The expresswayfrom Zhumadianto Xinyang, as the southern extension of the expresswayfrom to , and Zhumadianthat runsthrough the south of Henan province, is the vital passage of the north to. south highway transportationchannel in .It is an importantpart of -ZhuhaiNational TrunkHighway (NTH). It startsfrom the terminalof Luohe-ZhumadianExpressway, which is now under constructionand ends in the east of Xinyang City where the interchangeoverpasses the NationalHighway 312, withtotal lengthof 95 .52 km.

This section of expressway connects two important regions in south Henan- ZhumadianPrefecture and Xinyang City. It passes through Runan, Queshanand Pingqiaocounty/, etc. Theyare all major agriculturalareas in HenanProvince.. Accordingto statisticsof 1997,the area of Zhumadianand XinyangCity/Prefecture is 33618Sq.Km, the total populationis 15.49million and GDP is 43.563 billion- RMB.It takes 10.67%/of the GDPof HenanProvince.

In 1998,the dailytraffic volumecame to 10,000vehicle/day within this sectionof the existinghighways, which significantlyexceeded the capacityof the existinghighways. Therefore,it is necessaryto buildan expresswayfrom Zhumadian to Xinyang.

Constructionof this section of expresswaywill occupy certain amount of land (includecultivated land) permanentlyor temporarily.Some of the groundattachments will be removed.Therefore, the normal,fife and productionof the localpeople will be influencedat certain leveL This ResettlementAction Plan is preparedto solve and settlethese problemsproperly, offer reasonable compensation and resettlementto the people who are influenced by land requisitionand removal, protect the migrants' lawfil rights, and create conditionsfor future economicdevelopment to keep the migrants' livingstandard at least the not lowerthan the formone.

This project shall occupy 9,074mu(604.93 ha.) of land permanentlyand remove 31317Sq.mof buildings. 1,384mu(92.27 ha.) of land shall be occupiedtemporarily. The amountfor compensationshall be 231.86846million-yuan and 4,920people shall be affected.

The cultivatedland to be affectedis 252,812mu.The permanentland requisitionfor this project is 3.5% of the total cultivated land of to be villages of land requisition.'*->M; Therefore, the influence to the villages is not strong.

Thisproject is plannedto startonNov.20,2000 and completeinNov.30, 2003.-

1. Descriptionof the Project and Its Major Purpose The expresswayfrom Zhumadianto Xinyangis an importantpart of Beijing- NTH. It connectsthe importantregions in the south of HenanProvince-Zhumadian Prefectureand Xinyang City. It is an importantpassage on north to southhighway transportationof China. At present, fully enclosed and elevated expresswaysfrom Anyangto ,and fromZhengzhou to Xuchangand Luohehave beenbuilt up. The expresswayfrom Luohe to Zhumadianis now under construction.They are also parts of BeiJing-Zhuhai NTH. The upgradingof Class I highwayfrom Xinxiangto Zhengzhouand the preparatorywork for Xlnxiang-Zhengzhouexpressway are also in process. .

Becauseof the rapid economicdevelopment of China since reformationand opening to world,highway traffic volume is increasedgreatly. The investigatedtraffic volume betweenZhumadian and Xinyanghas beenmore than 10,000vehicle/day (converted into medium-typevehicle), whichsignificantly exceeded the capacityof the existing highways.Therefore, it is necessaryand urgently required to build Zhumadian- Xinyangexpressway. It has importantsignificance to improveand realizeBeijing- ZhuhaiNTH to be functionedas expressway,to clear cross interference,to enhance the capabilityof highway, to reduce traffic accidents and to promote further developmentof the nationaleconomy.

2. RegionsAffected and Benefitedby the Projec The expressway from Zhuniadian to Xinyang directly influences Zhumadian Prefecture and Xinyang City, including 12 counties or districts under their administration:, Runan, Queshan, Pingyu, Suiping, Shangcai, Xincai, Zhengyang,Pingqiao, Luoshan,Xixian and Guangshanas well as LuoheCity and HubeiProvince. It will influenceindirectly 5 countiesincluding Xinxian, Huangchuan, Huaibin,Gushi and Shangchengas well as Nanyang City, ZhoukouPrefecture and AnhuiProvince. The constructionof 95.52kmlong expresswayshall bringvigorous developmentfor the above-mentionedareas, which are main grain, cottonand edible oil producersin Henan Province.Also the investmentenviromnent shall be improved and the economical.development shall be promoted.It will makegreat rolein poverty fighting.

3. Socialand EconomicalBaCkground of the RegionsAffected by the Project ZhumadianPrefecture is located in the south of Henan Province with total area of 15,083Sq.m,753,000 ha. of which is cultivatedland. Its total populationis 7.89 million, in which 7.04 million are agriculural people and 850,000nonagricutural people.Its populationdensity is 523 personper square meter.The averagecultivated land per capita is 1.6mu.The main scopefor agricultureincludes grain, cotton and edibleoil. Mainindustxy sections include non-metal development, building mateials,

2 medicine,textile, machinery, electricityand chemistry.Its main products include cigarette, beverage, alcohol, textile products, machine-madepaper, paper plate, syntheticammonia, plastic productsand cement.Its GDP in 1997was 22.509billion- yuan, average2,806 yuan per capita,ranking the 15thin 17 cities and prefecturesin the province.

