Hérésies : une construction d’identités religieuses Quelles sortes de communautés réunissent les hommes ? Comment sont- elles construites ? Où est l’unité, où est la multiplicité de l’humanité ? Les hommes peuvent former des communautés distinctes, antagonistes, s’opposant violemment. La division externe est-elle nécessaire pour bâtir une cohésion interne ? Rien n’est plus actuel que ces questions. Parmi toutes ces formes de dissensions, les études qui composent ce volume s’intéressent à l’hérésie. L’hérésie se caractérise par sa relativité. Nul ne se revendique hérétique, sinon par provocation. Cela rend l’hérésie difficilement saisissable si l’on cherche ce qu’elle est en elle-même. Mais le phénomène apparaît avec davantage de clarté si l’on analyse les discours qui l’utilisent. Se dessinent dès lors les d’identités religieuses représentations qui habitent les auteurs de discours sur l’hérésie et les hérétiques, discours généralement sous-tendus par une revendication à EDITE PAR CHRISTIAN BROUWER, GUILLAUME DYE ET ANJA VAN ROMPAEY l’orthodoxie. Hérésie et orthodoxie forment ainsi un couple, désuni mais inséparable. Car du point de vue de l’orthodoxie, l’hérésie est un choix erroné, une déviation, voire une déviance. En retour, c’est bien parce qu’un courant se proclame orthodoxe que les courants concurrents peuvent être accusés d’hérésie. Sans opinion correcte, pas de choix déviant. La thématique de l’hérésie s’inscrit ainsi dans les questions de recherche sur l’altérité religieuse. -

A Brief Life Sketch of Shaykh Ibn Arabi al-Shaykh al-Akbar Qaddas Allah Sirrahu It is well known that when our lord, master and beloved, the Prophet of Allah, Muhammad al-Mustafa saw went on a missionary tour to the city of Taif, he was rejected by its citizens. They pelted him with stones to the point where it was difficult for him to take his shoes off because of the encrusted blood on them. At one point, when the Prophet saw was sitting sad and dejected, the angel Gibril as appeared to him and informed him that if he wished, God would order the angels to topple the two mountains besides Taif onto the city to punish its citizens, most of whom belonged to the Tay tribe. As only the Mercy to the Worlds saw could answer, he had requested that the people of Taif be spared perchance they, or their descendents, might become believers. Through the baraka of the Beloved of Allah’s saw prayer, nearly six centuries after him, one of the greatest saints of Islam was born to a pious Arab family of the Tay tribe that was originally from Taif, but had settled in far away Murcia in al-Andalus, Spain. The name of the child was Muhammad ibn Ali ibn Arabi al-Tayi qs , who later came to be known as al-Shaykh al- Akbar Muhyi al-Din Ibn Arabi qs . al-Shaykh al-Akbar qs was born to a religious and influential family on Monday, the 17 th Ramadan 560 AH/28 th July 1165 CE . -

PREFACE The Qur‘an is a book which emphasizes ‘deed‘ rather than ‘idea‘. There are, however, men to whom it is not possible organically to assimilate an alien universe by re-living, as a vital process, that special type of inner experience on which religious faith ultimately rests. Moreover, the modern man, by developing habits of concrete thought - habits which Islam itself fostered at least in the earlier stages of its cultural career - has rendered himself less capable of that experience which he further suspects because of its liability to illusion. The more genuine schools of Sufism have, no doubt, done good work in shaping and directing the evolution of religious experience in Islam; but their latter-day representatives, owing to their ignorance of the modern mind, have become absolutely incapable of receiving any fresh inspiration from modern thought and experience. They are perpetuating methods which were created for generations possessing a cultural outlook differing, in important respects, from our own. ‘Your creation and resurrection,‘ says the Qur‘an, ‘are like the creation and resurrection of a single soul.‘ A living experience of the kind of biological unity, embodied in this verse, requires today a method physiologically less violent and psychologically more suitable to a concrete type of mind. -

