Religious Minorities in Pakistan
Abdul Majid* RELIGIOUS MINORITIES IN PAKISTAN Abstract The Constitution describes Pakistan as an “Islamic State”. It is a predominately Muslim State but there are several non-Muslims groups living here as citizens. Pakistan’s Constitution stands for equality of all citizens irrespective of religion, caste, region, tribe language and gender. Islam the state religion of Pakistan stands for respect and toleration for all religions. This paper examines the population and constitutional position of religious minorities in Pakistan. It also provides a general picture of major religious communities the Hindus, the Christians and the Sikhs. The paper also explains the Ahmadya community was declared a minority in September 1947. Despite the handicap of small population, Pakistan’s religious minorities have freedom to practice their religion and pursue their cultural heritage. Key Words: All India Muslim League, PPP, 1973 constitution, Lahore resolution, Jammat-e-Islami, Makkah, Pakistan Hindus Welfare Association Introduction All resolutions of the All India Muslim League since 1940 made categorical commitments for granting religious and cultural freedom to all religious minorities. In Pakistan Minority community is able to assert that it is completely safe. For all those who are guided by reason and humankind’s becoming a modern, civilized and responsible state. The ethnic communities and diverse cultures included Punjabi, Baloch, Sindhi, Seraiki and similarly beside Islam, the believers of Hindu, Sikh, Christian and others religious were also living in Pakistan. The cultural diversity of the country is under threat and religious minorities and various ethnic communities are being denied rights and Identity. Pakistan was established in August 1947 as a homeland for the Muslims of British India. -

India-Pakistan: Trade Perception Survey ABOUT THE AUTHORS Nisha Taneja, Professor, ICRIER, leads the project on “Strengthening Research and Promoting Multi-level Dialogue for Trade Normalization between India and Pakistan”. She has been engaged in several research projects sponsored by the Ministry of Commerce, Ministry of Textiles and Ministry of Finance, Government of India, as well as the Asian Development Bank (ADB), UNIDO, London School of Economics and the South Asia Network of Economic Research Institutes (SANEI). Her most recent work is on informal trade in South Asia, trade facilitation, non-tariff barriers and various aspects of India-Pakistan trade. She has served on committees set up by the Government of India on Informal Trade, Rules of Origin and Non-tariff Barriers. Dr Taneja holds a PhD in Economics from Jawaharlal Nehru University, New Delhi. Sanjib Pohit, Professor AcSIR, is presently working as a Senior Principal Scientist at CSIR-National Institute of Science, Technology & Development Studies (NISTADS). Prior to this, he has held research position at National Council for Applied Economic Research, New Delhi (Senior Fellow/Chief Economist), Indian Statistical Institute (Research Fellow), and was a visiting scholar to University of Michigan (Ann Arbor, USA) and Conference Board of Canada. He has been member of several committees of Government of India and has provided Advisory Services to various national and international bodies, including The World Bank, ADB, The Energy & Resource Institute, OECD, CUTS, Price Waterhouse Coopers, Ernst & Young, ICRIER and RIS. Dr Pohit holds a PhD is Economics from the Indian Statistical Institute (ISI), New Delhi. Meenakshi Gopinath: Processing Peace: To Speak in a Different Voice Peace Prints: South Asian Journal of Peacebuilding, Vol. 4, No. 2: Winter 2012 Processing Peace: To Speak in a Different Voice Meenakshi Gopinath Abstract This paper investigates India’s approach to working around the ‘Kashmir’ factor to improve its relationship with Pakistan. The author argues that the Composite Dialogue (CD) framework marked a decisive shift in India’s approach to negotiations from a short term tactical militarist approach to a problem solving orientation in keeping with its self- image of a rising power seeking a place in the sun, through a normative positioning that simultaneously protected its strategic interests. This in the author’s view is an indication that a “peace process” is underway and is likely to yield positive outcomes for not only India but also Pakistan. Author Profile Meenakshi Gopinath is the Founder and Honorary Director of WISCOMP and Principal, Lady Shri Ram College, New Delhi. She was the first woman to serve as member of the National Security Advisory Board of India. Dr. Gopinath is a member of multi-track peace initiatives in Kashmir and between India and Pakistan. She has authored among others Pakistan in Transition, and co-authored Conflict Resolution – Trends and Prospects, Transcending Conflict: A Resource book on Conflict Transformation and Dialogic Engagement and has contributed chapters and articles in several books and journals. Non-Muslim Minorities in Pakistan (Sikhs, Hindus and Christians etc.) have awarded freedom to go their religious places for practicing their religious obligations. Government of Pakistan has established Evacuee Trust Property Board under Act No. XIII of 1975 (which was promulgated on 1st July 1974) for management, control and disposal of the Evacuee Trust properties all over Pakistan. Undoubtedly, Pakistan is a Muslim majority country with multi-religious and multi-sectarian population. Though, we keep hearing about events of inter and intra religious intolerance every now and then. This research papers gives a comprehensive detail about the interfaith harmony at Shrines in Pakistan in order to prove that all the news we are getting through print media, electronic media or social media about religious intolerance in Pakistan is only one side of picture. Withal throwing light on the interfaith harmonious culture at Shrines, it aims to explore the concept of religious harmony or interfaith harmony. This paper briefly encapsulates the background of different shrines in Pakistan and the communities visiting them. -