XinyangCity, which connects with Province,is located in the south end of HenanProvince. It has 18,915sq.mof land with 520,000ha.cultivated land. It has 7.6 millionpeople including 6.6 million'agriculturalpeople and 1 millionnon-agricultural people.The populationdensity is 402 per squaremeter. The averagecultivated land per capitais 1.2mu.The main scope for agricultureincludes grain, cotton,red ramie and tea. Main industry sections include machinery,electricity, medicine, building materials,foodstuff feedstuff,textile and chemistry.There are 38 kinds of explored

valuablemine resources,including serpentine and pearlitewhose storage ranks first in l. ' f China. Its GDP in 1997 was 22.054 billion-yuan,average 2,785 yuan per capita, rankingthe 16thin 17 cities and prefecturesin the province.

Zhumadian Prefecture and Xinyang City are both under-developedregions in economyof the province.The backwardsituation in economyneeds to be improved.

4. MeasuresTaken to MinimumMigrants A lot of work has been done to minimumthe influencecaused by land requisitionat the stage of feasibility study of the project. The alignment of this proposed expresswayis determinedaccording to the result of aerial photography,the land and the buildingsto be influencedcan be clearlydistinguished in the photograph.

In order to minimumthe influenceto the local people causedby land requisitionof this project,Henan ProvincialCommunications Planning, Survey & Design Institute discussed with the leaders of highway construction departments and local governmentsalong the route to work out the scheme of alignment.A 1:2000 topographicmap is finally adopted,with the purposeto take the influenceof removal and resettlementinto consideration,to determinethe scheme of alignment.From the stage of preliminarydesign, land requisitionand resettlementhas been the main factorsthat decidethe project designand alignment.Because a lot of work has been done in surveyand design stage,best effortshave been paidto minimum.the influence of landrequisition.

In orderto minimumthe quantityof land occupationand removal furtheradjustment for horizontalalignment is made during final design period, to avoid the alignment goes throughthose villages whose population'is large. Also, the longitudinalrdiei _ is reasonablyadjusted to shortenthe height of fill and the depth of cut, and the; interchanges are awrangedproperly. . .

In addition,effort shall be madeto minimumthe influencecaused by land requisition

3 and resettlement during construction period. The temporaryland used shall be focus on existing buildings and waste yards (e.g. township enterprises that have been closed). Also, best effort shall be made to balance the earthwork during construction period, borrow sources shall be arranged in the waste land or waste hills.

5. Economical and Technical Feasibility Study The preparatory work for this project is arranged earlier because of the big scale and the large investment of this project.

ln August 1990, "Pre-feasibilityStudy for Henan Section of Beijing- NTI" was completed by Henan Provincial Communicatio'nsPlanning, Survey & Design Institute. In 1995, "Pre-feasibility Study for Beijing-ZhuhaiNTH in the Section between Luohe and Xinyang"' was completed. In 1998, 'Pre-feasibility Study for Beijing-Zhuhai NTH in the Section between Zhumadian and Xinyang" andr 'Teasibility Study for Zhumadian-Xinyang Expressway of Beijing-Zhuhai NTW' were completed.

6. The Preliminary Design and Construction Design The Preliminary Design for this project has been completed during the period of October 1998 to January 1999, the Construction Design has been started in May, 1999 and shall be completed in October 1999 by Henan provincial Communications Planning, Survey & Design Institute.

7. Ownership and Organizational Structure of the Project Zhumadian-Xinyang Expressway is one part of the Beijing-Zhuhai National Trunk Highway, which characterizedas stated-owned highway.The Henan Communications Department and the High-grade Highway Construction and Management Bureau under it shall responsible for the said project's construction, management and maintenance. During the implementation period, all levels (county/district, prefecture/city and province) of construction authorities and the offices under them shall responsible for land requisition & removal and migrants' resettlement.

8. Social and Economical Survey The social survey for this project was carried out by the design unit and communication authorities at city, county (district) levels under the requirement of Henan Provincial Communications Department. The survey groups involved the Design nstitute, communications bureaus at city and county levels, villages and: households influenced. The survey period was from March 23, 1999 to June 4,1999, totally 74 days. The suvey was focus on economical situationof the counties, towns * and villages along the expressway. including basic production conditions, geological environment, production forms, living habits, lvng levels, people constion, soil- quality, attachment quantity, market price-of local materials and the attitude of the'- local people towards this project. The survey forms mainlyincluded checling statistic data of 1998,1997 and 1996 in statistic bureaus at county level, visiting officers at

4 county, township and village levels and the people who are involved in land requisition and removal. Permanent land requisition and the ground attachments that shall be removed were registered in details to be used as the basis in preparing this implementationplan.

