The mission of the Board of Nurse Examiners for the State of Texas is to protect and promote the welfare of the people of Texas by ensuring that each person holding a license as a nurse in the State of Texas is competent to practice safely. The Board fulfills its mission through the regulation of the practice of nursing and the approval of nursing education programs. This mission, derived from the Nursing Practice Act, supersedes the interest of any individual, the nursing profession, or any special interest group.

New Programs Result in Fee Increases The Board of Nurse Examiners for the State of Texas Regulatory agencies in Texas are funded by fees they generate through their various licensure programs. The amended rule language proposed in February 2005 includes a list of titles the Board will recognize for legal entry into advanced practice as well as a list of additional titles that may be recognized via an exemption for a limited period of time (until 2010). The new rule can be reviewed under the “Rules and Regulations” section of the bne web site: www.bne.state.tx.us.. Regulation must be able to assure the public that individuals licensed with advanced practice titles are educated broadly across patient populations and practice settings. In addition to broad-based educational preparation, examination must also test for entry-level competence at the advanced practice level across that same broad base. The new rule presumes that less specialization and broader preparation are essential for initial licensure at the advanced practice level. Specialization and sub-specialization would then be considered value-added after legal recognition for authorization to practice at the advanced practice level is granted. It is important to note that although this issue has been discussed by stakeholders at the national level, no consensus has been reached as of the writing of this update. SHELLEY ARMSTRONG, aka Michelle O’Connor, aka Shelly Ann Rich, aka Shelly Ruddick Armstrong Shelly Ann Armstrong, secured employment as a with a legal resource agency in Houston, Texas. In April 2004, Ms. Armstrong was assigned as a contract nurse for a consulting firm in Houston, Texas. On June 5, 2004 the consulting firm attempted to verify Ms. Armstrong’s education and licensure and found no information. Ms. Armstrong was instructed not to return to work until she brought verification of education and licensure. Ms. Armstrong brought in a copy of a diploma issued to Shelly Ruddick O’Connor from the University of Houston. The University was contacted and they verified that no degree had been issued to the individual named on the copy. The only Michelle O’Connor licensed in Texas is an Advanced Practice Nurse (APN) and Ms. Armstrong’s resume did not include that information. When questioned, Ms. Armstrong told the firm that she did not include the APN because she did not want to work in that area. The consulting firm reported their findings to Ms. Armstrong’s employer. The employer was not able to verify her licensure, and Ms. Armstrong was terminated from employment. The case was referred to the Harris County District Attorney’s Office, Houston, Texas. 14 July 2005 Texas Board of Nursing Bulletin Volume 36, No. 3 Workshop Update Nursing in Texas: A Regulatory Foundation for Safe Practice Two workshops addressing nursing jurisprudence and ethics issues are currently scheduled.

They also meet BNE completion requirements for jurisprudence and ethics if required per Board Order. Each offering is a one-day event. Early registration deadline for registration forms is August 19, 2005. The registration fee for these workshops is $90 pre-registered and $105 at the door. Workshop brochures with registration forms and map information may be accessed via the BNE website under “BNE Events.” Fiscal year 2006, workshops begin in September with Lubbock at the Holiday Inn on the 27th and El Paso at the Camino Real on the 29th. More information will be posted on the web page and in the brochure. Registration Information Pre-registration is accepted prior to the workshop and is always encouraged since space is limited. Payment must accompany the registration form, so registration cannot be taken by phone, e-mail, fax or via the internet. Registration forms are processed on a first-come, first-serve basis. REQUEST FOR PROPOSALS: BOARD OF NURSE EXAMINERS’ INNOVATIVE PROFESSIONAL NURSING EDUCATION PILOT PROGRAMS The Board of Nurse Examiners (BNE) for the State of Texas is accepting proposals for pilot programs designed to evaluate the efficacy and effect of innovative applications in professional nursing educational programs to promote the graduation of competent, safe registered nurses in the State of Texas. The BNE is requesting the submission of proposals as authorized by section 301.1605 of the Texas Occupations Code which was enacted by Senate Bill 718 in the 78th Texas Legislature, Regular Session. The BNE has adopted new chapter 227, 22 Texas Administrative Code, pursuant to Senate Bill 718. Chapter 227 was originally proposed in the May 13, 2005, issue of the Texas Register and was adopted without comment or changes. The effective date of chapter 227 is July 5, 2005.