The Newsletter | No.70 | Spring 2015 48 | The Network IIAS Reports Providing a reference point for the workshop as a Female Islamic authority in comparative whole, Mirjam Künkler gave an overview of recent state- and society-driven initiatives for the promotion of female perspective: exemplars, institutions, practices Islamic authority. Recent years have seen a surge in programs aimed at training and certifying women as legal scholars, International workshop, Leiden, 8-9 January 2015 preachers and counsellors. In most cases, however, this authority is fundamentally limited, in the sense that it David Kloos and Mirjam Künkler depends on, or is placed below male authority, or because it is confined to ‘women’s issues’. Interestingly, the latter limitation runs counter to all major schools of law (madhāhib) that allow women to provide advise (iftā) on any issue, not only issues of particular relevance to women. In light of the limits of top-down programs in training women as religious authority, Künkler called for a research agenda that turns the attention towards the way women are perceived as religious authorities by local communities. The other papers complemented this analysis by explor- ing how female Islamic leaders and authorities have been gathering a following by building up a community. Rahima, a women’s rights organization in Jakarta, and the focus of a paper presented by Nor Ismah, is responsible for one of the first female ulamā (religious scholars) training programs in Indonesia. To increase its reach among the grassroots, this organization has worked together with traditional Islamic boarding schools, most of which are located in rural areas. -

Selanjutnya, makalah ini menguraikan keberadaan masalah dan melihat lebih dalam ke dalam implementasi masalah sebagai dasar untuk pengembangan hukum Islam di Indonesia. Makalah ini adalah yuridis normatif menggunakan pendekatan doktrinal. Pada akhirnya, dapat disimpulkan bahwa konsepsi maslahah adalah metode penggalian hukum Islam yang didasarkan pada aspek manfaat dan kebaikan bagi manusia selama tidak bertentangan dengan norma syariah Islam. Selain itu, implementasi masalah sebagai dasar untuk penemuan hukum Islam di Indonesia tidak dapat disangkal. Hal ini dapat dilihat dari daruratnya undang-undang atau peraturan di bawahnya yang mengatur berbagai aspek hukum Islam di Indonesia dalam menanggapi masalah kehidupan masyarakat sebagai dampak dari zaman dan teknologi. Kata Kunci: eksistensi, maslahah mursalah, hukum Islam. Abstract This paper aims to analyze the conception of maslahah in the discourse of the development of Islamic law. Furthermore, this paper elaborates the existence of maslahah mursalah and looks deeper into the implementation of maslahah as a basis for the development of Islamic law in Indonesia. This paper is normative juridical using a doctrinal approach. In the end, it can be concluded that the conception of maslahah is a method of extracting Islamic law which is based on aspects of benefit and goodness for humans as long as it does not conflict with Islamic sharia norms. -

An attack from Syria was expected from the north, not the south. Visually, however, with its crowning fifteenth-century minarets, it is the most dramatic and it gives into abazaar quarter that is as full of life today as it was in the middle Ages المحاضرة اﻻولي • Bab Zuwayla, also called Bab al-Mitwalli, dates from 1092. It was part of the city fortifications put up by the Armenian wazir Badr al-Gamali and his Anatolian or Mesopotamian Christian architects. The gate was named after Fatimid soldiers from the Berber tribe al-Zawila who were quartered in the vicinity after the building of the original gate in 969, when alQahira was founded. The name Bab al-Mitwalli dates from Ottoman times, when the wali, or Ottoman officer, charged with maintaining public order, had his residence and headquarters near here. المحاضرة اﻻولي • The gate's projecting, rounded towers connected by a covered passageway over the large, arched opening are northern Syrian or Byzantine, not Arab, in inspiration and spirit. The two minarets that spring from the towers belong to the Mosque of al-Mu'ayyad Shaykh, just inside the gate, which forms the wall to the west. -

Oleh karena itu, gabungan kedua kata dimaksud al-ahkam al-khamsah atau biasa juga disebut hukum taklifi. Hukum taklifi adalah ketentuan hukum yang menuntut para mukallaf (aqil-baligh) atau orang yang dipandang oleh hukum cakap melakukan perbuatan hukum baik dalam bentuk hak, kewajiban, maupun dalam bentuk larangan. Apabila orang ingin mempelajari Islam dari sudut disiplin ilmu hukum, ia tidak mungkin menggunakan “western approach” yang sudah terbiasa semata-mata mengkaji kondisi dan pengaruh tipe tertentu dari sikap prilaku sosial yang penuh dengan prasangka.