The investigationgroup included the followingmembers (1) Hu Chaoyin:Deputy chief of the First Design Departmentof Henan provincial CommunicationsPlanning, Survey and Design institute(HPCPSDI), senior engineer, whoin chargethis investigation; (2) WangJianshen: Engineer of Planning& EconomyDepartment of HPCPSDI,who responsiblefor investigatingthe population,land, outputand rate of crops for each village,township and county; (3) Zhang Xinagjian: AssistantEngineer of Planning & EconomyDepartment of HPCPSDI,who assistto investigatethe population,land, output and rate of crops for. each village,township and county; (4) Du Junwang: Engineer of the First Design Departmentof HPCPSDI, who responsiblefor investigatingthe quantityof variousland occupiedand the quantityof structures,attachments, power and telecommunicationfacilities on variousland along the proposedhighway; (5) Du Zhanjun Assistant Engineerof the First Design Departmentof HPCPSDL- who assist to investigatethe quantityof various land occupiedand the quantityof structures,attachments, power and telecommunicationfacilities on variousland along the proposedhighway; (6) Zhang, Zhongmin: Senior Engineer of GeologicalExploring Department of ,IPCPSDI, who responsiblefor investigatingsoil property,geological environment and naturalresources in the areasalong the proposedhighway; (7) Wu Jingshun:Chief of PlanningDivision of CommunicationBureau ofZhumadian Prefecture,who responsiblefor investigatingthe economicalcondition of each village, townshipand countyalong the proposedhighway; (8) Miao Baogu: Chief of EngineeringDivision of CommunicationBureau of Zhumadianprefecture, who responsiblefor investigatingthe economicalconditionof each village,township and countyWlong the proposedhighway; (9) ZhangBaogang: Chief of DesignDivision of HighwayManagement Department of XinyangCity, who responsiblefor investigatingthe economicalcondition of each village,township and countyalong the proposedhighway; (10) Peng Zigang:Chief of PlanningDivision of HighwayManagement Department of XinyangCity, who responsiblefor investigatingthe economicalcondition of each - village,township and countyalong the proposedhighway..

9. Preparation of the ResettlementAction Plan (I) The design unit shall provide and requisitionquantity attachmentquantity and populationaffected by land requisitionand removalaccording to ConstructionDesign. It will also provide economicalsituation of the projectarea, traffic volumeforecast after completionof this projectand the foreseeingof economicaldevelopment based

5 on FeasibilityStudy Report. (2) Set up migrant resettlementorganization. The constructionauthorities of this projectat provincialand city levelswill be establishedin December1999. By that time, the relevant authorities or leading groups in Xnyang and Zhumadian City/Prefecture,and Pingqiao,Runan, Queshan counties/districts as well as townships (towns)under their administrationwill be set up. The Authoritiesat differentlevels willbe in charge of passingthrough land requisition formalities, carrying out removal plan, releasing compensationfee, settling down affectedpeople, guardig social security,coordinating relationship between the Contractorsand local people, solving problemsbased on contractsor authorizationof the higherauthorities. (3) Givingpublicity of the significanceof the project and the laws and rules on which compensationpolicy is made.The propagandashould be extendedto every family and everyperson. (4) The constructionauthorities and the offices under them at county and district A levels are -in charge of making up Resettlement Action Plan, especially land readjustmentplan.

10. Permission of Land Utilization,Resettlement and Construction The total permanentland occupationfor this project is 9,074muand the temporary occupationof land is 1,384mu.The plan of land utilizationand other relevant documentsshall be submittedfor approvalbefore May 2000,the best effort shall be madeto get the approvalfrom the State Land AdministrationBureau before Nov. 1, 2000. The people influenced by land requisition shall be resettled through rearrangementof land. And the rearrangementof land shallbe madeproperly before commencementof the works'

1. In China,there are three levelsof policiesregarding land requisitionand migrant resettlement. * Basicpolicy framework set up by central governmentthrough issuing state lawsand enforcementregulations. * Comprehensive/specialregulations and enforcementmethods on carryingout state laws issuedby provincialgovernments. * Relevant regulationsissued by Prefectures/cities,which are accorded with the state/provinciallaws and regulations,and are only applicable in the specified jurisdictionalareas.

The ResettlementAction Plan is preparedaccording to the followinglaws, regulations and the Guidelineof Non-volunteerMigrants (OD4.30)issued by the WorldBank. The implementationof the ResettlementAction Plan shallbe based on the said law framework.

2. Lawsand RegulationsRegarding Compensation (1) Statelaws and regulations The followinglaws contain the key policies aboutland, grassland and forest: A. "LandManagement Law of the People's Republicof China".It is approvedby the 16th sessionof StandingCommittee of the 6th NationalPeople's Congressin June 1986,and is revisedon Aug 29, 1998.It comesinto forcesince JanL 1 1999. B. '"nforcement Regulationsfor Land ManagementLaw of People's Republic of China", it is approvedby the StandingCommittee of the State Councilon April 24, 1998and comesinto force sinceJan. 1, 1999. C. "StateForest Law " and itsimplementing regulations.