Country Policy and Information Note Pakistan: Christians and Christian converts Version 4.0 February 2021 Preface Purpose This note provides country of origin information (COI) and analysis of COI for use by Home Office decision makers handling particular types of protection and human rights claims (as set out in the Introduction section). It is not intended to be an exhaustive survey of a particular subject or theme. It is split into two main sections: (1) analysis and assessment of COI and other evidence; and (2) COI. These are explained in more detail below. Assessment This section analyses the evidence relevant to this note – i.e. the COI section; refugee/human rights laws and policies; and applicable caselaw – by describing this and its inter-relationships, and provides an assessment of, in general, whether one or more of the following applies: x A person is reasonably likely to face a real risk of persecution or serious harm x The general humanitarian situation is so severe as to breach Article 15(b) of European Council Directive 2004/83/EC (the Qualification Directive) / Article 3 of the European Convention on Human Rights as transposed in paragraph 339C and 339CA(iii) of the Immigration Rules x The security situation presents a real risk to a civilian’s life or person such that it would breach Article 15(c) of the Qualification Directive as transposed in paragraph 339C and 339CA(iv) of the Immigration Rules x A person is able to obtain protection from the state (or quasi state bodies) x A person is reasonably able to relocate within a country or territory x A claim is likely to justify granting asylum, humanitarian protection or other form of leave, and x If a claim is refused, it is likely or unlikely to be certifiable as ‘clearly unfounded’ under section 94 of the Nationality, Immigration and Asylum Act 2002. -

This Article focuses upon the remarkably divergent pronouncements of Pakistan’s judiciary regarding the religious status and freedom of religion of one particular religious minority, the Ahmadis. The superior judiciary of Pakistan has visited the issue of religious freedom for the Ahmadis repeatedly since the establishment of the State, each time with a different result. The point of departure for this ex- amination is furnished by the recent pronouncement of the Supreme Court of Pakistan (”Supreme Court” or “Court”) in Zaheeruddin v. State,’ wherein the Court decided that Ordinance XX of 1984 (”Ordinance XX” or ”Ordinance”), which amended Pakistan’s Penal Code to make the public prac- tice by the Ahmadis of their religion a crime, does not violate freedom of religion as mandated by the Pakistan Constitution. This Article argues that Zaheeruddin is at an impermissible variance with the implied covenant of freedom of religion between religious minorities and the Founding Fathers of Pakistan, the foundational constitutional jurisprudence of the country, and the dictates of international human rights law. -

