    N M B 2018 NATIONAL MEDIATION BOARD / ANNUAL PERFORMANCE AND ACCOUNTABILITY REPORT CHAIRMAN’S November 15, 2018 N LETTER The National Mediation Board had a banner year in FY 2018. The Agency’s mission – to prevent disruption to interstate commerce – remains as critical today as it was in 1934, when the Board was created under amendments to the Railway Labor Act. M NMB is pleased to report that there were no interruptions in the rail or air industry in FY 2018. Through the work of this Agency, the over twelve million jobs directly supported by the rail and air industry continued as usual. By extension, the millions of jobs dependent on the ability to travel and transport goods were also not disrupted. As unemployment B rates reach lows not seen in decades, NMB acts to ensure that work disruptions in the air or rail sectors do not dampen economic growth. NMB is proud to play its part in keeping the United States’ job-producing economy strong. At the start of the fiscal year, the Board’s statutory complement of three members was restored when two new Board Members and one sitting Board Member were unanimously confirmed by the United States Senate. At full strength, the new Board has been able to address issues which have long been of concern at NMB. For example, the Board addressed the fact that NMB has no assigned Inspector General by establishing a Memorandum of Understanding with the Inspector General of the National Labor Relations Board to create an anonymous hotline to report fraud, waste and abuse.

    2015 FLORIDA RAIL SYSTEM PLAN December 2018 Table of Contents FLORIDA RAIL SYSTEM PLAN - 2018 UPDATE The Florida Department of Transportation (FDOT) Freight and Multimodal Operations Office (FMO) present this 2018 update of the 2015 Florida Rail System Plan. As new challenges have had a great impact on the needs and future projects identified in the 2015 Rail System Plan, FDOT prepared this update. CHALLENGES • New State Rail Plan Guidance was created in 2013 to set a standard format and elaborate on required elements of the plan to include a 5-year update cycle, and a requirement for states seeking capital grants under Sections 301, 302, and 501. See https://www.fra.dot.gov/Page/P0511. Thereafter, FDOT prepared a 2015 Rail System Plan that was completed in December 2015. The Plan was not published at that time, as major industry changes were expected and no public outreach had yet been conducted. • Major industry changes occurred that impacted most of the rail mileage in Florida: o CSX hired Hunter Harrison in spring of 2017, and radically changed the company by imposing precision-scheduled railroading instead of a hub-and-spoke system. This approach has been continued by CSX leadership through 2018. o Grupo México Transportes (GMXT), the leading rail freight transportation company in Mexico, successfully completed the acquisition of Florida East Coast Railway in 2017. o Brightline began service in 2018 between West Palm Beach, Ft. Lauderdale, and Miami later in the year, and with plans to connect to Orlando and potentially to Tampa in the future. APPROACH • The FAST Act (Title 49, Section 22702) passage in December 2015 changed the 5-year update cycle to a 4-year update cycle.

    NATIONAL ABOUT THE NMB CHAIRMAN’S LETTER 1 MEDIATION NMB BOARD CHAIRMAN’S NOVEMBER 15, 2016 LETTER For over 80 years the National Mediation Board has worked to administer the Railway Labor Act, and to minimize disruptions in two of the most important sectors of the economy of the United States: the railroad industry and the airline industry. Together these industries contribute trillions of dollars to the US economy, and they directly provide approximately twelve million jobs. Disruption in either industry would pose a severe threat to the health of the economy, and the well being of the citizens of the United States. As the case load reviews contained in this annual report will attest, the NMB has again in fiscal year 2016 performed its statutory duties in an exemplary manner. The NMB’s Office of Representation Services is charged with handling matters related to ensuring that employees in the industries have the opportunity to choose whether to elect union representation, and to choose which union will represent them. In FY 2016, a staff of only five attorneys successfully completed 30 representation cases. The NMB’s Office of Mediation Services and ADR is responsible for assisting in the negotiation of collective bargaining agreements and for offering training and intervention services for a broad range of disputes that occur on railroad and airline properties. In FY 2016, a staff of only 9 line mediators successfully negotiated 48 contracts and 41 training or grievance mediation sessions. In FY 2016, there were no strikes or other interruptions of service. In cooperation with the Office of Arbitration Services, Mediation and ADR staff were responsible for resolving over 2000 minor disputes, a figure that equals the number of minor disputes that could be funded with an entire year’s budget for traditional arbitration in the railroad industry.