(2) The majorprovisions of the Land ManagementLaw (the mostimportant part) are shownas follows:

Ownership (1) The people's Republicof China carries out socialistpublic ownershipfor land. That is national.ownership system and collectiveownership systeam The land in wban

(3) Theland owned by the collectiveof farmersshall be registeredand recordedin the countygovernment. The certificatesto provethe land ownershipshall be issued by the countygovernment after confirmation(Clause 11 of "LandManagement Law of China").

(4) If the purposeof the landownership is to be changed,it shallregistered (Clause 12 "LandManagement Law of China!).

(5) The ownershipand right of utilizationof the registeredland by law is protectedby law. It is prohibitedto violate by any units or individuals(Clause 13 of "Land ManagementLaw of China").

Land usage (I) Units or individualscan use the land that belongsto the state and collectiveof farmersby law.The land user has the obligationsto protect,manage and properlyuse the land (Clause9 of "LandManagement Law of China").

(2) Land surveysystem is set up by the state (Clause27 of "LandManagement Law of Chinaj).

(3) Land statisticsystem is set up by the state (Clause39 of "LandManagement Law of China").

(4) The governmentsat differentlevels shall organizeto preparean integralplan for land utilizationaccording to the plan of socialand national economydevelopment, requirementsfor state land renovationand environmentalprotection, land supply abilityand the need of land for constructions(Clause17 of 'Land ManagementLaw of China).

(5) Cultivatedland is stiicdy controUedbeing transferredinto non-cultivatedland. The state camiesout compe ion systemfor culivated land ocwation In the even't that the cultivated land is to be t tsferredto non-agriculura construction lnd after approval,the unit that occupyit shallbe responsibleto cultivateanother piece of land with the same quality and the same amountaccording to the principleof "ultivate. the sameland as you use". For thosewho incapableto cultivateor the cultivatedland can't meetthe requirement,cultivated land cultivationfee shall be paid accordingto

13 the relevantregulations. This fee will be specially used in cultivatingnew cultivated land(Clause 31 of "LandManagement Law of China").

Land used for state construction (1) Procedurefor approval If the approvedproject needsto use state land for construction,the constructionunit shall apply to the land administrationauthorities above county level that have approvalright with relevant documentsof law and administrativeregulations. The applicationshall be checkedby the land administrativeauthority and reportedto the governmentat the same levelfor approval(Clause 53 of "LandManagement Law of China").

(2) Confirmationfor approval Landused by units and individualsfor a specificproject shall be handledaccording to Clause22 and 23 of "Enforcementregulations of Land ManagementLaw". The authorityof approval to unusedstate land for constructionprojects is that: (a) land lessthan 2ha. shall be approvedby county(city) government;(b) land morethan 2 ha. but less than 4 ha. shall be approvedby city ( prefecture)government; (c) land more than4 ha, shall be approvedby provincial government.

Apartfrom paid use land, afterthe projectis completedand passedexamination for acceptance,"State Land Use Certificate"shall be issued (Clause36 of "Execution Methodfor Land ManagementLaw in HenanProvince").

2. Lawsand Regulations RegardingStandard of Compensation Permanentland requisitiondecrees are mainly based on the implementationmethod of "LandManagement Law" executedin Henan Province(It is approvedby the 11^ sessionof StandingCommittee of the 9th Provincial People'sCongress on Sep. 24, 1999and comesinto force sinceDec. 1, 1999):

It is markedin Clause 34 of the "LandManagement Law" that after the proposal of landused for constructionland is approved,the compensationto the unit whose land is in requisitionshall be executedaccording to followingrules:

(1) Landcompensation fee The requisitionedcultivated land (including vegetable plot) orchard,fish pond, lotus pondand tea garden in suburbof citiesunder direct provincialadministration shall be compensatedby 8-10 times of the annualoutut value. Otherland in suburbof oth; - cites, industry/miningareas and towns under direct admistration of countyhall bl compensatedby 7-9 times of the average annual output value for the last3 years. The * land in other places shall be compensatedby 6-8 times of the annualoutput value. '

In the requisitionedcultivated land, the by-products of crops(vegetables excluded) shallbe calculatedby 15-20%rof the output of their correspondingmain products.

14 When the orchards where no fruit is growing, newly-builtfish pond, lotus pond, reed pond, tea garden and forest land are requisitioned,the compensation shall be made according to the lowest standard of the adjacent cultivatedland.

For the land used for residence and the collective land used for public facilities, commonweal benefits or used for individual business, apart from removal subsidy shall be mad, it shall also be compensated as cultivatedland.

If the unused land is to be requisitioned, the compensationshall be made by 3 times of average output value of the adjacent cultivated land in last three years.

(2) Resettlement subsidy The resettlement subsidy for cultivated land and other land requisitioned shall be calculated accordingthe number of agricultural people to be resettled. That is: the agricultural people to be resettled = the requisitioned land/the average cultivated landper capita.

The standard of resettlement subsidy for each agriculturalperson to be resettled shall be 4-6 times of the average output value of the correspondingcultivated land in last 3 years.

