions

4.3.1 Income and Expenditurc

Changes in the amount and composition of the income and cxpenditure of the affected population during the implementation period and after implementationi are monitored anid cvaluated.

4,3.3 Living-Standard

During the implementation stage. comparative social and economic investigation of the affected population against un-affected population within the same area is carried out- in the form of sampling investigation. to find out and report potential problems in the recovery process of li-ing standards. Comprehensive social and economic invcstigation and analysis is conducted whlell monitoring is completed, and reports in ritten form regarding the living standards after resettlement is submined to evaluate the impact of the implementation of the resettlement action plan on the affected population.

5 Methodology

5.1 Investigation/Interview

The monitoring and evaluation work- is based on the results of field investigation and information collection, and information collected is verified for its authenticitv.

Questionnaires are used in the investigation process. After svstematic training, the investigators conduct field interv,iews xNith local residents and listen to their opinions on various issues. so that different viewpoints and wvider views are contained in the monitoring and evaluation work.

5.2 2 Selection of Samples

According to the type and degree of project impact. with location. economy and social and cultural characteristics takeen into account the samples are randomlr selected. This samplc is covered bx the monitoring and evaluation work.

5.3 Information Collection and Processing

(I ) Questioinaires are distributed to the affected villages, enterprises and houselolds. and then answered by individuals concemed and filled out by designated personncl: (2) Direct interviews xNithaffected individuals and enterprises: (3 ) Special tcams are formed to carry out investigation and find out problems. such as the elderhy women. children, affected enterprise. and other issues: (4) Information collected is classified and analvzed according to the followving critcria: affected location. affected time period. impact type. compensation level and length of relocation period: (5) The independent monitoring organization will keep a database. in which information collected from various sources is stored and updated through time: (6) Data regarding implementation progress is provided by the implementation organizations. and the monitoring and evaluation organization make verifications by means of sample investigation.

6 Monitoring Report

6.1 MonitoringPeriod

From the time when the implementation of the resettlement action plan commences. the monitoring and evaluation organization will submit an external monlitonng report everv six months. and the report submitting frequency is reduced to one report each year as resettlement implementation Zhuniadian-MnNwi-anIxpressxva% Project. 1elian Proin c Res.ttliomentionionnri and Fvalatioal Plan comes to a close. In addition. this organization will hold an investigatin rcgarding projcct impact background and sample (houscholdvillage) backoround information beforc project implcmnclitation and a conclusive monitorin, and evaluation when resettlemuent implemcentationiis completed. Meanwhile. special investigation and evaluation could be carricd out at the request of the World Banki or thc Project Emplover according to project implementation- progress. This workl will continue till the living standards of thc affected population stcadi] maintain thc same level as those of the un-affected population in the same area. The time to commence and finish work and report submitting should meet the demand of the W;orldBank and the Project Emplover.

6.2 Content of Report

A typical monitoring and evaluation report consists of the following parts:

(1) Verify the stated implementation progress of the rescttlement action plan: (2) Check whether compensation. relocation arrangement and recovery measures havc achieved the major objectives of the resettlement action plan: (3) Report the participation and degree of satisfaction of the affected population with the resettlement action plan: (4) Discover major problems during the resettlement implementation process, and provide suggestions for solutions and improvement of efficiency of the action plan: (5) Actions taken by relevant authorities regarding the suggestions raised in the previous rcport.

7 Coordination/Cooperation with the Monitoring and Assessment

Work

The Project Employer should sign a contract with the resettlement monitoring and evaluation organization, cnsure adequate fund for the monitoring and evaluation worTk and coordinate/cooperate with the implementation of this task-.When monitoring report is received, the Project Employer should organize meetings by the resettlement leading team to study and implement the suggestions and advice of the monitoring organization and thus improve the resettlemcnt work.

The monitoring and evaluation work should meet the project management demand of the Project Emplover and the World Bank. and the monitoring organization should cam- out effective -work on schedule and provide reports of high quality.
