Protection of Author's Moral Rights in Kosovo 1. Introduction
JURIDICA (Lack of) Protection of Author’s Moral Rights in Kosovo Armend Ahmeti1 Abstract: In Kosovo we have many young artists, writers, singers, actors, photographers, architects, painters and sculptors, who are young, talented and special, which amaze you with their works. The applicable law recognizes the aforementioned authors certain rights over their works (thore are property, moral and other rights). But the problem is that the protection of the moral rights of the author is problematic in Kosovo. This protection is missing or is very pale. As a hypothesis of this paper I have decided: the differencies between the moral and property rights of the author, the non- implementation and reasons of non-implementation of the moral rights of the author in Kosovo, the need for a deeper legal reform in this regard. The scientific methods I have used to come to conclusions are the method of research, analysis, especially the method of analysis of legislation, the method of comparison etc. Keywords: author; property rights; moral rights; other rights; legal reform; non-implementation of moral rights 1. Introduction Kosovo, in terms of legal infrastructure, we can say that it has progressed far since its declaration of independence in 2008 by the Assembly of Kosovo. Kosovo now has a modern constitution, there are many laws and sub-legal acts that regulate different fields, in this regard also the field of intellectual property, namely the field of copyright. Kosovo protects the right of intellectual property by constitutional provisions (article 46 of the Constitution of Kosovo, approved on 09 April 2008 and entered in to force on 15 June 2008). -

Report between the President and Constitutional Court and its influence on the functioning of the Constitutional System in Kosovo MSc. Luz Balaj, PhD Candidate Faculty of Law, University of Prishtina, Kosovo Abstract This paper aims at clarifying the report between the President and the Constitutional Court. If we take as a starting point the constitutional mandate of these two institutions it follows that their final mission is the same, i.e., the protection and safeguarding of the constitutional system. This paper, thus, will clarify the key points in which this report is expressed. Further, this paper examines the theoretical aspects of the report between the President and the Constitutional Court, starting from the debate over this issue between Karl Schmitt and Hans Kelsen. An important part of the paper will examine the Constitution of Kosovo, i.e., the contents of the constitutional norm and its application. The analysis focuses on the role such report between the two institutions has on the functioning of the constitutional system. In analyzing the case of Kosovo, this paper examines Constitutional Court cases in which the report between the President and the Constitutional Court has been an issue of review. Such cases assist us in clarifying the main theme of this paper. Therefore, the reader will be able to understand the key elements of the report between the President as a representative of the unity of the people on the one hand and the Constitutional Court as a guarantor of constitutionality on the other hand. -

Kosovo Independent Media Program Funded By USAID IREX Kosovo Independent Media Program (CA no. 167-A-00-01-00107-00) Quarterly Report January 1, 2003 - March 31, 2003 IREX submits this quarterly report in accordance with the requirement of the Kosovo Independent Media Program (CA no. 167-A-01-00107-00). IREX feels the report provides sufficient detail to allow USAID to adequately monitor the program or ask follow-up questions. IREX/DC and field staff has maintained close contact throughout the quarter on program implementation. IREX welcomes USAID comments and questions on the report, directed to Tadd Eakin, Senior Program Officer ([email protected]). I. SUMMARY This quarter the Kosovo Independent Media Program (KIMP) focused on improving the professionalism of television broadcast news, on specialty writing for print media, and on association development. Concurrently, IREX continued to assist television stations KTV and RTV21 to improve their business and programming strategies. IREX worked with KosovaLive, the Association of Independent Broadcast Media in Kosovo, the Association of Professional Journalists of Kosovo, and the Kosovo Terrestrial Transmission Network to determine activities and budgets for the coming year. IREX also worked with a number of media outlets, including Alem magazine and Radio Peja, to process additional subgrant requests. Training over the course of the quarter focused on features writing, research for television, and business reporting. Russell Peasgood, a resident media advisor with the IREX office in Serbia, also ran two-day training sessions in four regional television stations: TV Men in Gjilan, TV Liria in Ferizai, TV Prizreni in Prizren and TV Syri in Gjakova. -

On Opposite Sides of the Wall: Reporting Crisis in Kosovo By Isuf Berisha 1. Introduction This report examines an episode in relations between Serbs and Albanians in Kosovo, one in a long series of political crises. This particular episode had a very concrete conception in the form of the wall erected on 7 December 2016 in the town of Mitrovica, right at the line of delimitation between the two ethnic communities – an event that rubbed salt into still open wounds. In this study, we analyse some of the patterns of media reporting on this particular controversy, both through content analysis and interviews. The results indicate that the media in Kosovo and Serbia often tended to deepen sharp ethnic divides when reporting about the wall dispute, but that some media also displayed a certain, although limited, ability to step away from the divide. 1.1 The ongoing crisis in Kosovo-Serbia relations Kosovo’s post-war transition has been slow, controversial and painful. This is understandable if we bear in mind the heavy losses that Kosovo suffered during the war of 1998–1999. More than 13,000 people were confirmed dead or missing1, more than 20,000 women were raped2 and at least 188,000 houses and other structures, including 358 schools and 215 mosques, were destroyed or damaged.3 Rebuilding houses and infrastructure has been more or less successful mainly thanks to private initiative by Kosovars, but the healing of other wounds has been much more difficult. Kosovar society is still dealing with the painful legacy of the war in that ethno-national fragmentation still dominates social and political life. -

Since the military humanitarian intervention in 1999, reconciliation process initiated by the European Union, U.S., and other members in the international community, began almost immediately after the war, in attempt to bring peace to the former Yugoslav republic and territory. However, little effort has been made in attempt to dissect and analyze the causes of the ethnic conflict, such as patterns of ethnic boundaries, given that ethnic tensions continue to challenge the peace-building process. This thesis research, therefore, investigates ethnic relations and changing ethnic boundaries in Kosovo between the years of 1980 and 2015.
