Fotografia de capa 191 5 Apresentação É com prazer que apresentamos este número – o quarto – da Revista Eletrônica do IBPI – REVEL. Seguindo nas mudanças introduzidas a partir da edição anterior, este número traz textos internacionais como o de Ana Maria Pacón, sobre as disposições sobre PI dos Tratados de Livre Comércio (TLPs) e seus efeitos nas políticas de saúde pública dos países em desenvolvimento, chamando a atenção para a importância de flexibilizações que permitam harmonizá-las com as necessidades de acesso a medicamentos nesses países. Gert Würtenberger comenta, na seção de atualidades, a decisão da Corte de Justiça Europeia no caso L’Oreal, e a difícil questão quanto à definição da abrangência da proteção marcária para funções além da garantia de origem, e questiona ainda, com base na jurisprudência alemã, quem é o titular dos direitos de reprodução fotográfica de localidades históricas. A partir das notícias quanto à eventual opinião pela sua inadmissibilidade, Paulo Figueiredo discute a importância dos assim chamados “acordos para co-existência de marcas” e oferece um conjunto de requisitos que, no seu entender, se atendidos, deveriam ensejar a aprovação dos mesmos pelo INPI. No que toca o direito de patentes, Denis Barbosa analisa as hipóteses de incidência patentária do art. 10 do Código de Propriedade Industrial. O tema du jour – direito de autor – é abordado em dois artigos, de Eduardo Tibau e Daniel Campello, além de um texto de Paulo Coelho comentado pela Karin Grau-Kuntz. Os textos abordam a noção do autor – também sob a perspectiva de um best-seller –, além de oferecer considerações sobre o projeto de reforma da Lei de Direitos Autorais brasileira. Gabriel Leonardos e Raul de Castro escrevem sobre a evolução do instituto de licença compulsória, a “verificação da eficácia material das [suas] diversas formas de manifestação” e o seu papel na garantia da função social da propriedade, discussão pertinente aos diversos direitos de propriedade intelectual. A seção de textos clássicos foi ligeiramente modificada neste número, e traz um texto de Jens Eisfeld, traduzido pela Karin Grau-Kuntz, sobre um tema histórico e jusfilosófico importante para a compreensão da propriedade intelectual: a oposição entre o jusnaturalismo e a escola histórica alemã durante a primeira metade do século 19. Este é o texto de abertura do presente número. Continuamos a apresentar opções de capa para a Revista, todas de autoria de Roberto Grau-Kuntz. O tema que inspira este número consiste na apresentação de fotografias vinculadas aos assuntos temáticos da Revista. Se escolhido este Layout, Roberto pretende apresentar, a 6 Revista Eletrônica do IBPI - REVEL cada novo número da Revista, uma fotografia diferente, sempre adequada ao motivo em azul contrastado com linhas fortes negras. O trabalho foi traduzido do alemão para o português por Karin Grau-Kuntz e a tradução foi revista pelo Prof. Ignácio Maria Poveda Velasco. Dr. LL.M. Pesquisador titular de cadeira de pesquisa na Universidade de Bayreuth, Alemanha. 9 Revista Eletrônica do IBPI - REVEL Introdução Diethelm KlippelNT analisou, em diversas publicações, a discussão sobre a Propriedade Intelectual na literatura jurídica em língua alemã dos séculos XVIII e XIX.1 Nessas ocasiões ele demonstrou a extraordinária importância do Direito Natural do século XIX para a formação, fundamentação e implementação de direitos de autor, de inventor e relativos à atividade empresarial, como direitos de natureza imaterial. Ele contrapôs o efeito revolucionário do Direito Natural para a história da Propriedade Intelectual do século XIX à Escola Histórica do Direito, [escola] predominantemente romanista, que adotou e manteve, até mesmo para além da segunda metade do século XIX, uma posição hostil em relação ao conceito de Propriedade Intelectual, atitude que, por sua vez, dificultou de uma forma geral a modelação dogmática dos direitos mencionados.2 Isso suscita questionar as razões que geraram essa oposição. Poder-se-ia afirmar que o conceito jusnaturalista do direito de propriedade seria mais flexível do que o conceito correspondente do Direito Romano, limitado aos bens corpóreos. Porém, ao proceder a uma análise mais cuidadosa, constata-se ser tal afirmação insatisfatória, posto ela pressupor que a Escola Histórica do Direito estivesse vinculada ao conceito de propriedade do Direito Romano de tal forma que, mesmo se a proteção civil da propriedade intelectual viesse a ser considerada como necessária, ela não se deixaria estender de forma a alcançar as obras do espírito. Which are the epistemological and methodological bases that a conflict is profound? Being descriptive theories, both Systemic Geopolitical Analysis and Structural Realism have been constructed on the basis of axial hypotheses tested through historical practical case studies. They represent complementary approaches, based on the common Thucydidean legacy of description and analysis emphasizing ontology. My deliberations seek to demonstrate that Descartes’s philosophy is program- matically anti-naturalistic, while its being presented and interpreted as one of the possible forms of naturalism evinces misunderstanding of its basic principles. For this reason, Descartes’s “naturalism” is referred to using quotation marks. Admittedly, his philosophy does advance such postulations and assertions which lend themselves to interpretation in naturalistic categories, but only when they are abstracted from the broader entirety of the Cartesian philosophical system. The text provides only two such examples, though more could be found in the seventeenth-century though. In each case, they constituted a depar- ture from the very foundations of that system. Keywords: naturalism, Cartesianism, interpretive misunderstandings ne of the controversial issues relating to Descartes’s philosophy are its associ- Oations with naturalism. Although the authors of the Third and Fifth Objections to his Meditations on First Philosophy—who already set out from naturalistic positions—argued that the author of the latter erred chiefly by not having adhered to the naturalistic principles, there was no shortage of those who were convinced that the tenets were indeed embraced and implemented, at least in the most crucial respects. It is my belief that such a perception and presentation of said principles constitutes a departure from the position adopted by the philosopher.

Wprowadzenie Jesienią 1998 roku w Atenach, tuż po śmierci Panajotisa Kondylisa, Rein- hard Koselleck w swojej mowie na cześć zmarłego, w której nawiązał do ar- * Panajotis Kondylis (1943–1998) (Παναγιώτης Κονδύλης) urodził się 17 sierpnia 1943 roku w Olimpii w Grecji. Dorastał w Atenach, gdzie studiował filologię klasyczną i filozofię (1963– –1967). Już jako student tłumaczył na język grecki teksty wielkich europejskich autorów histo- rii myśli. Działalność tę kontynuował również po studiach. Jego intensywne życie było wy- starczająco długie, by obdarować nas, którzy go przeżyliśmy, swoją twórczo- ścią, z której będziemy jeszcze długo czerpać, niezależnie od tego, czy przyj- miemy pozycję krytyczną czy aprobującą. Jego twórczość w każdym wypadku zmusza do dalszego myślenia. Zarazem jego życie było także zbyt krótkie, by mógł on ukończyć swoje dzieło2 (przeł. L. Z). Dziś można powiedzieć, że sąd Kosellcka o twórczości Kondylisa pozo- staje nadal aktualny. W myśli tego filozofa można bowiem znaleźć zarówno trafną prognozę współczesnego rozwoju świata i nadciągających konfliktów, których dziś niestety jesteśmy świadkami3, jak i trafne oceny i ujęcia dale- i Frankfurcie nad Menem.
