The applicable law recognizes the aforementioned authors certain rights over their works (thore are property, moral and other rights). But the problem is that the protection of the moral rights of the author is problematic in Kosovo. This protection is missing or is very pale. As a hypothesis of this paper I have decided: the differencies between the moral and property rights of the author, the non- implementation and reasons of non-implementation of the moral rights of the author in Kosovo, the need for a deeper legal reform in this regard. Luz Balaj, PhD Candidate Faculty of Law, University of Prishtina, Kosovo Abstract This paper aims at clarifying the report between the President and the Constitutional Court. If we take as a starting point the constitutional mandate of these two institutions it follows that their final mission is the same, i.e., the protection and safeguarding of the constitutional system. This paper, thus, will clarify the key points in which this report is expressed. Further, this paper examines the theoretical aspects of the report between the President and the Constitutional Court, starting from the debate over this issue between Karl Schmitt and Hans Kelsen. An important part of the paper will examine the Constitution of Kosovo, i.e., the contents of the constitutional norm and its application. The analysis focuses on the role such report between the two institutions has on the functioning of the constitutional system. In analyzing the case of Kosovo, this paper examines Constitutional Court cases in which the report between the President and the Constitutional Court has been an issue of review. Such cases assist us in clarifying the main theme of this paper. Therefore, the reader will be able to understand the key elements of the report between the President as a representative of the unity of the people on the one hand and the Constitutional Court as a guarantor of constitutionality on the other hand.

Bartkowski boulder london 15 Kosovo: Civil Resistance in Defense of the Nation, 1990s Howard Clark Each year on March 5–7, Kosovo celebrates the Epopee of the Kosova Liberation Army (KLA)—the anniversary of the 1998 gun battle in the village of Donji Prekaz where Adem Jashari, a founder of the KLA, and more than fifty of his family members were killed. The Jashari home is now a shrine. The Epopee includes the Night of Flames when fifty fires are lit and a gathering in Prekaz of Kosovo’s leading dignitaries and the uniformed suc - cessors of the KLA (at one time the Kosovo Protection Corps, now the Kosovo Security Force). The main speeches in 2010 were made by the prime minister and president—at that time Hashim Thaçi, a founder of the KLA, and Fatmir Sejdiu, a founder and leader of the Democratic League of Kosova (LDK), the party most associated with the nonviolent struggle. Sejdiu began, On March 5, 1998 . the legendary Commander of the Kosovo Libera - tion Army, Adem Jashari, and his father Shaban and his brother Hamëz, fell on the altar of freedom. That day, besides these three martyrs, many other children and members of Jashari family were deprived of their lives. But, by virtue of their matchless sacrifice, they were decorated with the most precious and gilded crown in the history of our long-lasting war for freedom and independence and turned into an incomparable symbol of sublime self-sacrifice for the homeland.

    United Nations S/2006/361 Security Council Distr.: General 5 June 2006 Original: English Report of the Secretary-General on the United Nations Interim Administration Mission in Kosovo I. Introduction 1. The present report is submitted pursuant to Security Council resolution 1244 (1999) of 10 June 1999, by which the Council decided to establish the United Nations Interim Administration Mission in Kosovo (UNMIK) and requested the Secretary-General to report at regular intervals on the implementation of the mandate. It covers the activities of UNMIK and developments in Kosovo (Serbia and Montenegro), from 1 January to 30 April 2006. II. Political assessment 2. The process designed to determine the future status of Kosovo has moved forward during the reporting period. To date, my Special Envoy for the future status process for Kosovo, Martti Ahtisaari, has focused on bringing representatives of Belgrade and Pristina together in direct talks to discuss practical issues. Four rounds of direct talks between the parties on the decentralization of Kosovo’s governmental and administrative functions were held in Vienna on 20 and 21 February, 17 March, 3 April and 4 and 5 May. Talks between the sides on cultural heritage and religious sites were held on 23 May and a meeting on economic issues on 31 May. The direct talks held thus far have shown that there is some convergence on some specific points, but that in many areas the proposals of the parties remain far apart. In parallel, my Special Envoy has held continuing consultations on developments in the future status process with a range of interested Member States and regional organizations.
