Cruz* Introduction This article will examine the application of antitrust laws in combat sports. Specifically, it will look at three recent cases involving lawsuits brought under the Sherman Act Section 1 and 2.1 First, this article will examine the January 2017 dismissal by a Los Angeles federal court of a lawsuit filed by Golden Boy Promotions (“Golden Boy”) against Al Haymon and his business entities, which started Premier Boxing Champions (“PBC”).2 It will also examine Top Rank Boxing’s (“Top Rank”) similar lawsuit against Haymon, which was settled the previous fall. Finally, it will evaluate the ongoing lawsuit between several former fighters and the Ultimate Fighting Championships (“UFC”). While each lawsuit has its own set of facts, the conditions and marketplace for combat sports is unique and the application of antitrust law has been used sparingly by boxers and promoters. These three cases filed in the last three years reflect the changing market for boxing and MMA. The paper will look at the results of the Top Rank and Golden Boy lawsuits and determine whether those cases shed any light on the outcome of the UFC case. It will also explore whether there are alternatives to regulating combat sports outside of the use of the antitrust laws. One legal commentator has opined that a federal commission would aid the monopolistic structure of a sports league. But, does that apply to individual sports like MMA or boxing? This paper will explore this issue as well as determine whether organizing fighters would address the issues complained of in the lawsuits.

In 2015, two big promotional companies, Top Rank Inc. and Golden Boy Promotions, filed similar claims against manager and advisor Al Haymon accusing him of unfair and anticompetitive business practices. These incidents make one long-standing point clear: professional boxing’s current structure is an abyss of deception and corruption. Corruption is not only harmful to those intended to be harmed; corruptive practices also diminish the quality, creditability, and integrity of the sport. However, corruption in the sport of boxing is but a novel issue.

The district court granted summary judgment to Middendorf on the first issue and ruled in Middendorf’s favor on the second issue. We affirm the first ruling but reverse the second. I. Background On December 7, 2010, Crawford entered into a promotional rights agreement with TKO Boxing Promotions, LLC. Crawford gave TKO the exclusive right to promote his boxing matches. TKO paid Crawford $7,500 and guaranteed him a minimum number of fights (also called “bouts”) per year, with the minimum payment (or “purse”) that he would receive for each bout depending on the number of rounds. The agreement was for a three-year term, but TKO had the right to terminate it for various reasons.

National Association of Attorneys General Boxing Task Force MAY, 2000 I. Origin of the National Association of Attorneys General Boxing Task Force On January 1, 1997, the Professional Boxing Safety Act, 15 U.S.C. Section 6301, et seq., became law. The Act establishes minimum health, safety, and ethical guidelines for the boxing industry. In July 1997, the Senate sponsors of the Act, John McCain (AZ) and Richard Bryan (NV), wrote to Robert Pitofsky, Chairman of the Federal Trade Commission ("FTC"), to request that the Commission review "business practices that occur in the professional boxing industry." The FTC concluded that the state Attorneys General could play an important role in investigating and perhaps curbing potential abuse in this industry, since boxing is regulated on the state level by individual athletic commissions. National Association of Attorneys General (NAAG) agreed to form a task force comprised of the major "boxing states."1 The New York State Attorney General volunteered to head the Task Force. In March 1998, the NAAG Boxing Task Force was formally established with the New York Attorney General as Chair and the Illinois Attorney General as Vice-Chair. Eighteen states participated in the work of the Task Force: Arizona, Connecticut, Florida, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maryland, Mississippi, Missouri, Nevada, New Jersey, New York, Oklahoma, Oregon, Pennsylvania and Puerto Rico.