For suburb undef direct administration of the province, it shall be 6 times, For the suburb of other cities, land in industrial and mineral areas and towns under direct administration of the county, it shall be 5 times. For other land, it shall be 4 times, but l. the resettlement subsidy for per ha. shall be no morethan 15 times.

(3) Compensation for young crops shall be made accordingto the output value of one harvest.

(4) Compensation method and standard for ground attachments shall be executed l. - according to the regulations made by the provincial government. The regulations are based on two documents issued by the provincial government.They are the provincial

- - The collection, use and management of cultivation fee shall be regulated in other regulationsof the provincial government. (Note: The cultivation fee is temporarily determined as the same cost of land compensation.)

3. Principlefor Compensation (I) Avoidland requisition as far as possible. If it is impossibleto avoid, land requisitionshall be as fewer as possible,then a ResettlementAction Plan and payment for variouscompensation shall be madeaccordingly.

(2) Make sure the living standard,productive ability and incomeof the people. influencedcan be resumedto the originallevel.

(3) Buildingssuch as residentialhouses to be removed must be compensated accordingto replacementcost.

(4) In principle,the new housesfor the migrantsshall be ready beforethe demolition of the old ones, and the removalexpense shall be paid. If a transitionperiod is necessary,the units who undertakingthe proposed project shall properlypay the correspondingexpenses.

(5) The units who undertakng the proposed project shall strictly follow the compensationpolicy and standarddrawn up in the ResettlementAction Plan. If there are someimportant or major variationsduring the implementationperiod, a report concerningthis case shall be submittedto the WorldBank beforethey come into force. Whenit is necessary,revision shall be madeto the ResettlementAction Plan.

Arrangedby Henan ProvincialLand ManagementBureau and governmentof Pinqiao District, Xinyang City, in first of June 1999, the compensationstandard for land requisitionwas preliminaryestimated by Land ManagementBureau of Zhumadian Prefectureand Statistic Bureau of PingqiaoDistrict, Xinyang City, and a report in writing were furnished.The report showsthat the averageannual output value for every mu of cultivatedland is differentform the calculdtingresult, but the difference is slight.

In the "Budgetary Estimate Program for Compensationof Land Requistion" provided by Land ManagementBureau of Zhumadian Prefecture in June 15, 1999, the' - compensation rate is 1,118yuan/muyear, while the calculating result for compensationrate is 1,O91yuan/mu.year,'thedifference is only 2.4%. The anmnal averageoutput value per mu forthe township/townalong the proposedproject in year 1998 is 1054.5yuan/mu.year(data providedby StatisticBureau of PingqiaoDistrict,

26 (2) Restorationand Developmentof Production During June 16 to 17,1999, a forum was held to consult the opinion of the representativesform ZhumadianPrefecture and Xinyang City (incluingQueshang Countyand PingqiaoDistrict) and 13 town leaders as well as the farmeralong the route. They expressedthat the compensationgot form the land requisitionshall be well controlledand expendedin such way that the agriculturalproduction is not be adverselyaffected duo to land requisitionand removal. They will take this good chance of obtainingsuch big amount of money, at first to increasethe input of agriculturalproduction, especially in the followingaspects, to enablethe cropsto go up a newstage both in qualityand quantity-. a. Upgradingthe plant pattern, selectingthe fine strains,reject the backwardstrains which lack of market competition(such as Xinyangpoor qualityrice), and grow high-valuedcrops, such as tobacco,peanuts, etc. b. Developgreen houses to plantfruit, melons, vegetables and medicinalherbs. c. Improve water conservancy facilities, construct pump stations, deep wells, big water pond and perfect the auxiliaryfacilities for irrigation,enhance ability in combatingnatural disasters to guaranteegood harvest in bad whether condition. d. Improve condition of agriculturalproduction based on actual investmentin science- technology. e. Increase investment in science-technology to improve condition of agricultural production.

Secondly,properly increase living facilitiescost from the compensationwith the major purposes in building roads and water & power supply facilitiesfor the villages affected. Thirdly, take part of the compensation to strengthen education to the migrants, such as provide night schools, training classes, purchase scientific/technical books and build library to improve the quality of the migrants. 1. Organizations responsible for Planning, Management, Implementing and Monitoringof ResettlementAction Plan

The PMOshall be fullyresponsible for coordination,plan and implementationof land requisitionand resettlement.The migrantresettlement office at provinciallevel of the PMO shall be responsible for coordinating all the activities of the nigrant resettlement.The work of land requisitionand migrantresettlement is actuallybeing carriedout and implementedby countyland managementdepartments and migrant resettlementoffices at county/townshiplevel.