All are users of the bbcurdu.com website, and all are part of the global Pakistani diaspora. The term diaspora is used to describe the global dispersion of migrant groups of various kinds. Diasporas are of growing economic, political and cultural significance. In a world where migration, geopolitical dynamics, communication technologies and transport links are continually changing, it is clear that culture and geography no longer map neatly onto one another. Understanding diaspora groups inside and outside its base at Bush House, London, is ever more important for the BBC World Service, too. Diaspora audiences are increasingly influencing the way the BBC conceives and delivers output. For example, over 60% of the weekly users of bbcurdu.com are accessing the site from outside the subcontinent, and this proportion is rising. The same trend has been observed for other BBC language websites. (See BBC World Agenda, September 2008.) The research presented here is based on a unique partnership between BBC World Service Marketing Communication and Audiences (MC&A) and The Open University. Azad Kashmir
Azad Kashmir The home of British Kashmiris Waving flags of their countries of origin by some members of diaspora (overseas) communities in public space is one of the most common and visible expressions of their ‘other’ or ‘homeland’ identity or identities. In Britain, the South Asian diaspora communities are usually perceived as Indian, Pakistani, (since 1971) Bangladeshis and Sri Lankans. However, there is another flag that is sometimes sighted on such public gatherings as Eid festivals, Pakistani/Indian Cricket Matches or political protests across Britain. 1 This is the official flag of the government of Azad Jammu and Kashmir. 'Azad Kashmir' is a part of the divided state of Jammu Kashmir. Its future is yet to be determined along with rest of the state. As explained below in detail, Azad Kashmir is administered by Pakistan but it is not part of Pakistan like Punjab, Sindh, Pakhtoon Khuwa and Baluchistan. However, as a result of the invasion of India and Pakistan to capture Kashmir in October 1947 and the subsequent involvement of United Nations, Pakistan is responsible for the development and service provision including passports for the people of Azad Kashmir and Gilgit Baltistan, another part of Kashmir that is not part of, but is controlled by, Pakistan. Under the same UN resolutions India is responsible for the Indian controlled part of Kashmir. In all parts of the divided Kashmir there are political movements of different intensity striving for greater rights and autonomy, self-rule and/or independence. The focus of this chapter, however, is primarily on Azad Kashmir, the home of nearly a million strong British Kashmiri community. -

Submission to the UN Special Rapporteur on Freedom of Religion or Belief (FoRB) For the Report to the United Nations General Assembly on Eliminating Intolerance and Discrimination Based on Religion or Belief and the Achievement of Sustainable Development Goal 16 (SDG 16) Submission on behalf of the South Asia Collective (SAC)1. 1. The SAC welcomes the opportunity to make this submission to the Special Rapporteur on FoRB. This submission covers six South Asian countries: Afghanistan, Bangladesh, India, Nepal, Pakistan, and Sri Lanka. Given length restrictions, the specific dynamics of each context are not elaborated in an exhaustive manner.2 Yet each country overview seeks to underline the relationship between discrimination and intolerance based on religion or belief in legislation, policy, and practice with rising hostility and violence against religious minorities across South Asia. 2. The submission also notes how structural inequalities – such as poor socio-economic outcomes for religious minorities – and impunity for FoRB violations exacerbate underlying conditions which lend to tensions and conflict. There are concerns that these fragile foundations will be further undermined as a result of the socio-economic and political impact of the COVID-19 pandemic. In some contexts, this has already resulted in internal displacement of the marginalized, alongside discrimination against religious minorities who have been blamed for the spread of the disease, as well as denied proper funeral or burial rites.3 3. Intolerance and discrimination based religion or belief also has regional implications. For example, the rise of Hindu nationalism in India has contributed to the spread of intolerance in neighbouring Nepal4, while the emerging situation in Assam – which renders Bengali Muslims particularly vulnerable to statelessness – increases insecurity for minorities as well as the potential for regional instability.
