POLLUTION CONTROL BOARD, ZONALOFFICE, MADHAVADHARA, VUDA LAYOUT, VISAKHAPATNAM, A.P. Agenda Collection of processing charges on applications filed earlier at DEIAAs. No.124.I The committee noticed that the applications of the proposed mining projects of minor minerals (up to 5 Ha. of individual mines and cluster of mines of area less than 25 Ha.) to be processed/filed at the District leave Impact Assessment Authorities (DEIAAs) being transferred to SEIAA, A.P., for further appraisal vide recent MoEFF & CC notification/OM based on NGT judgement. It was also noticed that the EC processing charges were already paid at DEIAAs. The committee recommended to seek clarification from the SEIAA, A.P, on collection / transfer of EC process charges for the said project proposals which were submitted at the district level DEIAAs. Regular Agenda Items: Agenda Name of the Industry No. 20.315 Ha. M/s. Sri Sai Mines & Minerals, Sy.No. 98, Rangapuvalasa B1 124.01 Village, Therlam Mandal, Vizianagaram District, Andhra Pradesh (violation) The consultant of M/s. S. V. Enviro Labs & Consultants has attended. The authorised representative of the project proponent has not attended the meeting. The Committee after detailed discussions deferred this proposal to the next meeting for further appraisal. 52.76 Ha Siddavaram Silica Sand Mine of Smt. Rama S. Mendon at B1 124.02 S.No. 2, Village Siddavaram, Kota Mandal, Nellore, Andhra Pradesh (violation) The representatives of the project proponent and their consultant M/s. Perfect Enviro Solutions labs Pvt. Ltd. have attended the meeting. The Committee noted that this Silica Sand mine was in operation without Environmental Clearance till June 2013 and thus comes under violation under the provisions of MoEF&CC, Notification S.O. No.804, dated 14th March 2017. The credible action was initiated against the mine under Section 19 of E (P) Act and a case was filed in the Hon'ble District Court, Nellore ( C.C.No. 227/2017). The Committee after detailed deliberations on the proposal in the terms of the provisions of the MoEF&CC Notification S.O.No.804 ( E) dated 14th March 2017, confirmed the case to be of violation of the EIA Notification, 2006 and recommended for issue of Standard Terms of Reference ( TOR) along with the following Specific Terms of Reference and to conduct the public hearing, for undertaking EIA and preparation of Environmental Management Plan(EMP) by this Silica Sand mine for production quantities - 2,00,000 TPA. Specific Terms of Reference: (i) The State Government/SPCB to take action against the project proponent under the provisions of section 1 9 of the Environment (Protection) Act, 1986, and further no consent to operate to be issued till the project is granted EC (if Credible Action was not initiated). (ii) The project proponent shall be required to submit a bank guarantee equivalent to the amount of remediation plan and natural and community resource augmentation plan with the SPCB prior to the grant of EC. The quantum shall be recommended by the SEAC and finalized by the regulatory authority. POLLUTION CONTROL BOARD, ZONALOFFICE, MADHAVADHARA, VUDA LAYOUT, VISAKHAPATNAM, A.P. released after successful implementation of the EMP, followed by recommendations of the SEAC and approval of the regulatory authority. (iii) Assessment of ecological damage with respect to air, water, land and other environmental attributes. The collection and analysis of data shall be done by an environmental laboratory duly notified under the Environment (Protection) Act, 1986, or an environmental laboratory accredited by NABL, or a laboratory of a Council of Scientific and Industrial Research (CSIR) institution working in the field of environment. (iv) Preparation of EMP comprising remediation plan and natural and community resource augmentation plan corresponding to the ecological damage assessed and economic benefits derived due to violation. (v) The remediation plan and the natural and community resource augmentation plan to be prepared as an independent chapter in the EIA report by the accredited consultants. (vi) Funds allocation for Corporate Environment Responsibility (CER) shall be made as per Ministry’s O.M. No. 22-65/ 2017-IA.III released in May, 2018 