During the critical period of implementation,they couldget the personnelassistance from the departmentconcerned. Computer shall be equippedfor them to make populationcensus. Proper training,shall be providedfor them in keepingand recordingthe data of migrant resettlement.-The information providedby them for the municipalauthorities shall be used as the basis of interior monitoringfor migrantresettlement. Their responsibilities include: * Prepare county's ResettlementAction Plan based on popuation statistics data provided by investigationand design institute and the policy of the Provincial ConstructionAuthority; i Executethe ResettlementAction Plan; * Guideand supervisethe activitiesof townshipmigrant resettlement offices; * Collectmigrant resettlement capital for (-collectives-enterprises-individuals); * Providetraining for the staffof townshipmigrant resettlement offices; * Submitreport to the Municipaland ProvincialAuthorities.

34 VII. PublicConsultation The news briefingmeeting shall be made at village levelto provideinfornation on compensationstandard on houses, crops and property loss, as well as the determinationof the resettlementlocations.

Thedecision made in the meetingshall be includedin the ResettlementAction Plan to reflectthe requirementsof the migrants.Table 7.1 briefs the publicconsultation.

Such meeting shall be held regularly.Its purpose is to let the migrantsknow the progressof this project and obtainedthe furtherconsultation of the local people.In formulationof resettlement policy, the city and county governmentsshall also participatepositively.

The migrants have been told of the impact to their propertiesand the possible locationsof resettlement.They already explicit their choicein the preparatorymeeting (within the possible options). A brochure (as section 5-1 described)regarding resettlementinformation shall be preparedand it shall be printedout and distributed to each of the migrant fimilies after the ResettlementAction Plan is reviewedand acceptedby the WorldBank. Thebrochure lists the migrant'sexact rights.

Consultationhas been made with some unit affected to assessthe technicalimpact exertedby this project. Accordingto present and fiuturerequirements of the unit concerned,the locations,heights and widths of interchanges/gradeseparations shall be assessed.

Theway of publicconsultation during the periodof migrantresettlement is as follows. The migrantshave joined in parts of the followingmentioned activities, they will continueto take part in such activitiesduring the wholeimplementation period. * Selectthe locationsof resettlement; * Housesbuilt by migrantsthemselves ( or the migrantselect the housesprovide by the governments); * Supportedby the village committeesand migrants,the local resettlementoffices carryout implementationof resettlement.

Since the migrant participation of the whole process of the resettlementand reconstructionplan, it is expectedthat there will be no big complaintsoccur. In order to resolvethe problemseffectively in land requisitionand migrantresettlement, the ProvincialAuthority must set up the detailedprocedure to correctthe complaints.It is aimedto answerthe complaintsin a rapid.and transparentway. The unit designated shall be of simple, easy accessible,transparent and impartial,aiming at answering complaintsin an effective way in stead of via a complicatedofficial channel. The complaintsto be resolved via the authoritieswill boost the progressof this project effectively,the procedureis as follow:

Stage 1: If anybodydissatisfy with the migrantresettlement and reconstructionplan, they may put forwardtheir proposal to the village committeesor local migrantresettlement officesconcerned in oral or in writtenform. If the opinionsare in oralform, it shall be written on paperby villages and resolvedproperly, the complaintsshall be resolved withintwo weeksby villagecommittees or townshipmigrant resettlement offices.

Stage2: If the complainantsdisagree with the decisionmade in stage 1, they can go to the countyauthorities concerned within one monthafter receivingthe decisionmade in stage 1. Thecounty authorities shall make a decisionon complaintswithin two weeks.

Stage3: If the decisionmade by the countyauthorities still can not acceptedby the persons who makecomplainants, within one monthafter receivingthe stage 2 decision,they can go to the provincial or municipalauthorities, the provincial or municipal authoritiesshall make a decisionwithin three weeks.

Stage4: If the migrantsstill have problemsto the decisionmade in stage 3, they can make a suit to the civilcourt based on civillaw of procedure.Fifteen daysafter receivingthe decisionmade by the provincialor municipalauthorities, they may makea suit on

every aspect related to migrant resettlementand reconstructionplan, including - *- compensationstandard. - - -. -

The detailedprocedure for correctionof complaintsshall makepublic on the meeting . whichparticipated by migrants,and also sent to villagecommittees, township migrant= resettementoffices, county authorities, municipal (prefecture) authorties.

Before implementation,this informationshall be collected in the brochureto be

39 distributedto the migrants.

RAP shall be kept in coordinationdivision of Zhumadianand Xinyangconstruction authoritiesfor looking up by the localpeople whenever needed.

The complaintchannel will be guaranteedto be unimpeded.The names, telephone numbers and addressesof the persons in charge of receptionof complaintswill be open to the publicduring the excution of this project. .

40 IX. Monitoring

1. Procedure of Implementation During the process of implementation,prefecture. and municipal construction authorities and county construction authorities shall record implementation informationabout individuals, families and units fromtownship migrant resettlement offices accordingto'models preparedby the monitoringorganization. The'records regardingthe currentactivities shall be handed over to the ProvincialConstruction Authorityso as to maintaincontinuous implementation monitoring. The Provincial ConstructionAuthority shall conduct regular examinationto the township-and village-level (with all townships covered) organizationsto verify the reported progress.