for various activities therein. The details of fund allocation and activities for CER shall be incorporated in EIA/EMP report. (vii) Detailed hydrological study to be carried out in core and buffer zone of the project as per recent GEC guidelines 2015. (viii) Submission of report in tabular form regarding issues raised during hearing and commitment made by the PP. (ix) The project proponent shall give an undertaking by way of affidavit to comply with all the statutory requirements and judgment of Hon’ble Supreme Court dated the 2nd August 2017 in Writ Petition (Civil) No. 114 of 20 14 in the matter of Common Cause versus Union of India and Ors. Before grant of ToR/ EC. The undertaking inter-alia includes commitment of the PP not to repeat any such violation in future. (x) In case of violation of above undertaking, the ToR/Environmental Clearance shall be liable to be terminated forthwith. (xi) State Government concerned shall ensure that mining operation shall not commence till the entire compensation levied, if any, for illegal mining paid by the Project Proponent through their respective Department of Mining & Geology in strict compliance of judgment of Hon’ble Supreme Court dated the 2nd August 2017 in Writ Petition (Civil) No. 114 of 2014 in the matter of Common Cause versus Union of I ndia and Ors. (xii) All the Statuary Clearances/Approvals/Permissions shall be obtained from various Organisations/Departments like CGWA/SGWA/APPCB etc before starting the project activity. (xiii) The non-working condition of the cluster mines to be submitted to defend the proponent’s claim under category B1. 50.41 Ha. Mandadi Captive Limestone Mine of M/s. KCP Limited at B1 124.03 at Mandadi & Polepalli village, Veldurthy & Durgi Mandal, Guntur (TOR) District, A.P The project proponent has not attended the meeting. The Committee recommended to defer the case to the next meeting. 2.0 Ha Color Granite Mine of Sri.Gandi Suryanarayana at Survey No: 124.04 171, Gudem Village, Tekkali Mandal, Srikaulam District, Andhra B2 Pradesh 124th SEAC AP 24-26 Feb 2019 VSP MINUTES OF THE 124th MEETING OF STATE EXPERT APPRAISAL COMMITTEE (SEAC), A.P., HELD ON 24.02.2019, 25.02.2019 & 26.02.2019 AT A.P. POLLUTION CONTROL BOARD, ZONALOFFICE, MADHAVADHARA, VUDA LAYOUT, VISAKHAPATNAM, A.P. The representative of the project proponent and their consultant M/s. Pridvi Envirotech Pvt. Ltd., have attended the meeting. The Committee noted that this is a new mine. The Asst. Director of Mines & Geology, Srikakulam vide Lr.No. 3110/Q/2017, dt.20.11.2018 stated that there are 15 quarry leases within 500 meters from the proposed project. As the proponent submitted the latest ADMG letter dated 25.2.2019 with clarity on the cluster formation, which scopes it into B2, the cluster EMP submitted is examined. Hence, the Committee recommended to issue Environmental Clearance. Proposed Refrigerated Propane/Butane/LPG Import Terminal by M/s.NGC B1 Energy India Private Limited at Sy. No. 736.2, 737, 741A, 741B, 741C3, (TOR) 124.05 741C4, 888,889, Krishnapatnam Port, Nellore District, Andhra Pradesh The representative of the project proponent and their consultant M/s.Ultra Tech Env. consultancy & Laboratory have attended the meeting. The noted this project is an isolated storage of Petroleum products in the Krishnapatnam Port area. M/s. Krishnapatnam Port Corporation Limited (KPCL) has allotted 4.91 Ha. of land to this proposed project. The proposed project falls under item : 6 (b) –Isolated storage & handling of hazardous chemicals and the exemption of public consultation, as provided for under Para 7(i) III. Stage (3)(i)(b) of EIA Notification, 2006. The Committee recommended for issue of Standard Terms of Reference (TOR) for the proposed Refrigerated Propane/Butane/LPG Import Terminal by M/s.NGC Energy India Private Limited of storage capacity - 62255.7 KL. The proponent requested for public hearing exemption. The committee resolved to recommend for exemption of public hearing if the proponent submits certificate from Krishnapatnam port trust on the lease of the land. The additional TOR: i. The project proponent shall collect the primary data for one season and permitted to collect the existing baseline data for other season.