In the aboveframework exists a continuousinformation flow from the village-levelto the Provincial Construction Authority with a stipulated format, and also regular examination and verification made by {he Provincial Construction Authority. Therefore, all migrait resettlement organizations at various levels are involved in the system'of monitoring.

Living standard investigation . - Methdi Before the start of migrantresettlement implementation, an independentmonitoring organizationshall conduct a basal living standard survey about random migrant samplesand controls.The livingstandard survey shall be repeatedtwice each yearto . monitor the changesin living standardof the migrants.Random interviewing of the migrantsand observationsare used to supplementand directinterview formats.

41 Improvement of Tnvestigation and Pxaminatian: Questionnairesfor living standardinvestigation shall be modifiedand take into accountlocal cultural factorsto acquirequantity and qualityabout living standards. After the questionnaires are prepared, they shall be examined in practical investigationsto determinetheir efficacyas a measurementtool, and makecorrection accordingto the examination results..- ;

Trainingof recorders: Recordersshall get trainedin usingquestionnaires correctly and skillfully.

Investigationsediting and codingprocess: Recordersshall be put under the supervisionand examinationof a leading group composedof manypeople. Theleading group shall recordand edit all questionnaires on the day whenthe questionnairesare completed

Otherorganizations responsible for livingstandard investigations: During the period of living standardinvestigations, the ProvincialConstruction Authority shall assist the independentmonitoring organization.Local migrant resettlementoffices shall also assistthe independentmonitoring organization in its work.

The person who in charge of this project named Yao Songling, he is a senior enginer - - who owns doctordegree. He has the experiencein YellowRiver Dam (Xiaolangdi) project,Wanjiazhai project, etc.

42 PublicConsultation The independentmonitoring organizationshall attend village and township level public consultativeconferences. Shortly after acceptingappointments, it shall send two workingstaff to attend at least 2 public consultativeconferences in each quarter. Throughparticipating in these conferences,it shall evaluatethe effectof participation by migrants and their cooperationwith migrant resetdementprograms. If the independentmonitoring organization openly identifiesproblems and the results of these conferences, these conferences will be improved in terms of organization and procedures.

Comlanits The independentmonitoring organization often visit some places,and meet migrant resettlementoffices as well as the migrantsto find out complaints.The results of resolvingcomplaints shall be monitoreduninterruptedly. If necessary,suggestions for necessaryimprovement shall also be put forward as for proceduresin order to make the implementationprocess more efficient.

1. Interior Report A report shall be submittedto the World Bank every half-yearby the Provincial ConstructionAuthority, and the first report shall be furnishedin April 2000. The reports from the municipal/prefecture,county constructionauthorities to the ProvincialConstruction Authority shall be submittedlevel by levelat the start of each quarter.

Thecontent and the formof the reportshall include: Nameof reportingunit, reportingtime, report contents, and workplan on yearly basis. I Project Overview

The Zhumadian-XinyangExpressway is part of tlhenationial hiigliway from Beijing to Zhuhai. It begins at the endpointof Luohe-ZltitnadianiExpressway (tunlder consitrction), and stops at Xiniyang City. It passesRunan, Queshan and PingqiaoCounties and its totallengtih is 95.52 km;.This project also includesroads connectingto cities anidcounty seals along the way.It is expected to commence constructionon Junie1, 2000 and to finishin June of 2003.

For the main stem of the project,9074 mu land is to be acquired,1384 nu land is to be leased,225 households(868 people) resettled, and the area of houses affectedis 31752m2. Some power supply, telecommunicationsand water supply facilities are affected to varyingdegrees. To alleviatethe above-mentionedimpacts, it is planied to carry out land adjustiimenitin the 52 affectedvillages and resettle-the villagersaffected by land acquisition.Affected inlrastructurewill be recovered.The - total land acquisitionand tesettlementimvestment for the main stemiiof this project is 231.8685 mnillionyuan.

2 Purpose of Monitorinigand Assessmentt

To ensure resettlemnentis implementedaccording to the resettliemeitaction plan, in accordancewith the requirenmentsof the World Bank, the Govenmenit and the aftecctedpopulalion, the Project Employer should hire an organization, whiich is completely independent from the project implementationorganization and govemnmentagencies and acknowledgedby the World Bank, to-' carry out independentmonitorinig of resettlemenltimplementationi process and assessment or implementationresults. This monitorinigorganiizationi will lave an extensive and. long-temni viewpointand monitor and evaluateall resettlemilenitimplcilemilation activities in an objective,fair and comprehensivemanner to detenninewhethier:

(1) Resettlementimplementation has been carried out in accordancewith the principleof the resettlementaction plan and the action plan has been strictlyfollowed; (2) The living standardsand productionfacilities of tile affectedpopulation have been recovered or improved.

3 Duties of Monitoring anidAssessmentt

(4) Based on the overall monitoring anid evaluation of implcllemintationprogress, advice and improvement' measures regarding the elfecliveness and. efficiency of the resettleiuient management organizationis shouild be Fomiulated. Both sioit-lenil and long-term effects of resettlement are evaluated and Forecasted, and feasible improvement measures anld advice should be provided. (5) Comprehensive evaluation of resettlement results' should be carried out when the implementation of resettlemncitaction plan is completed.

4 Monitored Targets

4.1 Implementation Progress

4.1.1 CompenlsationDisbursemenet

(I) Progress of compensation disbursemeintto the affected population and enterprises before tile conmnencementof project construction; (2) Monitor and make detailcd records of complretisationity3pes and criteria, amount and date of compensation payment and recipient of compcnsation.

4.1.2 Housing

(1) The acknowledgement of the afcited populationi witli the reasonableness and faimnessof thle selection of new housing location: (2) The new locations should be close to the original locations; ' (3) Compensation for self-built houses should be made according to the constructiou criteria and individual characteristics and approximately equal to the re-construction cost of the houses (without deducting the value of depreciation and utilizablc materials); (4) Monitor and make detailed records of housing requirementis of the affected population, date they move into the new housas and housing relocation etc. - (5) Compensation should be paid to the aflec(ed population on time, including moving subsidy,' subsidy forthe 'transitionperiod and awards. etc. -' .~~~~ j~~.

4.1.3 Enterprise Relocation

(1) All affected enterprises shotild be compenisatedat the re-coistruction cost without deducting

depreciationor utilizableniaterials, (2) For the enterprises that need to relocatc,the date or movingand tihetinme span of transition periodshould be detemijuedatler discussionwith themlz; (3) During the period when the eniterprisesare not operatinig,tlhe affectcd. employees shiould receivesubsidies approximtlely cqual lo ilicirnoniial wages: (4) During the period when ihe enlerprises are not operatinig. they should be compensated for their lossdue to stop of produclion/operation.

4.1.4 ProductionRecovery

(1) Adjustmentto farmland shouldbe made withiiithe unit of village,and land compensationand relocationsubsidies should be utilizedto developcollective economy (village); (2) Developmentof other productionchannels/measures and employmentopportunities.

4.1.5 - InfrastructureRecovery

(1) All necessaryinfrastructute should at leastbe recoveredto its originallevel afler relocation: (2) Compensationfor infrastructuteshotild be einoughifor its re-constructionwith the same quality.

4.2 Public Participation and Negotiation

4.2.1 Extentof Participation

Duringthe implementationprocess, the participationtsystem for resettlersand other affectedparties shouldbe set up and operating smoothly.Make record of participationcontent and result etc.

4.2.2 Complaintsand Grievances

WVhetherthere are channels for complaintsand grievances;whlielter the, channels are unblockedand effective; whether records are made for complaints/grievanticesprocessing; scope of complaints/grievancesand treatmentmeasures.

4.2.4 Satisfaction of the Affected Parties

4.3 Social and Economic Conditions

4.3.1 Incomeand Expenditure

Changes in the amountand compositionof the incom1eand expeniditureof the affectedpopulationi during the implementationperiod gnd afler imsplementationlare moniitoredand evaluated.

4.3.2 Infrastructureand PublicUtilities

Changesin schools,hospitals, roads, water and powersupply facilities.

4.3.3 Living Standard

During the implementationstage, comiparativesocial and economicinvestigation of the affected _ population against un-affectedpopulation within tlic same area is carried out, in the form of samplinginvestigation, to find out and report potential problemsin the recoveryprocess of living standards. Comprehensive social and economilic investigation and analysis is conducted whei monitoring is completed, and reports in written form regarding the living standards after resettIementis submitted to evaluatetile impact or the implemcintationof the resettlementaction plan on the affectedpopulation.

5 Metihodology

5.1 lnvestigatlonnlntervlew

The monitoringand evaluationwork is based on thleresults of fieldinvestigation and infonnation - collection, and information collected is verired, foioritsauthentikity.ifw

5.2 Sampling Investigation

5.2.1 Sample Size

(1) The number of sample villages accounts for 20% of the tolal niuitiberof affected villages; (2)The sample size of livelihood resettlemenit houtiseiolds is 20% of the total nunmberof resettlement households; (3)1lTe sample size of production resetulemiienthouseliolds is 3% of the total number of production resettlement households.

5.2.2 Selection of Samples

According to the type and degree of project impact, with location, economy and social and cultural- characteristics taken into account, the samples are randomly selected. I1his sample is covered by the monitoring and evaluation work.

5.3 InformationCollection andProcessing

(1) Questioniaires are distributed to tlie affected villages, enterprises and households, and then answered by individuals concerned and filled out by designated personnel; (2) Direct interviews with affected individuals nnd enterprises; (3) Special teams are formed to carry out investigation and find out problems, suchias the elderly. women, children, affected enterprise, aindolher issucs; (4) Information collected is classified and analyzed according to the following criteria: affected location, affected time period, inipact type, compelnsation level and length of relocation period; (5) The independent monitoring organizationt will keep a database, in which information collected from various sources is stored and updated through timne; (6) Data regarding implementation progress is provided by the implementation organizations, and the monitoring and evaluation organization make verifications by means of sample investigation.
